Home buyer tax credit extended and expanded
For many Americans, home ownership is a key step towards achieving the American dream. It may seem like a challenging time to enter the market; however, recently passed legislation that extends and expands the home buyer tax credit can give potential and existing homeowners just the economic break they are looking for. On November 6, 2009, President Barack Obama signed "The Worker, Homeownership, and Business Assistance Act of 2009," bringing that dream one step closer to reality. To help consumers who are considering purchasing a primary residence, Coldwell Banker United, Realtors® has summarized the details of this new legislation and what it means for those thinking about entering the market:
SATURDAY, NOVEMBER 28, 2009
• Eligibility: The tax credit is now available for first-time home buyers and select homeowners. A first-time home buyer is defined as an individual who has not owned a principal residence during the three year period prior to the purchase. For married taxpayers, the law tests the homeownership history of both the home buyer and his/her spouse. For example, if you have not owned a home in the past three years but your spouse has owned a principal residence, neither you nor your spouse qualifies for the first-time home buyer tax credit. However, consumers should note that ownership of a vacation home or rental property not used as a principal residence does not disqualify a buyer as a first-time home buyer. A qualified homeowner is defined as someone who has owned and resided in a home for at least five consecutive years within the last eight.
• The maximum credit amount for firsttime home buyers is $8,000; the maximum credit amount for current homeowners is $6,500. The federal tax credit amounts to 10 percent of the cost of the home, up to a maximum credit of $8,000 for first-time homebuyers and $6,500 for current homeowners. Under the new legislation, a tax credit may only be awarded on homes purchased for $800,000 or less. e.g., If a home costs $60,000, the allowable credit for both a first-time homebuyer and a current homeowner would be $6,000. If a home costs between $80,000 and $800,000, then the allowable credit for a first-time homebuyer would be $8,000 and for a current homeowner, $6,500. • Single taxpayers with incomes up to $125,000 and married couples with a joint income up to $225,000 qualify for the full tax credit. Individuals whose Form 1040 filing status is "single" are eli-
gible for the tax credit if their income is no more than $125,000. Individuals who file a joint return are eligible if they have no more than $225,000 in income. Single taxpayers who earn between $125,000 and $145,000, and married couples who earn between $225,000 and $245,000 are eligible to receive a partial credit. Individuals with incomes greater than $145,000 (single) and $245,000 (joint return) are not eligible for this tax credit at all.
• The credit is available for homes purchased on or after November 7, 2009 and before May 1, 2010. The federal income credit can be claimed on one's individual or joint tax return for the purchase of any single-family home (newlyconstructed or resale, single-family detached, town homes or condominiums) between the dates of November 7, 2009 and April 30, 2010.

Home purchases subject to a binding sales contract signed before May 1, 2010 will also qualify for the tax credit provided closing occurs prior to July 1, 2010. The tax credit is a true credit. It does not have to be repaid unless the homeowner sells or stops using the home as their principal residence within three years after the purchase. In that case, the full credit amount will be recouped on the sale. For further understanding of how the extended tax credit differs from the previous version and how it can benefit first-time homebuyers and select homeowners, The National Association of Realtors® has prepared a quick comparison chart and "basics" guide for your reference. This is based on information available as of November 2009 and is not meant to be tax or legal advice. As with any tax law change, consumers should check with a tax advisor regarding availability, eligibility and possible timing of any tax credit. Mary Winter Teaster, managing director and broker-in-charge at CB Richard Ellis/Columbia (CBRE/Columbia) was awarded with Palmetto Center for Women's (PCW) Tribute to Women and Industry (TWIN) award for corporate at a luncheon held September 24th. The TWIN awards have recognized over 480 women for their business and personal contributions in their careers and community activities since its inception in 1980. The corporate award is presented to a woman that demonstrates excellence as an employee of a business or industry located in the Midlands. A committee of PCW board members selects the recipient. "All of the committee members felt that Mary Winter's contributions to her profession and to the community were outstanding and beneficial to all those around her," said Dana Snyder, branch executive director of Palmetto Center for Women at YMCA Columbia. "She is perceived as a consummate professional and strives to ensure women are represented in her profession." Teaster was named a partner/principal of CBRE/Columbia in December of 2007. She is responsible for oversight of all sales and leasing activity for the Columbia office in addition to overall business development and the company's community/civic activity. Teaster has been in business development and sales for over 25 years in the Midlands area. For the past ten years she has been involved in multiple office building sales and lease transactions representing multiple entities and companies. Prior to her commercial real estate career, she was senior commercial lender and business development officer for the banking/financial industry. Teaster has also been very active in community and civic organizations during her career. She serves as board president of the Mental Illness Recovery Center.
• The tax credit is refundable. A refundable credit means that if the amount of income taxes a home buyer owes is less than the credit amount he / she qualifies for, the government will send a check for the difference. In essence, the credit is a dollar-for-dollar reduction in what taxpayers owe for the calendar year following the year they close on their home. e.g., A first-time home buyer who qualifies for the full $8,000 tax credit and owes $5,000 in federal income taxes would owe nothing to the IRS and receive a $3,000 payment from the government. A current homeowner who qualifies for the full $6,500 tax credit and owes $5,000 would pay nothing to the IRS and receive $1,500 back from the government. If the move-up buyer is due to get a $1,000 refund, he/she would get $7,500 ($1,000 plus the $6,500 move-up buyer tax credit).

