          WILLIAM J. CALLAHAN, being duly sworn, deposes and says
that he is a Group Supervisor with the Drug Enforcement
Administration ("DEA") and charges as follows:

                                    COUNT OblE

          1.   From at least in or about August 2008, up to and
including in or about April 2010, in the Southern District of New
York and elsewhere, DENNIS PATRICK FAIRLEY, THOMAS FAIRLEY, ANA
SANCHEZ, KEVIN YAN, FRANK BISMAN, JASON ABBATE, BARRY GOLDRING,
THERESA GOLDRING, KENNETH KUTIN, MARK VANDERBORG, BRUCE SIEGMAN,
HOWARD ARONSON, GARY BRUSTEIN, LEONARD ROSENFELD, MICHAEL
SILVERMAN, EDWARD RUBIN, MELANIE TAX IN , MITCHELL TEPPER, RALPH
MARAZZO, NINA MARAZZO, and RONALD VESSIA, the defendants, and
others known and unknown, unlawfully, intentionally and knowingly
would and did combine, conspire, confederate and agree together
and with each other to violate the narcotics laws of the United
States.

              2. It was a part and an object of the conspiracy that
DENNIS PATRICK FAIRLEY, THOMAS FAIRLEY, ANA SANCHEZ, KEVIN YAN,
FRANK BISMAN, JASON ABBATE, BARRY GOLDRING, THERESA GOLDRING,
KENNETH KUTIN, MARK VANDERBORG, BRUCE SIEGMAN, HOWARD ARONSON,
GARY BRUSTEIN, LEONARD ROSENFELD, MICHAEL SILVERMAN, EDWARD
RUBIN, MELANIE TAXIN, MITCHELL TEPPER, RALPH MARAZZO, NINA
MARAZZO, and RONALD VESSIA, the defendants, and others known and
unknown, would and did distribute and possess with the intent to
distribute a controlled substance, in violation of 21 U.S.C. §
841 (a) (1) .

          3.   The controlled substance involved in the offense
was methaqualone, in violation of 21 U.S.C. § 841(b) (1) (C).

           (Title 21, United States Code, Section 846.)

                            COUNT TWO

          4.   From at least in or about January 2010, up through
and including in or about April 2010, in the Southern District of
New York and elsewhere, DENNIS PATRICK FAIRLEY and NEIL
WEINSTOCK, the defendants, and others known and unknown,
unlawfully, intentionally and knowingly would and did combine,
conspire, confederate and agree together and with each other to
violate the narcotics laws of the United States.

          5.   It was a part and an object of the conspiracy that
DENNIS PATRICK FAIRLEY and NEIL WEINSTOCK, the defendants, and
others known and unknown, would and did distribute and possess
with the intent to distribute a controlled substance, in
violation of 21 U.S.C. § 841(a) (1).

          6.   The controlled substance involved in the offense
was methaqualone, in violation of 21 U.S.C. § 841(b) (1) (C).

           (Title 21, United States Code, Section 846.)

          The bases for my knowledge and the foregoing charge
are, in part, as follows:

           7.   I am a Group Supervisor with the DEA, and I have
been personally involved in the investigation of this matter.
This affidavit is based upon my conversations with law
enforcement agents and others and my examination of reports and
records.   Because this affidavit is being submitted for the
limited purpose of establishing probable cause, it does not
include all the facts that I have learned during the course of my
investigation. Where the contents of documents and the actions,
statements and conversations of others are reported herein, they
are reported in substance and in part, except where otherwise
indicated.

          8.   In the course of the investigation, the Nassau
County Police Department ("NCPD") obtained judicial authorization
to intercept communications occurring over the following 17
telephones, among others:

               a.   A phone bearing a call number ending in the
digits 6350 (the "6350 Phone"). AT&T records reflect that the
6350 Phone is listed to "Ralph E. Marazzo," at an address in
Woodbury, New York (the "Marazzo Residence").

               b.   A phone bearing a call number ending in the
digits 7530 (the "Marazzo Home Phone"). AT&T records reflect
that Marazzo Home Phone is listed to "Nina Marazzo," at the
Marazzo Residence.

               c.   A phone bearing a call number ending in the
digits 4366 (the "Vessia Cell Phone"). Sprint records reflect
that the Vessia Cell Phone is listed to another individual at an
address in Oakland Gardens, New York.

               d.   A phone bearing a call number ending in the
digits 1931 (the "Silverman Cell Phone"). Verizon Wireless
records reflect that the Silverman Cell Phone is listed to
"Michael Silverman," at an address in Bayside, New York (the
"Silverman Residence") .

               e.   A phone bearing a call number ending in the
digits 8081 (the "Vanderborg Cell Phone"). AT&T Wireless records
reflect that the Vanderborg Cell Phone is listed to "Marc
Vanderborg," at an address in Woodbury, New York (the "Vanderborg
Residence") .

                 f.  A phone bearing a call number ending in the
digits 8934   (the "Goldring Cell Phone"). AT&T records reflect

that the Goldring Cell Phone is listed to ~Barry Goldring," at an
address in Bellmore, New York (the ~Goldring Residence").

               g.   A phone bearing a call number ending in the
digits 8966 (the ~Goldring2 Cell Phone"). AT&T Wireless records
reflect that the Goldring2 Cell Phone is listed to ~Barry
Goldring" at the Goldring Residence.

               h.   A phone bearing a call number ending in the
digits 4366 (the "Goldring Home Phone"). Verizon-New York records
reflect that the Goldring Home Phone is listed to "Barry
Goldring" at the Goldring Residence.

               I.   A phone bearing a call number ending in the
digits 4350 (the ~Vanderborg Home Phone").  Cablevision records
reflect that the Vanderborg Home Phone is listed to "Mark
Vanderborg," at the Vanderborg Residence.

               j.   A phone bearing a call number ending in the
digits 3706 (the "Abbate Cell Phone"). AT&T Wireless records
reflect that the Abbate Cell Phone is listed to "Jason Abbate,"
at an address in Huntington, New York.

               k.   A phone bearing a call number ending in the
digits 6282 (the "Bisman Cell Phone"). Verizon Wireless records
reflect the Bisman Cell Phone is listed to "Frank Bisman," at an
address in Fresh Meadows, New York (the "Bisman Residence").

               1.   A phone bearing a call number ending in the
digits 2202 (the "Bisman Home Phone"). Verizon New York records
reflect that the Bisman Home Phone is listed to "N. Herman" and
located at the Bisman Residence.

               m.   A phone bearing a call number ending in the
digits 5739 (the "Fairley Cell Phone"). AT&T records reflect
that the Fairley Cell Phone is listed to "Dennis Fairley," at an
address in Emeryville, California.

               n.   A phone bearing a call number ending in the
digits 0707 (the ~Ana Sanchez Cell Phone"). AT&T records reflect
that the Ana Sanchez Cell Phone is listed to "Ana Sanchez," at an
address in Baldwin, New York.

               o.   A phone bearing a call number ending in the
digits 3762 (the "Fairley Home Phone"). Verizon-New York records
reflect that the Fairley Home Phone is listed to ~Patrick
Fairley," at an address in New York, New York (the "Fairley
Manhattan Residence").  Further, JetBlue Airways records reflect
that on or about September 1, 2009, ~Dennis P. Fairley" flew from

JFK Airport in New York to Oakland, California. On or about
September 8, 2009, "Dennis P. Fairley" flew from Oakland to JFK.
The phone information provided to JetBlue in connection with
these flights was the name "Dennis P. Fairley," and the Fairley
Home Phone number.

               p.   A phone bearing a call number ending in the
digits 1574 (the "Ana Sanchez/2 Cell Phone"). AT&T records
reflect that the Ana Sanchez/2 Cell Phone is listed to "Ana
Fairley," with an address in Baldwin, New York.

               q.   A phone bearing a call number ending in the
digits 2598 (the "Fairley/Commodore Phone"). AT&T records
reflect that the Fairley/Commodore Phone is listed to "Dennis
Fairley" at an address in Emeryville, California.  Further,
JetBlue Airways records reflect that on or about December 24,
2009, "Dennis P. Fairley" flew from JFK to Oakland, and on or
about January 4, 2010, "Dennis P. Fairley" flew from Oakland to
JFK. The phone information provided to JetBlue in connection
with these flights was the name "Dennis Fairley" and the
Fairley/Commodore Phone number.

          9.   Surveillance over the wiretaps, coupled with
visual surveillance and other investigative techniques, as set
forth in further detail below, has revealed the following:

               a.   DENNIS PATRICK FAIRLEY, THOMAS FAIRLEY, ANA
SANCHEZ, KEVIN YAN, FRANK BISMAN, JASON ABBATE, BARRY GOLDRING,
THERESA GOLDRING, KENNETH KUTIN, MARK VANDERBORG, BRUCE SIEGMAN,
HOWARD ARONSON, GARY BRUSTEIN, LEONARD ROSENFELD, MICHAEL
SILVERMAN, EDWARD RUBIN, MELANIE TAX IN , MITCHELL TEPPER, RALPH
MARAZZO, NINA MARAZZO, RONALD VESSIA, and NEIL WEINSTOCK, the
defendants, and others known and unknown, are involved in a drug
trafficking organization.

               b.   From at least in or about August 2008, the
defendants have been involved in a conspiracy to distribute and
to possess with intent to distribute methaqualone in the form of
pills commonly known as "Quaaludes.'"  During the course of the
conspiracy, DENNIS PATRICK FAIRLEY, the defendant, has

the wiretaps, set forth below at paragraphs 10.t, 12.1 and 12.n.

manufactured Quaaludes at a laboratory in California called
CalCoast Labs, among other places, with the assistance of THOMAS
FAIRLEY, ANA SANCHEZ, and KEVIN YAN, the defendants. DENNIS
PATRICK FAIRLEY has then distributed Quaaludes, with the
assistance of THOMAS FAIRLEY and SANCHEZ, to FRANK BISMAN, JASON
ABBATE, and NEIL WEINSTOCK, the defendants, in New York, each of
whom has further distributed Quaaludes to other individuals.
BISMAN and ABBATE have further sold Quaaludes to BARRY GOLDRING
and THERESA GOLDRING, the defendants. BARRY GOLDRING and THERESA
GOLDRING have further sold Quaaludes to KENNETH KUTIN, MARK
VANDERBORG, and BRUCE SIEGMAN, the defendants, each of whom has
further distributed Quaaludes to other individuals. VANDERBORG
has further sold QUAALUDES to HOWARD ARONSON, GARY BRUSTEIN,
LEONARD ROSENFELD, and MICHAEL SILVERMAN, the defendants, each of
whom has further distributed Quaaludes to other individuals.
SILVERMAN has further sold Quaaludes to EDWARD RUBIN, MELANIE
TAX IN , MITCHELL TEPPER, RALPH MARAZZO, NINA MARAZZO, and RONALD
VESSIA, the defendants, each of whom has resold Quaaludes to
other individuals.

