3rd Quarter 2006
Secretary of the Commonwealth Pedro A. Cortés and Basil L. Merenda, Acting Deputy Secretary for Regulatory Programs and Commissioner of the Department’s of Professional and Occupational Affairs, announced 207 disciplinary actions taken by the following State Health Licensing Boards: Chiropractic; Dentistry; Medicine; Nursing Home Administrators; Occupational Therapy; Optometry; Osteopathic Medicine; Pharmacy; Physical Therapy; Podiatry; Psychology; Social Workers, Marriage and Family Therapists and Professional Counselors; Examiners in Speech-Language and Hearing; and Veterinary Medicine. Actions were taken against individuals or firms in the following counties: Allegheny (13 actions); Beaver (2 actions); Berks (5 actions); Bucks (11 actions); Centre (2 actions); Chester (1 action); Clearfield (1 action); Clinton (1 action); Crawford (2 actions); Cumberland (1 action); Dauphin (3 actions); Delaware (4 actions); Elk (3 actions); Erie (4 actions); Lancaster (2 actions); Lawrence (1 action); Lebanon (3 actions); Lehigh (3 actions); Luzerne (3 actions); Lycoming (1 action); Mifflin (2 actions); Montgomery (18 actions); Northampton (3 actions); Northumberland (2 actions); Philadelphia (18 actions); Pike (1 action); Somerset (3 actions); Washington (5 actions); Wayne (1 action); Westmoreland (4 actions); and York (4 actions). A total of 80 actions involved Pennsylvania licenses with out-of-state addresses.
BOARD OF CHIROPRACTIC Allegheny County Stephen J. Wilhelm of Carnegie, license no. DC-006755-L, had no disciplinary sanction imposed for failing to provide proof of completion of the required amount of continuing education in board-approved courses. (08-03-06) Karl E. Kyle of Greensburg, license no. DC-007814L, was suspended by the Allegheny County Court of Common Pleas on June 23, 2006. The court issued the suspension, which was effective immediately, under section 4355 of the Domestic Relations Code. (09-13-06)
Bucks County Kathleen K. Petrucci of Yardley, license no. DC-006880L, was assessed a $350 civil penalty. Petrucci failed to provide proof of having completed 24 hours of continuing education in acceptable courses taken between Sept. 2, 2002 and Sept. 1, 2004. (09-28-06) Erie County Vernon Edwin Stafford of Erie, license no. DC-005164-L, was suspended, with the suspension stayed in favor of probation, based on his guilty plea to a felony of in federal court. (06-05-06) Fayette County William C. Filcheck, Jr. of Uniontown, license no. DC-005467-R, was suspended for a minimum of one year based upon his criminal conviction, disciplinary action in another state and failure to report those actions to the board. (04-03-06) Lawrence County Thomas R. Wilkins of New Castle, license no. DC-007143-L, was automatically suspended based on his guilty plea to a felony of knowingly or intentionally possessing a controlled or counterfeit substance. (06-27-06) Philadelphia County Anthony P. Galzarano of Philadelphia was assessed a $300 civil penalty for failing to complete board-required continuing education. (06-05-06) William S. Matura, DC, license no. DC-001218-L, of Philadelphia, was revoked and assessed a $5,000 civil penalty based upon his convictions in federal court for conspiracy to commit health care fraud and obstruction of justice, as well as making fraudulent statements in the practice of chiropractic, submitting to thirdparty payors claims for service or treatment not actually provided, and committing immoral or unprofessional conduct. (06-05-06) Richard S. Capacio of Philadelphia, license no. DC-002723-L, was suspended for five years and assessed a $3,000 civil penalty based upon his convictions in federal court for conspiracy to commit health care fraud and obstruction of justice, as well as making fraudulent statements in the practice of chiropractic, submitting to third-party payors claims for service or treatment not actually provided, committing immoral or unprofessional conduct, and failing to report his convictions to the board. After one year of active suspension, the remaining period of suspension was stayed in favor of probation. (6-23-06) Lewis Korff of Philadelphia, license no. DC-003793-L, agreed to a permanent, voluntary surrender of his license to practice chiropractic medicine. Korff was convicted of a felony in federal court; made misleading, deceptive, untrue or fraudulent representations in the practice of chiropractic medicine; intentionally submitted to third-party payors claims for service or treatment that was not