Checking up on delinquent neighbors Is condo association obligated to name names?
DEAR BENNY: I am a condo owner in a 200-unit building. Recently there was an assessment broken down into four payments. There are many people who have not paid. Do I, as an owner, have the right to know who these people are? The president of the condo association will not discuss this with me. Is this common knowledge? --Richard DEAR RICHARD: This issue is perhaps one of the hotly debated subjects among unit owners, board members, property

managers and even association attorneys. There is and must be a delicate balance between privacy and freedom of information. We often see this at the federal level, but the issues apply to associations as well. If I am delinquent in paying my condo fees, I don't want the world to know; but if I am a condo owner, I want to know the financial situation of my association, including the number of delinquencies. One compromise position that boards have taken is to provide the number but not the names of delinquencies. Some associations actually publish those names in their community newsletter but this has to be absolutely factual or a lawsuit for libel could be filed against the board and the association. For example, if the report said that John owed $400, but by the time the newsletter was published, John had already paid some money, then the information was inaccurate.
Personally, I have mixed opinions on this. But I have no problem with the board-advising members of the number of delinquencies in the association and the amount collected over the past year. Keep in mind, however, that if a collection lawsuit is filed against a delinquent owner, that information becomes public, and privacy is lost.
Is it appropriate to request a house be inspected before an offer is made?
DEAR BENNY: We are considering making an offer on a home built in 1887. It appears to be in good shape, but of course we will be hiring an independent home inspector. One of our major con-
cerns is that the house, which sits on 5acres, is not hooked up to the city sewer, although it is within the city limits. It has a septic system, but the current owners who have lived there more than 25 years said they don't know where the tank is located, and that it has not been serviced at all since they took ownership. There are other concerns, including a one-lane gravel driveway that slopes up at least a quarter mile to the home. A plumber's estimate on removing the septic system (assuming he can find it) and putting in piping to hook up to the city sewer lines (around 400 feet) was about $12,000. The house has been on the market since April 2006, and to our knowledge has not had an offer made on it. As this move would be from the East Coast to the Midwest, this is a major deal for us.

How appropriate is it to request the house inspection before an offer is made, and if so, and the request is denied, should I be even more concerned than I am? I understand any offer would be contingent on the inspection. --Sally DEAR SALLY: When it is a seller's market, I generally do not recommend having an inspection before you sign a contract. You may spend a lot of time and money on the inspection, only to find that the house has been sold out from under you. On the other hand, if you are not concerned that you may lose the house, because the market is slow, then it might make sense to have the house inspected before you enter into a sales contract. Actually, if you sign a contact with an inspection contingency i.e., if you don't like the house after the inspection, the contract is void and you get your money back you accomplish the same thing as if you had the inspection first. Clearly if the sellers refuse to allow an inspection either before or after you sign a sales contract then I would be very concerned. You and your husband are obviously city folks used to city water. Do you know anything about septic systems, how they work and how to maintain them? I would be very careful and cautious before you make the final decision to buy this house. approved at our annual meeting. This homeowner, who is a new board member, sells insurance. He has proposed our homeowners association get directors and officers liability insurance to protect us against disgruntled homeowners suing the association for something like his gazebo rejection. The policy is a $2 million "condo director's liability" with a $350 annual premium. It covers errors and omissions. He says he won't be on the board without it. I will solicit all the homeowners' votes rather than it being a board decision. Do you think this insurance is applicable in a small association like ours? I've received conflicting opinions (even from another insurance representative). --Shelley DEAR SHELLEY: First, as I tell all newly elected association board presidents, "you have my condolences." However, I am a little confused. You state there are no common grounds. If so, why do you need lawn service and snow removal? Shouldn't those things be the responsibility of each homeowner? But to answer your question, yes, every association should have directors and officers liability insurance (called "D&O"). We live in a litigious society, and board members must have this insurance protection. I don't like the idea, however, that your board member is trying to sell you that policy. It is not illegal or even unethical so long as there is full disclosure, but you must shop and compare prices and terms and conditions with other agents. You should also carefully review the legal documents of your association. I suspect that those documents spell out the level of insurance you must carry. DEAR DEB: Hopefully, you and your partner will be able to reach an agreement whereby he/she sells his/her share to someone either directly to you or to a third party or you both may have to sell. If you can't reach agreement, your partner can take you to court, file what is known as a partition suit, and the judge will require that the property be sold. You will have an opportunity to buy, but it will be more expensive for you. There is a lesson to be learned here. Any time you buy property with a friend (or a stranger for that matter), you must reach agreement on a number of issues before you sign a sales contract. Some lawyers call this a partnership agreement; others refer to it as a co-ownership agreement. Whatever it's called, however, here are a few things the agreement must contain: What happens if one owner wants out? What happens if one owner dies? What happens if one owner cannot make the share of the monthly mortgage payments? I would rather enter into such an agreement while the two of you are still friendly and talking to each other than wait until there is friction between you.
Death knocking at disclosure's door Must seller reveal death from natural causes?
DEAR BENNY: A relative with a terminal disease was recently found unresponsive while visiting my home. We called an ambulance but he never recovered. We now have our home for sale and I am wondering if we are required by state or federal law to disclose this information to our buyer. The neighbors were certainly aware of the fire department and the ambulance being here. Most people die in the hospital but many die at home, and I don't know whether there is a law regarding this that I should be aware of. --Delores DEAR DELORES: You will have to ask an attorney in your state, because there are different disclosure laws throughout the country. But what's the harm in disclosing this especially if anyone asks you if there is anything unusual about the house? To die of natural causes in a house is quite different from being murdered. I believe in full disclosure. I have represented clients over the years who bought a house, only to learn later that there were undisclosed problems such as leaking roofs, defective heating appliances, etc. Many of these clients did not have an inspection contingency, which was their mistake. Some of their sellers lied when they filled out the disclosure statements.

