        Wax sealed / packing by PVC tape sealed tenders are invited by the General Manager Telecom, BSNL,
Satara, on behalf of BSNL, for “ERECTION AND MAINTENANCE OF TOWERS OF ANY TYPE, MAKE &
ASSOCIATED WORKS AS PER BSNL STANDARDS, AT ANY PLACE IN SATARA TELECOM DISTRICT
”, from the experienced tenderers, as per the specifications, which can be had from the SDE (Tender-1), O/o
G.M.Telecom, BSNL, Satara or can be downloaded from web site http://Maharashtra.bsnl.co.in/Tender of
Mh.circle. The details are as under:
1. Cost of each tender form (non-refundable).        : Rs.1125/- in cash, including sales tax @ 12.50 %.

7. Particulars of work                                  : As mentioned below.
8. Experience                                           : Experience in erection 40m or more height towers & allied works for
                                                          not less than Rs.20 lakh OR 20 Nos of 40 mtr or more height towers
                                                         in DoT/ BSNL/ MTNL/ Private Telecom Service Providers irrespective
                                                          of Technology used there of since April 2004 on wards. Experience
                                                          certificate issued by DE or above rank officer in the name of the
                                                          tendering firm should be submitted. In case of private telecom service
                                                          providers experience certificate should be from competent authority
                                                          with his name , designation telephone /Mobile No. & seal should be
                                                          submitted
  Tenders with out-station payable DD for EMD will be strictly rejected. Tender forms will be issued to contractors on written
                                                    request on official letterhead.
           Completed tender document (along with original DD as mentioned above) in wax sealed / PVC tape sealed cover
super scribed as “ERECTION & MAINTENANCE OF TOWERS OF ANY TYPE, MAKE & ASSOCIATED WORKS AS
PER BSNL STANDARDS, AT ANY PLACE IN SATARA TELECOM DISTRICT ” should be sent to the A.G.M. (PLG),
O/o G.M.Telecom, Satara, by registered post/speed post/courier, or may be dropped in tender box kept in O/O A.G.M.
(Plg), 2nd floor, O/o GM BSNL Satara on or before 15:00 Hrs of 04/09/2009. Tenders received late will not be
accepted.
           If within the validity period of the tender (within 240 days after opening of the tenders), any tenderer withdraws his
tender or makes any modifications in rates / terms & conditions which are not acceptable to GMT, BSNL – Satara, then the
GMT, BSNL – Satara shall without prejudice to any other right or remedy, be at liberty to forfeit the EMD absolutely.
           The right to accept the whole tender or part thereof or to reject any tender, without assigning any reason whatsoever
is reserved by the G.M.Telecom, BSNL, Satara.

Sir,
              With reference to your tender notice no. T-73/Tender - Tower Erection & Mtce./2009-2010/05
dated at Satara the 13/08/2009, regarding calling for tender on the above mentioned subject, I/We offer
my/our tender on the terms and conditions & specifications given and at the rates quoted in Annexure-
finance bid.
              The rates are including transportation, all the taxes & duties except service tax. I/We have
fully understood the terms and conditions of the tender & offer to execute the work, at the rates mentioned
above.
              I/We agree to abide by this bid for a period of 240 days from the date fixed for bid opening
and it shall remain binding upon us and may be accepted at any time before the expiring of that period
until a formal agreement is prepared and executed, this bid together with your written acceptance thereof
in your notification to award shall constitute a binding contract on us.
              If within the validity period of the tender (240 days from the date of opening of tender), I/we
withdraw the tender or make any modifications in rates / terms & conditions which are not acceptable to
GMT, BSNL – Satara, then the GMT, BSNL – Satara shall, without prejudice to any other right or
remedy, be at liberty to forfeit our EMD absolutely.
              Should this tender be accepted either fully or in parts, I/We hereby agree to abide by and fulfill
all the terms and conditions of the contract hereafter as applicable or in default thereof, forfeit to and pay
to the BSNL, the sum of money mentioned in the said conditions without prejudice.

                    GENERAL TERMS AND CONDITIONS AND INSTRUCTIONS:

1. The tender documents will be issued by SDE (Tender-1), O/o G.M.Telecom, BSNL - Satara, on
    written request, submitted on official letterhead of the contractor.
2. The tender should be written in Hindi or English.
3. No responsibility for postal delay will be accepted & for that, no extension of time will be granted.
4. Attested Xerox copies of following documents are to be enclosed:
   a) In case of Partnership/Proprietorship/ Ltd company, the relevant documents regarding the -firm
        partnership / proprietorship / Ltd company.
   b) Firm registration certificate BST / CST/ VAT.
   c) Solvency Certificate, issued after 1-04-2009, for at least Rs.10 Lakh, from any Nationalised /
        Scheduled Bank, on the name & address of the tendering firm as per proforma enclosed.
   d) Experience certificate issued by an officer not below the rank of Divisional Engineer, for erection
        & allied works for 40m or more height towers, carried out in DoT/BSNL/MTNL/ private Telecom
        Service providers irrespective of technology used there of since April 2004 onwards for not less
        than Rs20 Lakh or 20Nos of 40 M or more height towers & associated works in the name of
        tendering firm. In case of private Telecom service providers certificate from competent authority
        with name, Designation , Telephone / Mobile No. & seal should be submitted.
   e) Attested copy of Latest Income tax return filed for the assessment year 2007-08 0r 2008-09 and
        attested copy of PAN card.
   f) Certificate about no relatives of the tenderer as per Proforma on page No.6 of tender document
        duly filled & signed OR on separate letter head of the tenderer in prescribed proforma.
5. The tender papers submitted without payment of EMD or without any of the documents mentioned in
    clause 4 or without the name & authority of the person signing the tender form will not be considered.
6. After acceptance of tender, work will be allotted as and when required, during the validity period of
    the tender, which is one year from the date of signing the agreement. The validity period of the tender
    can be extended for further one more year by G.M. BSNL Satara on same rates, terms & conditions.
7. Service tax should be charged by the Contractor (if applicable) at prevailing rates from time to time
    and the TR – 6 Challan, evidencing payment of Service Tax to the concerned authorities should be
    submitted to the AO (Cash) & SDE (Estimate) for effecting regular payments.
8. The rates should be quoted clearly in words & in figures, without any correction. If there is any
    ambiguity in rates, the rates quoted in words will be taken as correct and final. Also Sales Tax or any
    other chargeable duty must be specifically mentioned separately, failing which no such tax or duty
    will be paid or allowed later on.
9. The work should be completed within a period specified (depending on urgency of work), in the work
    order issued by D.E. Transmission Satara. The work must be carried out during daytime only.
10. If the work is not completed within the period given in the work order, the tenderer has to pay the
    penalty. For penalty, period will be calculated from the date of completions as given in the work
    order. Any fraction of week will be rounded off to next higher week. The rate of penalty will be 1.0 %
    of the bill amount per week for delay up to 1st four weeks. For delay exceeding 4 weeks, 1.5 % of bill
    amount per week for delay up to next four weeks. If delay exceeds 8 weeks, contract will be
    terminated by giving one months registered notice for unsatisfactory / undue slow work or the
    contractor will be allowed at higher rate of penalty on mutual agreement between work order issuing
    authority and the contractor. In this case decision of GM BSNL Satara will be final.
11. Prices quoted & the tender bid should be firm & valid for acceptance within 240 days from the date of
    tender opening. If within this validity period, any tenderer withdraws his tender / makes any
    modifications in rates / terms, conditions which are not acceptable to GMT, BSNL – Satara, then the
    GMT, BSNL – Satara shall, without prejudice to any other right or remedy, be at liberty to forfeit of
    the EMD absolutely. Also if the successful tenderer fails to accept the work order or commence the

    work or to carry out the work according to the specifications given, the entire money (whole EMD and
    Security Deposit) may be forfeited without prejudice to any other right or remedies.
12. Tenderer should attest all the corrections in the tender to avoid rejection.
13. Separate deposit of EMD and or Security Deposit are necessary for every tender and every section. No
    adjustment of previous deposit is acceptable.
14. Completed tender document (all the pages of tender form) should be returned, duly signed along with
    the name of the signatory on EACH AND EVERY PAGE, by the tenderer (proprietor/ all the
    partner‟s or authorized signatory or consent letter of all the partner‟s , in case of partnership firm) with
    company-seal, indicating the name of the tenderer/firm, partner/proprietor/ authorized signatory, full
     address for correspondence & contact telephone number, etc., at the right side bottom corner, as a
     token of acceptance of all the terms and conditions mentioned in the tender document. Signature
     should be accompanied with the name of the proprietor/partner who has signed the form. Otherwise
     the form will not be considered.
15. The wax sealed/ Packing by PVC tape sealed envelope, containing the completed tender document as
    mentioned in clause 14 above and in tender notice, along with the DD / Bank guarantee towards EMD
    payment (The DD should be in favour of A.O. Cash, BSNL, Satara & payable at Satara.) & DD for
    form fee or ACG-67 receipt (copy) if form is purchased from this office, super scribed as “
    ERECTION AND MAINTENANCE OF TOWERS OF ANY TYPE AND MAKE AND
    ASSOCIATED WORKS (AS PER BSNL STANDARDS), ANYWHARE IN SATARA
    TELECOM DISTRICT ” should be sent to the A.G.M. (PLG) , O/o G.M.Telecom Satara, by
    registered post/speed post/courier, or may be droped in tender box kept in O/o A.G.M. (Plg)
    O/o GM BSNL Satara (2nd Floor), Old LIC Building , Palace street, Near City Post Satara on or
    before 15:00 Hrs of 04/09/2009.
16. The completed tender document as mentioned above, shall be received upto 15:00 Hrs of
    04/09/2009 & will be opened on the same day, in the presence of those tenderers/ their authorized
    representatives whomsoever may be present, at 15:30 Hrs.
17. Any provision of clause in the tender for instance “subject to market fluctuations” which might effect
    the price of articles, will result in tender being rejected.
18. The General Manager Telecom, BSNL, Satara reserves the right to reject any or all the tenders
    without assigning any reason whatsoever. Also he is not bound to accept the lowest tender.
19. The General Manager Telecom, BSNL, Satara reserves the right to award the ENTIRE WORK OR
    PART OF THE WORK TO ONE OR MORE THAN ONE CONTRACTOR, WHO MAY NOT BE
    LOWEST TENDERER.
20. Any tender not according to the specifications, terms and conditions mentioned in the tender
    document or conditional or not to the point, are liable to be rejected without any further notice.
21. Tender should be submitted in two well sealed envelopes ( Packing by PVC tape / Wax seal) enclosed
in a outer properly sealed envelope & addressed to A.G.M. (Plg) Satara ( Packing by PVC tape / Wax
seal) as follows (tenders which are not properly sealed will not be opened):
   a) The first envelope marked as “Technical Bid” for Erection and Maintenance of towers in Satara
       SSA, should contain 1) DD‟s / Bank guarantee valid for 270 days towards EMD 2) Cost of tender
       form – if the form is downloaded then DD for form fee should be attahed/ACG-67 receipt (copy),
       if the form is purchased from this office. 3) Tender document with all pages duly filled & signed
       EXCEPT finance bid page No.26 to 30 of tender document and documents as per clause 4 &14.
   b) The second envelope marked as “Finance Bid” , should contain only rates quoted ( finance bid