actually provided to the patient; and committed immoral and unprofessional conduct in the practice of chiropractic medicine. (07-27-06) Joseph J. Davidson, license no. DC-005414-L, was revoked and assessed a $5,000 civil penalty based upon his federal criminal conviction and for making fraudulent statements in the practice of chiropractic, submitting to third-party payors claims for service or treatment not actually provided, committing immoral or unprofessional conduct, and failing to report this conviction to the board. (0929-06) Out of State Scott G. Taylor of Morgantown, WV, license no. DC-004781-L, was suspended for a minimum of one year based upon his criminal conviction, disciplinary action in another state and failure to report those actions to the board. (04-03-06) Gertrude Elizabeth Johnson of Rialto, CA, license no. DC-005880-L, was reprimanded based upon disciplinary action in another state. (08-03-06) Brian S. Torchin of Boca Raton, FL, license no. DC-006613-L, was revoked of his license to practice chiropractic. Torchin displayed misconduct in carrying on the practice of chiropractic, committed immoral and unprofessional conduct, intentionally submitted to a third-party payor a claim for a service or treatment which was not actually provided, and committed an act involving moral turpitude, dishonesty or corruption. BOARD OF DENTISTRY Allegheny County Jerry Schulhof of Pittsburgh, license no. DS-016831L, was automatically suspended. Schulhof was convicted of a felony under the Drug Act. (05-17-06) Frank John Massioni of Coraopolis, license no. DS-013313-L, was reprimanded and assessed a $750 civil penalty based upon his failure to submit proof of completion of required continuing education hours for the 2001-2003 biennial period. (06-09-06) Jayanthi Ganne of Pittsburgh was denied a license because applicant failed to receive a passing score on the endodontics component of the WREB exam. (0804-06) Susan L. Province of Sharpsburg, license no. DS-025562-L, was suspended for no less than three years, retroactive to the date of suspension by the Ohio State Board of Dentistry on March 1, 2004. Province’s dental license was suspended by the proper licensing authority of another state, and she is unable to practice with reasonable skill and safety to patients by reason of excessive use of

controlled substances, chemicals or any other type of material. (09-08-06) Alan S. Wright of Pittsburgh was denied a license because he failed to meet the equivalent standards required for a PA license to practice dentistry. (07-28-06) Beaver County Amy Lynn Ilko of Ambridge, license no. DH-011036L, was assessed a $150 civil penalty, a reprimand was placed on her board record, and she must complete the lacking three hours of continuing education within six months. Ilko failed to meet the required continuing education credits by three hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Pamela G. Crumrine of Beaver, license no. DS-027177L, was assessed a $1,275 civil penalty and a reprimand was placed on her record with the board. Crumrine failed to complete and submit proof of completion of at least 30 credit hours of continuing education in approved courses, of which no more than 50 percent of the courses were obtained through individual study. The board also ordered her to complete the remaining 17 hours of continuing education that she failed to complete. (09-08-06) Bucks County Brenda L. Smith of Quakertown, license no. DH-011267L, was assessed a $250 civil penalty, a reprimand was placed on her board record, and she must complete the lacking five hours of continuing education within six months. Smith failed to meet the required continuing education credits by five hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Anthony J. Ermocida of Langhorne, license no. DS-027173L, was assessed a $1,000 civil penalty and also placed on probation until such time as his NJ license is returned to unrestricted status based on findings Ermocida had disciplinary action taken against his license by the proper licensing authority of another state. (07-24-06) Clearfield County Jonathan K. Cole of DuBois, license no. DS-024511-L, had his dental license indefinitely suspended for no less than three years with the suspension immediately stayed in favor of no less than three years of probation, subject to terms and conditions. Cole was unable to practice the profession with reasonable skill and safety to patients by reason of illness, addiction to drugs or alcohol. (09-08-06) Delaware County Mary C. LeCleire of Haverford, Montgomery and Delaware counties, license no. DS-019174L, was assessed a $350 civil penalty, a reprimand was placed on her board record, and she must complete the lacking 18 hours of continuing education within six months. LeCleire failed to meet the required continuing