Renting a home with a reverse mortgage
DEAR BENNY: Can I rent my home if it has a reverse mortgage? --Janet DEAR JANET: The short answer is no; a reverse mortgage is limited to people who actually live in their home and are aged 62 or older. Lenders (and the federal government where that kind of loan is federally insured) take a risk that you may live so long that your mortgage balance will be higher than the value of the house. So lenders (and the federal programs that insure those loans) do not want you to be a landlord. However, in recent months, I have heard that there are a couple of lenders who are willing to provide reverse mortgages to investors. I don't know any names, and I cannot provide any endorsements because I don't know more about those programs. Perhaps you can find such a lender on the web.
Should a home owners association have directors and officers liability insurance?
DEAR BENNY: I have just been elected president of a seven-year-old home owners association. There are only 12 separate (moderate-sized) fee-simple homes. There isn't any common ground. Housing tax credit now open to more home buyers
If you've been thinking about buying a home, and weren't eligible for the firsttime homebuyer tax credit, here's some good news: the housing tax credit has been expanded and extended. On November 6, President Barack Obama signed into law the Worker, Homeownership, and Business Assistance Act of 2009, which enables many more Americans to take advantage of new government incentives to buy a home. In fact, the National Association of Home Builders (NAHB) estimates that close to 70 percent of all potential homebuyers should now qualify for some form of the housing tax credit. The new law extends the popular first-time homebuyer credit, which more than 1.4 million taxpayers have already claimed, through April 30, 2010. Buyers who have signed a sales contract by that deadline have until June 30 to close on the home. First-time home buyers who the IRS defines as someone who has not owned a home in the three years preceding the purchase can qualify for a credit of 10 percent of the cost of the home, up to $8,000. Existing homeowners, or those who recently sold their home, may also now qualify for a tax credit of up to 10 percent of the cost of a new principal residence. This new credit is capped at $6,500. "Repeat" home buyers must have been living in the home they currently own (or previously owned) for five consecutive years out of the eight years prior to buying the new home. Many buyers in markets with a higher cost of living didn't qualify for the earlier tax credits due to the income limits. Those have been increased and now single taxpayers with incomes up to $125,000 and married couples earning

up to $225,000 may be eligible for a full credit. Homebuyers earning up to $20,000 more than the limit may be able to claim a partial credit. Both first-time and repeat buyer credits can only be used with the purchase of a home that will be the buyer's principal residence. It cannot be claimed for the purchase of a vacation home or property to be used as a rental. Homes purchased for more than $800,000 are not eligible. NAHB has created a web site at www.federalhousingtaxcredit.com to provide information about the housing tax credits. It provides basic information about the first-time and repeat buyer credits, detailed question and answer sections, and links to additional homebuying resources. The new tax credits, combined with today's near record-low interest rates and competitive home prices, make it an ideal time to buy if you've been considering moving up, downsizing, or just moving into a home more suited to your current lifestyle.