       signed by the tenderer. This will be opened on later date after technical scrutiny of documents.
   c) Finance bid will be opened on later date after scrutiny of technical bid and date of opening of
       finance bids will be intimated to the qualified bidders only. If DD/any document as mentioned in
       clause 4 are not enclosed & tenderer is not exempted, the bid will not be considered.

23. Security deposit should be paid within stipulated time by the approved tenderer; otherwise the EMD
will be forfeited.
24. No person, directly or indirectly connected with Govt/BSNL Service, should submit the Tender for
   above-mentioned subject. If at a later date, it is noticed that any of the successful tenderer/tenderer(s)
   is / are directly or indirectly connected with the Govt/BSNL Service, the contract of such tenderer(s)
   shall be terminated without any further notice & the EMD and/or Security Deposit paid will be
   forfeited. In this case, the decision of the General Manager Telecom, BSNL, Satara will be the final.
25. The Contractor shall keep an account of work done from time to time and shall intimate to this
    office whenever the approximate work mentioned in tender has completed.
26. Evaluation of tender will be as follows –
     Part A and Part B will be evaluated Separately & will be evaluated as a composite bid. Quantity given
     for evaluation mentioned in annexure is approximate.
27. When number of contractors / suppliers finalized are more than one, the tentative distribution of order
    shall be made according to the formula given below.

28. The successful tenderer shall be required to deposit Security Deposit of 10% of the cost of work
awarded either by Cash / DD (Nationalized or Scheduled Bank) or in the form of Bank Guarantee valid
for One & half years, from any Nationalized or Scheduled Bank, in 15 days from the receipt of Letter of
Approval cum notice for payment, otherwise EMD will be forfeited. Also if more than one contractor‟s
are selected as per annexure wise work, Security Deposit will be reduced proportionately. The EMD
submitted in the form of DD shall be converted in to security deposit. In case EMD is submitted in the
form of bank guarantee, then the approved tenderer has to pay the security deposit in the form of D.D. or
Bank guarantee of full amount should be submitted . Conversion of EMD in to security deposit shall not
be applicable for EMD submitted in the form of bank guarantee. The EMD submitted in the form of bank
guarantee will be released after submission of required full amount of security deposit in the form of DD
or in the form of bank guarantee. There is no any interest payable on the EMD or security deposit amount.
29. Security deposit will be returned to the contractor after completion of 3 months from the date of
termination of tender, after realizing any sums of money payable by the Contractor to the G.M.T. BSNL,
Satara & on written request from him after production of no objection certificate from field units.
Production of no objection certificate is the tenderers responsibility.
30. After depositing the Security Deposit to this office, tenderer has to sign an agreement on Rs.100/-
non-judicial stamp paper. Then only this office will issue the final letter of approval for starting the
works. Based on this approval, as per the requirement, work orders will be issued by the AGM / DE after
ascertaining the validity of labour license. After issuing of the allotment letter, for doing the work,
approved tenderer should register himself with the Asstt. Labour Commissioner, Pune to obtain the valid
labour license (if required so for doing the work) under Contract Labour Regulation and Abolition Act-
1970. Otherwise obtain NOC from him or L.E.O. – Solapur . The labour license/NOC such obtained
should be valid for the entire period of the contract.
31. Based on this approval, if required for doing the work, the approved tenderer should apply–
                    i. For Service Tax registration, to Central Excise Authorities concerned.
                   ii. For EPF registration, to concerned EPF Authorities.
     The labour license, the EPF registration, Service tax registration so obtained should be valid for the
     entire period of the contract.