education credits by 18 hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Erie County Linda A. Straub-Bruce of Erie, license no. DH-009719L, was assessed a $425 civil penalty, a reprimand was placed on her board record, and she must complete the lacking 8.5 hours of continuing education within six months. Straub-Bruce failed to meet the required continuing education credits by 8.5 hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Lancaster County David L. Rubio of Ephrata was denied a license to practice dentistry by criteria approval because he failed to demonstrate that he has met the requirements of the Dental Law and regulations of the Board. Rubio did not successfully pass all components of a regionally administered clinical examination. (06-02-06) Lehigh County Floyd A. Shultz of Coopersburg, license no. DS-020452-L, was assessed a $900 civil penalty, a public reprimand was placed on his board record, and he is required to submit proof of successful completion of 12 hours of approved continuing education within six months of the effective date of the order. Shultz failed to complete and submit proof of completion of at least 30 credit hours of continuing education in approved courses of which no more than 50 percent of the courses were obtained through individual study. (07-14-06) Luzerne County Alireza Asgari of Wilkes-Barre, license no. DS-030571-L, was revoked because Asgari was found guilty of 42 felonies (theft by unlawful taking and criminal attempt) in violation of the laws of this Commonwealth. (05-05-06) Mifflin County Christ Zook of Milroy, unlicensed, was assessed a $1,000 civil penalty and ordered to cease and desist from engaging in the unlicensed practice of dentistry. (09-08-06) Montgomery County Rosemarie Cooley-Dugan of Gwynedd Valley, license no. DH-009708-L, was assessed a $200 civil penalty and ordered to complete four hours of continuing education within six months. Cooley-Dugan failed to submit proof of completion of required continuing education hours for the 2001-2003 biennial period. (0505-06) Howard D. Popky of Norristown, license no. DS-014940L, was assessed a $525 civil penalty, a reprimand placed on his board record, and he must complete the lacking seven hours of continuing education within six months. Popky failed to meet the required continuing education credits by seven hours for the April 1,

2003 through March 31, 2005 licensing period. (07-14-06) Northampton County Rebecca A. Licastro of Easton, license no. DH-067534, was assessed a $550 civil penalty, a reprimand placed on her board record, ordered to complete six hours of continuing education credits, and she shall submit proof of current certification in CPR. Licastro failed to complete and submit proof of completion of 20 credit hours of continuing education, and failed to maintain and submit proof of current certification in CPR. (09-08-06) Northumberland County Stephen A. Madden of Shamokin, license no. DS-023520L, was assessed a $450 civil penalty, a reprimand was placed on his board record, and he must complete the lacking six hours of continuing education within six months. Madden failed to meet the required continuing education credits by six hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Philadelphia County John M. Ruggieri of Philadelphia, license no. DS-030472L, was assessed a $300 civil penalty, a reprimand placed on his board record, and he must complete the lacking four hours of continuing education within six months. Ruggieri failed to meet the required continuing education credits by four hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Richard P. Schell of Philadelphia, license no. DS-017214L, was assessed a $3,250 civil penalty, a reprimand placed on his board record, and he must complete the lacking 30 hours of continuing education within six months. Schell failed to meet the required continuing education credits by 30 hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Erik D. Williams of Philadelphia, license no. DS-027201-L, was ordered to pay a $500 civil penalty because he had administered nitrous oxide/oxygen analgesia on an expired permit. (7-14-06) Washington County David Fuderich of Claysville, license no. DS-026430-L, was automatically suspended based on his guilty plea to a felony under the Controlled Substance, Drug, Device and Cosmetic Act. (06-09-06) Deborah A. Petty of Roscoe, license no. DH-008099-L, was suspended for a period of three years, with the suspension stayed in favor of probation, for pleading guilty to misdemeanors that involve moral turpitude. (06-15-06) Guy G. Troy of McMurray, license no. DS-014974-L, was reprimanded and assessed a $1,000 civil penalty because Troy practiced dentistry on an expired license. (7-14-06)

