                                 I.     GENERAL PROVISIONS

         1.      The Network Statement of the Public Railway Infrastructure (hereinafter-the
Network Statement) is an informative publication of AB “Lietuvos geleţinkeliai” - the manager of
public railway infrastructure.
         2.      The Network Statement is prepared and announced by AB “Lietuvos geleţinkeliai”
that was appointed infrastructure manger of the public railways by Order No. 997 of 22 August
1996 of the Government of the Republic of Lithuania.
         3.      The Network Statement is an informative publication prepared under the guidance
of the Railway Transport Code of the Republic of Lithuania, Regulations for the Allocation of
Infrastructure Capacities of the Public Railway Infrastructure and other legal acts of the Republic
of Lithuania.
         4.      The Network Statement is prepared under the guidance of the following legal acts:
         4.1.    2002/844/EC: Commission Decision of 23 October 2002 amending Directive
2001/14/EC in respect of the date for changing the working timetable for rail transport ;
         4.2.    The Railway Transport Code of the Republic of Lithuania (Official Gazette, 2004,
No. 72-2489; 2006, No. 72-2672);
         4.3.    The Law on the Fundamentals of Transport Activities of the Republic of Lithuania

         6.      This Network Statement is aimed at informing in detail the applicants about all
requirements, documents and charges so that they could use the capacities of the public railway
infrastructure of AB “Lietuvos geleţinkeliai”.

         8.     The following terms are used in the Network Statement:
         8.1. “The last minute” application – an application to allocate capacities submitted at the
time of effect of the official train schedule.
         8.2. Other terms used in this Network Statement meet the terms used in the Railway
Transport Code of the Republic of Lithuania, Law on Railway Transport Traffic Safety of the
Republic of Lithuania, Regulations for the Allocation of the Public Railway Infrastructure
Capacities, Provisions of the Railway Technical Use and other legal acts of the Republic of
Lithuania.

         II.     CONDITIONS FOR ACCESS AND USE OF THE PUBLIC RAILWAY
                                  INFRASTRUCTURE

          9.    The conditions of access to the public railway infrastructure are governed by:
          9.1. Regulations on the Allocation of Public Railway Infrastructure Capacities
(hereinafter – the Capacity Allocation Regulations) approved by Resolution No. 167 of 15 February
2006 of the Government of the Republic of Lithuania;
          9.2. Regulations on the Allocation of Public Railway Infrastructure Capacity in an
Overcrowded Part of the Public Railway Infrastructure approved by Order No. 3-361 of 18
September 2006 of the Minister of Transport and Communications of the Republic of Lithuania;
          9.3. The Principles of Coordination and the Description of Procedure for Applications of
Railway Undertakings (Carriers) when the Same Public Railway Infrastructure Capacities are
requested to be allocated approved by Order No. V-90 of 31 July of 2007 of the State Railway
Inspectorate.
          10. The right to use the public railway infrastructure is granted to:
          10.1. a railway undertaking (carrier) and (or) a group of international railway undertakings
(carriers) (hereinafter – an applicant) who acquired a licence and a safety certificate under the
procedure established in the laws and have concluded a Contract on the use of public railway
infrastructure with the public railway infrastructure manager.
          10.2. an exclusive right to use the public railway infrastructure by providing rail transit
services belongs to railway undertakings (carriers) that belong, or which all shares belong by the
right of ownership to the state of Lithuania.
          11. An applicant willing to use the public railway infrastructure, or using it shall
meet the following requirements:
          11.1. shall have a corresponding licence to engage in the railway transport economic
activities issued pursuant to the Railway Transport Code of the Republic of Lithuania and Licensing
Rules for the Carriage of Passengers, Luggage and Freight by the Railway Transport;