          10. Surveillance over the wiretaps, coupled with
visual surveillance and other investigative techniques, has
revealed the following about DENNIS PATRICK FAIRLEY, THOMAS
FAIRLEY, ANA SANCHEZ, KEVIN YAN, FRANK BISMAN, JASON ABBATE,
BARRY GOLDRING, MARK VANDERBORG, and NEIL WEINSTOCK, the
defendants:

                a.   On or about September 11, 2009, at
approximately 11:59 a.m., law enforcement agents intercepted a
call over the Goldring2 Cell Phone between BARRY GOLDRING and
JASON ABBATE at the Abbate Cell Phone. GOLDRING stated "I'm
talking in circles because I'm on my cell phone, you know what I
mean?" ABBATE stated that "you're at eleven [i.e., likely $11
per pill]" and "we're at seven [i.e., $7]" and "we split the four
 [i.e., $4]."   ABBATE stated, "so when you give him 38 [i.e.,
likely $38,000] he should be keeping 32 [i.e., likely $32,000] . .
   . And taking six [i.e., $6,000] and putting it on the side and
when you come bring him the fifty [i.e., $50,000]." ABBATE
stated, "that makes fifty six . . . . and eight times seven is
fifty six." ABBATE stated "What he's probably been doing is
keeping the thirty eight . . . . Instead of keeping the thirty two
and putting the six on the side." GOLDRING stated "and keeping
the six for himself." ABBATE stated "[Frank] should only be
keeping thirty two and saving six." GOLDRING agreed, "to give to
this guy." ABBATE stated, "What I think he's doing is, you're
bringing him the thirty eight . . . He's giving me my two times
eight [i.e., likely 2 multiplied by $8,000].      . And he's
keeping the rest instead of putting the six on the side."
GOLDRING stated, "Why don't you sit there with Frank when I come

every month and then you'll see for yourself." GOLDRING asked,
"Is there any way that me and you could do this without him?"

                b.   I believe this conversation indicates that
GOLDRING advised ABBATE that he was going to speak cryptically,
out of a likely concern for law enforcement detection.   Further,
I believe that according to ABBATE, he and his "partner," FRANK
BISMAN, buy pills from their supplier for $7 per pill and sell
them to GOLDRING for $11 per pill. ABBATE and BISMAN then split
the $4 per pill profit and each receives $2 per pill.    Further
still, GOLDRING has been purchasing approximately 8,000 pills per
month (i.e., "a normal cycle") for a total of $88,000 to ABBATE
and BISMAN.  The pills are purchased with an initial down payment
of $38,000. Of that amount, ABBATE and BISMAN split a $32,000
(i.e., $16,000 each) profit. The remaining $6,000 BISMAN is
supposed to "put on the side." Thereafter, GOLDRING delivers the
$50,000 balance to BISMAN. BISMAN adds the $6,000 he "put on the
side" to the $50,000 and then the $56,000 is given to their
supplier (i.e., 8,000 pills times $7 per pill = $56,000).    As
set forth in further detail below, BISMAN and ABBATE's supplier
was determined to be DENNIS PATRICK FAIRLEY. Moreover, GOLDRING
was upset with BISMAN because BISMAN was making mistakes with the
math and advising his suppler that GOLDRING was shorting him.
GOLDRING wanted to deal with ABBATE directly and cut BISMAN out
of the picture.

               c.   On or about October 15, 2009, law enforcement
agents conducted surveillance in the vicinity of an address in
Brooklyn, New York (the "Brooklyn Lab"). At approximately 1:18
p.m., agents observed DENNIS PATRICK FAIRLEY enter this location.
At approximately 6:33 p.m., agents observed JASON ABBATE and
FRANK BISMAN arrive at this location in ABBATE's vehicle (the
"Abbate Vehicle")' and pUll into the garage. At approximately
6:56 p.m., the Abbate Vehicle left. At approximately 7:08 p.m.,
all the lights were turned off in the building and DENNIS PATRICK
FAIRLEY left the garage and was followed to the Fairley Manhattan
Residence where he entered the building.  I believe that this
meeting was conducted in order for DENNIS PATRICK FAIRLEY to
provide BISMAN and ABBATE their supply of Quaaludes.

               d.   On or about October 16, 2009, law enforcement
agents conducted surveillance in the vicinity of the Brooklyn
Lab. At approximately 5:47 p.m., ABBATE and BISMAN arrived at
this location in the Abbate Vehicle. DENNIS PATRICK FAIRLEY
opened the garage door holding a shopping bag.  FRANK BISMAN then


     ,    DMV records reflect that the Abbate Vehicle is registered
to "Jason Abbate" with an address at the Abbate Residence.

placed the shopping bag into ABBATE's trunk. ABBATE and BISMAN
then got into the Abbate Vehicle and drove away. On or about
October 16, 2009, at approximately 10:06 p.m., law enforcement
agents intercepted a call over the Vanderborg Horne Phone between
MARK VANDERBORG and BARRY GOLDRING. GOLDRING stated "They
brought back half from the add on.         They got to go back
again tonight. But, I'm not going back tonight.   Frank he's just
gonna leave somewhere it for me.   I'm gonna catch it after the
weekend." I believe in this call GOLDRING is telling VANDERBORG
that FRANK BISMAN and JASON ABBATE got only half the order of
Quaaludes that had been added to the original order from DENNIS
PATRICK FAIRLEY and that GOLDRING would be getting his order from
BISMAN.

               e.   On or about November 8, 2009, at
approximately 2:48 p.m., law enforcement agents intercepted a
call over the Bisman Cell Phone between FRANK BISMAN and BARRY
GOLDRING at the Goldring Cell Phone. BISMAN stated "the line on
the game is, is 10." GOLDRING responded, "Is 10 okay, and it's
that hour earlier than normally correct?" BISMAN responded
"Today is the eighth so corne over tomorrow morning or Tuesday
morning." GOLDRING stated "no, I'm going to corne and I'm gonna
meet you guys like I, like I did last month." I believe BISMAN
and GOLDRING are discussing a monthly meeting with DENNIS PATRICK
FAIRLEY, which was scheduled to take place November 10, 2009.

               f.   On or about November 10, 2009, law
enforcement agents conducted surveillance at the Fairley
Manhattan Residence. At approximately 3:10 p.m., DENNIS PATRICK
FAIRLEY left the building carrying a white shopping bag bearing
the name "Dean & DeLuca." At approximately 3:35 p,.m., ANA
SANCHEZ picked up DENNIS PATRICK FAIRLEY in a Mercedes Benz (the
"Sanchez Vehicle").3 Agents followed FAIRLEY and SANCHEZ to the
Brooklyn Lab where they drove inside and the automatic door
closed. At approximately 6:15 p.m., SANCHEZ greeted BISMAN and
ABBATE and then the garage door closed. At approximately 7:43
p.m., the Abbate Vehicle left the Brooklyn Lab's garage. BISMAN
and ABBATE were then followed back to the vicinity of the Bisman
Residence, where they entered a driveway which accesses garages
for Bisman's building. BISMAN removed two large bags from the
trunk of the Abbate Vehicle. BARRY GOLDRING, who was parked on
197th Street in a black BMW (the "Goldring BMW"), entered the
driveway in his vehicle. BISMAN, ABBATE, and GOLDRING then
entered a garage near the driveway, with BISMAN carrying the two

bags. BARRY GOLDRING then left carrying two shopping bags, which
he placed into the trunk of the Goldring BMW and drove away. At
approximately 7:54 p.m., DENNIS PATRICK FAIRLEY and ANA SANCHEZ
left the Brooklyn Lab carrying shopping bags and were followed to
the Fairley Manhattan Residence where both DENNIS PATRICK FAIRLEY
and ANA SANCHEZ entered the building carrying the shopping bags.
I believe that at the Brooklyn Lab, BISMAN and ABBATE purchased
Quaaludes from SANCHEZ and FAIRLEY which BISMAN and ABBATE then
sold in part to GOLDRING.

               g.   On or about December 10, 2009, law
enforcement agents conducted surveillance in the vicinity of the
Brooklyn Lab. At approximately 2:00 p.m., DENNIS PATRICK FAIRLEY
entered the Brooklyn Lab carrying a shopping bag. Other law
enforcement agents conducted surveillance at the Bisman
Residence, and at approximately 3:56 p.m., JASON ABBATE arrived
at the Bisman Residence. At approximately 6:00 p.m., BARRY
GOLDRING arrived at the Bisman Residence in a black vehicle (the
"Black Goldring Vehicle"). BISMAN went into the trunk of his car
and then back inside the Bisman Residence. At approximately 6:07
p.m., GOLDRING, BISMAN, and ABBATE left, GOLDRING in the Black
Goldring Vehicle and BISMAN and ABBATE in the Abbate Vehicle. At
approximately 6:42 p.m., the Abbate Vehicle entered the garage at
the Brooklyn Lab. At approximately 7:20 p.m., DENNIS PATRICK
FAIRLEY was observed in the garage as ABBATE exited the garage in
his car and drove away. At approximately 7:35 p.m., DENNIS
PATRICK FAIRLEY exited the location carrying two large shopping
bags, a Duane Reade bag and a holiday bag. At approximately 7:38
p.m., DENNIS PATRICK FAIRLEY left in a livery car with the two
shopping bags and was followed to the Fairley Manhattan
Residence, where DENNIS PATRICK FAIRLEY exited the car and
entered the building with the two bags.

               h.    On or about December 10, 2009, at
approximately 5:48 p.m., law enforcement agents intercepted a
call over the Goldring2 Cell Phone between BARRY GOLDRING and
FRANK BISMAN at the Bisman Home Phone. BISMAN stated "Thought we
were going to the diner?" GOLDRING responded he would "be there
in two minutes." I believe that GOLDRING and BISMAN are
discussing meeting for GOLDRING to get his supply of Quaaludes
from BISMAN after BISMAN has met with DENNIS PATRICK FAIRLEY.

               i.   On or about December 11, 2009, at
approximately 8:19 p.m., law enforcement agents intercepted a
call over the Bisman Cell Phone between FRANK BISMAN and another
individual ("Individual-1"). BISMAN stated, "Last chance, I can
get you fifty tickets for ah six hundred dollars." Individual-1
responded "Tickets to what?" BISMAN stated "Code, code, fifty of
them."  Individual-1 stated "I can't take that many . . . I'll

take some of them" and then ordered half.  I believe this
conversation indicates that BISMAN planned to sell Individual-1
25 Quaaludes for $12 each.

               j.   On or about December 28, 2009, at
approximately 12:46 p.m., law enforcement agents intercepted a
call over the Abbate Cell Phone between JASON ABBATE and FRANK
BISMAN at the Bisman Cell Phone. BISMAN asked "What did you do
with that movie, did you.    . watch it, Dennis finish it?"
ABBATE responded that "the last was, the last movie was ah not
bad, but the movie before.    . the shorter movie.     . that he
gave me. That was much better.   I liked that movie much better."
I believe this conversation indicates that in ABBATE's opinion,
the batch of Quaaludes he purchased from DENNIS PATRICK FAIRLEY
in November was "much better" than the batch he purchased in
December.

               k.   On or about January 10, 2010, at
approximately 10:05 a.m., law enforcement agents intercepted a
call over the Abbate Cell Phone between DENNIS PATRICK FAIRLEY,
who answered the Abbate Cell Phone, and FRANK BISMAN at the
Bisman Cell Phone. When BISMAN asked where he was, DENNIS
PATRICK FAIRLEY responded "at the laboratory you know urn.    . I
heard you a little bit ah.    . under the weather." BISMAN then
asked "Where is he [i.e., ABBATE]?" When DENNIS PATRICK FAIRLEY
tried to put ABBATE on the phone, ABBATE is heard in the
background saying "I don't want to talk to him." DENNIS PATRICK
FAIRLEY stated that ABBATE "picked up twenty." BISMAN stated
that he had to "get five."  I believe this conversation indicates
that ABBATE met with DENNIS PATRICK FAIRLEY at the Brooklyn Lab
without BISMAN and that ABBATE purchased 20,000 Quaaludes from
FAIRLEY.