32. The approved Contractor shall in no circumstance sublet the contract. If found so S/D will be
forfeited. Also in case of insolvent suppliers S/D will be forfeited, by giving registered notice.
33. The successful tenderer shall be responsible for arranging and obtaining all necessary materials / tools,
easements, permits and licenses for transportation of material/tools/equipment‟s/persons etc. required for
execution of work or all material supplied by BSNL / material recovered at or from local stores depot to
work site and vice versa. The cost for all this will be entirely borne by the tenderer & no claim of any type
for this work will be entertained.
34. The work consists of transportation of tower material from SDE (MM), MIDC – Satara & erection of
tower, painting of erected tower, hoisting of antenna, antenna orientation, ring earthing of towers erected
and other allied necessary works as described in Annexure, to be done as per requirement, anywhere in
Satara Telecom District, as per the specification given. Also maintenance works of any type / height tower
in Satara SSA. The work not carried out as per specifications should be replaced within 7 days, at no any
extra cost. Otherwise penalty as per clause 10 will be charged. The work has to be offered for T & D wing
or officer nominated by GM BSNL Satara for acceptance testing.
35. Work per each work order or part thereof will be treated as separate work, covered by separate work
order. Conditions and specifications will be the same for all works.
36. BSNLSatara will not be responsible for payment of compensation / damages etc. to the successful
tenderer, if the work is stopped in between due to non-availability of stores or for any other unavoidable
circumstances / reasons.
37. The Contractor shall be responsible for any losses, damages, accidents etc. that may have occurred
during the execution of the work. All damages caused to the private property, during execution of work
should be promptly attended to, at no any extra cost. Also the Contractor shall pay compensation to the
BSNL, Satara / any other agency or his workmen, payable under Insurance Cover to all workmen working
under this Contract & Workmen Compensation Act – 1923 V (iii), for injuries caused to workmen. If such
compensation is paid by the G.M.T.BSNL, Satara as a Principal Employer under the Sub Section (1) of
Section 12 of the same Act on behalf of the Contractor, it will be recovered by the G.M.T.BSNL, Satara
from the Contractor, under Section (ii) of the said Section from the S/D or any dues payable by the
G.M.T.BSNL, Satara to the Contractor on any accounts.
38. The Contractor will be responsible for all damages caused in the course of all the above said work. If
the Contractor or his working people or labours/servents damage any water pipe, drains, electric or
telephone cables or Departmental/Subscriber‟s properties, during the course of execution of work or if
any defects appeared in the work after completion of work or within three months after a certificate final
have been given by the concerned field In-Charge SDE/JTO, the Contractor shall upon a receipt of notice
in writing in that behalf, make the same good at his own cost, or in default, if the In – Charge of the said
work (SDE/JTO) have made the same good from other workmen, then such amount will be deducted from
the S/D or from any sums that may then or at any time there after become due to the contractor. The
security deposit of the Contractor shall not be refunded before the expiry of three months after the issue of
the certificate final or otherwise of completion of work or till the final bill has been prepared and passed,
NOC obtained from concerned field SDE, whichever is later
39. The successful tenderer shall be responsible for arranging and obtaining all necessary materials/tools,
easements, permits and licenses for transportation of material / tools / equipment‟s /persons etc. required
for execution of work or all material supplied by BSNL / material recovered at or from local stores depot
to work site and vice versa. The cost for all this will be entirely borne by the tenderer & no claim of any
type for this work will be entertained. The contractor shall be able to execute the works at 4 to 5 or more
locations simultaneously by keeping sufficient number of suitable staff/workmen under efficient
supervision (for speedy & timely execution of the ordered work) and should follow all the
rules/regulations under Contract Labour Regulation And Abolition – (a) Act 1970 and (b) Rules 1971.
The Contractor should fulfill / comply all the terms & conditions & provisions of EPF & Misc. Provisions
Act 1952 and EPF Scheme 1962, in respect of labourers/employees engaged for performing / execution of
the said work.

40. It is the sole responsibility of the tenderer that all the labours engaged under this work under
the said contract are insured for safety, by the successful tenderer. GMT, BSNL, Satara will not be
responsible for any compensation on account of any accidental injury to the workers working
under the tenderer.
41. The EMD of unsuccessful bidder will be refunded after finalization of tender. EMD of successful
bidder will be converted in to security deposit, if EMD paid in Demand draft. If EMD is submitted in the
form of bank guarantee then EMD will be refunded after submission of security deposit if full amount as
required ( In the form of Demand Draft or in the form of bank guarantee ) by the successful bidder.
42. No escalation in rates will be entertained during or after approval of the tender, till the completion of
the entire contract period. Any hike in the cost of material / labour rates etc. will be at the risk and cost of
the tenderer only. Also the quantity given in the tender notice is approximate and may vary (can be
increased or decreased). The GM BSNL Satara at the time of award of work under the contract, reserves
the right to decrease or increase the work by up to 25 % of the total quantum of work specified in the
schedule of requirements without any change in the rates or other terms and conditions The rates should
be quoted while taking these facts into account.
43. NO TENDERER SHALL TRY TO INFLUENCE THE BSNL ON ANY MATTER RELATING TO THIS BID, FROM THE
TIME OF BID OPENING TILL THE CONTRACT IS AWARDED. ANY SUCH EFFORT TO MODIFY BID/INFLUENCE THE
TENDER EVALUATION, COMPARISON OR CONTRACT AWARDING DECISIONS, SHALL RESULT IN THE REJECTION
OF THE SAID TENDER/BID.
44. If the successful Tenderer fails to accept the ordered work or if in the opinion of the General Manager
Telecom, BSNL, Satara, the work carried out is not satisfactory or the work is not being carried out at
sufficient rate or the material supplied is of substandard quality or the tenderer violates any of the
conditions of the tender / contract, the contract will be terminated by giving one month‟s notice & the
work will be carried out from other agencies at the risk and responsibility & cost of the defaulting
tenderer & the Security Deposit will be forfeited. However, the tenderer will be paid for the work he has
carried out satisfactorily. The decision of the General Manager Telecom, BSNL, Satara will be final in
this respect.
45. All the work carried out in respect of this tender by the Contractor shall be offered for Acceptance
testing to T & D A.T. or the representatives nominated by the G.M.T. BSNL – Satara. Approved
contractor or his representative should be present at the time of A.T.
46. Any dispute arising out of contract shall be referred to C.G.M.T., BSNL, Mumbai for arbitration as
per arbitration clause given below and his award shall be binding to both the parties.
47. I/Tax & all other taxes and duties such as Works Contract Tax etc., as applicable from time to time,
will be deducted at source, from the bills submitted. Service tax should be charged by the Contractor (if
applicable) at prevailing rates from time to time and the TR – 6 Challan, evidencing payment of Service
Tax to the concerned authorities should be submitted to the AO (Cash) & SDE (Estimate) for effecting
regular payments.
48. The machine numbered bills should be submitted within 15 days of completion of work, after
acceptance testing. Late bills (beyond 3 months after date of acceptance testing) will be paid only after
vigilance clearance.
49. The bills submitted should be:
      a) In duplicate, one copy marked as “Original” & other “Duplicate”.
      b) The bill should be in printed form and machine numbered and imprinted with Sales Tax, Service
           Tax , Income Tax No. etc. particulars.
      c) Along with the details of work carried out, copy of work order issued, total number of work
           orders issued till the said bill & work order, progressive total of bills submitted, dates of
           commencement and completion of work, acceptance testing report along with satisfactory work
           certificate issued by concerned SDE.
      d) By the contractor, along with the statement of details of –
          List of labourers/employees engaged for the said work & duration of engagement.