         11.2. shall have a corresponding safety certificate issued pursuant to the Railway
Transport Code of the Republic of Lithuania and Safety Certification Rules for Railway
Undertakings (Carriers) and Public Railway Infrastructure Manager.
         Licences and safety certificates are issued in the Republic of Lithuania by the State
Railway Inspectorate under the Ministry of Transport and Communications (hereinafter – the State
Railway Inspectorate);
         11.3. shall be guided in its activities by the laws of the Republic of Lithuania,
resolutions of the Government of the Republic of Lithuania, orders of the State Railway
Inspectorate and normative documents governing the carrier’s activities prepared by the public
railway infrastructure manager;
         11.4. shall have authorizations to start operation of the rolling stock issued under the
procedure established in the legal acts of the Republic of Lithuania. Authorizations are issued by the
State Railway Inspectorate;
         11.5. employees whose work is associated with train traffic, shall have to pass
examinations and have documents attesting to their qualification under the procedure established by
the State Railway Inspectorate
         11.6. shall conclude a Contract on the use of public railway infrastructure pursuant to the
legal acts of the Republic of Lithuania;
         11.7. shall submit a civil liability instance policy, bank guarantee or surety contract by
which the applicant’s obligations to indemnify for damage in case of a railway traffic accident are
guaranteed;
         11.8. shall enter into other contracts with the public railway infrastructure manager and
(or) other subject if their necessity is established at the time of negotiations regarding a Contract on
the use of the public railway infrastructure or allocation of capacities;
         11.9. when carrying out international carriages, shall conclude all necessary contracts and
agreements on the organization of passenger and freight traffic, accounting of rolling stock,
settlements, procedures, liability, participation in the activities of international organizations and
other issues necessary for ensuring the safety of international train traffic and passengers, luggage
or freight, if during the negotiations regarding a Contract on the use of public railway infrastructure
or allocation of capacities it turns out that it is necessary to conclude them.
         12. Conclusion of the contract on the use of public railway infrastructure (hereinafter
– Contract):
         12.1. requirements for the contract are set forth in Chapter VII of the Capacity Allocation
Regulations;
         12.2. the contract shall be made for one period of validity of the official train schedule
and shall be made or renewed on a yearly basis even in the case if a general agreement has been
concluded;
         12.3. all agreements signed by the applicant or certified copies thereof which necessity
was established during negotiations shall be attached to the contract as an integral part thereof;
         13.     The State Railway Inspectorate, the public railway infrastructure manager and an
applicant may conclude a general agreement. When concluding a general agreement, its content
shall be made with reference to the requirements set forth in chapter VIII of the Capacity Allocation
Regulations.
         14. Transportation of non-standard and heavy load:
         14.1. the transportation of non-standard and heavy load is regulated by Instruction DČ-
1835 on the transportation of non-standard and heavy load on the railway of the CIS countries,
Republic of Estonia, Republic of Latvia, Republic of Lithuania;
         14.2. a project for loading and fixation of non-standard and heavy load shall be prepared
for the transportation of non-standard and heavy load that will be approved by AB “Lietuvos
geležinkeliai” commission for verification of the method of freight loading and fixation;
         14.3. Information shall be provided by the Freight Division of the Freight Service of the
Freight Transportation Directorate by phone 2693324.

          15.      Transportation of dangerous goods:
          15.1.    the transportation of dangerous goods by the railway transport on the territory of
Lithuania is governed by the following main legal acts:
          15.1.1. Law on the Transport of Dangerous Goods by the Road, Railway and Inland
Water Transport of the Republic of Lithuania (Official Gazette, 2001, 2001, No. 111-4022; 2008,
No. 71-2705);
          15.1.2. Appendix C of Regulations concerning the International Carriage of Dangerous
Goods by Rail (RID) to the Convention concerning International Carriage by Rail (COTIF) (the
document is available on AB “Lietuvos geleţinkeliai” webpage www.litrail.lt (only in Lithuanian));
          15.1.3. Appendix 2 “Rules for the Transport of Dangerous Goods” with amendments of
the Agreement about International Freight Transport (SMGS) (the document is available on AB
“Lietuvos geleţinkeliai” webpage www.litrail.lt (only in Lithuanian));
          15.1.4. Resolution No. 84 of 22 January 2002 of the Government of the Republic of

