                           Committee Report on the Executive Appointment of
                Ms. Ann Marie Roth to serve as a Member of the Guam EPA Board of Directors

                                              Committee Report Digest

I.      OVERVIEW

        Senator Rory J. Respicio, Chairperson of the Committee on Rules; Federal, Foreign and
        Micronesian Affairs; and Human & Natural Resources, convened a public hearing on
        Wednesday, March 9, 2011 at 9:00AM in I Liheslatura's Public Hearing Room. Among the
        items on the agenda was the consideration of the executive appointments of five individuals to
        serve as members of the Guam Environmental Protection Agency Board of Directors, one of
        which was Ms. Ann Marie Roth, whose appointment history is as follows:

            •   Appointed by Governor Eddie Baza Calvo on January 11, 2011, for a term of three
                years;
            •   Appointment transmitted to the Legislature on January 20, 2011;
            •   Forwarded to this Committee for consideration on February 1, 2011.

       Public Notice Requirements
       In accordance with Open Government Law, notices were disseminated via e-mail to all
       members of this Committee, all other senators and all main media broadcasting outlets on
       March 2, 2011, providing 5-days notice), and again on March 7, 2001, providing 48-hours notice.
       Invite letters were also sent to the appointing authority, the governor's special assistant for
       external affairs and the Guam EPA Acting Administrator.

Senator Rory Respicio called the public hearing to order at 9:00 AM, and addressed all five
appointments simultaneously, beginning with inviting the first panel of individuals who signed
up to provide testimony on the appointments.

Former Senator Ben Ada is the first to testify. Former Senator Ada greeted the committee and
read his written testimony into the record. He thanks Senator Respicio for the opportunity to
provide testimony in support of the appointment of Mr. Eming Victor Zhou to serve as a
member of the Guam Environmental Protection Agency. Former Senator Ada then shared with
the Committee a brief history of Mr. Zhou and how he knows him.

Senator Respicio thanked the former senator for his testimony and then invited Mr. Bob Perron
to testify.

Mr. Bob Perron, who currently serves as member of the Guam EPA Board of Directors, greets
the panel of senators and explains that he has met with all the appointees, is impressed with
them, and expresses his hope that all appointees will be confirmed.

Senator Respicio asked if the Board can make quorum and if there is an acting administrator.

Mr. Bob Perron replied that the Governor appointed the acting administrator.

Senator Respicio then invited Mr. Peter Gill to provide testimony.

Mr. Peter Gill, appeared before the Committee, providing testimony in support of the
appointment of Mr. Victor Zhou, who he has known for 12-14 years in a professional capacity.
Mr. Gill shared a brief history of his experience in being financially indebted to Mr. Zhou, a
position in which, in Mr. Gill's opinion, is the best to judge the character of a man. In his early
stages as a businessman, Mr. Zhou helped Mr. Gill and was willing to work with him to find
solutions that worked for them both. Mr. Gill expressed his position to the Committee that it's
good to have someone like Mr. Zhou on the GEPA Board- someone who is judicious, fair and
equitable.

There being no other individual signed up to provide testimony before the Committee, Senator
Respicio called up on appointees to provide their testimony.

The discussion began with Ms. Ann Marie Roth. While Ms. Roth's professional background
has not focused on environmental protection, she is honored to be selected to serve as a member
of the Guam EPA Board of Directors. She is someone who feels strongly about the issue and
realizes how important it is to protect Guam's limited resources. She is interested in seeing how
to help strengthen and develop Guam EPA as an agency, by looking at the money that's coming
in from the military buildup, Guam EPA's position as an almost fully federally funded agency,
and weighing that against the responsibilities of the agency.

When asked by Senator Respicio what in fact her professional background does include, Ms.
Roth responded with marketing management and investments, serving as a "stockbroker" of
sorts.

Next to present his testimony was Mr. Jerome Rocco, who explained that his background is in
environmental work, although indoor environmental work which is relatively unknown, but is
slowly growing in public awareness. Mr. Rocco expanded on his personal background,
mentioning that he made Guam his home after the first Gulf War and eventually became a
small business owner. In regards to environmental protection, and Guam EPA in particular, he
reflected on the last construction "boom" Guam, remembering that there were many
shortcomings and cut comers. However, for the sake of good stewardship, Mr. Rocco believes
we should do our best to preserve our resources for the future generations. Mr. Rocco adds that
when it comes to the environment, we cannot afford to make mistakes because we cannot really
"correct" mistakes or errors made, and any attempts to do so, are very costly.