York County Sharon Ann Wise of York, license no. DH-006032L, was assessed a $250 civil penalty, a reprimand was placed on her board record, and she must complete the lacking five hours of continuing education within six months. Wise failed to meet the required continuing education credits by five hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Out of State Jennifer Lyn Dartois of Sarasota, FL, license no. DH-013455-L, was assessed a $150 civil penalty, received a public reprimand and was ordered to complete three credit hours of continuing education within six months, based on her failure to submit proof of completion of at least 20 hours of continuing education for the 2001-2003 biennial period. (05-17-06) C. Benson Clark of Newport News, VA, license no. DS-018505-L, was assessed a $1,000 civil penalty because his license to practice dentistry was disciplined by the proper licensing authority of the Commonwealth of Virginia. (06-09-06) Mark David Levenson of Boca Raton, FL, license no. DS-023366-L, was assessed a $1,000 civil penalty because his license to practice dentistry was disciplined by the proper licensing authority of the State of Ohio. (06-09-06) Robert Rosen of Wilmington, DE, license no. D017252-L, was assessed a $300 civil penalty and ordered to complete four hours of continuing education within six months because he failed to submit proof of completion of required continuing education hours for the 2001-2003 biennial period. (06-09-06) Allen Vershel of New York, NY, license no. DS-029156-R, was reprimanded and assessed a $1000 civil penalty based upon his failure to submit proof of completion of required continuing education hours for the 2001-2003 biennial period. (06-09-06) Steve Hiep Nguyen of Las Vegas, NV, license no. DS-030312-L, was assessed a $1,000 civil penalty and received a public reprimand because he had disciplinary action taken against his license by the proper licensing authority of the State of Nevada. (06-19-06) Robert M. Block of Sterling, VA, license no. DS-021117-L, voluntarily and permanently surrendered his dental license, because Block had his license to practice dentistry revoked, suspended or had other disciplinary action imposed or consented to by the proper licensing authority of another state. (07-14-06) Debra L. Coll of Kalamazoo, MI, license no. DH-009087L, was assessed a $1,750 civil penalty, a reprimand was placed on her board record, and she must complete the lacking 20 hours of continuing education within six months. Coll

failed to meet the required continuing education credits by 20 hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Linda E. Fletcher of Steubenville, OH, license no. DH-067565, was assessed a $200 civil penalty, a reprimand was placed on her board record, and she must complete the lacking four hours of continuing education within six months. Fletcher failed to meet the required continuing education credits by four hours for the April 1, 2003 through March 31, 2005 licensing period. (07-14-06) Leonard Vertsman of Fort Lee, NJ, license no. DS-030003-L, was assessed a $2,000 civil penalty because he had disciplinary action taken against his license by the proper licensing authority of another state. (7-14-06) Beverly Jo Garrett of Ranson, WV, license no. DS-026654-L, was assessed a $500 civil penalty because her license to practice dentistry was disciplined by the proper licensing authority of the state of West Virginia. (07-14-06) Matthew M. Riffee of Lexington Park, MD, license no. DS-027115L, was indefinitely suspended. Riffee had disciplinary action taken against his license by the proper licensing authority of another state. (07-24-06) Chester K. Little of Warner Robins, GA, was denied a license because he failed to demonstrate the qualifications or standards for licensure contained in the dental law and the regulations of the board because he is addicted to narcotics. (07-27-06) C. Benson Clark of Newport News, VA, license no. DS-018505L, was suspended based on his violation of a lawful disciplinary order of the board for failure to pay a civil penalty. (08-07-06) Beverly Jo Garrett of Ranson, WV, license no. DS-026654-L, was suspended based on her failure to pay a civil penalty previously imposed by the board. (0821-06) Ronald F. Gerhard of Red Bank, NJ, license no. DS-021120-L, agreed to the permanent voluntary surrender of his license to practice dentistry in PA. Gerhard had disciplinary action imposed on his license to practice dentistry by the proper licensing authority of another state. (09-08-06) Young Suk Kim of Henderson, NV, a/k/a Young K. Dill, license no. DS-030781-L, agreed to the permanent voluntary surrender of her license to practice dentistry in PA. Kim had disciplinary action imposed on her license to practice dentistry by the proper licensing authority of another state. (09-08-06)

Richard S. Weiser of Strongsville, OH, license no. DS-025710-L, was assessed a $1,000 civil penalty because his license to practice dentistry was disciplined by the proper licensing authority of the State of Ohio. (09-08-06) Lawrence J. Korenman of Richardson, TX, license no. DS-035246-L, was reprimanded and assessed a $1,000 civil penalty because his license to practice dentistry was disciplined by the proper licensing authority of another state. (0919-06)
