NEW Pool Safety Laws
From December 1, 2010 Pool Owners in Queensland face tough new regulations in relation
to pool safety certificates. Pool owners have to meet a new standard of pool compliance if
they sell or rent their property after December 1 2010. If owners do not sell or rent, they
have 5 years from commencement to meet the new Pool Safety Standard.
Units for holiday letting have a six month postponement date, whilst units with permanent
letting have a two year postponement date from commencement. There is no
postponement date for houses.
Although there is a postponement date of actually obtaining the Pool Safety Certificate
requirement for units, obligations of unit owners (and body corporates) still apply such as
providing a government Form 36 (Notice of No Pool Safety Certificate) prior to entering into
a rental agreement. This form must also be provided to the Government and to body
corporates.
Any rental agreement for a house cannot be entered into after 1 December 2010 without a
Pool Safety Certificate.
Before entering into a sales contract, and before settlement, a buyer of a property with a
pool must be provide with the Form 36 – Notice of No Pool Safety Certificate if a Pool Safety
Certificate is not in place.
Only Pool Safety Inspectors and Building Certifiers (for one year only after commencement)
can issue Pool Safety Certificates. If the pool does not comply the new Pool Safety Standard,
a non conformity notice may be issued. Fines for non compliance that can be issued are up
to a maximum of $16 500.