          15.1.6. Order No. 3-547 of 01 December 2005 of the Minister of Transport and
Communications “On Requirements for Ensuring Safety for the Transport of Special Dangerous
Goods by 1520 Gauge Railways on the Territory of the Republic of Lithuania” (Official Gazette,
2005, No. 147-5376; 2008, No. 70-2691, 2010, No. 64-3161).
          15.2.    It was established by Resolution No. 84 of 22/01/2002 of the Government of the
Republic of Lithuania that dangerous goods shall be transported by the railway transport on the
territory of the Republic of Lithuania:
          15.2.1. to the countries (from the countries) that are contracting member states of the
Convention concerning International Carriage by Rail (COTIF) - pursuant to Appendix 1
Regulations concerning the International Carriage of Dangerous Goods by Rail (RID) of
Appendix B Contract for International Carriage of Goods by Rail (CIM) to the Convention
concerning International Carriage by Rail (COTIF) and other legal acts of the Republic of
Lithuania;
          15.2.2. to countries (from countries) that are contracting member states to the
Organization for Cooperation of Railways (OSJD) – pursuant to Appendix 2 “Rules for the
Transport of Dangerous Goods” of the Agreement about International Freight Transport (SMGS)
and other legal acts of the Republic of Lithuania;
          15.2.3. inside the country – pursuant to Appendix 1 Regulations concerning the
International Carriage of Dangerous Goods by Rail (RID) of Appendix B Contract for
International Carriage of Goods by Rail (CIM) to the Convention concerning International
Carriage by Rail (COTIF), Order No. 3-547 of 01 December 2005 of the Minister of Transport and
Communications “On Requirements for Ensuring Safety for the Transport of Special Dangerous
Goods by 1520 Gauge Railways on the Territory of the Republic of Lithuania”, and other legal acts
of the Republic of Lithuania.
          15.3.    employees whose work is associated with the transport of dangerous goods, shall
have to pass examinations and have documents attesting their qualification under the procedure
established by the State Railway Inspectorate.
          15.4.    for particular hazard categories of dangerous goods the legal acts establish an
additional control by the public railway infrastructure manager. Information about the provision of

               III.   MAIN CHARACTERISTICS OF THE PUBLIC RAILWAY
                               INFRASTRUCTURE NETWORK

         16.     Information provided in this chapter and the actual condition of the network may
not coincide due to regularly improved technical level of the infrastructure.
         17.     The main characteristics of the tracks of the public railway infrastructure and
stations are provided in Appendix 1 The Main Characteristics of the Public Railway Infrastructure.
Appendix 1 (only in the Lithuanian language) is provided when acquiring the Network Statement
under the procedure set forth in clause 67.
         18.     Geographical location of the public railway infrastructure:
         18.1. the geographical location of the public railway infrastructure network is provided in
Appendix 1;
         18.2. associated railway networks;
         18.3. of the Republic of Latvia (LDZ);
         18.4. of the Republic of Belarus (BČ);
         18.5. of the Republic of Poland (PKP);
         18.6.     of the Kaliningrad Region of the Russian Federation (RŢD).
         19.     The total length of the railways is 1765,4 km, of which:
         19.1. single track -1383,1 km;
         19.2. secondary track – 380.2 km;
         19.3. three-way track – 2.1 km;
         20.     The width of the track gauge is 1520 mm (1743.6 km long), and 1435 mm (21.8 km
long).
         21.     A four-way line of 1520 mm and 1435 mm gauge was aligned from Mockava to
Šeštokai railway stations. An automatic device for changing the gauge width (1435/1520) between a
wheel pair has been installed. 21.8 km long 1435 mm gauge line was constructed from the state
border with the Republic of Poland to Šeštokai railway station.
         22.     Railway stations are divided into the following groups according to their purpose
or type of operations carried out in them:
         22.1. Passenger station - a station which core activity is passenger services. This is
Vilnius station in the Republic of Lithuania.
         22.2. Load station – a station which core activity is loading works and the performance
of commercial operations. There are 23 load stations in the Republic of Lithuania, of which the
major ones are Bugeniai, Draugystė, Kaunas, Klaipėda and Paneriai.
         22.3. Railway sorting yard – a station which core activity is assembling and
disassembling of freight trains. These are Radviliškis and Vaidotas railway stations.
         22.4. Intermediate station – a station that is intended for accepting, sending and passing
passenger and freight trains, train crossing or passing.
         22.5. Transmission station – a station with a developed track network, having the
necessary technical devices and employees that have to ensure that the rolling stock were
transferred and accepted from another state and containers in good technical and commercial
condition, and that freight documents were properly executed. These are stations for the
transmission of rolling stock, containers and freight of Bugeniai, Pagėgiai, Kybartai, Vaidotai,
Radviliškis and Draugystė in the Republic of Lithuania.
         22.6. Boundary station – a station located the closest to the state border of the Republic
of Lithuania where the state institutions carry out border control procedures associated with
international freight and passenger carriages. These are the stations of:
         22.6.1. Kena, Stasylos – with the Republic of Belarus;
         22.6.2. Pagėgiai, Kybartai – with the Russian Federation (Kaliningrad Region);