Third to present his testimony was Mr. Eming 11Victor'' Zhou. He provided the Committee
with a look into his personal background, including his first time to Guam being in 1986 when
he was working as a construction manager for a Chinese construction company doing business
in Guam. His first visit to Guam provided his first opportunity to see clear blue skies and clean
water and he immediately fell in love with Guam's scenery and environment. Mr. Zhou
decided he wanted to make Guam his home and in 1993, he started his own construction
business, which has served to a variety of interests, including those seeking to build homes,
businesses, government structures, hotels and even wedding chapels. Mr. Zhou expressed his
honor to be the first Chinese from Mainland China to be appointed by the Governor and he will
work hard to make Guam better.

 The fourth appointee to present his testimony was Mr. William Nault, who read into the record
 his written testimony. Said testimony included his personal background, including his arrival
 to Guam at the early age of 6, his student career in Guam's public school system, his
 involvement in community sports leagues from his younger years to his teenage, high school
years and most currently as a member of the Guam Masters Baseball League. Mr. Nault has
provided community service efforts in various forms, including serving on a task force that
brought the Japan (baseball?) team to Guam. During his lifetime, Mr. Nault has seen the days
when the waters of Guam were not polluted. Furthermore, his professional background of over
 twenty years in the tourism industry has also given him a different understanding and
 appreciation for the importance of environmental protection, not just for future generation, but
for the sustatainability of Guam's economy. Mr. Nault's written testimony is attached to this report
for easy reference.

The fifth, and final, appointee to provide his testimony before the Committee was Mr. Terrence
Brooks, who also read his written testimony into the record. Areas of particular concern for

Mr. Brooks include solid waste management, the condition and vulnerabilities of Guam's water
lens, recycling and the pursuit of renewable resources, the condition and future of Guam's
landfills, the condition and vulnerabilities of Guam's fresh water aquifer, air quality in Guam
and last, but not least, the occurrences of brush fires across the island. Mr. Brooks has
previously served our island community as a former member of the Commission on
Consolidated Utilities. Mr. Brooks' written testimony is attached to this report for easy reference.

At the conclusion of the presentation of testimonies of all appointees, Senator Respicio opened
the floor for discussion. He began with informing all appointees that in the previous Legislative
term, he introduced legislation to grant Guam EPA autonomy. Senator Respicio explained that
he recognized that there needs to be identified seed money and a set transition period. He also
recognized that while it was good the staff had actively attempted to work out the mechanics of
this transition, there were more pressing matters at hand and the previous administrator put a
stop to this work.

Senator Respicio also explained that while he would commit to reintroducing such legislation,
he would like to see the support come from ground up, meaning he would first like to see
support coming from the governor, the agency Board, management and staff. He also
recognized while there is still important work to be done, he hopes there will be time to revisit
the matter as the purpose of autonomy is to strengthen the agency and to insulate the
employees from political pressure.

Respicio explained his self-described role as an oversight chair as being one an agency is likely
not to hear from too much, unless he sees the agency is going in the wrong director. As an
oversight chair, Respicio further explained, he is not a micro-manager, but is always ready and
willing to support the agencies needs. In line with that, the Chairperson explained that he will
be conducting a roundtable to provide the agency an opportunity to brief the Legislature's
Natural Resources Committee on the current condition of the agency, including the various
issues the agency is currently dealing with.

The next senator to speak was Senator Tom Ada who did not have any particular questions for
the panel of appointees, but did express his impressiveness with the composition of the panel,
which is made up of individuals he has personally known for years. Senator Ada also added
that he is looking forward to working with the panel, especially in his capacity as the
Chairperson of the Legislative Committee on Utilities.

Senator Respicio then recognized minority committee member Senator Aline Yamashita to
address the panel of appointees. Senator Yamashita clarified that while she has never been a
student of the environment, she has always been a consumer, and one who thoroughly enjoys
and appreciates Guam's environment and beauty, but is concerned about the condition of the
environment.

Senator Yamashita's first question for the panel was about polluted water advisories. She asked
the panel if they had any insight into why, on one hand, public advisories would go out
regarding polluted waters for anywhere from 12 to 24 beaches, or beach closures on Mondays
or Fridays, yet all along the island one can find families still in the water.