               1.   On or about January 10, 2010, at
approximately 10:36 a.m., law enforcement agents intercepted a
call over the Bisman Home Phone between FRANK BISMAN and DENNIS
PATRICK FAIRLEY at the Fairley Cell Phone. BISMAN stated "I
wanted to apologize to you.  It's just that breakfast was all
messed up." DENNIS PATRICK FAIRLEY responded, "I just said look,
ah, if all you want is just the five, I can have them in two
days." BISMAN responded "I'll see you during the week, probably
Tuesday night.  I'll call you tomorrow." DENNIS PATRICK FAIRLEY
stated, "Yeah, 6:30 usual time, just give me a call alright?" I
believe this conversation indicates that BISMAN was placing a
separate order for 5,000 Quaaludes directly from DENNIS PATRICK
FAIRLEY.

               m.   On or about January 12, 2010, law enforcement
agents conducted surveillance at the Brooklyn Lab. At

approximately 5:21 p.m., DENNIS PATRICK FAIRLEY entered the
location.   At approximately 6:23 p.m., FRANK BISMAN and JASON
ABBATE arrived in the Abbate Vehicle. At approximately 6:51
p.m., the vehicle BISMAN and ABBATE had arrived in left the
Brooklyn Lab. At approximately 7:28 p.m., DENNIS PATRICK FAIRLEY
exited the Brooklyn Lab, entered a livery car, and went to the
Fairley Manhattan Residence.

               n.   On or about January 15, 2010, at
approximately 5:06 p.m., law enforcement officers intercepted a
call over the Fairley Cell Phone between DENNIS PATRICK FAIRLEY
and ANA SANCHEZ at the Ana Sanchez Cell Phone.   DENNIS PATRICK
FAIRLEY stated to "bring it with you." SANCHEZ asked "Both of
them? Because you have the Fed Ex box too." DENNIS PATRICK
FAIRLEY stated, "Small okay, bring that and the mail.     . Just
bring the box and the mail for me that's all."   I believe this
call reflects that SANCHEZ is bringing Quaaludes that have been
shipped from California to the Fairley residence located in
Baldwin, New York to the Brooklyn Lab.

               o.   On or about January 15, 2010, at
approximately 10:30 p.m., a law enforcement officer acting in an
undercover capacity ("UC-l"), entered a pub in Baldwin, New York.
Another patron of the pub introduced UC-l to DENNIS PATRICK
FAIRLEY as "Patrick Fairley." UC-l and another law enforcement
officer acting in an undercover capacity ("UC-2") then spoke with
DENNIS PATRICK FAIRLEY.  FAIRLEY stated that he was a chemist by
trade; that he owns three laboratories, as well as homes in
Baldwin, New York, Manhattan, New York, California and Istanbul,
Turkey, and an adult entertainment club located on 47th Street in
the vicinity of 11th Avenue in Manhattan.  FAIRLEY further stated
that he was working on a project in California with his brother.

               p.   On or about January 21, 2010, at
approximately 3:04 p.m., law enforcement officers intercepted a
call over the Fairley Cell Phone between DENNIS PATRICK FAIRLEY
and THOMAS FAIRLEY at a number ending in digits 5704 (the
"Fairley CA Lab Phone").' During the call, DENNIS PATRICK


     ,     AT&T records reflect that the cellular number ending in
digits 5704 is listed to "Dennis Fairley," with an address in
Emeryville, California (the "Tom Fairley Cell Phone"). A review of
the Cal Coast Labs website, www.calcoastlabs.com (last visited on or
about April 2, 2010), lists "Tom Fairley" as an employee.         The
website lists the business address as the same address listed for
the Tom Fairley Cell Phone.         On or about March 8, 2010, at
approximately 11: 08 a. m., law enforcement agents intercepted a call
placed from the Fairley Home Phone to the voicemail of NEIL

FAIRLEY stated "uh so that's that anyway ah, I'll be back on
Saturday night, and then uh Sunday laboratory pick up, pick up
the usual crap and uh then we get out of there on the weekend.    I
gotta be back [i.e., in New YorkJ on the uh seventh [i.e., likely
February 7, 2010J for the boys and uh, they want twenty as usual
or it's becoming usual . . . it's more important than uh hanging
around here· doing nothing." THOMAS FAIRLEY stated, "Yeah." I
believe this conversation indicates that DENNIS PATRICK FAIRLEY
was planning to pick up Quaaludes at CalCoast Labs in California
before returning to New York to sell the Quaaludes to the "boys"
- FRANK BISMAN and JASON ABBATE - who wanted "twenty," meaning
20,000 Quaaludes,. which was "becoming" the usual quantity of the
orders.

               q.   On or about February 6, 2010, law enforcement
agents conducted surveillance at the Brooklyn Lab. At
approximately 3:00 p.m., an individual carrying a white gym bag
with a shoulder strap entered through the garage. At
approximately 4:30 p.m., DENNIS PATRICK FAIRLEY exited the garage
with a light blue shopping bag. At approximately 4:33 p.m., ANA
SANCHEZ left the garage carrying two large white gym bags with
shoulder straps.  SANCHEZ and FAIRLEY got into a Lincoln Town Car
with their respective bags.

               r.    On or about Sunday, February 7, 2010, law
enforcement officers conducted surveillance at the Bisman
Residence. At approximately 8:20 a.m., JASON ABBATE arrived in
the Abbate Vehicle, parked on 197th Street, and walked toward the
Bisman Residence. At approximately 9:12 a.m., agents observed
DENNIS PATRICK FAIRLEY and THOMAS FAIRLEY leave the Fairley
Manhattan Residence.    THOMAS FAIRLEY was carrying a light blue
bag. DENNIS PATRICK FAIRLEY and THOMAS FAIRLEY then took a taxi
to the Brooklyn Lab.     At approximately 9:37 a.m., BARRY GOLDRING
arrived at the Bisman Residence in a black Mercedes Benz (the
"Goldring Vehicle") ,5 removed a white Dunkin' Donuts bag from his
trunk, and then entered Bisman's Residence. At approximately


WENSTOCK, the defendant,. at a call number ending in the digits 6268
(the "Weinstock Phone").     Verizon Wireless records reflect that
phone number ending in the digits 6268 is listed to "Neil
Weinstock," with an address in Paramus, New Jersey. During this
message, DENNIS PATRICK FAIRLEY, the defendant, stated that he lost
his cell phone and WEINSTOCK should call FAIRLEY's home number
"or call [his] my brother's cell phone, it's the same number as my
phone except the last two digits are 0-4        . 5704."

"Acetic Anhydride," a precursor chemical used in the production
of methaqualone.

                u    On or about February 21, 2010, at
approximately 9:05 p.m., law enforcement agents intercepted a
call over the Fairley Cell Phone between DENNIS PATRICK FAIRLEY
and ANA SANCHEZ at the Ana Sanchez/2 Cell Phone. During this
call, I believe they discuss an order to be filled.    DENNIS
PATRICK FAIRLEY stated, "There's already five in there, you just
got to make two." SANCHEZ responded, "that's almost nothing we
can do that in one day." DENNIS PATRICK FAIRLEY stated "Of
course, 'cause I told Tom when I left he should be stuffing the
plates.     . so everything is ready." SANCHEZ responded
"Everything stuff I can make it in no time." I believe this
conversation indicates that DENNIS PATRICK FAIRLEY needed 2,000
more Quaaludes and had previously asked THOMAS FAIRLEY to fill
the encapsulating machine (i.e., "stuffing the plates") so that
"everything is ready."

                v.   On or about February 24, 2010, at
approximately 7:26 p.m., law enforcement agents intercepted a
call over the Fairley Cell Phone between DENNIS PATRICK FAIRLEY
and THOMAS FAIRLEY at the Fairley CA Lab Phone. During the call,
DENNIS PATRICK FAIRLEY stated "And, ah so, I'm okay, just ha
. the ah.     .making.    .1 got six from Kevin [YAN] making
eighteen." THOMAS FAIRLEY replied, "Yeah, I can imagine, is
everything working okay, the equipment?" DENNIS PATRICK FAIRLEY
stated, "Yeah I lubricated everything, and I mean the.     . you
know whatever and the a [inaudible] I need to, I ordered some of
the parts but of course the DEA got involved and all sorts of
shit like that you know." Later in the conversation, DENNIS
PATRICK FAIRLEY stated that "Ana" is "supposed to be over there
one of these days.   I told her I need two, make up two
[inaudible].   I said Tom's.    . you're filling all those plates,
right?" THOMAS FAIRLEY replied, "Yeah." DENNIS PATRICK FAIRLEY
stated, "So the plates should already be full, should be no
problem making two," and THOMAS FAIRLEY said, "okay." DENNIS
PATRICK FAIRLEY stated, "I've already got six and eighteen .
because it's still pushing for twenty," and THOMAS FAIRLEY
replied, "Yeah, and the extra two should make it up." I believe
this conversation indicates that DENNIS PATRICK FAIRLEY "already"
had 6,000 Quaaludes (from KEVIN YAN) and 18,000 Quaaludes, and
needed THOMAS FAIRLEY to make 2,000 more Quaaludes using the
encapsulating machine (the "equipment," the "plates") at CalCoast
Labs.

               w.   On or about February 26, 2010, at
approximately 10:30 p.m., law enforcement agents intercepted a
call over the Fairley Cell Phone between DENNIS PATRICK FAIRLEY

and THOMAS FAIRLEY at the Fairley CA Lab Phone. During the call,
THOMAS FAIRLEY stated that "Ana" "was over there filling up some
product." DENNIS PATRICK FAIRLEY stated, "Should be running
heroin or cocaine or you know making bombs," and THOMAS FAIRLEY
responded, "If you made ammunition you would be working for the
government.    . it would be a stricter job." Law enforcement
agents believe this conversation indicates that THOMAS FAIRLEY is
telling DENNIS PATRICK FAIRLEY that ANA SANCHEZ, DENNIS's wife,
is at the Brooklyn Lab making Quaaludes, and that making
ammunition for the government would be a "stricter" job than
making Quaaludes.

               x.    On or about March 1, 2010, at approximately
3:29 p.m., law enforcement agents intercepted a call over the
Fairley Cell Phone between DENNIS PATRICK FAIRLEY and NEIL
WEINSTOCK at the Weinstock Phone. During that call, DENNIS
PATRICK FAIRLEY asked, "what are you gonna need?" WEINSTOCK
responded, "I guess a thousand." DENNIS PATRICK FAIRLEY then
asked, "ten?      . ten you said?" WEINSTOCK responded "just a
thousand." DENNIS PATRICK FAIRLEY responded, "Sure, I'll have it
all ready; yeah sure that's no problem."    I believe WEINSTOCK is
ordering 1,000 Quaaludes from DENNIS PATRICK FAIRLEY.

               y.   On or about March 1, 2010, at approximately
8:23 p.m., law enforcement agents intercepted a call over the
Fairley Cell Phone between DENNIS PATRICK FAIRLEY and ANA SANCHEZ
at the Ana Sanchez/2 Cell Phone.  FAIRLEY indicated he was not in
New York and stated, "When you go to the lab it should be, you're
probably gonna go there Wednesday or Thursday, there should be a
couple of boxes." SANCHEZ asked, "You want to put in the ahh,
the ahh, in your office? . . Okay, I can go tomorrow." I believe
that DENNIS PATRICK FAIRLEY is instructing SANCHEZ to place boxes
of Quaaludes in his office in the Brooklyn Lab.

               z.   On or about March 1, 2010, at approximately
9:41 p.m., law enforcement agents intercepted a call over the
Fairley Cell Phone between DENNIS PATRICK FAIRLEY and THOMAS
FAIRLEY at the Fairley CA Lab Phone. During the call, DENNIS
PATRICK FAIRLEY asked, "You, you filled all those      . all those
trays right?" THOMAS FAIRLEY replies, "Um huh." DENNIS PATRICK
FAIRLEY stated, "So.     . I don't really need any more by
Wednesday before I come, because the package.     . we should be
all set up.    . for Sunday." I believe this call indicates that
DENNIS PATRICK FAIRLEY is asking whether THOMAS FAIRLEY filled
the "trays" on the machines that produce Quaaludes, so that they
would be ready to fill orders on Sunday.

               aa.  On or about March 3, 2010, at approximately
8:58 p.m., law enforcement agents intercepted a call over the

Fairley Cell Phone between DENNIS PATRICK FAIRLEY and ANA SANCHEZ
at the Ana Sanchez/2 Cell Phone.    SANCHEZ stated "I told you
     . after the machine.     . if we can find i t .  . you, you
don't worry about that.      . I, I take care of that I can make
you urn thirty in a week, thirty thousand.   I know my capacity and
I know I can do it. Even not, even killing myself.     When you not
here I can go three days a week, four hours and I can make you
thirty thousand I'm sure.      . I'm good with hands.    . with
manual things you know.   I'm working with my hands all my life."
DENNIS PATRICK FAIRLEY responded, "Okay.      . everything is there
already so don't' worry Ana." DENNIS PATRICK FAIRLEY continued
"you'll find two boxes, just put them in my office and we'll
process everything on Saturday for Sunday." I believe that
during this call SANCHEZ is stating that if DENNIS PATRICK
FAIRLEY is able to find another encapsulating machine, she could
produce 30,000 Quaaludes "in a week." In addition, I believe
DENNIS PATRICK FAIRLEY sent two boxes containing Quaaludes to the
Brooklyn Lab which he asked ANA SANCHEZ to put in his office.
These pills will then be packaged and sold on Sunday during a
planned meeting with FRANK BISMAN and JASON ABBATE.

               bb. On or about March 5, 2010, at approximately
9:12 a.m., law enforcement agents intercepted a call over the
Fairley Home Phone between DENNIS PATRICK FAIRLEY and NEIL
WEINSTOCK at the Weinstock Phone. During that call, DENNIS
PATRICK FAIRLEY and WEINSTOCK agreed to meet on Monday March 8,
2010 at noon.