        22.6.3. Klaipėda is the only one port of the Republic of Lithuania that connects Lithuania
with Sweden, Finland, Germany and Poland by the railway ferry lines.
        23.       A list of stations where freight loading and unloading works and other commercial
operations are carried out is provided in the Book of imported, exported and local freight tariffs 01-
LG/2008 and is provided in Appendix 2.
        24.       Freight clearance allowable in all railway lines is provided in diagram 1:

          25.     Weight limits:
          25.1. an axle load of 22.5 t is allowable in all railway lines;
          25.2. an equivalent load (t/m) per each railway line is determined by the public
infrastructure manager with consideration to equivalent loads allowable on the track structures. The
limits of equivalent load on the Lithuanian railway network range from 7.5 to10.5 t/m. A list of
locomotives that are allowed to ride on the Lithuanian railway lines is provided in the second
Appendix to Order No. Į-282 of the Director General of 8 June 2006.
          26.     Gradient inclines:
          26.1. A gradient incline on the Lithuanian railway network is considered a part of the
longitudinal section making an angle with the horizon line. A gradient incline on which a train goes
up the hill is called a rise, whereas a gradient incline on which a train goes down the hill is called a
downgrade. The steepest (including the resistance of curves) downgrade which length is not
shorter than the braking stopping distance is called the ruling gradient;
          26.2. The biggest ruling gradient on the Lithuanian railway network is in the line: the
state border with the Republic of Lithuania – Obeliai- Radviliškis;
          26.3. A list of other ruling gradients is provided in Appendix 3.
          27.     The biggest allowable speeds of trains and locomotives on the railway station
tracks, side tracks and sidings were determined by Order No. Į-843 of 3 November 2009 of the
Director General of AB “Lietuvos geleţinkeliai” and Order No. Į-232 of 10 March 2007 of the
Director General of AB “Lietuvos geleţinkeliai”. The orders may be updated by taking into
consideration changes in the track facilities.
          28.     The maximum weight of freight trains and the length of freight and passenger
trains are specified in the Appendix to the official train schedule.
          29.     Electrified railway lines:
          29.1. electrified railway lines N. Vilnia-Vilnius, Vilnius-Kaunas, and Lentvaris-Trakai;
          29.2. 25 kV alternating current of 50 Hz frequency is used in the contact network of the
electrified lines. The electrified lines are adapted only for the suburban train traffic;
          29.3. an operational length of the electrified railway lines is 122 km, of which:

           29.3.1. single track – 4.98 km;
           29.3.2. secondary track – 117.02 km;
           29.4.      In case of the alternating current, voltage in the electric rolling stock receivers in
any block district shall be at least 21 kV and not higher than 29kV. Wires of the contact network on
the side tracks and in the stations over the railhead shall be suspended no lower than at 5750 mm,
and on the level crossings – no lower than at 6000 mm;
           30.        Railway signalling system:
           30.1.      the railway signalling system ensures a safe train traffic with a speed of up to 120
km/h, whereas on the line where the signalling facilities have been upgraded – a speed of 160 km/h;
           30.2.       signalling facilities were upgraded (are being upgraded) in the following railway
lines:
           30.2.1. the signalling facilities were upgraded in Kaišiadorys - Radviliškis line (IX-B
corridor) in 2004. Computerized interlocking Ebilock 950 was installed;
           30.2.2. facilities on the Šiauliai- Klaipėda (IX-B corridor) line. The newly installed
SIMIS-IS facilities will be integrated into the Vilnius Traffic Control Centre;
           30.3.      Signalling facilities of the regional significance railway lines are upgraded using
relay equipment.
           30.4.      Signalling facilities are divided into station and side tracks;
           30.4.1. The signalling systems of station are divided into:
           30.4.1.1. relay interlocking. Such interlocking is installed in the majority of Lithuanian
railway stations. All outdoor objects (depending on the signalling type of each station): switches,
traffic lights, rail chains, ALSN codes, etc., and their condition are relay controlled;
           30.4.1.2. microprocessor interlocking. The microprocessor signalling systems are
installed in the renewed railway lines. Two microprocessor interlocking types are used in the
Lithuanian railways: Ebilock 950 that was installed in the Kaišiadorys-Radviliškis line stations, and
SIMID-IS which operation will be commenced in the Šiauliai-Klaipėda line stations;
           30.4.2. the signalling systems of side tracks are divided into:
           30.4.2.1. automatic block signalling. It regulates train traffic on the side tracks (depending
on the number of blocked districts several trains may go at the same time on the side tracks). It is
used together with ALSN (automatic locomotive signalling of continuous operation) train safety
system. The signalling automatic train stopping devices are installed in locomotives that stop a train
automatically in case of restrictive signal, if the driver does not stop a train on time. An automatic
locomotive signalling of continuous operation (ALSN) with which help the signals of track traffic
lights that are approached by a train are continuously transmitted to the driver’s cabin alongside the
entire length of a blocked district and stations. In the ALSN system, the function of communication
channel between the track and a locomotive is performed by the rail chains. Coded current power
signals running on the rails are used in the system.
           30.4.2.2. semi-automatic block signalling. It regulates train traffic in the station-to-station
block (only one train may go on the side track at the same time):
           30.5.      The location of signalling systems in the railway network is provided in
Appendix 4.
           31.        Until the A class signalling system installation is not completed, all locomotives
shall be supplied with STM module that would ensure the interoperability of the systems mentioned
in paragraph 30. Technical requirements to the STM module can be founded on the official AB
“Lietuvos geleţinkeliai” website www.litrail.lt.
           32.        The radio communication systems used for organizing train traffic are divided
into:
           32.1.      linear radio communication systems intended for communication by a
locomotive driver with a train dispatcher responsible for the line on which a locomotive is, and with
the persons on duty in adjacent stations (and vice versus). A linear radio communication system
operates within a hectometre wave radius at a 2.13 MHz frequency (a standby channel – 2.15
MHz);