Mr. Brooks was the first to respond, saying that a lot is due to the way the water flows during
rainfall, as he has learned from his experience with Guam Waterworks Authority. Mr. Rocco
agreed, saying that when it rains, a lot of pollution comes from inland sources. He also referred
to many construction dumpsites, of white goods in particular, that he would personally come
across during his time outdoors, for example, during hikes with his son. He thinks that it's
small and medium sized construction companies which take advantage of dumping sites. He
knows that all this waste is going to affect either the reefs or the water lens. Sometimes, some of
it could be naturally occurring because of certain activities on the reef and tidal concerns. Mr.
Rocco also believes that there should be room for enforcement and penalties.

Senator Yamashita then raised the issue of noise pollution, which was addressed in a hearing
the day prior by the Guam EPA Acting Administrator, Mr. Ivan Quinata. Senator Yamashita
reiterated the concern expressed by Mr. Quinata, saying that many times, with regard to noise
pollution issues, Guam EPA just isn't paid attention to. Her question, then, was what can be
done to ensure that these things are taken seriously, that everybody works to protect our health,
and how such messages could be better understood and better received.

Mr. Rocco was the first to answer, explaining that although he wasn't sure exactly what Mr.
Quinata was referring to, he was aware of previous concerns regarding aircraft noise. He
acknowledges that while we want our military to be trained and well prepared, these concerns
of the community cannot go unaddressed. He references a program in place that would help to
do so, which involves the federal counterpart for aviation, the Federal Aviation Administration,
working with local counterparts to install sound-proof windows in affected houses. Mr. Rocco
also suggests maybe working with the military to find alternative flight paths or training times.
As a resident of the north, he speaks from experience, when he says that such noise
disturbances are quite the annoyance.

Ms. Roth also contributed to this topic, saying that both enforcement and education are
necessary to tackle these issues and man power and resources will be needed to do both.

Senator Respicio then acknowledged Senator Tony Ada to address the panel of appointees.
While Senator Ada had no particular questions for the panel, he thanked them for their service
and expressed his support for their confirmations.

The next senator to address the panel was Senator Chris Duenas. His question dealt with
Waste-to-Energy (WTE) technology. He asked the appointees for their thoughts on the
potential for exploring such an opportunity.

Mr. Nault was the first to answer, saying that he supports the idea and has actually had the
opportunity to live in Honolulu and to inspect their WTE plant.

Ms. Roth chimed in expressing her support for exploring the opportunity. While she thinks it
will take time, she is certain it can happen.

Mr. Zhou, who was next to respond, encouraged payment for people who dump in landfills
and not just anywhere.

Mr. Rocco added that such an opportunity would be possible to explore. He also added the
possibility of exploring "Waste-to-Industry", where, for example, wasted tires could be resold
for industrial purposes, such as road construction or other construction-related projects. Mr.
Rocco emphasized the need to look for various ways to reduce the amount of trash generated in
Guam, and great if we can tum it into something beneficial. He cautioned such an exploration,
though, with the reminder of the fact that one must always keep in mind the effect on the
environment. He went on to explain that he's not very familiar with the process, other than
incineration, which is known to have harmful effects on the environment.

Mr. Brooks also added to the conversation with the mention that exploring the possibility of
WTE, must be focused on waste-to-AFFORDBLE-energy, because, for example, CPA cannot just
take go this route at any cost and pass the costs onto consumers. While Mr. Brookes is also
concerned with the byproducts of WTE, not only smoke coming out of stacks, but also the ash
that results, he recognizes that such a development would reduce the amount of trash
generated, thereby lengthening the life of the landfill. He closes with saying that while there are
a lot of issues to address, the option of WTE should definitely not be ruled out.

The next senator to address the panel was Senator Sam Mabini, who congratulated the
appointees and expressive her impressiveness with the diversity of professional backgrounds of
the individuals appointed. Senator Mabini then made mention of some of the issues she would
like to see the appointees address as Board, including green waste; run-off; mulching socks;
exhaust from tour buses and large trucks; recycling of white goods; working with other
agencies and organizations, like GAIN, to address Guam's stray animal population; youth
involvement and service learning; and workforce development, especially "green" careers. Her
question to the panel was whether or not there are any "best practices" that the appointees have
seen used in other places that they would like to see used in Guam.