               cc. On or about March 5, 2010, at approximately
9:57 a.m., law enforcement agents intercepted a voicemail message
over the Fairley Cell Phone between DENNIS PATRICK FAIRLEY and
the voicemail of the Yan CA Lab Phone. During this message,
Fairley stated "Hi Kevin it's Friday.  I'm in New York.  I need
you to send me two here and I'll send you on Monday, oh, I'll
take care of that on Monday. And also lowe you for the last
two, so you're getting both FedEx. Give me a call so I'll make
sure you're there Monday.  It will be second day [delivery] and
be addressed to you." I believe this message indicates that
DENNIS PATRICK FAIRLEY is requesting that YAN send him 2,000
Quaaludes.

               dd. On or about March 5, 2010, at approximately
3:55 p.m., law enforcement agents intercepted a call over the
Fairley Cell Phone between DENNIS PATRICK FAIRLEY and KEVIN YAN
at the Yan CA Lab Phone.  FAIRLEY asked whether YAN got his
voicemail message. YAN responded that he did but he "cannot
order the.    . today because ah Jenny is off.  I.    . I can
send to you on.    . on Monday." DENNIS PATRICK FAIRLEY stated,
"to put, to get everything straight to get the balance straight

for the two you're sending and the two I took already. Okay?
. Yeah and then when I get back ah the same old thing.  Four to
six."   I believe this conversation indicates that YAN has
prepared and sent 4,000 pills and DENNIS PATRICK FAIRLEY expects
that they will go back to their usual order of 4,000-6,000 pills.

               ee.  On or about March 8, 2010, law enforcement
officers conducted surveillance in the vicinity of the Fairley
Manhattan Residence. At approximately 12:03 p.m., DENNIS PATRICK
FAIRLEY and THOMAS FAIRLEY left the Fairley Manhattan Residence,
each carrying a bag, and walked to a FedEx/Kinkos store. Minutes
later, DENNIS PATRICK FAIRLEY and THOMAS FAIRLEY exited the store
and DENNIS PATRICK FAIRLEY no longer had a bag in his possession.
Law enforcement agents followed DENNIS PATRICK FAIRLEY and THOMAS
FAIRLEY to a restaurant on West 47th Street, where they met NEIL
WEINSTOCK at approximately 12:45 p.m. Moments later, an agent
observed DENNIS PATRICK FAIRLEY pick up the bag THOMAS FAIRLEY
had been carrying earlier and leave the restaurant with
WEINSTOCK. Minutes later, DENNIS PATRICK FAIRLEY exited the
vehicle without a bag and WEINSTOCK drove away. At approximately
1:02 p.m., another agent observed DENNIS PATRICK FAIRLEY and
THOMAS FAIRLEY leave the restaurant without bags.  The agent then
followed DENNIS PATRICK FAIRLEY and THOMAS FAIRLEY to a Bank of
America located on 51st Street, west of Fifth Avenue, where the
agent observed DENNIS PATRICK FAIRLEY with a teller.

               ff.  On or about March 8, 2010, at approximately
3:20 p.m., law enforcement officers intercepted a call over the
Vanderborg Cell Phone between MARK VANDERBORG and BARRY GOLDRING.
GOLDRING stated, "So, you, you saw both guys?" VANDERBORG
stated, "Yeah, I saw both guys but I might not be seeing Lenny
until tomorrow morning." GOLDRING stated, "I gotta get up for
Frank by next weekend      . Ya know what I'm saying, a lot of
money . . . I hope, I hope it could work.   I hope it could work."
VANDERBORG stated, "I got my regulars." I believe this
conversation indicates that GOLDRING is planning to buy QUAALUDES
from FRANK BISMAN, that GOLDRING is planning to sell QUAALUDES to
VANDERBORG, and that VANDERBORG has a number of "regular"
customers, including LEONARD ROSENFELD.

                gg. On or about March 14, 2010, at approximately
1:44 p.m., law enforcement agents intercepted a call over the
Bisman Cell Phone between FRANK BISMAN and another individual
 ("Individual-2").  Individual-2 stated, "make up a nice one
though" and BISMAN responded "They're all weighed."   Individual-2
responded "I know, but you know what I mean. Make me a nice one
and urn I have the money from last time.  lowe you two hundred
with this here one now, right? . . . I have you the two fifty,
the two twenty five.   Right now I have to give you a hundred

dollars lowe you. And I'm gonna pay you for this one too now.
So, I'm gonna give you two hundred now, right? And, we're gonna
be even." I believe this conversation indicates that Individual
2 purchases Quaaludes from BISMAN.

               hh. On or about March 23, 2010, at approximately
12:06 p.m., law enforcement agents intercepted a call over the
Fairley Home Phone between DENNIS PATRICK FAIRLEY and NEIL
WEINSTOCK at the Weinstock Phone. DENNIS PATRICK FAIRLEY asked
if WEINSTOCK "want [ed] something before I leave, uhh, which is
Thursday morning." WEINSTOCK asked "How long will you be gone
for?" DENNIS PATRICK FAIRLEY responded "Two weeks, usual."
WEINSTOCK stated "I should be right about when you walk back in
I'll be perfect, I'll be due, that will actually be perfect .
. And I am going to take double this time." WEINSTOCK further
stated he was increasing his order because he wanted "the
discount." DENNIS PATRICK FAIRLEY asked "what's the discount
anyway?" WEINSTOCK stated "a dollar" which then made the price
"Seven." They continued:

          FAIRLEY:       Okay, that's going to change alright?
                         That's going to go back up 50 cents in
                         July 1 st •

          WEINSTOCK:     What do you mean?

          FAIRLEY:       I mean it is going to go up 50 cents uh,
                         urn July 1st because and at the end of
                         the year, it is going to go up a dollar,
                         it will be back where you were.

          WEINSTOCK:     Well it went from seven to eight?

          FAIRLEY:       Yeah, uhh, it's going up to 8 the first
                         of the year, 7.50 is in July 1st.

          WEINSTOCK:     Okay, that's fine; in the meantime I'll
                         take ah advantage of it when it's seven.

I believe this call indicates that WEINSTOCK planned to purchase
Quaaludes from DENNIS PATRICK FAIRLEY for $7 per pill, and that
FAIRLEY planned to raise the prices on July 1 and at the end of
the year.

          11. Surveillance over the wiretaps, coupled with
visual surveillance and other investigative techniques, has
revealed the following about BARRY GOLDRING, THERESA GOLDRING,
KENNETH KUTIN, MARK VANDERBORG, BRUCE SIEGMAN, HOWARD ARONSON,
GARY BRUSTEIN, LEONARD ROSENFELD, and MICHAEL SILVERMAN, the

defendants:

               a.   On or about June 1, 2009, at approximately
12:34 p.m., law enforcement officers intercepted a call over the
Silverman Cell Phone between MICHAEL SILVERMAN and MARK
VANDERBORG on the Vanderborg Cell Phone.   SILVERMAN stated "maybe
things will pick up.    . right now I'm looking for cash .
I'll give you a call in a little bit." I believe this
conversation indicates that SILVERMAN needed to make money in
order to purchase Quaaludes from VANDERBORG.

                b.  On or about June 4, 2009,.law enforcement
officers conducted surveillance at the Silverman Residence. At
approximately 2:35 p.m., a law enforcement officer saw MARK
VANDERBORG driving a Mercedes Benz vehicle (the "Vanderborg
Vehicle"),' arrive at the Silverman Residence, exit the vehicle,
remove a Duane Reade shopping bag from the trunk and enter the
location. Minutes later, at approximately 3:10 p.m., the law
enforcement officer observed VANDERBORG leave the location
carrying a brown shopping bag.

               c.   On or about August 16, 2009, at approximately
7:50 a.m., law enforcement agents observed MARK VANDERBORG arrive
at the Goldring Residence and enter the house. At approximately
7:58 a.m., VANDERBORG left the residence carrying a white
envelope, which VANDERBORG placed into the trunk of his car.
VANDERBORG was followed to GARY BRUSTEIN's residence, in
Brookville, New York (the "Brustein Residence").8

               d.   On or about August 23, 2009, at approximately
12:28 p.m., law enforcement agents intercepted a call over the
Vanderborg Cell Phone between MARK VANDERBORG and HOWARD ARONSON.
During this conversation, ARONSON stated "there are two addresses
-- 100 and the second address is 20." VANDERBORG stated that
ARONSON should meet him at VANDERBORG's house.  I believe this
conversation indicates that ARONSON placed two Quaaludes orders,
one for 100 pills and a second for 20 pills.

               e.   On or about August 27, 2009, law enforcement
agents conducted surveillance in the vicinity of Major's Steak
House, in Woodbury, New York. At approximately 12:01 p.m.,
HOWARD ARONSON arrived at that location and at approximately


     ,    DMV records reflect that the Vanderborg Vehicle      is
registered to "Mark Vanderborg" at the Vanderborg Residence.

the address in Brookville, New York.

12:03 p.m., MARK VANDERBORG arrived and parked next to ARONSON.
HOWARD ARONSON exited his vehicle and leaned into the passenger
side of VANDERBORG's car. Thereafter, VANDERBORG and ARONSON
entered the restaurant.

               f.   On or about August 31, 2009, law enforcement
agents conducted surveillance in the Plainview Center, South
Oyster Bay Road, Plainview, New York. At approximately 1:52
p.m., MARK VANDERBORG and LEONARD ROSENFELD left a coffee shop
and entered the Vanderborg Vehicle. VANDERBORG was followed to
another address, where he dropped off ROSENFELD.

               g.   On or about September 1, 2009, at
approximately 8:18 p.m., law enforcement agents intercepted a
call over the Vanderborg Home Phone between MARK VANDERBORG and
HOWARD ARONSON. ARONSON stated: "the addresses are as follows:
250 . . 110 . . and 55.    .250,110 and 55." VANDERBORG
responded "You got it." During this call, ARONSON asked
VANDERBORG to write it down.  I believe this conversation
indicates that ARONSON placed three orders for Quaaludes,
packaged for distribution, and that VANDERBORG maintains records
of his narcotics dealings.

                h.  On or about September 10, 2009, at
approximately 1:04 p.m., law enforcement agents intercepted a
call over the Vanderborg Cell Phone between MARK VANDERBORG and
HOWARD ARONSON.    During this conversation, VANDERBORG stated,
"What you gave me was 100 short." ARONSON replied, "Do it once
more because at first I counted 1,195 and then I counted 1,295."
VANDERBORG responded, "I got 1195." ARONSON replied, "I'll make
it up to you." I believe this conversation indicates that ARONSON
and VANDERBORG are discussing the amount owed for a purchase made
by ARONSON.

               I.   On or about September 30, 2009, at
approximately 12:39 p.m., law enforcement agents intercepted a
call over the Vanderborg Cell Phone between MARK VANDERBORG and
HOWARD ARONSON at a phone number ending in the digits 4644. 9
During this conversation, ARONSON told VANDERBORG that he had a
meeting with "The doc on Friday" and stated that because of that
meeting he needed to see VANDERBORG the next day. They arranged
to meet at 6:00 that evening.  I believe this conversation

records related to the death of another individual reflect that
one of the deceased's "friends" was "Howard Aronson," with his
phone number ending in the digits 4644.

indicates that ARONSON was discussing a customer for whom he
needed to purchase pills.

                j.   On or about September 28, 2009, at
approximately 9:25 a.m., law enforcement officers intercepted a
call over the Goldring Home Phone between BARRY GOLDRING and
BRUCE SIEGMAN at a telephone number ending in the digits 5917
 (the "Siegman Phone").l0 During this conversation, SIEGMAN
stated "Is it too much to ask, I could just pop over for a
second, I have some business to do." Goldring replied "I can't
do this man." SIEGMAN replied "Just do it for me 'cause I have
some guy you know." BARRY GOLDRING agreed.    I believe this
conversation indicates that SIEGMAN was planning to pick up
Quaaludes from BARRY GOLDRING, which were destined of "some guy."

               k.   On or about September 28, 2009, law
enforcement agents conducted surveillance at the Goldring
Residence. At approximately 9:40 a.m., an officer observed BRUCE
SIEGMAN exit the Goldring Residence and enter a black Mazda
automobile (the "Siegman Vehicle") ," which was parked in the
driveway. Officers followed the Siegman Vehicle to the Siegman
Residence.