50. FORMATION OF RINGS FOR QUOTING CARTEL RATE: If one or more groups of bidders are found
to have rings for bidding Cartel Rates with intension to restrict competition and to boost up rates of tender
items to the detriment of the BSNL, the GMT BSNL, Satara reserves the right to ignore their offers. If the
offers are taken into consideration for some reasons and other, group or groups forming the cartel shall be
treated as one offer and quantity distribution shall be made accordingly. If all the bidders form one cartel
rate, the GMT BSNL, Satara reserves the right to limit the number of firms. In such a situation a limited
number of offers would be drawn from all the offers on random basis from eligible bidders after opening
the bids.
51. LABOUR LAWS: The contractor shall be responsible for any losses/damages etc. that may have occurred
during execution of work and shall pay compensation to his workman payable under workmen
compensation Act 1923 (VII) for injuries caused to the workmen. If such compensation is paid by Govt.
as a Principal Employer under sub section (I) of section 12 of the same Act on behalf of the contractor, it
shall be recovered by the Govt. from the contractor under section (ii) from security deposit or any other
dues payable by the Govt. to the contractor on any account. If required for carrying out the work, the
contractor shall obtain a valid license under the Contract Labour (R&A) Act 1970 and the Contract
Labour (Regulation and Abolition) Central Rules 1971 before the commencement of work, and continue
hold the said license till completion of the contract. The contractor shall comply with the provisions of the
payment of wages Act, 1936, Minimum Wages Act-1948, Employees liability Act 1938, Workmen‟s
Compensation Act 1932, Employees Provident Fund Act 1952-EPF Scheme 1962,, Building &
Construction Act, Equal Remuneration Act, Contract Labour (Regulation and Abolition) Act 1970 or the
modification thereof or any other law relating thereto and the rules made there under from time to time.
He shall also indemnify the BSNL against any payments to be made for due observance of the said laws.
No minor labour (below the age of eighteen years) shall be employed on the work.
52. ARBITRATION: In the event of any question, dispute or difference arising under the tender/ agreement
for this tender or in connection there-with except as to matter the decision of which is specifically
provided under the agreement for this tender, the same shall be referred to sole arbitration of the Chief
General Manager, Maharashtra Circle BSNL, Mumbai or in case his designation changed or his office is
abolished then in such case to sole arbitration or the officer for the time being is entrusted whether in
addition to the functions of the Chief General Manager, Maharashtra Circle BSNL, Mumbai or whatever
designation such officers may be called hereinafter referred to as the said officer) and if the Chief General
Manager, Maharashtra Circle BSNL, Mumbai or the said officer is unable or unwilling to act as such to
the sole arbitration or some other person appointed by the Chief General Manager, Maharashtra Circle
BSNL, Mumbai or the said officer. The agreement to appoint an arbitrator will be in accordance with the
Arbitration and Conciliation ACT 1996. There will be no objection to any such appointment that the
arbitrator is Government Servant or that he has to deal with the matter to which the agreement relates or
that in the course of his duties as Government Servant he has expressed views on all or any of the matter
under dispute. The award of the arbitrator shall be final and binding on the parties. In the event of such
arbitrator to whom the matte is originally referred, being transferred or vacating his office or being unable
to act for any reasons whatsoever such Chief General Manager, Maharashtra Circle BSNL, Mumbai or
the said officer shall appoint another persons to act as arbitrator in accordance with terms of the
agreement and the person so appointed shall be entitled to proceed from the stage at which it was left out
by his predecessors. The arbitrator may from time to time with the consent of parties enlarge the time for
making and publishing the award. Subject to aforesaid Indian Arbitration and Conciliation Act 1996 and