BOARD OF MEDICINE Allegheny County Maureen A. Loyer of Glassport, license no. RT-003283, was assessed a $500 civil penalty. Loyer continued to practice while his certificate to practice as an athletic trainer was expired during the period from Feb. 1, 2005 to Feb. 17, 2006. (08-22-06) Berks County Luther L. Wright of Reading, license no. MT-181660, was assessed a $5,000 civil penalty and his license was suspended for a period of three years, with the suspension immediately stayed in favor of probation subject to terms and conditions. Wright was convicted of a felony in a federal court. (08-22-06) Bucks County Harvey Walter Brookman of Yardley, license no. MD-026946-E, was revoked and assessed a $50,000 civil penalty for unprofessional conduct in the continued practice of medicine beyond the scope of his license. (08-23-06) Clearfield County Thomas J. Bradley of DuBois, license no. MD-021402-L, was ordered to enroll and successfully complete and document a board-approved course in medical record-keeping within six months. (04-27-06) Crawford County Anil K. Dutt of Titusville was granted a medical license, with the license shall immediately be placed on probation for no less than six months subject to terms and conditions based on affirmatively demonstrating that he can practice medicine and surgery in Pennsylvania with reasonable skill and safety and would not present a threat to the public health and safety. Cumberland County Willis W. Willard, III of Carlisle, license no. MD-007896E, was permitted to permanently and voluntarily surrender his medical license. Willard engaged in immoral or unprofessional conduct by prescribing medications to individuals with whom he had no physician-patient relationship. (09-26-06) Dauphin County Safa P. Farzin of Harrisburg, license no. MD-421521, was assessed a $1,000 civil penalty because Farzin failed to report to the board within 60 days of receipt of notice of a complaint in a medical professional liability action that was filed against him. (08-22-06) Elk County Michael A. Moclock of St. Mary’s, license no. MD-041757-E, was suspended for no less than three years with the suspension immediately stayed in favor of no less than three years probation with terms and conditions, including his successful participation in the Disciplinary Monitoring Unit of the Professional Health Monitoring Programs. Moclock is unable to practice medicine and surgery with reasonable skill and safety to patients by reason of addiction to drugs or alcohol. (06-27-06) Franklin County Jeffrey L. Fahnestock of Chambersburg, license no. MA-001458-L, was revoked based on his unprofessional conduct and practicing in violation of the board's order. (04-28-06) Lancaster County Pamela L. Craddock of Narvon, license no. MW-008479-L, was assessed a $1,000 civil penalty and a public reprimand was placed on her permanent board record. Craddock practiced midwifery without a valid unexpired license. (08-2206) Lebanon County Benson Harvey, Jr. of Lebanon, license no. MD-034196-E, was publicly reprimanded and paid a $1,000 civil penalty. Harvey failed to remove a surgical drape from a patient prior to completing a surgical procedure. (06-27-06) Michele Joanne Lea-Stokes of Lebanon, license no. MD-043845-L, agreed to the issuance of an order by the board in which Lea-Stokes shall: 1) pay a $1,000 civil penalty; 2) enroll in and successfully complete a two-day, on-site, medical record keeping course approved by the prosecuting attorney; and 3) successfully complete the 30 hours of continuing medical education ordered by the Texas Board on April 8, 2005. The two-day, on-site, medical record keeping course and the 30 hours of continuing medical education must be successfully completed within one year of the board adopting and approving the

consent agreement in this matter. The two-day, on-site, medical record keeping course and the 30 hours of continuing medical education must be completed in addition to Lea-Stokes completing the required continuing medical education necessary to maintain an active license to practice medicine and surgery in Pennsylvania. Failure of Lea-Stokes to successfully complete the two-day, onsite, medical record keeping course and the 30 hours of continuing medical education within one year of the board adopting and approving the consent agreement in this matter shall result in the immediate suspension of her license until Lea-Stokes completes the two-day, on-site, medical record keeping course and the 30 hours of continuing medical education. Lea-Stokes was disciplined by the board because she had disciplinary action taken against her license to practice medicine by the proper licensing authority of another state. (09-26-06) Montgomery County Steven M. Kessler of Wynnewood, license no. MD-041757-E, was suspended for no less than three years with the suspension immediately stayed in favor of no less than three years probation with terms and conditions, including his successful participation in the Disciplinary Monitoring Unit of the Professional Health Monitoring Programs. Kessler