               1.   On or about October 27, 2009, at
approximately 8:05 a.m., law enforcement officers intercepted a
call over the Goldring Home Phone between BARRY GOLDRING and
BRUCE SIEGMAN. During the call, SIEGMAN stated, "I'm coming but
I got no orders today." I believe that this call indicates that
SIEGMAN was going to buy Quaaludes from GOLDRING later that day,
but did not have any orders from Quaaludes customers.

               m.   On or about November 2, 2009, at
approximately 5:18 p.m., law enforcement agents intercepted a
call over the Goldring2 Cell Phone between BARRY GOLDRING and
BRUCE SIEGMAN at the Siegman Phone. During the call, SIEGMAN
asked whether he could "borrow a hundred and fifty dollars from
you," and BARRY GOLDRING replied, "If it's not one fifty, it's
one." SIEGMAN said, "But it has to be over one. You know what
I'm saying?" BARRY GOLDRING responded, "You're moving and
grooving, huh?" SIEGMAN said "I can't do nothing unless you give

need, I need, I need over a hundred dollars." BARRY GOLDRING
responded, "Alright, I hate to talk on the phone." I believe
this conversation indicates that SIEGMAN needed 150 Quaaludes
from BARRY GOLDRING to resell to another customer, that BARRY
GOLDRING would only guarantee that 100 Quaaludes would be
available, and that BARRY GOLDRING does not like to talk about
the Quaaludes business on the phone, because of a fear of law
enforcement detection.

               n.   On or about November 3, 2009, at
approximately 10:17 a.m., law enforcement agents intercepted a
call over the Goldring Cell Phone between THERESA GOLDRING and
BARRY GOLDRING at the Goldring Cell Phone. During this call,
BARRY GOLDRING asked whether THERESA GOLDRING could "take a ride
by Ken and Eileen's today." I believe this conversation
indicates that BARRY GOLDRING was instructing THERESA GOLDRING to
go to KENNETH KUTIN's house to pick up Quaaludes.

               o.   On or about November 4, 2009, at
approximately 1:11 p.m., law enforcement agents intercepted a
call over the Goldring Home Phone between BARRY GOLDRING and
THERESA GOLDRING at the Goldring Cell Phone. During this call,
BARRY GOLDRING stated, "Oh great and here Ken asked, me .
everybody's fucked up.     . he said 'how is she getting here?'
Like we didn't discuss it you know. what I'm saying?" THERESA
GOLDRING replied, "Just say Sandy's dropping her off and she's
picking something up." BARRY GOLDRING stated, "No ahh, I told
her that you're gonna drop her off. We don't want [Sandy] to
know where you live." I believe this conversation indicates that
BARRY GOLDRING wanted THERESA GOLDRING to obtain Quaaludes from
KENNETH KDTIN without "Sandy" being present.

                p.   On or about November 4, 2009, law enforcement
agents conducted surveillance in the vicinity of Little Neck, New
York. At approximately 3:14 p.m., an agent observed THERESA
GOLDRING and another individual ("Individual 10") arrive at this
location and park a white Infiniti, (the "Individual-10
Vehicle") .'2 The agent further observed THERESA GOLDRING exit
the vehicle and wait in front of the location. Minutes later,
KENNETH KUTIN arrived at the location in a black Honda, bearing
New York registration KMK 7 (the "Kutin Vehicle"), met THERESA
GOLDRING and entered the house. Thereafter, THERESA GOLDRING
exited the house carrying a plastic shopping bag, which she
placed into the vehicle.   I believe that THERESA GOLDRING was

picking up Quaaludes from KENNETH KUTIN.

               q.   On or about November 19, 2009, at
approximately 2:10 p.m., law enforcement agents intercepted a
call over the Goldring Cell Phone between THERESA GOLDRING and
BARRY GOLDRING at the Goldring2 Cell Phone. During this call,
BARRY GOLDRING stated, "Hi, if I could get Ken on the phone,
could you pass by him and get one for me?" THERESA GOLDRING
stated, "Yeah, I guess so." I believe this conversation
indicates that BARRY GOLDRING wanted THERESA GOLDRING to obtain
"one," meaning 1,000 Quaaludes, from KENNETH KUTIN.

                r.   On or about November 19, 2009, at
approximately 2:11 p.m., law enforcement agents intercepted a
voicemail over the Goldring2 Cell Phone from BARRY GOLDRING to
KENNETH KUTIN at a phone number ending in digits 3920 with a
unique extension,l3 wherein the following message was left: "I
was wondering if T could pass by today, right after work for a
one-ski urn, give me a call.  I'm home; you can call me home or
cell, okay? Thanks, kid bye."    I believe this message indicates
that BARRY GOLDRING wanted THERESA GOLDRING to pick up 1,000
Quaaludes ("one-ski") from KENNETH KUTIN.

               s.    On or about November 19, 2009, at
approximately 3:24 p.m., law enforcement agents intercepted a
call over the Goldring2 Cell Phone between BARRY GOLDRING and
KENNETH KUTIN, at a phone number ending in digits 1154 (the
"Kutin Cell Phone") .'4 During this call, KUTIN stated, "What's
the matter?" BARRY GOLDRING responded, "Well, Terry was gonna
come by, but it's too late now, unfortunately." KUTIN said,
"Terry, Oh. Oh you mean for, oh." GOLDRING said, "Yeah, yeah,
yeah, yeah." KUTIN said, "You gotta call me in advance kid."
GOLDRING said, "Well, ya know it was a last minute thing." KUTIN
said, "Yeah, but so what do ya wanna do about this thing?"
GOLDRING said, "Do you think urn, tomorrow after work, she could


     13   On or about November 9, 2009, at approximately 9:28 a.m.,
law enforcement officers intercepted a voicemail message over the
Goldring2 Cell Phone from BARRY GOLDRING to KENNETH KUTIN at a
phone number ending in digits 3920. During this message, the call
was answered as follows:     "You have reached Ken Kutin, Youth
Development Coordinator.  Please leave your message when you hear
the tone, thank you."    Based on this call, I believe the 3920
number belongs to KENNETH KUTIN.

     14     AT&T records reflect that the cellular telephone
assigned number ending in digits 1154 is listed to "Kenneth Kutin,"
with an address in Little Neck, New York.

uh see you?" KUTIN said, "Of course." GOLDRING said,
"Beautiful. Only a one-ski." I believe this conversation
indicates that BARRY GOLDRING wanted to obtain "one-ski," meaning
1,000 Quaaludes, from KUTIN, and that THERESA GOLDRING would meet
with KUTIN the following day, November 20, 2009, to execute the
transaction.

               t.   On November 20, 2009, at approximately 2:56
p.m., law enforcement agents intercepted a text message to
THERESA GOLDRING from BARRY GOLDRING over the Goldring2 cell
Phone, which read "Me too I'm torn u r stopping after school
right?" The Goldring Cell Phone (THERESA GOLDRING) replied "Y up
dous r u home." The Goldring Cell Phone (THERESA GOLDRING) then
sent an additional text message, which read "Yeah, im stopin dos
rite R u home?" The Goldring2 Cell Phone (BARRY GOLDRING) replied
"Wat does dos right mean?" The Goldring Cell Phone (THERESA
GOLDRING) responded "Two rite." The Goldring Cell Phone (THERESA
GOLDRING) then sent an additional text "Get 2 from Ken?" The
Goldring2 Cell Phone (BARRY GOLDRING) replied "Now I get u yeah
2." Law enforcement agents believe this text message exchange
indicates that THERESA GOLDRING was planning to pick up 2,000
Quaaludes from KENNETH KUTIN.

               u.   On or about November 20, 2009, another law
enforcement agent conducted surveillance of the Goldring
Residence. At approximately 4:19 p.m., the agent observed
Individual-10 pull into GOLDRING's driveway in the Siegman
Vehicle. The agent further observed THERESA GOLDRING exit the
vehicle and remove a large shopping bag from the trunk and then
enter her house.

               v.   On or about December 31, 2009, at
approximately 11:50 a.m., law enforcement agents intercepted a
call over the Goldring Cell Phone between BARRY GOLDRING and
KENNETH KUTIN at the Kutin Cell Phone. During the call, BARRY
GOLDRING stated, "if you don't mind, bring that two with you?"
KUTIN replied, "there's one problem.     . in one of the two
I've got two that, that I'm, I'm getting rid of on Saturday, is
that alright?" BARRY GOLDRING responded, "of course that's
alright. What are you kidding?" KUTIN stated, "So, then I'll
just owe you, you know the extra, the three and whatever." I
believe this conversation indicates that BARRY GOLDRING wanted to
obtain Quaaludes from KUTIN.

               w.   On or about January 14, 2010, at
approximately 7:37 a.m., law enforcement agents intercepted a
call over the Goldring Home Phone between BARRY GOLDRING and
BRUCE SIEGMAN, in which SIEGMAN asked if they could "do it now,"
instead of later in the day, "because I wanted to like try and

sell those diamonds this morning." I believe this call indicates
that SIEGMAN resells Quaaludes he buys from BARRY GOLDRING.

               x.   On or about January 14, 2010, at
approximately 8:27 a.m., law enforcement agents intercepted a
call over the Vanderborg Cell Phone between MARK VANDERBORG and
HOWARD ARONSON. ARONSON stated, "I heard from the trainers."
VANDERBORG asked, "and how many people are coming?" ARONSON
responded that they need "for the party 165." I believe this
conversation indicates that ARONSON was placing an order for 165
pills.

               y.   On or about January 15, 2010, at
approximately 8:33 a.m., law enforcement agents intercepted a
call over the Vanderborg Home Phone between MARK VANDERBORG and
HOWARD ARONSON. During this conversation, ARONSON told
VANDERBORG "twenty and fifteen people are coming, thirty five
total." VANDERBORG replied, "Alright, call me when you're
leaving the coffee shop." I believe this conversation indicates
that ARONSON was placing an order for 35 Quaaludes packaged
separately into groups of 20 and 15.

               z.   On February 19, 2010, at approximately 11:51
a.m., law enforcement agents intercepted a call over the
Goldring2 Cell Phone between BARRY GOLDRING and BRUCE SIEGMAN at
the Siegman Phone. During this call, BARRY GOLDRING stated, "You
took thirty and you gave me for twenty," and BRUCE SIEGMAN
responded, "Right and I'm gonna sell these and give you the money
tomorrow."   BARRY GOLDRING later stated, "well we shouldn't be
doing this on the phone anyway, so we'll talk tomorrow." I
believe this call indicates that SIEGMAN took 30 Quaaludes from
BARRY GOLDRING but only paid BARRY GOLDRING for 20 Quaaludes, and
that SIEGMAN planned to sell the 30 he had taken to payoff the
balance he owed to BARRY GOLDRING.

               aa. On or about February 22, 2010, at
approximately 2:01 p.m., law enforcement officers intercepted a
call over the Vanderborg Home Phone between MARK VANDERBORG and
MICHAEL SILVERMAN on the Silverman Cell Phone.  SILVERMAN stated,
"I'm having some people over so I'm probably gonna need, I'm
gonna probably go shopping for nine shirts." VANDERBORG stated,
"You got it." I believe that SILVERMAN is asking VANDERBORG for
900 Quaaludes.

               bb.  On or about March 7, 2010, at approximately
4:44 p.m., law enforcement agents intercepted a call over the
Vanderborg Home Phone between MARK VANDERBORG and LEONARD
ROSENFELD at a phone number ending in the digits 8088 (the

"Rosenfeld Phone") .'5 ROSENFELD stated, "Make it a C-note.   She
just landed.   I'll see her tomorrow so I'll give you a little
more gelt.      . I need as much as I can dog." VANDERBORG
responded affirmatively.   I believe this call indicates that
ROSENFELD is ordering 1,000 Quaaludes on behalf of one of his
customers.

               cc. On or about March 19, 2010, at approximately
1:28 p.m., law enforcement agents intercepted a call over the
Vanderborg Cell Phone between MARK VANDERBORG and LEONARD
ROSENFELD at the Rosenfeld Phone. ROSENFELD stated "the doctor
wants to come out tomorrow, you around today?"   VANDERBORG
responded affirmatively and ROSENFELD stated, "Call me when
you're home, he wants to bring twelve people with him." I
believe that during this call, ROSENFELD is placing an order for
12 Quaaludes for a customer.

               dd. On or about March 23, 2010, at approximately
8:31 p.m., law enforcement agents intercepted a call over the
Vanderborg Cell Phone between MARK VANDERBORG and GARY BRUSTEIN
at a phone number ending in the digits 0650. '6 During this
conversation, VANDERBORG and BRUSTEIN agreed to meet the
following day for "one." I believe that VANDERBORG and BRUSTEIN
are meeting for an order of 100 Quaaludes.

               ee. On or about March 24, 2010, at approximately
7:41 a.m., law enforcement agents observed MARK VANDERBORG leave
the Vanderborg Residence in the Vanderborg Vehicle and arrive at
the Brustein Residence.