the Rules made there under, any modification thereof for the time being in force shall be deemed to apply
to the arbitration proceeding under this clause.
53. SET OFF: Any sum of money due and payable to the contractor (including security deposit refundable
to him) under this contract may be appropriated by the BSNL, SATARA or any other person or persons
contracting through the BSNL, SATARA and set off the same against any claim of the BSNL, SATARA or
such other person or persons for payment of a sum of money arising out of this contract made by the
Contractor with BSNL, SATARA or such other person or persons contracting through BSNL, SATARA.
54. FORCE MAJEURE: Neither the BSNL nor the Contractor shall be liable to the other for any delay in or
failure of performance of their respective obligations under the agreement caused by occurrences beyond
the control of the BSNL or the Contractor (as the case may be) including but not limited to fire (including
failure or reductions), acts of God acts of public enemy, wars, insurrections, riots, strikes, lock-outs,
sabotage, any law, status or ordinance, thereof or any other local authority or any compliance therewith or
any other causes, contingencies or circumstances similar to the above. Either party shall promptly but not
later than twenty days thereafter notify the other of the commencement and cessation of such contingency
and if such contingency continues beyond three months, both parties agree upon the equitable solution for
termination of this agreement or otherwise decide the course of action to be adopted.
55. CONTINGENCIES:- If during execution of work, certain additional activities are required to be
carried out for completion of the work and which are not covered in the scope of work or schedule of
rates, the rates for such contingency words will be fixed by the G.M. Telecom, Satara considering the
prevailing market rates. Similarly G. M. Telecom Satara reserves the right to add, delete or alter any item
of work or tender documents in the interest of the BSNL. The quantity of work mentioned in the tender is
approximate.
56. G.M. BSNL Satara reserves the right to call minor clarifications from the bidders.
57. During the entire tender period / evaluation process, if it is observer that, the downloaded
document / purchased document is exactly not as per the original tender document and / or it is
tampered / changed /altered / modified in any way, the tendered bid will be rejected.

                                           BRIEF DESCRIPTION OF WORK


        The work consists of erection / maintenance of telephone towers of various sizes & heights on
land , 15 mtrs. to 100 mtr single / coupled masts / Tower on land or roof top and the associated works like
erecting platforms, hoisting / dehoisting of antennas, feeder cable / wave guide Cable, earthing of the
tower, earthing of lightening spike, fixing of aviation lamps, erection of wave-guide rack and its
protection etc.

       The contractor has to carry out all works mentioned in this tender document as well as in work
order with his own tools and machinery. The tower/mast material (viz. lightening spike, Antenna, wave
guide & related accessories etc) will be supplied by BSNL Satara. The contractor will have to arrange all
other material such as that for fabricating antenna fixtures or coupling angles for 15 mtrs / 100 mtrs.
Single/coupled masts / tower. All the material should be of good / standard quality and deeply galvanized
iron.

       The work also includes the maintenance of existing towers and masts. Maintenance of tower/masts
includes periodic checkup, tightening of nut and bolts of tower/masts, minor work (viz. Removal of bends
to tower material, wave guide, runways etc) replacement of aviation lamp, Painting of tower, earthing of
tower, Minor Repair work of base foundation of tower, Cleaning of base foundation tower area &
surrounding area, Painting of base foundation of tower with water proof cement paint etc. & all other its
associated works as mentioned in work order by the Divisional Engineer In charge of work.

        The approved contractor shall in no circumstances award the work to a subcontractor without
written permission of this office.

       No water or light will be provided by the BSNL Satara for the work and contractor will have to
make his own arrangement for the same. He will also arrange for warehouse, accommodation for
labourers etc. On completion of work he shall remove these temporary erections and clear the site.

       While erection of tower / mast and maintenance of mast/tower contractor should not make any
damage to BSNL property other wise it will be recovered from the contractor. Again if any damage
occoured to other than BSNL property while erection / maintenance of tower / mast work, BSNL will not
be responsible for such cases, contractor has to settle the case at his own.

         SPECIFICATION FOR ERECTION OF TELEPHONE TOWERS AND
            ASSOCIATED WORKS IN SATARA TELECOM DISTRICT.
         A) SCOPE OF WORK
         The work consists of erection and maintenance of 15 mtrs to 100 mtrs. Telecom towers/mast on
the land, 15 mtrs./ 21 mtrs. Single mast on ground or the roof top for the purpose of provision of
UHF/MW/Mobile /WLL transmission systems between two exchanges and carrying out other associated
works like dismantling of towers including coupled towers, earthing of lightening spike, ring earth,
erecting antenna fixtures, platforms, wave-guide rack, wave-guide protection and hoisting / dehoisting of
antenna, wave-guide and feeder cable, or their dismantlement, earthing of the tower, fixing of aviation
lamps, orientation of antenna & allied works. The approximate numbers of towers to be erected are given
in the tender notice. However the quantity may vary depending upon availability of material.

