Easier than it sounds ?


• EU Directive (2003/59/EC)

• Introduced across EU simultaneously
• New initial Qualification and
• Periodic Training
• DSA Implementation in UK (Competent authority)
• (On behalf of Department for Transport)
• Implementation date 10th September 2009
• (2008 for Bus and Coach Drivers)
                What is it not?

• It is not a Transport Manager’s CPC
• There is no ‘cross over’ between the two
                        Who is Affected?

•   Everyone who is licenced to drive over 3.5TE Vehicles

• Category B (Pre 1997 - 3.5TE to 7.5TE)

• Category C1 (Post 1997 - 3.5TE to 7.5TE)

• Category C

• Category C+E

• Including Owner-Drivers

• Exemptions include road testing and ‘incidental’ drivers

                 Any Exemptions?

• Drivers of vehicles with an authorised
  maximum speed < 45 kph
• Armed Forces, Emergency Services,
• Drivers road testing vehicles
• Drivers of vehicles being used for driving
• Non Commercial purposes
• Incidental Drivers
                        Whose Responsibility?

• Drivers to obtain CPC where required
• Drivers to carry DQC or report loss
• Drivers not to apply for employment if not suitably qualified
• Drivers to ensure they complete the necessary
  periodic training
• Employers obliged not to employ non CPC drivers
  where qualification required
• Employers to check by DQC or website
• Employers to add DQC card details to others, i.e,
  driving licence, digital card
• Trainers to upload training records

• Mandatory carriage of DQC for all drivers -
  including other nationals
• Offences include
    - Driving without holding valid CPC
    - Cause or permitting
    - Not carrying evidence in vehicle
    - Forging or altering evidence of CPC
    - Lending with intent to deceive
    - Resembling documentation with intent to deceive

• Power to seize documents
• (Offences relating to the requirement to carry
  evidence of CPC in vehicle) - Level 3 fine up
  to £1,000.00
• (Offences relating to forgery and false
  statements) - Level 5 fine up to £5,000.00,
  and/or imprisonment

 Legal Requirements
    Duty of care - Drivers’ Hours, WTD, Digital Tachographs, Driver CPC
    Vehicle defect reporting
    Weights and dimensions, axle weights

    Environmental - low emmision zones, etc

 Health & Safety
    Supply chain specific location
    Accident prevention, accident reporting, First Aid
    Hazard reporting, near-miss reporting
    Manual Handling
    Security issues, handling emergencies
                DCPC and ADR

• Up to a maximum of 21 hours of the initial basic
  course can be approved
• 7 hours of the core module refresher course can be
  approved for periodic training
• The specialist modules will not be accepted for
  Periodic Training
• Training centres and courses will need to be
  approved in line with the DCPC regulations
       Is Funding going to make things easier?

• Funding agency for England is the Learning and
  Skills Council, and for Scotland and Wales it is the
       devolved authorities
• Rulings specifically exclude funding for
  mandatory industry training
• Therefore Periodic Training does not qualify for
  any direct public funding
• Some providers may be delivering Periodic
  Training within a broader NVQ programme

•   Operators would need to complete this larger
    NVQ programme to access the funding
• Not all programmes leading to NVQs have been
  approved by JAUPT
• Not all drivers will be eligible for funding NVQs
  (for example if they already have one NVQ)

    Questions to be asked before committing to
                 ‘funded’ options
• What is being funded? Is it completion of an NVQ?
• What part of the training programme has been
  approved by JAUPT?
• How many hours of Approved training will the
  course deliver?
• Will all of my drivers attract public funding?
• What about future years? (An NVQ can only be
  funded once).