          12. Surveillance over the wiretaps, coupled with
visual surveillance and other investigative techniques, has
revealed the following about MICHAEL SILVERMAN, EDWARD RUBIN,
MELANIE TAXIN, MITCHELL TEPPER, RALPH MARAZZO, NINA MARAZZO, and
RONALD VESSIA, the defendants:


     15   verizon Wireless records reflect that telephone number
ending in the digits 8088 is listed to "Leonard Rosenfeld," with an
address in Plainview, New York.

     16   On or about August 30,2009, at approximately 2:31 p.m.,
law enforcement agents intercepted a voice mail message over the
Vanderborg Cell Phone to MARK VANDERBORG from GARY BRUSTEIN at a
call number ending in the digits 0650.        During this message,
BRUSTEIN stated "Mark, it's Gary.      . call me back at either .
. 0-6-5-0 or.     . 7-6-0-0.  A check with verizon disclosed that
number ending in the digits 7600 is listed to Champion Motors, with
an address in Jericho, New York.

               a.   On or about August 29, 2008, and on or about
September 12, 2008, a confidential information (the "CI")'7
purchased pills from RALPH MARAZZO in a controlled buy.    During
the controlled buys, the CI was wearing a concealed audio
recording device and law enforcement officers conducted visual
surveillance. Laboratory tests later confirmed that the pills
the CI purchased on these two occasions were Quaaludes.   On each
occasion, the CI bought five pills for $35 per pill.

                b.  On or about March 5, 2009, at approximately
3:19 p.m., law enforcement agents intercepted a call over the
6350 Phone between RALPH MARAZZO and another individual
 ("Individual-3"). During this conversation, Individual-3 stated
that he owed money to RALPH MARAZZO. Also, Individual-3 told
RALPH MARAZZO, "I would buy four from you but what is four gonna
do for me, nothing and that's another hundred and forty dollars."
I believe this call indicates that Individual-3 is purchasing
four Quaaludes from RALPH MARAZZO, because RALPH MARAZZO had
previously sold Quaaludes for $35 per pill to the CI, and
Individual-3's offer to pay $140 for four pills is consistent
with that price.

               c.   On or about March 9, 2009, at approximately
2:22 p.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and Individual-3. During this
conversation, Individual-3 asked RALPH MARAZZO, "You have
anything left, or no? ..  Like 7 or so?" RALPH MARAZZO replied
"yeah, yeah .      How many do I have left here? I'm seeing him
tomorrow so whatever you can give me, give me.    . What time are
you coming by?" Individual-3 replied "I'll call you in a little
while". At approximately 2:55 p.m., law enforcement officers
intercepted a call over the 6350 Phone between RALPH MARAZZO and
Individual-3. During this conversation, Individual-3 told RALPH
MARAZZO that he went to the bank and was on his way to RALPH
MARAZZO's house. RALPH MARAZZO replied "Okay, you coming by?
I'll walk right out 1, 2, 3, 4, 5, 6, 7. Okay.     . Just blow
the horn." I believe these calls indicate that Individual-3
bought seven Quaaludes from RALPH MARAZZO.

               d.   On or about March 9, 2009, at approximately
3:05 p.m., a law enforcement officer was conducting surveillance
in the vicinity of the Marazzo Residence when he observed a grey
Bentley vehicle (the "Individual-3 Vehicle"), arrive at the

Marazzo Residence. RALPH MARAZZO left his residence and got into
the grey Bentley. Shortly thereafter, RALPH MARAZZO exited the
vehicle with a small item in his hand and re-entered his
residence. DMV records reveal that the grey Bentley automobile
is registered to Individual-3, with an address in Woodbury, New
York (the "Individual-3 Residence").

               e.   On or about March 15, 2009, at approximately
11:01 a.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and Individual-3. During this
conversation, Individual-3 stated, "I wanted 5 more.    . I want
to give you money, but I can't drive now.    . we did 4 each this
morning." RALPH MARAZZO replied "well you sound it .      what do
you give me for the 57.    . Give me 175." I believe this
conversation indicates that RALPH MARAZZO previously gave pills
to Individual-3, and that the price of the pills ($175 for 5
pills) was consistent with the prices RALPH MARAZZO had
previously charged the CI for Quaaludes.

               f.   On or about March 15, 2009, at approximately
11:20 a.m., law enforcement agents observed RALPH MARAZZO leave
his residence driving the Marazzo Vehicle. An officer followed
RALPH MARAZZO to the Individual-3 Residence.

               g.   On or about April 3, 2009, at approximately
3:47 p.m., law enforcement agents intercepted a call over the
6350 Phone between Ralph Marazzo and Individual-3. During this
conversation, Individual-3 said he wanted to buy "22." RALPH
MARAZZO said "I will put them inside an envelope between the two
doors [i.e., of RALPH MARAZZO's residence]. We'll straighten out
[at a later date]."

               h.   On or about April 3, 2009, at approximately
4:00 p.m., law enforcement officers observed Individual-3 go to
the Marazzo Residence and retrieve a white envelope from the
front door area of the residence.

               i.   On or about April 14, 2009, at approximately,
10:55 a.m., law enforcement officers conducted surveillance in a
parking lot at Douglaston Plaza, in Queens, New York. At
approximately 10:48 a.m., RALPH MARAZZO arrived in the Marazzo
Vehicle. MICHAEL SILVERMAN arrived at the Douglaston Plaza in
the Silverman Vehicle, and removed a large envelope from the
vehicle and then entered the passenger side of the Marazzo
Vehicle. Approximately five minutes later, SILVERMAN exited the
Marazzo Vehicle without the large envelope, entered the Silverman
Vehicle, and drove away.

               j.   On or about April 15, 2009, at approximately

4:42 p.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and Individual-3. During this
call, Individual-3 asked, "Do you have ten for me?" RALPH
MARAZZO responded, "I'll give you whatever you want      . I got
you know, I filled up." Individual-3 stated "Okay, so do you
want to put them at the door and I'll take care of you later?"
RALPH MARAZZO stated, "Yeah. How many do you want?" Individual-
3 stated "Ten, that's it." I believe this call indicates that
RALPH MARAZZO "filled up" his Quaaludes supply at his meeting
with MICHAEL SILVERMAN on or about April 14, 2009, described
above.

                 k.   On April 18, 2009, at approximately 11:54
a.m. , law enforcement officers intercepted a call over the 6350
Phone between RALPH MARAZZO and another individual ("Individual-
4 n) . During this conversation, Individual-4 asked to borrow
money from RALPH MARAZZO. RALPH MARAZZO replied "I have no money
       I'm not going to have any money until May 15 th •     •  I'm
getting some money from a big customer.       . I have no money
 . You know what I told you about things I used to do? It's
finished, it's over, I told Nina today, 'what we do, we have a
little habit of doing something, if you can read between the
lines, we have a habit, it's got to stop.'     I said 'it's got to
stop because I have nobody left.'    I used to make a lot of money.
Now, I'm doing it to break even and get my own enjoyment out of
things.       . Last week I gave the guy $13,800 that's what I had
collected from inventory - $13,800 I made for myself, and this is
the truth, you're gonna yell at me when I tell you.       I make for
myself $250 on $13,800 because Nina and I enjoy these things.         So
I take one hundred and fifty [150] for Nina and I.       If I sold it,
if I did none and I sold the one fifty [150] I would make myself
about, at the cheapest thirty five [i.e., $35 per pill], I'd make
myself about.       . instead of $250 would have been thirty five
and seventeen, fifty two, about $5,500.       . I would have made
$5,500 eventually when they were all gone.     Instead of making
$5,500 I made $250. And I told her today.         . because what
happened today is my neighbor who is my good friend.           . is very
wealthy.     . two Bentleys, Mercedes.     . he was giving me
almost $3,500 a week in business.    My profit on $3,500 was
$1,100.   So far this week he gave me, he owes me $500 .           From
3,500 it dropped to 500, he owes it to me.     There's a rich girl I
know who works for Donald Trump.      . she owes me $11,500 and
$2,850 on the side that she can't pay me. And these are rich
people.     . rich beyond rich and they have no money.          .and she
works for Donald Trump.      . They owe me but I can't tell them to
go fuck themselves because she owes me $11,500 plus $2,850 which
she promised me Friday, but she blew me off.        . I have no money
        " I believe this conversation indicates that RALPH
MARAZZO buys Quaaludes from MICHAEL SILVERMAN, to whom RALPH

MARAZZO paid $13,800 the prior week for a lot of Quaaludes, and
that RALPH MARAZZO then sells the Quaaludes, but because he keeps
150 from a given lot for personal use, only makes a profit of
$250 on the lot.

               1.   On or about April 20, 2009, at approximately
4:53 p.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and Individual-3. During this
conversation, RALPH MARAZZO stated "we're a little buzzed, so
talk to me." Individual-3 said, "If I had a dime in my pocket,
I'd say Ralph I'll, I'll be by to get a couple of ludes from you,
I don't have nothing." I believe this conversation further
establishes that the items Individual-3 purchased from RALPH
MARAZZO are Quaaludes.

                 m.   On or about April 21, 2009, at approximately
4:15 p.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and another individual
 ("Individual-5") During this conversation, among other things,
RALPH MARAZZO said: "I lost [Individual-3]         . he lost his
business.      . I was making $3,500 a week with him . . so far,
today's Tuesday, I made $560.       . that's $3,000 less I took in,
which means I can't buy one, so my business is over.        . The
girl she just fucked me out of another $2,800, she gave me some
story.     . I told Nina, 'the minute you walk into this house we
are eating because I don't' want to do those things.        . I
bought last week from the guy, you know who I'm talking about and
I put 250 away and I got 150 free, for me.       . but I'm gonna
have to cut out taking them and start making some money          .But
even though I had 250, since last Tuesday I sold 10, 6, 1, I sold
17, on 250.      . I only have three people. Who wants it? The
girl, she has no money.    [Individual-3] stopped totally.       . he
took 10 and 6 and 1, 17 out of 250.       . What am I gonna do with
them? They're worth nothing." I believe this conversation
indicates that RALPH MARAZZO has three Quaaludes customers, but
that since Individual-3 stopped buying Quaaludes, the business is
suffering.

               n.   On or about April 23, 2009, at approximately
11:42 a.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and Individual-3. During this
conversation, among other things, Individual-3 stated, "ludes
don't show up in the test right?" RALPH MARAZZO replied
"absolutely not." I believe this conversation indicates that
Individual-3 had ingested Quaaludes and was concerned about an
upcoming drug test.

               o.   On or about May 6; 2009, at approximately
2:47 p.m., law enforcement officers intercepted a call over the

6350 Phone between RALPH MARAZZO and Individual-3. During this
conversation, Individual-3 said "I need eight more from you."
RALPH MARAZZO replied "I can't drive." Individual-3 responded
"I'll come by in five minutes.    . I'm gonna give you two [i.e.,
likely $200]." RALPH MARAZZO stated "you owe me three eighty
. Nina'S probably gonna come down, I can't walk around." I
believe RALPH MARAZZO means that NINA MARAZZO would deliver
Quaaludes to Individual-3.

               p.    On or about May 10, 2009, at approximately
7:16 p.m., a text message was intercepted over the 6350 Phone to
RALPH MARAZZO from MICHAEL SILVERMAN at the Silverman Cell Phone,
which read:  "Tues better 500? Same price 4 now." I believe this
text message indicates that SILVERMAN preferred to meet MARAZZO
on Tuesday and confirmed the sale of 500 Quaaludes. RALPH
MARAZZO replied via text message, "yes ty."

                q.   On or about May 12, 2009, at approximately
11:06 a.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and Individual-5. During this
conversation, RALPH MARAZZO told Individual-5, "all that extra
money that I was making from those things, it was easier than
lending people money.      . yesterday I bought, 500, yesterday.  I
needed them like a hole in the head       . I did it because I
didn't want to lose the guy.      . I spoke to him yesterday, I
said 'it looks like it's gonna be a once a month thing, that's
it.' Used to be once a week, looks like it's gonna be once a
month.     . I only have two people, with two people it will take
me fuckin' six months." I believe this call indicates that
MARAzzo did, in fact, purchase 500 Quaaludes from MICHAEL
SILVERMAN because he did not want to "lose" SILVERMAN as a
supplier, but that RALPH MARAZZO was concerned about his ability
to sell the Quaaludes because he only had two customers.

