              Adopting the proposed Zoning Map Amendment will allow the Town, if
              necessary, to convert former residential buildings to office and storage
              space. Converting residential structures to offices will also require
              approval by the Board of Commissioners, due to the change of use.
              The advertisement requirements as outlined in Part D, Article II, Sections
              6.3.3 and 6.3.4 of the Zoning Ordinance have been met.

Staff Recommendation:     The Planning and Zoning Board is concerned about the proposed zoning
                          map amendment in the Town Center (See pages 6 and 7 for details). To
                          help address these concerns, while still allowing a proposed zoning
                          amendment that complies with the current Land Use Plan to move
                          forward, the Planning Department recommends approval of the proposed
                          zoning amendment subject to the following conditions:
                             1. The parcels shall be restricted to municipal government services.
                             2. All proposed municipal and government service uses shall be
                                located within existing structures. Only necessary improvements
                                such as landscaping, ADA accessibility, and parking are allowed.

Minutes:           Planner Courtney Tanner presented the item stating that the conditional use
                   proposed is to limit the parcels to municipal services only. The Land Use Plan
                   identifies these properties as part of the Town Center. She added that the reason
                   the Town wishes to rezone the properties is that there are immediate needs for
                   staff workspace and associated storage, which are prohibited under the current
                   residential zoning district.

                   Chairman Peter Prichard opened the public comment session.

                        Public Comment Session
                   Mr. Andrew Rose, 201 Cedar Street, Morrisville, NC 27560
                   Mr. Rose asked if the Planning Department had a site plan. Planner Courtney
                   Tanner answered that she could give some schematics of parking and
                   landscaping, but the buildings currently there would remain; there would just be
                   some internal changes for offices. Mr. Rose asked about changes in the future.
                   Ms. Tanner answered that any change of use would have to go back before this
                   Board and the Board of Commissioners for approval. Mr. Rose thanked her and
                   the Board for answering his questions.
                   Tony Chiotakis, Director of Community Services for Town of Morrisville
                   Mr. Chiotakis told the Board that the Town is currently trying to acquire other,
                   more permanent space; this would fulfill some immediate needs. He showed an
                   example of the schematic, noting there would be six parking spaces per the
                   Town requirements; the front of the building would be brought up to Town
                   standards. He would be happy to answer any questions from the public or the
                   board.
                   Stephanie Belbase, 122 Chinabrook Drive, Morrisville, NC 27560
                   Ms. Belbase said she found the request very reasonable; she inquired if there
                   were any specific wording, and asked if this would worsen the traffic problem at
                   Church Street and Morrisville-Carpenter Road. Tony Chiotakis answered that it
                   wouldn’t; the house at that intersection would only be used for storage; it was
                   not appropriate office space. Planner Courtney Tanner added that the conditional
                   use restricted the use to municipal/government services only.