         32.2.      zonal radio communication systems intended to transmit voice commands and
other voice messages about shunting, course of repairs and/or other works, condition of the rolling
stock and other machinery, etc. in the local railway station territories. The zonal radio
communication system operates within the ranges of metric (150-154 MHZ) and decimetric (445-
450 MHz) waves.
         33.      Limitations of train traffic:
         33.1.    there is no specialized infrastructure restricting the train traffic;
         33.2.    there are no environmental restrictions on the train traffic;
         33.3.    there are no tunnels were train traffic is restricted;
         33.4.    traffic restriction for bridges. All railway bridges, except for pedestrian, are
classified by the load bearing capacity. A bridge category by bearing capacity is a generalized
indicator of the bride strength. Bridges are divided by load capacity into five categories:
         33.4.1. I category - bridges calculated for N 8 and S 14 load where there are no defects
reducing the load capacity without reducing the speed;
         33.4.2. II category - bridges on which the rolling stock with a longitudinal track load
capacity of maximum 10.5 t f/m (ton force per linear meter), if the track load by one wheel pair of a
locomotive or wagon is 27 t, also all presently used 500 t capacity transporter wagons with some
speed limitations may run;
         33.4.3. III category – bridges on which the presently used rolling stock, including eight-
axle open wagons with a longitudinal track load of maximum 9 t f/m with some speed restrictions
may run;
         33.4.4. IV category – bridges on which four-axle wagons with a longitudinal track load of
maximum 7.5 t f/m with some speed limitations, and 300 t capacity transporter wagons with some
speed limitations may run;
         33.4.5. V category - all other bridges of smaller load capacity by restricting the speed of
heavy trains.
         33.5.    the location of bridges on the railway network by categories is provided in table 2:

         34. The list of the most important infrastructure projects for the public railway
infrastructure aimed at enhancing technical capacities of the railway lines is provided in Appendix
5.
                             IV.     ALLOCATION OF CAPACITIES

         35. The capacities are allocated to applicants by the State Railway Inspectorate per one
validity period of the official train schedule.
         36. The capacities for more than one validity period of the official train schedule may be
granted only if an applicant has concluded a general agreement with the State Railway Inspectorate
and the public railways infrastructure manager where the volume of capacities requested is
indicated.
         37. An application shall be written in the Lithuanian language and submitted by
registered mail with delivery confirmation to the State Railway Inspectorate at:

        38. An application form and the list of documents to be attached thereto were
determined by Order No. V-68 of 18 August 2006 of the State Railway Inspectorate “On the

Establishment of Requirements for the Content of an Application to Allocate the Railway
Infrastructure Capacities and a List of Documents to be Attached to the Application” .
         39.     An application to allocate capacities shall not be examined and the documents
submitted shall be returned in cases listed in clause 11 of the Capacity Allocation Regulations.
         40. After making sure that all data were provided for the allocation of capacities in an
application and that all documents were attached, the State Railway Inspectorate shall transfer an
application to the public railway infrastructure manager for carrying out a technical analysis no later
than within one month after the deadline for the submission of applications.