               r.   On or about May 19, 2009, at approximately
3:31 p.m., law enforcement officers intercepted a call over the
6350 Phone between NINA MARAZZO and Individual-3.  Individual-3
asked NINA MARAZZO to "tell him to call me when he is free."
NINA MARAZZO responded, "Oh, okay ah he said you could tell me."
Individual-3 said "Seven." NINA MARAZZO replied, "Okay, oh,
could you come by?" NINA MARAZZO further said that Individual-3
should come by at "seven" and that she would "stick it
downstairs." I believe this conversation establishes that NINA
MARAZZO planned to give Individual-3 Quaaludes at the Marazzo
Residence.

               s.   On or about May 29, 2009, at approximately
2:18 p.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and Individual-3. During this

conversation, RALPH MARAZZO said, "At one time I was, you know,
taking five, eight hundred a week.  Now I'm doing, ahh, every
three weeks, so from three weeks ago I took 500 and I probably
still have 100 left. And urn, and uh I don't give a fuck either
way.  I truly don't care anymore, I just don't care.  If it ends,
it ends, if it doesn't it doesn't." I believe this conversation
indicates that until recently, RALPH MARAZZO purchased 500 to 800
Quaaludes per week.

               t.   On or about May 31, 2009, law enforcement
officers conducted surveillance at the Silverman Residence. At
approximately 12:18 p.m., an officer saw MICHAEL SILVERMAN
talking on his cellular telephone, while leaving the pool area of
the building, and head towards the front of the residence.
Minutes later, MITCHELL TEPPER walked toward the Silverman
Residence talking on a cellular telephone. At approximately
12:23 p.m., TEPPER and SILVERMAN met at the front and SILVERMAN
placed his hand into a bag he was carrying and walked beside
TEPPER. TEPPER then left the area and walked past the officer,
who observed that TEPPER's pants' pockets were bulging. Minutes
later, the officer saw TEPPER at the bus stop at Bell Boulevard
and 18th Avenue, where TEPPER removed a number of bottles from
his pants pocket that appeared to the officer to be similar to
prescription pill bottles.

                 u.   On or about June 1, 2009, at approximately
9:24 a.m., law enforcement officers intercepted a call over the
Silverman Cell Phone between MICHAEL SILVERMAN and MITCHELL
TEPPER at a phone number ending in digits 9293 (the "Tepper
Phone") . 18 TEPPER said," I have your cash in my pocket.   I need a
few more hundred.    I have that money.     . Let's do it right
after work." I believe this conversation means that TEPPER
planned to purchase Quaaludes from SILVERMAN.

               v.   On or about June 1, 2009, at approximately
1:31 p.m., law enforcement officers intercepted a call between
MICHAEL SILVERMAN and MITCHELL TEPPER on the Tepper Phone.
During this conversation, they discussed meeting that evening at
approximately 7:00 p.m. TEPPER stated, "just get a hundred
together, 'cause one of the guys only gave me half the money, so
I said 'fuck you, you got everything is prepaid from now on I am
not going to deal with the shit.' The girl gave me half, I don't
even want to tell you she gave me half.    .," "You I have the
money I owe you.  I have 2,300." SILVERMAN then stated that some

"other guy called me up," and TEPPER stated, "That's not for
Jason," and "[i]t can't be for [another individual ("Individual-
6")]." SILVERMAN replied, "It can't be for the people on the
Island but whatever, I could not match the price. But wanted to
tell you just between me and you I think the guy only charges
twenty four, so I don't know." TEPPER said, "Even if it's twenty
four, if that's the price, so you still make two hundred, fuck
that." I believe this conversation indicates that one of
TEPPER's Quaaludes customers only paid TEPPER "half" of what the
customer owed TEPPER for the Quaaludes, and that SILVERMAN and
TEPPER were discussing the prices others charge for Quaaludes.

               w.   On or about June 1, 2009, at approximately
2:51 p.m., law enforcement officers intercepted a call over the
6350 Phone between RALPH MARAZZO and another individual
("Individual-7"). During this conversation, RALPH MARAZZO stated
"Nina and I overdo i t .  . Honestly, with tomorrow's purchase
Nina and I are going to make $50 and 70 free.  Now, if I was
smart, I would do none and sell those 70, but we like them so
that's the way it is." I believe this conversation indicates
that NINA MARAZZO assists RALPH MARAZZO in selling Quaaludes,
that they jointly make money from this business, and that they
also use Quaaludes.

               x.   On or about June 7, 2009, at approximately
4:26 p.m., law enforcement officers intercepted a call over the
Silverman Cell Phone between MICHAEL SILVERMAN and MITCHELL
TEPPER at the Tepper Phone. On this call, TEPPER stated that he
was "selling a lot of shoes.    . 150," that TEPPER was "meeting
her at 8:15," and that "she told me she has the green, it's in
her pocket, waiting for me in an envelope." I believe this call
indicates that TEPPER is selling approximately 150 Quaaludes, and
that he was planning to meet with one of his customers later that
evening.

               y.   On or about June 12, 2009, at approximately
8:24 a.m., law enforcement agents intercepted a call over the
Silverman Cell Phone between MICHAEL SILVERMAN and EDWARD RUBIN
at a number ending in the digits 1957 (the "Rubin Phone") .19
During this conversation, RUBIN said he would arrive at the
Silverman Residence around 9:00 a.m. and added "I want to buy a
40,000 square foot lot.    . the one around the corner, a 20 .
. and the one next to it, a 10, no a 12.    . and the final small
lot on the corner 6." SILVERMAN replied "okay."    I believe this

call indicates that RUBIN wanted to buy Quaaludes from SILVERMAN
packaged in lots of 40, 20, and 12 pills.

               z.   On or about June 12, 2009, at approximately
8:56 a.m., law enforcement agents intercepted a call over the
Silverman Cell Phone between MICHAEL SILVERMAN and MELANIE TAXIN
at a number ending in digits 8187 (the "Taxin Phone") .20 During
this conversation, SILVERMAN asked, "what are you meeting me
for?" Taxin replied, "I'm meeting you to buy stuff." SILVERMAN
then asked, "what do you want?" TAXIN responded "I guess I want,
uhh, I don't know.  I guess he wants, I have to call [another
individual ("Individual-8")]      . probably 35, but if it's
changed I'll call you back." I believe this call indicates that
TAXIN purchases Quaaludes from SILVERMAN to sell to other
individuals.

                 aa. On or about June 12, 2009, another law
enforcement agent conducted surveillance at the Silverman
Residence. At approximately 9:20 a.m.,the agent observed EDWARD
RUBIN arrive at this location in a 2004 Mercedes Benz (the "Rubin
Vehicle") ,21 and park. Moments later, MICHAEL SILVERMAN
approached the Rubin Vehicle and leaned into the passenger side
window. Thereafter, RUBIN drove away. The agent followed RUBIN,
who eventually pulled over on the side of a road. Two other
individuals exited separate vehicles ("Vehicle-I" and "Vehicle-
2"), and approached the Rubin Vehicle. The two individuals
leaned into the passenger side window. Moments later, RUBIN
pulled away and drove back towards the Silverman Residence.

                  bb. On or about June 12, 2009, a law enforcement
agent conducted surveillance at a spa, at an address in Great
Neck, New York. At approximately 11:18 a.m., the agent observed
MICHAEL SILVERMAN and another individual ("Individual-9") arrive
in the Silverman Vehicle. Minutes later, the agent saw MELANIE
TAXIN arrive at this location in a 2008 Mercedes Benz (the "Taxin
Vehicle") . 22 SILVERMAN exited his vehicle and entered TAXIN's
car. Minutes later, Individual-9 approached TAXIN's car and
spoke to SILVERMAN and TAXIN.    Thereafter, TAXIN drove away and

SILVERMAN and Individual-9 entered the spa.

                cc. On or about July 1, 2009, at approximately
8:38 a.m., law enforcement agents intercepted a call over the
Silverman Cell Phone between MICHAEL SILVERMAN and EDWARD RUBIN
at the Rubin Phone. During this conversation, RUBIN stated "I
like the lot on the corner, the 24,000.     . the one behind it,
21,000.     . and the 20,000." SILVERMAN replied "three lots?"
RUBIN responded "Yeah." RUBIN and SILVERMAN then agreed to meet
near Silverman's residence twenty to thirty minutes later.   I
believe this conversation indicates that RUBIN planned to buy
Quaaludes from SILVERMAN packaged in lots of 24, 21, and 20.

               dd. On or about July 1, 2009, law enforcement
agents conducted surveillance in Bayside, New York. At
approximately 9:05 a.m., a law enforcement officer observed
EDWARD RUBIN, who was driving the Rubin Vehicle, meet with an
unidentified male, in the vicinity of Water's Edge Drive and 15th
Road in Bayside, New York, who was driving the Powell Vehicle.
The unidentified male exited the Vehicle-1 and entered the Rubin
Vehicle. At approximately 9:09 a.m., a law enforcement agent
observed RUBIN and the unidentified male arrive in the Rubin
Vehicle at the Silverman Residence. An officer observed MICHAEL
SILVERMAN approach the Rubin Vehicle and hand something to RUBIN.
Thereafter, RUBIN drove back to the Vehicle-I, dropped him off
and then departed the area.

               ee. On or about July 6, 2009, at approximately
3:16 p.m., law enforcement agents intercepted a call over the
Silverman Cell Phone between MICHAEL SILVERMAN and MELANIE TAXIN
at the Taxin Phone. TAXIN said, "that guy that came to give me
money for you.    . ten dollars.    . he said 'So now you gotta
get them for me tomorrow,' I said 'I can't.'  He said 'maybe he
has five, he could stop on the way.     ' I said 'listen, I'm not
driving to Bayside.   .' but if you have like ten maybe you could
stop on the way." SILVERMAN replied "I don't have any." I
believe this call indicates that TAXIN purchases Quaaludes from
SILVERMAN to resell to others.

               ff.  On or about July 6, 2009, at approximately
12:04 p.m., law enforcement agents intercepted a call over the
Silverman Cell Pone between MICHAEL SILVERMAN and MELANIE TAXIN
on the Taxin Phone, wherein the following conversation ensued:

          TAXIN:         Well, so you wanna give me 50 today?

          SILVERMAN:     No, I have to go back upstairs, you
                         always have friends that want right?

          TAXIN:         Yeah, I'm back and forth for them.

          SILVERMAN:     Right, so if you take a hundred, unless
                         you get in trouble.

          TAXIN:         Don't think I don't make money on them
                         either, I do.

          SILVERMAN:     Oh good. You should, they all charge,
                         whatever.

          TAXIN:         I make two dollars, I'm trying to raise
                         the. This is ridiculous.

          SILVERMAN:     I'm just saying, charge them 35 a pop.

          TAXIN:         That's what I'm gonna do.

          SILVERMAN:     You know if they fuckin' want you to do
                         all this running.

          TAXIN:         Yeah, back and forth, back and forth.
                         It's crazy.