        B) TECHNICAL TERMS AND CONDITIONS AND SPECIFICATION

        1) ERECTION OF TOWER:- All galvanised components, nuts and bolts supplied by the
Department should be arranged component wise for each tower erection and quantity checked before
commencing the work. The tower should be erected on the tower foundation at the site as per structural
diagrams. components required to be bent to shape or straightened as per requirement should be done.
        The tower should be erected perfectly vertical without any twist and all nuts and bolts should be
fully tightened, after modifying any mismatched holes within the permissible limits or changing such
component if modifications weaken it significantly. The contractor should widen or elongate or align the
holes for proper fitness. Proper size and proper number of bolts and components should be used for fitting
as per erection diagram and if any fabrication work required to be carried out for erection of tower.
        The inner fittings with horizontal cross-bracings between adjacent and opposite sides of tower
should be properly fitted at each designed level. Bolts of horizontal level should be inserted from inside
and nuts fitted outside the tower. Bolts of vertical level should be inserted from beneath and nuts fitted
from upside of the tower.
        The contractor should aquiatant himself to the structural diagrams and interpret them correctly.
      The contractor should also clean, degrease or touch up with red oxide paint/zinc rich primer for the
components if required.
2) TIGHTENING OF NUTS & BOLTS:- In the first place, the first and second sections of the tower
   should be tightened tentatively. First section should be tightened only after confirming that the third
   section is accurately assembled. This procedure should be followed at all subsequent stages of
   erection. All the sections should be tightened properly. On completion of erection, tightening of nuts
   and bolts should be checked thoroughly once again. No forceful fitting and hammering through
   bolts will be allowed.
       3)      Work should be carried out only between 6 am to 6 pm subject to adequacy of natural light
and provided there is no rain and the erected tower components are not wet.
       4)      During installation of mast, arrangement should be made by the contractor for providing
temporary obstruction light, as required under Aviation Regulation when the tower height reaches 150 ft
and beyond.
       5)       The antenna fixtures are required to be mounted at the towers at various heights for
mounting the antennae ranging from 1.2 m diameter to 3 m diameter. The types of antennae to be
mounted are:
          1) Standard parabolic antenna.
          2) Parabolic grid type antenna.
          3) Sectorial vertical type antenna
          4) Any other type of antenna

The antenna used for CDMA WLL are sector antenna (i.e. sectorial vertical type antenna) of height
around 2-3 mtrs. But the antennas used for CORdect WLL are three types –

a) Omini Direction Antenna - These antenna are light weight, about 1mtr. in height, the size of antenna
   is like a cricket stump & are mainly used at BSDs(Base Station Distribution) and RBS(Relay Base
   Station).

b) Patch Pannel Antenna - These antenna are light weight, about 1mtr. in height , the size of antenna is
   like a cricket stump & are mainly used at BSDs(Base Station Distribution) and CBS (Compact Base
   Station).

c) RBS directional antenna - having 2feet height and one feet width is used for RBS. For each CBS
     either 2 omini direction antennas or 2 patch panel antennas are required. In each BSD total 4 CBS are
     installed and at DIU site total 8 CBS are required to be installed. I.e. One CORdect system total 20
     CBS are required to be installed. (i.e. total 40 antenna) and 3 RBS or maximum as per requirement. At
     present six RBS per CORdect are used.
For CORdect system – CBS and antennas are required to be mounted on single structure and connected to
each after by jumper cable. From CBS to MDF(DIU) three cable pairs are required to provide
supply/signals to CBS from DIU. For this local cable of 10/20 pair capacity is required to be erected from
CBS to DIU i.e. Feeder cable/waive guide is not required for CORdect system. The cable shall be
properly secured by clamps at intervals specified by SDE(WLL) or Officer In charge of work.
Also for RBS site solar panel of size about (3‟ X 10‟) is required to be installed at each RBS site.
                 The material required for antenna fixtures will be hot dip galvanized and will be suitable to
carry the load of antenna.
         6)      Platforms are required to be constructed on the towers for movement of working staff at
various heights. All the material should be hot dip galvanized iron. Plates used or the platform should be
MS sheets of 6 mm thickness with hot dip galvanised. The exact size of the platform will depend upon the
height at which it is to be erected and will also differ from tower to tower, details of which are given in
the quotation.
         7)      Guard rings are to be provided on the ladder at an interval of 1 mtr and are vertically
connected with each other through MS Flats. Size of the flats used for the work will be 20x3 mm. All the
material will be hot dip galvanized.
         8)      Wave-guide racks are required to be provided between tower and building with
intermediate supports wherever required with the help of G.I. Pipe of 80mm size. Size of the rack will be
12” / 18” /24” wide. Material used for these racks will be angle irons of 50 x 50 x 5 and flats 25 x 5 mm.
The material should be hot dip galvanised. These racks will also be provided with semi-circular cover of
24 guage G.I.sheet supported by G.I.Plates welded or bolted at every two feet for protection. Earth
resistance shall be less than one ohm.
         9)      Earthing of Tower & Earthing of lighting spike - Contractor shall provide proper earthing
of. lighting spike on the top of the tower & he should ensure proper earthing, by way of ring earthing, of
tower at the foundation level of tower, from all sides of tower to the satisfaction of concerned D.E.
(Ring earthing is to be done as per E.I. number PROTECTION EARTHING I-001, DTD. 24/09/1998, issued by T&D
CIRCLE
         10)   DISMANTLING OF TOWERS:- Besides erection, the work also involves dismantling of
towers / masts including coupled towers and the accessories erected on the towers. The contractor will
follow all the Engineering instructions during erection and dismantling of towers. The dismantled towers
will be transported to the new site and erection at new site as per the instructions of the concerned
D.E.(Tx). Tn case of 15 mtr mast/coupled mast solar panel and its accessories, wave guide cable, clamps
should be hand over to concerned S.D.E. / JTO under clear receipt.