is unable to practice medicine and surgery with reasonable skill and safety to patients by reason of addiction to drugs or alcohol. (06-27-06) Robert P. Ditizio of Collegeville, license no. MD-047027-L, was indefinitely suspended for no less than three years, retroactive to Feb. 27, 2006, with all but eighteen months stayed in favor of probation. Ditizio failed to abstain from the use of controlled substances or drugs of abuse. (06-29-06) Ian M. Goonewardene of Royersford, license no. MD-064260L, was assessed a $1,000 civil penalty. Goonewardene failed to report to the board within 60 days of receipt of notice of a complaint in a medical professional liability action that is filed against him. (08-22-06) Prashant Pramod Parikh of Lansdale, license no. MD-066280-L, was publicly reprimanded and assessed a $1,000 civil penalty. Parikh had his license or other authorization to practice the profession revoked or suspended or had other disciplinary action taken against his license by the proper licensing authority of another state. (08-22-06) Northumberland County Jere L. Wagner of Shamokin, license no. MD-025370-E, had his license indefinitely suspended, with the suspension immediately stayed in favor of probation, subject to provisions. Wagner prescribed controlled substances to patients without conducting proper re-evaluations, or maintaining appropriate medical records. (08-22-06)

Philadelphia County Sohail S. Chaudhry of Philadelphia, license no. MT-181822, had his license to practice as a graduate medical trainee temporarily suspended since his continued practice as a graduate medical trainee presents an immediate and clear danger to the public health and safety. (04-16-04) Joseph J. Mele of Philadelphia, license no. YN-000480-L, was assessed a $250 civil penalty. Mele practiced respiratory care without a valid, current license. (08-22-06) Somerset County Anna Yoder of Meyersdale, unlicensed, was ordered to cease and desist from the practice of midwifery and assessed a $1,000 civil penalty. Yoder engaged in the practice of medicine when she was not licensed to do so, prescribed and administered the prescription drug Pitocin and practiced midwifery without a license or the necessary training needed to obtain a nurse-midwife license. (0816-06) Ruth Yoder of Meyersdale, unlicensed, was ordered to cease and desist from the practice of midwifery and assessed a $1,000 civil penalty. Yoder engaged in the practice of medicine when she was not licensed to do so, prescribed and administered the prescription drug Pitocin and practiced midwifery without a license or the necessary training needed to obtain a nurse-midwife license. (0816-06) Washington County Gurbachan S. Kathpal of Canonsburg, license no. MD-035764-L, was indefinitely suspended by reason that he is unable to practice with reasonable skill and safety to patients because of illness, addiction to drugs or alcohol. (07-05-06) Westmoreland County Doug Lenhart of New Kensington, unlicensed, was issued an order to cease and desist from the practice of medicine and surgery and assessed a $10,000 civil penalty for unauthorized practice without a license. (06-13-06) York County Glenn F. Leister of Hanover, license no. MD-026778-L, voluntarily and permanently suspended his license to practice medicine effective Aug. 1, 2006. Leister was ordered to turn in his wall certificate, registration certificate and wallet card to the Department of State Legal Office by Aug. 7, 2006. Leister prescribed controlled substances for other than acceptable medical purposes and engaged in unprofessional conduct with respect to his prescribing practices in that his prescribing practices failed to comply with the quality of standards of the profession. Hunter, Jr. of Bluefield, WV, license no. MD-066647-L, was suspended until all terms and conditions are removed from his WV license. Hunter had his license or other authorization to practice the profession revoked or suspended or had other disciplinary action taken against him by the proper licensing authority of another state. The suspension of Hunter’s license shall remain in effect until the board grants Hunter’s petition to terminate the suspension. The petition will be granted upon a showing to the board’s satisfaction that: (1) all terms and conditions have been removed from Hunter’s WV license; and (2) Hunter can practice with reasonable skill and safety to patients. (07-25-06) Milton M. Smith of New York, NY, license no. MD-064653-L, agreed to voluntarily surrender his license to practice medicine in PA. Smith had his license to practice the profession revoked by the proper licensing authority of another state and then failed to report the disciplinary action taken against him to the board within 60 days. In the event that Smith wishes to have his medical license reinstated, he must petition the board, and show to the board’s satisfaction that: (1) Smith’s NY medical license has been reinstated without any restrictions, terms, or conditions; (2) there are no restrictions on Smith’s license to practice medicine in any other jurisdiction; and (3) Smith can practice with reasonable skill and safety to patients. Feiler was deficient by three category one continuing education credits and 80 category two continuing education credits for the biennial reporting period from Nov. 1, 2002 through Oct. 31, 2004. (07-12-06) Crawford County Khanh Nguyen Vu of Titusville, license no. OS-010754-L, voluntarily and permanently surrendered his license. Vu has criminal charges pending against him regarding allegations he inappropriately touched female patients and has not complied with recommendations for further evaluation and treatment. Kimmel deviated from the standards of acceptable and prevailing osteopathic medical practice by signing prescriptions in blank and permitting a CRNP who was not authorized to prescribe and dispense drugs and/or delegated the performance of medical services to a CRNP who was not permitted to perform those services. (07-12-06) Out of State Marshall Pressman of Gloucester City, NJ, license no. OS-003644-L, was publicly reprimanded and assessed a $5,000 civil penalty because Pressman was disciplined by the proper licensing authority of another state. (07-12-06) Richard W. Kruse of Wilmington, DE, license no. OS004986L, was assessed a $1,500 civil penalty. (09-20-06) Walmart Pharmacy 10-1670 of Wyomissing, license no. PP-414482L, was assessed a $500 civil penalty. Walmart Pharmacy sold a drug that was misbranded. (10-17-06) Bucks County Clare L. Ditommaso of Langhorne was issued a public reprimand for practicing on a lapsed license. (06-27-06) Centre County Charles S. Talarigo of Milesburg, license no. RP-035190R, was suspended for no less than three years, with the suspension immediately stayed in favor of no less than three years of probation, and the probation to be subject to terms and conditions. Talarigo was unable to practice the profession because of intemperance in the use of alcoholic beverages, controlled substances or any other substance which impairs the intellect and judgment to such an extent as to impair the performance of professional duties. (09-20-06) Dauphin County Andrea E. McConnell of Camp Hill, license no. RP-042577L, paid a $500 civil penalty. McConnell dispensed a drug which contains less than the proportionate quantity of ingredient specified by the person who prescribed the drug. (10-1706). Delaware County Squire Drugs, Inc. of Springfield, license no. PP-413223-L, was assessed a $1,700 civil penalty. Squire Drugs, Inc. pharmacy did not maintain an adequate reference library, had outdated medications in active stock, failed to properly label all prescriptions for generic medications with the correct manufacturer name, failed to reduce to writing all oral prescriptions received by phone, and failed to include on the prescription label the correct expiration date of a drug that had less than one year of full potency. (05-17-06) Bruno Allen Iorfido of Ridgway, d/b/a Iorfido Family Pharmacy, license no. PP410967-L, was suspended for six months, stayed in favor of probation. The holder of the permit violated a provision of the Pharmacy Act. (05-17-06) Erie County Gary P. Abatta, license no. RP-029900L of Erie, was indefinitely suspended for no less than three years, immediately stayed in favor of no less than three years probation, and the probation to be subject to terms and conditions. Abatta is unable to practice the profession due to intemperance in use of alcoholic beverages, controlled substances or other substances which impairs the intellect and judgment to such an extent as to impair the performance of duties. (08-1506) Fayette County Mr. Trush, license no. RP-036357-R of Brownsville, was indefinitely suspended for three years, immediately stayed in favor of three years probation. Trush received ARD in disposition of felony charges and offenses in connection with the practice of pharmacy. (6-21-06) Greene County Joseph F. Gula, III of Waynesburg, license no. RP-040073-L, was suspended for at least three years, with the first 60 days to be served on active suspension, and the remaining suspension stayed in favor of probation, subject to terms and conditions. Gula had disciplinary action being taken against his license by the office licensing authority of DE. (05-19-06) Lebanon County Michael Christopher Peterson of Lebanon, license no. RP-045773L, was suspended for one year; after 30 days Peterson may petition to have the suspension stayed in favor of a two year probationary period. Peterson obtained drugs, for personal use, by fraud, deceit, misrepresentation or subterfuge. (0721-06) Lehigh County Discount Drugs of Canada, of Allentown, was assessed a $1,000 civil penalty and ordered to cease and desist of using any term