I believe this conversation indicates that TAXIN purchases
Quaaludes from SILVERMAN and sells them to others, making a $2
profit per pill.

               gg. On or about July 4, 2009, at approximately
7:30 p.m., law enforcement agents intercepted a call over the
Marazzo Home Phone between RALPH MARAZZO and Individual-3.
During this conversation, Individual-3 advised RALPH MARAZZO, "we
want one each before dinner." RALPH MARAZZO told Individual-3 he
would have to pick it up from the Marazzo Residence "between the
doors." At approximately 7:37 p.m., law enforcement agents
intercepted a call over the Marazzo Home Phone between RALPH
MARAZZO and Individual-3. During this conversation, RALPH
MARAZZO told Individual-3, "I'm gonna have Nina put them between
the doors."  I believe this conversation indicates that RALPH
MARAZZO was planning to ask NINA MARAZZO to put Quaaludes
"between the doors" for Individual-3 to pick up.

               hh. On or about July 10, 2009, a law enforcement
officer conducted surveillance in the vicinity of the Silverman
Residence. At approximately 10:30 a.m., the officer observed
MICHAEL SILVERMAN exit the rear door of his building carrying an
envelope. At approximately 10:33 a.m., another officer saw
MITCHELL TEPPER arrive in the area driving a black Chrysler

automobile (the "Tepper Vehicle") . 23 The officer observed
SILVERMAN hand the envelope to TEPPER through the passenger side
window of TEPPER's car. Law enforcement officers then followed
TEPPER to a parking lot on the corner of Glen Cove Road and North
Service Road in East Hills, New York. At that location, at
approximately 11:07 a.m., an officer observed TEPPER enter the
passenger seat of a black BMW SUV, which was driven by an
unidentified white female believed to be Individual-6, for the
reasons set forth in this paragraph, below. At approximately
11:15 a.m., TEPPER exited the vehicle, entered his car and drove
away. An officer followed the unidentified female to an address
in Old Westbury, New York (the "Old Westbury Address"). DMV
records reflect that the black BMW is registered to Hercules
Corporation, with an address in Hicksville, New York, and that
Individual-6 resides at the Old Westbury Address. As described
above, during a calIon or about June 1, 2009, at approximately
1:31 p.m., TEPPER references Individual-6 during a discussion of
Quaaludes prices.

               ii. On or about July 17, 2009, at approximately
9:22 a.m., law enforcement officers intercepted a call over the
Silverman Cell Phone between MICHAEL SILVERMAN and MITCHELL
TEPPER on the Tepper Phone. SILVERMAN stated that he "should be
by you" and asked whether he should "bring two." TEPPER stated
"Yes, I have twenty, I have more than that," and SILVERMAN
replied, "throw it in hers." SILVERMAN also asked, "so you're
going to give it to her, so you're not going to come back here
this morning?" TEPPER replied, "no, not this morning." I
believe this conversation indicates that TEPPER was picking up
Quaaludes from SILVERMAN which he planned to sell to a woman.
Following the sale, TEPPER was going to drop money-off with
SILVERMAN.

               JJ.  On or about July 17, 2009, a law enforcement
officer conducted surveillance at the rear entrance to the
Silverman Residence. At approximately 10:35 a.m., he observed
MITCHELL TEPPER arrive in the Tepper Vehicle. Moments later,
MICHAEL SILVERMAN entered the passenger side of the Tepper
Vehicle. At approximately 10:37 a.m., TEPPER drove away.

               kk. On or about July 26, 2009, at approximately
12:07 p.m., a text message was intercepted over the Silverman
Cell Phone to MICHAEL SILVERMAN from the RONALD VESSIA at the
Vessia Cell Phone, which read "Need 200 tomorrow around 2."
SILVERMAN replied, "If this is r cust[omer] keep it cool."


     23   DMV records reflect that the Chrysler is registered to
"Mitchell D. Tepper," with an address in Whitestone, New York.

               11.   On or about July 27, 2009, the following took
place:

                    i.    At approximately 11:48 a.m., law
enforcement officers intercepted a call over the Silverman Cell
Phone between MICHAEL SILVERMAN and RONALD VESSIA at the Vessia
Cell Phone. SILVERMAN and VESSIA discussed meeting at 2:30 p.m.
VESSIA also stated "I have to meet this guy at four o'clock." I
believe that this call indicates that VESSIA had to meet a
Quaaludes customer at 4:00 p.m., and wanted to meet with
SILVERMAN before that meeting to purchase Quaaludes.

                    ii.  On or about July 27, 2009, at
approximately 2:13 p.m., law enforcement officers intercepted a
call over the Silverman Cell Phone between MICHAEL SILVERMAN and
RONALD VESSIA at the vessia Cell Phone. SILVERMAN and VESSIA
agreed to meet between 3:00 p.m. and 3:15 p.m.

                    iii. At approximately 2:53 p.m., law
enforcement officers intercepted a call over the Silverman Cell
Phone between MICHAEL SILVERMAN and RONALD VESSIA at the Vessia
Cell Phone. During this conversation, VESSIA asked, "can you put
fifty in a separate bag?" SILVERMAN replied "give you one and a
half and fifty?" VESSIA responded, "yeah."

                      iv. Law enforcement officers conducted
surveillance in the vicinity of an address in Bayside, New York.
At approximately 3:00 p.m., an officer observed RONALD VESSIA
arrive at that location driving a 2008 Ford Automobile (the
"Vessia Vehicle") ,24 and meet with an unidentified female who was
driving a black Mercedes Benz. An officer saw VESSIA counting
money. Minutes later, the officer saw MICHAEL SILVERMAN arrive,
park behind VESSIA's vehicle; and exit his car. The officer saw
SILVERMAN approach the driver's side window of VESSIA's car and
reach inside.

                    v.    Officers followed VESSIA to 208th Street
and 48th Avenue where he entered a residence. Approximately ten
minutes later, at approximately 3:30 p.m. VESSIA exited the
residence with a bag, entered his the Vessia Vehicle, and drove
to the Douglaston Car Wash on Northern Boulevard where he met
with another individual ("Individual-11").   Individual-11 was
driving a black Mercedes Benz.   Following their meeting,
Individual-11 drove away.

to "Ronald G. Vessia," with an address in Bayside, New York.

                    vi.  On or about July 27, 2009, after meeting
with VESSIA, law enforcement officers followed Individual-11 back
to Nassau County and stopped him. At that time, Individual-11
possessed approximately 584 pills, which lab test confirmed were
Quaaludes. After being read his Miranda rights, Individual-11
stated, in sum and substance, and in part, that the pills he had
were Quaaludes, that he had purchased the pills from an
individual he knew as "Ron," that he had purchased 550 pills for
$10,000, that he had met "Ron" at the funeral of the last
individual he used to purchase Quaaludes, and that he picks up
the lots of pills for a friend of his and keeps 50 pills for
personal use.

               mm.   On or about August 6, 2009, the following
took place:

                    i.   SILVERMAN and TEPPER exchanged a series
of calls and text messages about meeting.   For example, at
approximately 4:26 p.m., law enforcement officers intercepted a
call over the Silverman Cell Phone between MICHAEL SILVERMAN and
MITCHELL TEPPER during which SILVERMAN asked "did you see the
second guy?" TEPPER responded "no, the second guy yeah.      . but
he didn't want it tonight.     . I'm seeing the first guy then I'm
coming in tomorrow." SILVERMAN asked "what are you taking from
me tonight eleven?" TEPPER replied "yeah."

                    ll.  At approximately 7:30 p.m., law
enforcement officers executed a court-ordered search warrant on
MITCHELL TEPPER, who was traveling in a livery cab.   The search
resulted in the seizure of approximately 1,050 pills, which lab
tests sUbsequently confirmed were Quaaludes. The Quaaludes were
in a bag on TEPPER's lap in the livery cab.

                     lll.    At approximately 7:44 p.m., law
enforcement officers intercepted a call over the Silverman Cell
Phone between MICHAEL SILVERMAN and MITCHELL TEPPER on the Tepper
Phone. TEPPER said, "I just got pulled over.         . by the police
in this car.        . I had a couple bottles of vitamins, they took
everything.        . they let me go.    . I couldn't fight to take
them back...I' m freaking out.     . My friend's gonna have a fucking
shit fit.    This is the same guy with the money before I don't
know what to tell him..." SILVERMAN asked, "they took all eleven?"
TEPPER said "yeah.        . if they come after me I gotta think about
to say what they are." SILVERMAN stated, "well, I'm not
involved." TEPPER stated "I know, Michael I'm gonna protect you.
I wouldn't say anything, but you gotta help me think of a story
to say when they come back to me and say these were .
something." SILVERMAN stated that TEPPER should have told the
police "that wasn't mine, what are you talking about?"

                     iv. At approximately 7:54 p.m., law
enforcement officer intercepted a call over the Silverman Cell
Phone between MICHAEL SILVERMAN and MITCHELL TEPPER on the Tepper
Phone. During this conversation, SILVERMAN asked TEPPER, "Did
they ask you where you were coming from?      . Did they ask you
what address?      . Did they talk to the cab driver?      . They
were undercover?      . Did they ask you what apartment?      . Did
they ask the cab driver where he picked you up?       . He just
said the building." TEPPER replied "don't worry, I didn't say a
name Michael, I would never do that to my friend.   I'm shaking."

                    v.    At approximately 8:05 p.m., law
enforcement officers intercepted a call over the Silverman Cell
Phone between MICHAEL SILVERMAN and MITCHELL TEPPER on the Tepper
Phone. During this call, TEPPER said, "they took the whole black
bag," "I said they're vitamins," "the thing is what freaks me out
is that they took 1100 of those things and now they have my
address, they have my work number and he goes 'Buddy, if these
are not what you say they are, we're gonna have a problem,' then
they let me go," "I'm never gonna rat on you Michael," and "Maybe
these cops are not gonna test them.  If they test them they're
gonna come after me, but how can they come after me a week
later?" SILVERMAN replied, "They could never come after you, how
can they say they were yours?" TEPPER responded, "What? Because
they were in my bag." SILVERMAN replied, "I understand that, but
they could have put them there, that's bullshit." TEPPER asked,
"How do you let me go when you just took a bag that's marked 500
and 500. So yeah, we can say they're vitamins, and I don't know
what they were."

                nn. On or about September 5, 2009, at
approximately 10:49 a.m., law enforcement agents intercepted a
text message intercepted over the Silverman Cell Phone to MICHAEL
SILVERMAN from the Taxin Phone which read "I need a few .
what's last 4?" SILVERMAN replied "4 2 weeks at least." TAXIN
responded, "well see u tues then. I'll try to make them last."
SILVERMAN replied, "Amt tues?" TAXIN responded, "60.      . I

September 8, 2009, at approximately 8:44 a.m., law enforcement
agents intercepted a text message over the Silverman Cell Phone
to MICHAEL SILVERMAN from the Taxin Phone, which read "At least
100. someones taking almost half." SILVERMAN replied, "B there
in 15." I believe these text message exchanges indicate that
TAXIN resells Quaaludes she buys from SILVERMAN to other
individuals.

               00.  On or about September 8, 2009, a law
enforcement agent conducted surveillance in the vicinity of

Macy's parking lot, 1100 Northern Boulevard, Manhasset, New York.
At approximately 10:05 a.m., the agent observed MICHAEL SILVERMAN
park the Silverman vehicle in the lot next to the Taxin Vehicle.
The agent observed SILVERMAN exit his vehicle and enter the Taxin
Vehicle, where he remained for approximately fifteen minutes.

               pp.   On or about January 4, 2010, at approximately
3:58 p.m., a text message was intercepted over the Silverman Cell
Phone to MICHAEL SILVERMAN from the Rubin Phone, which read "50
28 12 940 tomorrow."    The Silverman Cell Phone responded "By
me." The Rubin Phone replied "K." I believe this text message
exchange indicates that EDWARD RUBIN planned to purchase
Quaaludes packaged separately into lots of 50, 28, 12.

                qq.  On or about February 12, 2010, at
approximately 2:16 p.m., law enforcement officers intercepted a
call over the 6350 phone between RALPH MARAZZO and another
individual ("Individual-12"J.   RALPH MARAZZO stated, "I'll meet
you at the bank you just got to tell me what it is, I'll get it
ready."  Individual-12 responded, "How many? What are you ready
for? Ten, ten."   I believe this call indicates that RALPH MARAZZO
planned to sell 10 Quaaludes to Individual-12.

               rr.   On or about'March 8, 2010, at approximately
8:11 a.m., a text message was intercepted over the Silverman Cell
Phone to MICHAEL SILVERMAN from the Rubin Phone at the Rubin
Phone, which read "135-100-20-15." I believe this text message
indicates that EDWARD RUBIN planned to purchase 135 Quaaludes
packaged separately into lots of 100 20 and 15.

           WHEREFORE, deponent respectfully requests that. warrants
be issued for the arrests of DENNIS PATRICK FAIRLEY, THOMAS
FAIRLEY, ANA SANCHEZ, KEVIN YAN, FRANK BISMAN, JASON ABBATE,
BARRY GOLDRING, THERESA GOLDRING, KENNETH KUTIN, MARK VANDERBORG,
BRUCE SIEGMAN, HOWARD ARONSON, GARY BRUSTEIN, LEONARD ROSENFELD,
MICHAEL SILVERMAN, EDWARD RUBIN, MELANIE TAX IN , MITCHELL TEPPER,
RALPH MARAZZO, NINA MARAZZO, RONALD VESSIA, and NEIL WEINSTOCK,
the defendants, and that they be arrested and imprisoned, or
bailed, as the case may be.