Mr. Nault's response to the question was the segregation of trash, using segregated trash bins,
like they do in Japan, Honolulu and Houston.

Mr. Rocco replied saying that he has seen such "mulching socks" and he believes they don't
work. His response also touched on the need for funding to tackle all the issued discussed, and
also touched on the need for the agency and the community to prepare for reductions in federal
funding because of the fiscal condition of the federal government. He quotes the saying, "we're
going to have to do more with less." He believes the start for change begins with the school-age
youth. At this level, we need to instill a better sense of community and, particularly,
"ownership" in community. Practicing good stewardship and good citizenry, Mr. Rocco
believes, allows for policing one another to protect our environment.

At the close of discussion on Senator Mabini' s question, Senator Respicio raises a question
called in by Ordot resident, Ms. Millie Sablan, who was watching the hearing on TV. Senator
Respicio asked the panel of appointees if their acting administrator had briefed them on the
issue of illegal dumping in Ordot, as the question was posed:

       "What could be done to prevent illegal dumping in Ordot?"

None of the appointees were aware of the situation. Senator Respicio explained that the Ordot
community has been very vigilant, but their patience is wearing thin. He also speculates that
the illegal dumping problem stems from residents not being able to afford the tipping fee; and
hopes that the Board might find a proactive response to this growing problem.

Discussion closed with Senator Tom Ada asking the panel of appointees their final question of
the day:

       "During your tenure as a Board member, when you walk away, what would you want
       to be seen as the champion of?"

To this, Mr. Brooks replied that he would just want to see that the entire island is able to clean
itself up.

Mr. Rocco would like to raise awareness of our citizenry to the importance of the environment
we all live in.

Mr. Zhou replied that he would like to see to it so that trucks can drive through all the villages;
and that residents are paid for delivering recyclable items.

       Ms. Roth would like to re-launch the agency's website and keep it updated. She would also
       like to see streamlining of the permitting processes, so members of the community will know
       where to go and how long the process is expected to take.

       Mr. Nault closed off the discussion by adding that he would like to see the development of a
       well networked system. He would also like to see the island fully transition to the use of
       biodegradable bags; an would also like to look at the issues raised during the days hearing,
       including WTE, alternative energy fuels, and keeping Guam's beaching clean and safe.

       There being no further discussion, Senator Respicio adjourned the public hearing at 10:23 AM.

III.   FINDINGS & RECOMMENDATIONS

       Having received fully favorable testimony in support of the executive appointment of Ms. Ann
       Marie Roth to serve as a member of the Guam Environmental Protection Agency Board of
       Directors, the Committee on Natural Resources hereby reports back to I Liheslatura on said
       appointment, with the recommendation to do confirm.

                                      Second Notice of Public Hearing
                                          March 9, 2011- 9:00AM

      (Hagatfia, Guam) - Please be advised that the Committee on Rules; Federal, Foreign &
      Micronesian Affairs; and Human & Natural Resources will be conducting a public hearing on
      Wednesday, March 9, 2011, beginning at 9:00AM in the Legislature's Public Hearing Room.
      This hearing is scheduled to receive public testimony on the following:

      •     Executive Appointment of Mr. Jerome Rocco to serve as a Member of the Board of
            Directors for the Guam Environmental Protection Agency;
      •     Executive Appointment of Ms. Ann Marie Roth to serve as a Member of the Board of
            Directors for the Guam Environmental Protection Agency;
      •     Executive Appointment of Mr. Eming Victor Zhou to serve as a Member of the Board of
            Directors for the Guam Environmental Protection Agency;
      •     Executive Appointment of Mr. William D. Nault to serve as a Member of the Board of
            Directors for the Guam Environmental Protection Agency;
      •     Executive Appointment of Mr. Terrence Brooks to serve as a Member of the Board of
            Directors for the Guam Environmental Protection Agency
      •     Bill No. 49-31 (COR) - B.J.F. Cruz - "An Act to amend §70116 of Title 22, Guam Code
            Annotated, relative to expanding the Guam Contractor's License Board's authority to
            revoke, suspend, and renew a contractor' s license subject to the contractor's financial
            standing with government agencies that provide healthcare to a contractor's non-immigrant
            temporary work."