in the name of its business prohibited by the pharmacy Act. Montgomery County Enelia Maria Santiago of Huntingdon Valley, license no. RP-043832-R, was ordered to complete 15.5 ACPE-approved continuing education credits and assessed a civil penalty of $750. Santiago failed to provide documentation of completion for 15.5 hours of ACPE-approved continuing education credits (0223-06) Michael J. Choi of Lansdale, license no. RP-045796L, was assessed an $8,000 civil penalty and his license was suspended; following a period of two months of active suspension, with the remaining 10 months immediately stayed in favor of probation subject to terms and conditions. Choi dispensed drugs to himself without a prescription. (09-20-06) Haeun Pharmacy of Melrose Park, license no. PP-481283, was assessed a $2,500 civil penalty. Haeun Pharmacy had various facility violations. (09-20-06) Amy Kristen Hahn of Limerick, license no. RP-044257L, was suspended for a period of three years, with the suspension immediately stayed in favor of three years probation subject to the terms and conditions set forth in the order. Hahn is guilty of incompetence, gross negligence or other malpractice, or the departure from, or failure to conform to, the standards of acceptable and prevailing pharmacy practice. (09-20-06) Medications-4-Less of Bala Cynwyd, unlicensed, was assessed a $1,000 civil penalty and ordered to cease and desist from the use of any term in the name of its business prohibited by the Pharmacy Act. Medications-4-Less operated a business with the word “medications” in the name of the business without being issued a permit to operate a pharmacy. (07-21-06) Philadelphia County Paula K. Ferro of Philadelphia, license no. RP-040171-L, was automatically suspended effective July 17, 2006 based on findings that she pled guilty to a felony under the Pennsylvania Drug Act for knowingly and intentionally distributing Percocet and Oxycontin, Schedule II controlled substances, without a legitimate prescription. (06-26-06) Lewis Korff of Philadelphia, license no. RP-028082-L, was assessed a $1,500 civil penalty and was indefinitely suspended, with the first 12 months active and the remaining period of suspension stayed in favor of probation, and the entire period of suspension to run concurrently with Korff’s criminal probation period. Korff pleaded guilty to a felony in a federal court. (07-18-06) Daniel J. Bereza of Philadelphia, license no. RP-029273L, was assessed a $5,000 civil penalty and ordered to complete two Accreditation Council for Pharmacy Education (ACPE)-approved continuing education courses in the category of ethics, two ACPE-approved continuing education courses in the

category of pharmacy law and two ACPE-approved continuing education courses in the category of safety. Bereza failed to ensure that only licensed pharmacists or licensed pharmacist interns have access to Schedule II controlled substances or work in an area where open containers of the controlled substances are shelved or stored. (09-20-06) Warren County Thomas R. Gentz of Youngsville, license no. RP-030039-L, had his license revoked and was assessed a $1,000 civil penalty for practicing pharmacy on a suspended license. York County Karl Vincent Schittle of York, license no. RP-034855-L, was suspended no less than three years, retroactive to April 19, 2006, based on findings that he is unable to practice pharmacy with reasonable skill and safety by reason of addiction to alcohol or other drugs which tend to impair judgment or coordination. (06-26-06) Out of State Geoffrey Brown of East Aurora, NY, had his application for transfer of pharmacist license denied for failure to meet the qualifications for licensure. (04-11-06) Joseph A. Emanuele of Keizer, OR, license no. RP-044857-L, was assessed a $1,500 civil penalty based on his having entered a plea of nolo contendere to crimes of moral turpitude and having made false representations with respect to the renewal of his license. (05-19-06) Paul F. Cerza of Egg Harbor Township, NJ, license no. RP-437856-L, was suspended and assessed a $1,000 civil penalty based upon disciplinary action in another state. (08-30-06) Arthur H. Hackendahl of Random Lake, WI, license no. RP-037784-R, has received a written reprimand from the board. Hackendahl had his license to practice pharmacy disciplined by the proper licensing authority of another state and in that he failed to report to the board the disciplinary action taken in another state on the biennial registration application or within ninety days of final disposition. Fall obtained a registration to practice as a physical therapy assistant by fraud or misrepresentation, was convicted of a misdemeanor which relates to Fall’s suitability for registration as a physical therapist assistant in the commonwealth, and Fall became addicted to alcohol which tends to impair judgment or coordination.