                    SPECIFICATION FOR PROVISION OF RING EARTH
(A) Laying of ring earth around Telecom Building :

i)       The ring earth around the Telecom building and tower should be as per E. I. No.
         PROTECTION EARTHING I – 001 Dated 24/09/1998, issued by T&D Circle.
         A trench 30 cms wide and normally 150 cms deep is dug. The depth should not be less than 60
cms. In any case. G. I. (Galvanized Iron) strip of 50x5mm. is laid in the trench. The trench should be
minimum one meter away from the tower. In the case of black cotton soil, the trench should be
sufficiently deep to avoid cracking of soil in summer. In case of rocky or hard murum soil, the depth
may be 60 to 90 cms. In case of rocky, hard murum and black cotton soil, the trench should not be filled
by the excavated material and instead foreign good earth, i.e. yellow soil or ash, which are fine and
cohesive in nature should be used.. While filling the trench, the earth may be rammed in layers, so as to
give cohesiveness and compactness to the soil.

ii) The G. I. Strips are to be connected with each other. The joints are to be properly wrapped and
sealed by water proof tape to avoid any ingress of moisture at the joint, while Laying the G. I. Strips for
ring earth, it should not be bent sharply at right angles but should be laid in a smooth curve of not less
than one meter radius.

(B) Connection of Tower and the Antenna subsystem to the ring earth:

        Each leg of the tower should be separately connected by 50x5mm. G. I. Strips above the ground
level of each leg and other end is connected to the ring earth. The connection of G. I. Strip to the tower
leg is done by tower bolts & for nuts with lead sheaths in between. The sheath of the cable for warning
light on tower, if armoured, should be separately connected to the tower at the top end, and to the ring
earth at the bottom end by GI strips.

( C ) Measurement of earth resistance and it’s limit:

      THE EARTH RESISTANCE SHOULD BE LESS THAN OR EQUAL TO 0.5 ohm IN ANY
CONDITION.

( D ) Material used in earthling:

  i) G. I. Strips of size 50x5 mm are laid in a ring trench and connected to tower legs, earth bar in power
room and engine room etc. All joints inside the earth should be made waterproof.

ii) Tower and other connection:
            Each leg is connected to ring earth by means of G. I. Strip. All connections are made by GI
nuts & bolts for GI to GI ( with a lead strip of 1 to 3mm thick as a washer in between, for ensuring proper
surface contact) viz.

ii)  This power cable should carry-50 V D.C. & the length should be from Aviation Lamp (Top) up
     to equipment room.
iii) This power cable should be drawn through ¾” PVC pipe, along the
     tower/runway. Clamping should be done by the tenderers. All the material &
     labour required would be supplied by the tenderer.

   b) At 60 M height- Two lamp in diagonal position.

     SPECIFICATION FOR PAINTING OF OLD AND NEW TOWERS IN SATARA TELECOM
                       DISTRICT.(LABOUR WITH MATERIAL).

   A) SCOPE OF WORK
   The work consists of supply and painting of unpainted new towers as well as painting of old towers
which have been painted five years earlier or whose paint has been pealed of and the tower shows signs of
rusting at many places. Old towers will have to be painted after carrying out routine maintenance work &
tightening of all nuts and bolts.

B) TECHNICAL TERMS AND CONDITIONS AND SPECIFICATION

1) The painting of towers is intended to give `Day warning' to flying Aircrafts as per Civil Aviation
Specification and also to give protection against corrosion thereby prolong the life of the towers wherever
erected in Satara Telecom District.
2) The new towers which have not been painted hitherto, will be first applied a coat of Zinc rich metal
primer of ISI mark, after thoroughly cleaning the surface of the metal with sand paper or soft wire brushes
to remove dust, dirt, soil, greases etc.
3) After this coat of primer has dried up, two coats of Brilliant White Synthetic and International Orange
Epoxy/Polyurethane paints of standard colour code of reputed companies (Standard make) will be applied
as per the standard required for the towers.
4) The Civil Aviation Specifications requires that the colour of International Brilliant white and orange
be applied in alternate bands. The top of the structure is started with International deep orange and bottom
of the structure also is finished with International deep orange. The height of the structure is to be
conveniently divided into a number of bands to achieve this.
5) In case of old towers which have been painted three years earlier or those towers whose paint has
pealed off due to heavy rains and wind within three years, should also be painted after consulting the
concerned field officer. Such towers should first be thoroughly cleaned off all the earlier paint/rust with
sand paper or soft metal brush.
6) All the nut and bolts of the tower should be tightened. Pre monsoon precautions like tightening of all
connectors, jumper cables waive guide connectors will have to be done by the contractor.
7) After cleaning as above, they will be first applied the Zinc rich metal primer and then the two coats of
white synthetic enamel and international deep orange as per (3) & (4) above.
8) Tower includes antenna fixture assembly, waveguide rack, waveguide supporters, ladder, rings,
platform, or any other fixtures to the tower.
9) Cement painting of base foundation of any type of tower. Cement paint snowcem make as per field
requirement
10) Miscellaneous minor repair works.
                            a) repair work of base foundation. Such as warn out / damage / cracks etc of
                                any type of tower with cement plastering before painting of base foundation
                            b) Cleaning of base foundation tower area and tower surrounding area of any
                                type of tower.

         wherever herein used.
    3) The contractor shall also supply the requisite number of workmen with means & material as well as tools,
         appliances, machines, implements etc. required for proper execution of work within the time prescribed in
         the work order.
    4) The contractor hereby declares that nobody connected with or in the employment of the Department of
         Telecommunications / BSNL/ MTNL is not / shall not ever be admitted as partner in the contract.
    5) The contractor shall abide by the terms and conditions, guidelines, construction practices, safety
         precaution etc. stipulated in the tender document including any correspondence between the contractor and
         the BSNL having bearing on execution of work and payments of work to be done under the contract.
