Final Agenda MINEFILL PRACTICES FOR COAL COMBUSTION RESIDUE FACILITATED STAKEHOLDERS MEETING May 19 & 20, 2003 U.S. EPA East Building, Room 1153 Note: The meeting will be held in the U.S. EPA East Building, located at the corner of 12th St. and Constitution Ave., NW, Washington, DC. The entrance is on Constitution Ave., NW. The building was formerly the Interstate Commerce Commission building. Everyone should leave with a firm understanding of the current status of minefill regulation, stakeholder views on benefits of and concerns with minefill practices, and constructive ideas to resolve issues identified by the stakeholders. • Desired Outcome: Session 2: Federal Regulatory Background on SMCRA and RCRA Statutes • Office of Surface Mining (OSM) - John Craynon, Chief, Division of Technical Support - Kimery Vories, Mid-Continent Region EPA - Steven Silverman, OGC Overview of SMCRA authorities and regulations, SMCRA implementation for coal minefill practices, federal-state relationships. • Overview of RCRA authorities, RCRA applicability to minefill practices (coal & non-coal mines), federal-state relationships, decision making processes - Dennis Ruddy, OSW - Bonnie Robinson, OSW Background, regulatory determination, rulemaking schedule, beneficial use. Coordination with OSM and IMCC, overview of state and site visits, summary of reports. Page 2 Session 4: Focused Discussion on Issues Following is an initial list of minefill-related issues that are shared by some stakeholder groups. These issues w ill be discussed in plenary se ssion as w ell as possibly in break out sessions if small group wo rk seems appropriate. The intent of the discussions will be to further define/clarify the nature of the issues and to explore ideas to address concerns. This list may be supplemented based on discussions during the cours e of S ess ions 2 and 3. • • • • • • • • • • Characterization of Waste and Sites Placement in Ground Water, Barriers and Liners Long-term Ground-water Monitoring, and Number of Monitoring Points Corrective Action Financial Assurance Post-closure Care Post-closure Use Restrictions Effectiveness of PPW in Treating AMD Impact of CAA Regulations on PPW and Its Implications for PPW Disposal in Mines Regulatory System Session 5: Recap of Issues and Discussion of Future Stakeholder Involvement This session will summarize the issues discussed in Session 4 and possibly identify processes to resolve som e of the issues, and w ill include a discuss ion of future s take holder involveme nt. Session 6: Assessment of Meeting and Closing Remarks Opportunity to make sure that all stakeholders leave with a feeling that they gained understanding of the SMCR A and RCRA statutes relating to minefill, that they had sufficient time to express their views to the other participants, and they have a fuller understanding of the other participants’ positions and concerns.