         42. An official train schedule may be changed and updated with consideration to
seasonal, protocol and other (e.g. at the request of adjacent states’ railway infrastructure managers,
administrations or applicants) changes in the train traffic schedule. If an official train schedule is
changed at the request of the public railway infrastructure manager or one of the applicants, the
volume of capacities allocated to other applicants shall not be reduced. Then amendments and
adjustments shall come into effect of the date and time indicated by the public railway infrastructure
manager.
         43. It shall be informed of changes in the official train schedule no later than two weeks
before their entry into effect.
         44. “The last minute” applications shall be submitted and examined under the
procedure set forth in chapter IX of the Capacity Allocation Regulations.
         45. Applications to allocate the same capacities of the public railway infrastructure
shall be coordinated pursuant to 31 July 2007 Order No.V-90 “On Approval of the Principles of
Coordination and the Specification of Procedure for Applications of Railway Undertakings
(Carriers) when the Same Public Railway Infrastructure Capacities are Requested to be Allocated”.
         46. If the public railway infrastructure manager may not satisfy all applications to
allocate capacities in one section of the public railway infrastructure after negotiations with the
applicants due to insufficient capacities, it shall inform thereof the State Railway Inspectorate that a
particular part of the public railway infrastructure is overcrowded.
         47. Capacities shall be allocated in an overcrowded section of the railway
infrastructure pursuant to the Regulations on the Allocation of Public Railway Infrastructure
Capacity in an Overcrowded Section of the Public Railway Infrastructure approved by Order No. 3-
361 of 18 September 2006 of the Minister of Transport and Communications of the Republic of
Lithuania.

          48.      Applications to allocate capacities for carrying out maintenance and repairs
of the public railway infrastructure shall be submitted to the State Railway Inspectorate before
the deadline for drawing up an official train traffic schedule.
          49.      If applications to allocate capacities for the maintenance and repairs of the public
railway infrastructure are provided at the time of validity of the official train schedule, they shall be
examined as “the last minute” applications.
          50.      Use of the public railway infrastructure:
          50.1.    the capacities granted to an applicant may be used under the conditions and within
the scope set forth in the contract and according to the official train schedule;
          50.2.     it is forbidden to sell and (or) transfer the allocated capacities;
          50.3.    upon receipt of the right to use particular capacities an applicant shall ensure that
the intensity of their use shall be at least of ¾ of the scope specified in the contract;
          50.4.    the public railway infrastructure manager has the right to demand that a train line
was withdrawn in an overcrowded section of the infrastructure, if it was used to the extent smaller
than ¾ of the order for at least one month.
          51.      Waiver of the right to use the public railway infrastructure:
          51.1.    upon receipt of the right to use capacities and having no possibilities to use them,
an applicant must appeal to the State Railway Inspectorate and the public railway infrastructure
manager with a refusal to use them or with a request to allocate other capacities;
          51.2.    if an applicant does not make use of the capacities allocated, the initial
contribution shall not be refunded;
          51.3.    if an applicant appealed to the State Railway Inspectorate with an application to
allocate other capacities than those allocated to him, such applications to allocate other capacities
shall be examined as the “last minute” applications;
          51.4.    upon receipt of a written notice from a railway undertaking (carrier) on the refusal
to use further the capacities allocated, within 14 calendar days of the receipt of such a notice the
public railway infrastructure manager shall submit to the State Railway Inspectorate a motivated
offer regarding the use of such capacities for repairs and maintenance works of the public railway
infrastructure or their announcement as vacant;
          51.5.    The State Railway Inspectorate shall take a decision to allocate the available
capacities for the repairs and maintenance works of the public railway infrastructure within five
working days of the receipt of a motivated offer;
          51.6.     The State Railway Inspectorate shall announce of the capacities available on its
website.
          52.      Liquidation of train traffic accidents:
          52.1.    Actions of the public railway infrastructure manager and railway undertakings
(carriers) in liquidating accidents are regulated by the Regulation on the Investigation of Railway
Transport Traffic Accidents and Liquidation of Consequences thereof approved by Order No. 3-
370 of 11 June 2010 of the Minister of Transport and Communications (Official Gazette, 2010, No.
71-3605);
          52.2.     the public railway infrastructure manager has the right without a notice and
compensation to suspend the train traffic completely or partially in those sections where a traffic
accident took place and for the time that is necessary for restoring the train traffic;
          52.3.    after restoring the train traffic, the public railway infrastructure manager shall
determine the priority of dispatching the accumulated trains depending on their amount to
corresponding directions and guided by the train traffic schedule.

V. SERVICES PROVIDED BY THE PUBLIC RAILWAY INFRASTRUCTURE MANAGER

         53.     Services provided for the initial and final instalment of the charges:
         53.1.   processing of applications to allocate capacities;

          53.2.   use of tracks and switches, railway sorting yards, train assembling equipment, lead
tracks;
         53.3. train traffic control, including signalling, regulation, train traffic management;
         53.4. transfer and provision of information about train traffic (the scope of information
provided is determined during negotiations);
         53.5. all other information necessary to start the provision or to provide a particular
service for which the capacities were allocated.
         54.    Additional services provided for an additional charge:
         54.1. use of the contact electrical network and current power supply (N.Vilnia – Vilnius
– Kaunas; Lentvaris- Trakai);
         54.2. escorting of non-standard load.
         55.    Additional services provided at the request of the railway undertaking (carrier).

                                            VI. LEVIES

56. A charges consists of:
         56.1.         payment for the provision of services specified in clause 52 of the Network
Statement consisting of:
         56.1.1.       initial instalment;
         56.1.2.       final instalment;
         56.1.3.       payment for the provision of additional services indicated in clause 53 of this
Network Statement.
         57.           A charge shall be equal to the amount of all these constituents of the charge.
         58.           The amounts of instalments were fixed by Order No. V-27 of 28 January 2010
of the State Railway Inspectorate “On Determining the Rates of Instalments of the Levy for the Use
of Public Railway Infrastructure and Fees for Additional Services provided by the Manager of
Public Railway Infrastructure ”:
         58.1.          initial instalments:
         58.1.1.        per train kilometre for railway undertakings (carriers) transporting passengers
and luggage:
         pass = LTL 4,7480 /train km;
         58.1.2.        per train kilometre for railway undertakings (carriers) transporting freight:
         pfreight = LTL 7,4743 /train km.
         58.2.         final instalments:
         58.2.1.        per gross tonne kilometre for railway undertakings (carriers) transporting
passengers and luggage:
         tpass = LTL 0.0278 /tkm gross;
         58.2.2.       per gross tonne kilometre for railway undertakings (carriers) transporting
freight:
         tfreight = LTL 0.0218 /tkm gross.
         58.3.          The charge for using the contact electrical network and power supply
(N.Vilnia – Vilnius – Kaunas; Lentvaris- Trakai) – LTL 4,97 per km of electric train.
         58.4.          The fee for escorting non-standard freight – LTL 270,00 per hour of escorting
a non-standard freight.
         59.           Approval of the amount of charges and instalments and their application
procedure was set out in chapter V of the Regulations for Determining the Amount of Instalment of
the Charge for the Use of Public Railway Infrastructure.
         60.           Procedure for paying the charge is set out in chapter VI of the Regulations on
the Charge for the Use of Public Railway Infrastructure.

                                   VII. FINAL PROVISIONS

          61. This Network Statement shall come into effect of the day of publication thereof and
shall be applicable for the official train schedule from 0000 of 29 May 2011 till 0000 of 27 May
2012.
          62. The Network Statement may also be updated at the time of validity of the official train
schedule upon change of legal acts of the Republic of Lithuania and (or) technical characteristics of
the infrastructure used.
          63. The Network Statement shall be valid to the extent they do not contravene the laws of
the Republic of Lithuania and other legal acts.
          64. Relationships between the public railway infrastructure manager and railway
undertakings (carriers) are regulated by the Ministry of Transport Communications of the Republic
of Lithuania which performs the functions of a market regulator. The market regulator shall
examine complaints of railway undertakings (carriers) associated with the decisions made by the
public railway infrastructure manager regarding the Network Statement, allocation of public railway
infrastructure capacities, system for charging the use of public railway infrastructure, amount and
structure of such charges.
          65. Decisions of the market regulator may be appealed against under the procedure set
forth in the legal acts of the Republic of Lithuania.
          66. The Network Statement have been drafted in the Lithuanian and English languages.
The text of the Network Statement is publicly available for an applicant on the website at
www.litrail.lt.