Mary Fiore, 104 Button Road, Morrisville, NC 27560
Ms. Fiore said she had some suggestions, as she had been through this same
process with other communities. She asked the Board to have each parcel
changed individually, since the Town might sell it when it no longer needed it;
rezoning each one individually would help protect the surrounding properties.
There were no other comments and the public comment session was closed at
7:01 p.m.
Discussion
Esther Dunnegan said she liked the idea of making use of the buildings, but had
concerns about the house at Morrisville-Carpenter Road and Church Street; if it
were to be used for storage, how easy would it be to access the stored items on a
regular basis, given the congestion on the road.
Planner Courtney Tanner explained that it wouldn’t be items that are needed all
the time; plans were currently being scanned in as electronic copies, so the paper
ones could be stored elsewhere and free up space.
Kathleen Gordon said she was very uncomfortable with the request. She
acknowledged that Town staff was growing but she didn’t think this would solve
the problem; also there had been so much work done on the Town Center plan,
and these properties had been purchased for Town Center use. She felt that
approving this request would mean standing in the Town’s own way or steer
things in the wrong direction. She understood that the Town wished to only use
the properties temporarily, but said oftentimes these types of situations become
permanent.
Planner Courtney Tanner offered to address some of her concerns. She noted that
once the actual zoning of Town Center is in place, there would be a mass
rezoning including these properties. She proposed that another condition could
be added to say that no new structures would be put on the properties. They
could also add a limit to the time the Town could use the structures, such as a
five-year cap.
Kathleen Gordon said she did not think storage is what they wanted for the Town
Center.
Ward Mercer said he shared the same concerns as Kathleen Gordon, but said he
thought it might be better to reconsider after a few more meetings for the Town
Center. He also thought they should be separated and rezoned individually.
Catherine Willis asked how long it would be, from the completion of the process,
before the Town could utilize the buildings.
Planner Courtney Tanner answered that it had to be approved by the Board of
Commissioners first, which would take an additional three months.
Catherine Willis explained that she asked because the Board keeps talking about
widening Morrisville-Carpenter Road; some property had been purchased so that
widening could be accommodated but now it was delayed. She had some
concern about spending time, money and energy on a whole; she pointed out that
regardless of the use inside, the outside of the building would remain the same.
Michael Roberts questioned the safety issue; the fire code and safety of the
documents being stored.

John Gretz said his concern is that he had seen too many “temporary” uses like
this become permanent. He felt very uncomfortable with the request.
Esther Dunnegan asked what else these houses would be used for, if not this. A
vacant house would become an eyesore.
Director of Community Services Tony Chiotakis said he wanted to clear up any
misconceptions about the storage use; there would not be any type of units on the
property, it would all remain the same. He explained that the Town tries to
surplus and re-use as much as it can, so items like older copy machines and older
records would be kept there. Regarding the use of the property, he did not see
any difference between the offices and a dentist’s or doctor’s office. The only
thing the Town wished to do was temporarily utilize what they had and maintain
the properties. As for the widening of Morrisville-Carpenter road, the structures
there might have to go; the Board hadn’t decided on an exact plan, but one
reason the Town had bought that property was to be able to remove the structure
for widening. He continued by saying there would be very little change to the
properties; and not all of them would be used for storage. The Town simply
wished to be in compliance with its own standards. For the house at 219 Church
Street, a handicap ramp would be added for the ADA requirements. He felt the
use was consistent with the Town Center plan, which calls for a mix of uses. Mr.
Chiotakis reiterated that the Town is seeking out a permanent solution, but there
were immediate needs for staff and he saw no reason for the Town to spend
money leasing properties further away, when these were paid for and adjacent to
existing Town structures. He then addressed Ward Mercer’s question about other
owners wishing to rezone to O&I, acknowledging that was a good question. He
explained that is why the condition was added to the rezoning.
Chairman Peter Prichard admitted he was torn on the issue. He liked that the
Town was trying to comply with standards and that it wanted to use taxpayers’
money wisely. However, he had also witnessed temporary situations becoming
permanent; the perception of that was scary and the timing of the request
disastrous.
Ward Mercer felt that Mr. Chiotakis had summed up the request well; however,
the “protection” being offered by the condition was, in his opinion, dangerous
territory.
John Gretz said they could say it was for government use only but felt it wasn’t
fair to deny another property owner who wished to do the same.
Kathleen Gordon said she just didn’t think this was why the property had been
purchased. She preferred to wait until the Town Center plan had jelled
completely – she wasn’t sure this was in the best interest of the town.
Esther Dunnegan said that regardless of the work done so far on the Town
Center, that project in itself would be a very long process. She thought the use of
219 Church Street would be acceptable; she asked how much surplus the Town
has.
Tony Chiotakis said he understood the Board’s concerns but asked them to look
at it from the point of view that, the Town is trying to utilize everything it has
and not get rid of equipment that can still be used. The main point is that the
Town of Morrisville has immediate office needs for staff, and to fulfill those
needs the property has to be rezoned. He also emphasized that this was in no
way non-supportive of the Town Center; these properties would be rezoned to

that use once it is in place. He had no problem with limiting the number of years
for use, but stated that staff was very crowded and there was a need to solve the
overcrowding problem.
John Gretz asked if it was possible to put a time limit on a rezoning.
Tony Chiotakis answered that typically, no – but since the Town is the property
owner, it could self-impose that requirement. He added that staff, too, was doing
a tremendous amount of extra work and energy to help create the Town Center.
Ward Mercer remembered at some of the Town Center charrettes that residents
questionedwhy the Town was even in the real estate business.
Motion
Ward Mercer made a motion to table the request to January 2007. Kathleen
Gordon seconded the motion.
Esther Dunnegan interjected that if these weren’t to be used by the Town of
Morrisville, what did this Board suggest they be used for?
Kathleen Gordon said she just felt it would be better to wait until the Town
knows what it wants in the Town Center.
John Gretz said the motion should include looking at the legality of limiting a
rezoning. He also suggested that a temporary use permit be pursued.
Michael Roberts stated he thought the use was a good idea; at the workshops,
people did not seem to care what the uses would be in the buildings as long as
the outside appearance remained the same.
Planner Courtney Tanner told the Board that regretfully the ordinance doesn’t
allow a temporary use for business or office. She also told the Board she had just
come across a restriction in the ordinance; if a rezoning is not re-examined in
forty-five days or less, it automatically moves on with a recommendation of
approval. As a result, this would not allow the Board to sit on this item until such
time that the Town Center Plan was developed.
Kathleen Gordon pointed out there would be another Town workshop before the
next meeting.
Ward Mercer made a motion to table the item until the September meeting.
Kathleen Gordon seconded the motion.
Tony Chiotakis, speaking as representative for the owner, respectfully asked the
Board to vote tonight; nothing would change in the next thirty days for this item.
The motion to table the item failed.
John Gretz made a motion to recommend denial. Ward Mercer seconded the
motion and the vote was as follows: Kathleen Gordon, John Gretz, and Ward
Mercer voted for the motion; Esther Dunnegan and Peter Prichard voted in
opposition of the motion. The motion passed three to two.
Chairman Peter Prichard stated that the Board really did value the support and
work by staff on the downtown project.

Recommendation:        The Planning and Zoning Board expressed the following concerns:
                           1. The timing of the request in relation to the Town Center planning
                              process, which is still underway;
                           2. How temporary or permanent the proposed use changes might be; and
                           3. Traffic concerns in relation to the parcels located adjacent to
                              Morrisville-Carpenter Road.

                       The Planning and Zoning Board forwards a recommendation of denial of the
                       proposed map amendment with the following Consistency Statement..
                       Consistency Statement:
                       Land Use Plan (1999): Relevant goal of the Land Use Plan: Goal 2.1.4 –
                       “Preserving and enhancing the Village Core.” The town has purchased several
                       residential properties in the Town Center. Using existing structures as the Town
                       Center Plan is developed, allows the town to use its resources in a cost effective
                       manner, while preserving the character and integrity of the district.
                       Transportation Plan (2002): Changing the use from residential to office will
                       not create an additional traffic burden. Primary access to the structures that will
                       be used as temporary office space is via Church Street which is identified as a
                       minor thoroughfare.
                       Parks, Recreation, Greenways, and Open Space Plan (2002): The plan does
                       not identify these parcels as an open space priority.
                       Greenways Plan (2001): The plan does not show any planned greenway
                       corridors within or adjacent to the rezoning.
                       CORE Pedestrian, Bicycle, and Green Space Plan (2005): The plan identifies
                       proposed bicycle amenities along Morrisville-Carpenter Road and Church Street.
                       Hazard Mitigation Plan (2004): The Hazard Mitigation Plan does not
                       designate this area as undevelopable or prone to flooding.
