5. MINUTES
The minutes of the meeting of the Committee held on 21st May 2009 were
confirmed and signed.
6. DISCLOSURES OF PERSONAL INTERESTS
No disclosures of personal interest were made.
7. PLANNING APPLICATIONS
The applications for planning permission set out in the appendix to the agenda,
together with the recommendations of the Director of Development, were
considered.
In accordance with the procedure for public speaking at meetings, the following
member of the public and representatives of the applicant attended the meeting and
expressed their views:
(i) Mr B. Mullin (Marrons Solicitors on behalf of applicant) in respect of
application P/09/0243/2;
(ii) Mr C. Shields (local resident) in respect of application P/09/0234/2;
(iii) Mr N. Cooper ((HSSP) on behalf of applicant) in respect of application
P/09/0827/2.
In accordance with Council Procedure Rule 33, the following councillors attended
the meeting and expressed their views:
(i) Councillor Fryer in respect of application P/09/0243/2;
(ii) Councillor Stork in respect of applications P/09/0234/2 and P/09/0233/2;
(iii) Councillor Preston in respect of application P/09/0749/2;
(iv) Councillor Wise in respect of application P/09/0827/2.

In addition to the letters of representation reported in the agenda, details of the
following, which had been received after the agenda for the meeting had been
prepared, were submitted:
(i) in respect of application P/09/0243/2:
• comments and additional documentation from the applicant’s solicitor
in support of the application;
• comments from the Director of Development regarding the issues
raised above;
• comments from the Highway Authority in respect of a Green Travel
Plan, together with a recommendation for an additional condition;
(ii) in respect of application P/09/0234/2:
• an agreement in principle from the applicant to provide protective
fencing within the golf course to prevent golf balls entering gardens of
properties that back onto the golf course;
• comments from the Haddon Way Residents Association reiterating its
comments as set out in the main report;
• comments from a resident of Honeysuckle Way regarding potential
loss of privacy to his property;
• comments from a resident of Calke Close raising concerns regarding
the proposed width of the landscape belt, issues of land maintenance
and proposed planting;
• confirmation from the Council’s Senior Ecologist that the wildlife
route was acceptable;
• confirmation from Natural England that it was in agreement with the
Council’s Senior Ecologist;
• confirmation from the applicant’s solicitors that the applicant was
confident that the site boundaries had been correctly drawn and
accurately reflected ownership;
(iii) letters of support for the application from the occupier of Hillcrest and
105 Cotes Road, Barrow upon Soar, together with a letter and a
supporting statement from the applicant in respect of application
P/09/0749/2:
(iv) in respect of application P/09/0827/2:
• additional comments from the occupiers of 88 Swithland Lane
regarding the proposed landscaping and front boundary treatments
and objections to the proposed lighting plan;
• additional comments from the occupiers of 92 Swithland Lane
objecting to the proposed landscaping and front boundary treatments;
• comments from Rothley Parish Council objecting to the excessive
lighting in the garden;
• amended details of the lighting and gates, together with comments
from the Director of Development regarding those amendments.

One additional condition recommended by the Highway Authority in respect of
application P/09/0243/2, four additional conditions in respect of application
P/09/0234/2, two additional conditions in respect of application P/09/0233/2 and
three additional conditions in respect of application P/09/0827/2 were recommended
by the Director of Development, details of which were submitted.
An amendment to informative 2 in respect of application P/09/0243/2 and an
additional condition in respect of application P/09/0472/2 were recommended by the
Director of Development, details of which were reported verbally.
RESOLVED
1. that, in respect of application P/09/0749/2 (Barkby Road Nurseries, Barkby
Road, Queniborough), as the Committee was minded to grant planning
permission, against the recommendation of the Director of Development, it
was resolved that consideration of the application be deferred to allow a
report outlining the reasons for granting planning permission and the possible
conditions which would need to be attached to a grant of planning permission
to be submitted to the next meeting of the Plans Committee;
Councillor Radford requested that her vote against the decision in respect of
application P/09/0749/2 be noted.
2. that, in respect of application P/09/0234/2 (Land off Haddon way, Grange
Park, Loughborough), planning permission be granted as recommended by
the Director of Development, subject to the conditions referred to in the
report and to the following four additional conditions:
No occupation of the dwellings on plots 879 – 883, 894, 1010 – 1013, 1018 –
1019, 1027 – 1042 and 1044 shall take place until such time as measures have
been implemented to minimise the risk that golf balls from the adjacent land
do not fall within the curtilages of the properties.
REASON: In the interests of the safety of the occupants of the dwellings and
their residential amenity.
All driveways and parking spaces shall be laid using a porous construction to
ensure that surface water does not drain into the public highway or to
surface water drainage systems, and thereafter shall be so maintained. For at
least the first 5m behind the highway boundary the surfacing shall be of a hard
bound material.
REASON: To reduce the possibility of surface water from the site being
deposited in the highway, causing dangers to road users and to prevent the
discharge of surface water causing an increase in the risk of flooding in the
locality.
The badger corridor and badger tunnel under the spine road shall be
completed in accordance with the details agreed to discharge condition 3
before the spine road is open to vehicular traffic.
REASON: To ensure the provision of a badger commuting route.

No development shall be carried out on the site unless it is fully in
accordance with the mitigation strategy, specified in section 5.2 of the badger
survey report dated February 2009 approved as part of this application.
REASON: To ensure that important features of ecological interest are
protected;
3. that, in respect of application P/09/0233/2 (Land off Haddon way, Grange
Park, Loughborough), planning permission be granted as recommended by
the Director of Development, subject to the conditions referred to in the
report and to the following two additional conditions:
No development shall commence until a scheme for the provision of bird
boxes and bat roosts within the buildings has been submitted to and agreed in
writing by the local planning authority. The scheme shall provided in
accordance with the agreed details a building containing such features is first
occupied.
REASON: To build-in beneficial biodiversity features as part of the design of
the development.
Before any part of the development is first occupied, details of a scheme for
the provision of CCTV within the local centre, including arrangements for its
monitoring and maintenance, shall be submitted for the approval of the local
planning authority. The approved scheme shall be implemented in
accordance with a programme which shall have formed part of the submitted
and approved scheme, unless otherwise specifically agreed, in writing, with
the local planning authority.
REASON: To provide a safe and secure environment and to deter criminal
or anti-social behaviour in the area;
4. that, in respect of application P/09/0827/2 (90 Swithland Lane, Rothley),
planning permission be refused against the recommendation of the Director
of Development for the following reason:
It is the opinion of the local planning authority that the use of a grey single ply
membrane as a roof material over the large expanse of flat roof extensions
would introduce a material that is inappropriate to the locality. The
development would be visually intrusive and would conflict with the
character and appearance of the existing dwelling and, therefore, appear as an
incongruous element which would be harmful to the unique, spacious and
dignified character of the Ridgeway Area of Rothley, as defined in the
adopted Borough of Charnwood Local Plan. The development is thereby
contrary to saved Policies H/17, H/20 and EV/1 of the Local Plan and the
Council's adopted Supplementary Planning Guidance on House Extensions
and the Council's adopted Supplementary Planning Document ‘Leading in
Design’;
5. that, in respect of application P/09/0472/2 (61 Highway Road, Thurmaston),
planning permission be granted as recommended by the Director of

Development, subject to the conditions referred to in the report and to the
following additional condition:
