         We will also refer your application to a credit reference agency and any other third party including HM Revenue and Customs and

J. IMPORTANT INFORMATION (Applies to Offset Applicants)

 Agreement to Assign Windfalls to Charity
 The Newcastle Building Society wishes to avoid disruption caused by speculators. As a result all new customers opening an Offset
 Account are required to assign any windfall benefits to which they might become entitled on a future takeover or conversion of the
 Society. The assignment will be in favour of the Community Foundation, serving Tyne & Wear and Northumberland, one of the leading
 community foundations in the U.K.

 The agreement will be for a period of five years.

 Paragraphs 1 to 5 below will apply to you unless you are an exempt customer at the time when the account is opened. By submitting
 and signing the application form you:

 1. agree with the Society that, if the right to any windfall benefits is granted to you after the account is opened, you will assign those
 windfall benefits to the selected charity unless either of the following applies:

 1.1 the period between your account being opened and the conversion announcement date is more than 5 years
 (or, if applicable, the shorter period; see notes); or

 1.2 on the conversion announcement date, you are a borrowing member of the Society.

 2. authorise the Society and the successor to pass any windfall benefits direct to the selected charity (or to any other charity which the
 selected charity may nominate to receive those benefits), without notice to you;

 3. understand that:

 3.1 the Society has promised to transfer to the selected charity the benefit of the agreement which you have given under paragraph 1 above;

 3.2 neither the Society nor the selected charity will release you from that agreement; and

 b. The “conversion announcement date” means the date on which the Society makes a public announcement of a proposal to transfer
 its business to a successor.

 d. You are an “exempt customer” when you open the account if:

     i. you have held shares in the Society (other than permanent interest bearing shares) at all times since 31 March 1999; or

     iv. you belong to one of the groups of other people who, in the Society’s opinion, do not need to be asked to agree to the current terms.

 time to time, but no alteration will apply retrospectively.

 e. A person “opens” an account either by opening a new account or by having an existing account transferred into his or her name
 (whether as sole or joint holder).

 f. The “selected charity” means the Community Foundation or, if it is at any time no longer a registered charity, any other charity or
 charities selected by it to receive assignment of windfall benefits.

 g. A “shorter period” is applicable if, when the Society opens your account, you belong to one of the groups of people who, in the
 Society’s opinion, do not need to be asked to agree to the usual 5-year period. A list of these groups, stating the periods applicable to
 them, is available from the Society at any time. The Society may alter the number and composition of the groups and the periods applicable
 to them from time to time, but no alteration will apply retrospectively.

 h. The “successor” is any company or other corporate body to which the Society transfers its business under section 97 of the Building
 Societies Act 1986 (or under any provision which amends or replaces it).

DECLARATIONS (GUARANTOR)
Your Information

Your attention is drawn to the following terms and conditions that you must agree to before we can begin processing the Borrower’s
application.

a)     The Guarantor covenants with the Society that the obligations of the Borrower arising under the said Mortgage will be duly
       discharged.

b)     The Guarantor shall as between himself and the Society be deemed a principal debtor and not a surety and the Guarantor shall not
       be discharged nor shall his liability be affected by any act, thing, omission or means by which his liability as surety would have been
       discharged or affected.

c)     The Guarantor waives all rights to participate in the proceeds of any security held or acquired by the Society or in any money which
       may be received by the Society whether from the Borrower or any other source in or towards reduction of the monies secured by
       the Mortgage unless or until all the money secured by the Mortgage has been received by the Society in full.

d)     The Guarantor acknowledges that where the Mortgage is subject to Mortgage Guarantee Insurance he will be liable for reimbursing
       the insurer against any loss arising from the Borrower’s fault.

e)     The Guarantor acknowledges that he is liable for the Mortgage to the same extent as the borrower.

f)     The extent of the Guarantors liability will be the capital sum of the mortgage, plus costs reasonably incurred and three months
       interest.

g)     In asking us to consider your guarantee, you acknowledge that we have recommended that you take independent legal advice to
       make sure that you understand the nature of the commitment you are about to enter into.

h)     In giving the guarantee you then may become liable for the mortgage debt of the borrower if they cannot pay us.

i)     We will use the information you have disclosed in your application to make enquiries of your employer (and previous employer if
       any), your Accountant, Bank, Lender and Landlord you have named. We will also refer your application to any other third party
       including the HM Revenue and Customs and Department of Work and Pensions who may seem appropriate to us for credit
       assessment purposes. Such persons will keep a record of our enquiry.

j)     To assess this application and to verify your identity we will make searches of our own Group records and those at Credit Reference
       Agencies. The agencies will record details of the search which may be seen by other lenders whether or not this application proceeds.
       The agencies will supply to us both public (including the electoral register) and shared credit and fraud prevention information. Credit
       searches and other information which is provided to us and/or the credit reference agencies, about you and those with whom you are
       linked financially may, be used by us and other companies if credit decisions are made about you, or other members of your
       household. This information may also be used for debt tracing and the prevention of money laundering as well as the management of
       your account.

k)     To prevent or detect fraud, or to assist in verifying your identity, we may make searches of Group records and at fraud prevention
       agencies that will supply us with information. We may also pass information to other financial institutions and other organisations
       involved in fraud protection to protect ourselves and our customers from theft and fraud. If you give us false or inaccurate
       information and we suspect fraud, we will record this. We and members of the Group and other companies may use this information if
       decisions are made about you or others at your address(es) on credit or credit-related services, or motor, household, credit, life or
       any other insurance facilities. It may also be used for tracing and claims assessment.

l)     In the event that we take possession of the mortgaged property you authorise us to pass this information to the Council of Mortgage
       Lenders for inclusion on the Possessions register.

m)     An association between the joint applicants and or any individual identified as your financial partner, will be created at credit reference
       agencies, which will link your financial records. You and anyone else with whom you have a financial link understand that each
       other's information will be taken into account in all-future applications by either or both of you. This linking will continue until one of
       you successfully files a "disassociation" at the credit reference agencies.

n)    You declare by stating a financial association with another party that you are entitled to:

       • Disclose information about the joint applicant and or anyone else referred to by you.
       • Authorise us to search, link and or record information at credit reference agencies about you and anyone else referred
         to by you.

o)     Note that information held about you by the Credit Reference Agencies may already be linked to records relating to one or more of
       your partners. For the purpose of this application you may be treated as financially linked and your application will be assessed with
       reference to any "associated" records
