					MINUTES OF THE REGULAR PUBLIC MEETING OF THE UINTAH COUNTY COMMISSION OCTOBER 18, 2010
IN THE COMMISSION CHAMBERS OF THE STATE AND COUNTY BUILDING AT 147 EAST MAIN, VERNAL,
UTAH. THE MEETING COMMENCED AT 11:00 A.M.

WARRANTS: DATED OCTOBER 7, 2010 IN THE AMOUNT OF $1,429,497.27 AND WARRANTS DATED
OCTOBER 14, 2010 IN THE AMOUNT OF $85,603.95 WERE APPROVED AS PRESENTED.

VERNAL CITY PURCHASED PARCEL NUMBER 05:011:0039 AND IS REQUESTING AN ABATEMENT OF 2010
TAXES IN THE AMOUNT OF $1,463.14. THE TAX DISTRICT WILL CHANGE FROM 24 TO 95- CITY OWNED
PROPERTY.

VERNAL CITY PURCHASED PARCEL NUMBER 05:011:0132 AND IS REQUESTING AN ABATEMENT OF 2010
TAXES IN THE AMOUNT OF $388.57. THE TAX DISTRICT WILL CHANGE FROM 24 TO 95- CITY OWNED
PROPERTY.

VERNAL CITY PURCHASED PARCEL NUMBER 05:011:0001 AND IS REQUESTING AN ABATEMENT OF 2010
TAXES IN THE AMOUNT OF $388.57. THE TAX DISTRICT WILL CHANGE FROM 24 TO 95- CITY OWNED
PROPERTY.

UINTAH COUNTY PURCHASED PARCEL NUMBER 06:051:0065 AND IS REQUESTING AN ABATEMENT OF
2010 TAXES IN THE AMOUNT OF $88.53. THE TAX DISTRICT WILL CHANGE.

THE UNITED STATES OF AMERICA PURCHASED SEVERAL PROPERTIES FOR THE LOWER DUCHESNE
RIVER WETLANDS PROJECT AND IS REQUESTING AN ABATEMENT OF 2010 TAXES IN THE AMOUNT OF
$576.10, TOTAL. THE TAX DISTRICT WOULD CHANGE FROM 1 TO 99.

COMMISSIONER MCKEE WAS CONCERNED ABOUT APPROVING THE ABATEMENT FOR THE UNITED
STATE OF AMERICA. OUR POLICY SAYS SUCH REQUESTS WILL BE DENIED IF IT RESULTS IN A NET LOSS.
THE UNITED STATE OF AMERICA PURCHASED PRIVATE PROPERTY AND SHOULD REPLACE IT. THE
NUMBER OF ACRES WAS QUITE LARGE AND UINTAH COUNTY IS ALREADY IN SHORT SUPPLY OF
PRIVATE PROPERTY TO BEGIN WITH. UINTAH COUNTY SHOULD RECEIVE COMPENSATION.

COMMISSIONER MCKEE MOVED TO APPROVE ALL THE ABATEMENTS AS PRESENTED EXCEPT FOR THE
uNrrED STATE OF AMERICA. COMMISSIONER RAYMOND SECONDED. MOTION PASSED UNANIMOUSLY.

COMMISSIONER MCKEE MOVED TO DENY THE TAX ABATEMENT REQUEST FROM THE UNITED STATES
OF AMERICA, IT IS IN VIOLATION OF COUNTY POLICY AND WILL NEED TO BE REVIEWED.
COMMISSIONER RAYMOND SECONDED. MOTION PASSED UNANIMOUSLY.
Ell ZURBUCHEN ASKED ABOUT THE PURCHASE. COMMISSIONER MCKEE RESPONDED IT WENT
THROUGH THE PUBLIC PROCESS AS IT SHOULD AND THESE CONCERNS HAVE BEEN BROUGHT UP
ALONG THE WAY. DUCHESNE COUNTY HAS ALSO HAD SIMILAR CONCERNS.

CEMETERY CERTIFICATES: JAY HASLEM
DORIS M HUTTAKER AND CHAD WINN HLTFFAKER AND STEVEN DON HUFFAKER PURCHASED BLOCK H
117 LOT 3 SPACES 1,2, AND 3 IN THE VERNAL MEMORIAL PARK CEMETERY.

MIKE GARDINER AND CONNIE SHUMWAY, TRUSTEES OF THE JEAN GARDENER SMITH TRUST,
REQUESTED A CORRECTION ON 'IHEIR CEMETERY CERTIFICATE. THEY HAD PURCHASED II 218 3/4 LOT 1
SPACES 1 THROUGH SIX RATHER THAN H 218 1/4 LOT 2 SPACES 1 THROUGH 6, IN THE VERNAL MEMORIAL
PARK CEMETERY.

COMMISSIONER RAYMOND MOVED TO APPROVE THE CEMETERY CERTIFICATES AND CORRECTION AS
PRESENTED. COMMISSIONER MCKEE SECONDED. MOTION PASSED UNANIMOUSLY.

ALCOHOLIC BEVERAGE SALES TO MINORS: PUBLIC HEARING: JOHN GOTHARD

1. PELICAN LAKE CAFE - GARTH JARMAN, OWNER.
JOHN GOTHARD ASKED IF GARTH JARMAN WAS AWARE OFTHE CHARGE AND HE AFFIRMED. JOHN
GOTHARD PROVIDED A COPY OF THE POLICE REPORT AND COPY OF THE STATE CODE. THE STATE
CODE SAYS THE OWNER POTENTIALLY COULD BE HELD PERSONALLY LIABLE FOR SELLING ALCOHOL
TO MINORS. THE COUNTY WILL NOT PURSUE CRIMINAL CHARGES FOR A FIRS''' . OFFENSE AND
NOTHING THEY SAY AT THIS PRELIMINARY HEARING WILL BE INCRIMINATING.

GARTH JARMAN ADMITTED TO THE OFFENSE. THIS IS THE FIRST IN FIVE YEARS. THE EMPLOYEE HAS A
PLEA TRIAL PENDING FOR NOVEMBER 8 111 . TO ENSURE THIS DOES NOT HAPPEN AGAIN, THE EMPLOYEE
WILL BE TRAINED. SHE IS A WAITRESS AND NORMALLY DOES NOT PARTICIPATE IN ANY SALES. SHE
HAD NOT BEEN TRAINED. HE WAS UNAWARE OF THE ONLINE TRAINING AVAILABLE BUT WILL
CONTACT ROCKY SAMUELS TO LEARN MORE.

JOHN GOTHAM) RECOMMENDED A TEN DAY SUSPENSION HELD FOR A PERIOD OF ONE YEAR. IF THERE
ARE NO OTHER OFFENSES IN THAT YEAR, THE SUSPENSION IS VOID. IF THERE IS AN OFFENSE THE TEN
DAY SUSPENSION WILL GO INTO EFFECT IMMEDIATELY.

JOHN GOTHARD ASKED IF STEVE FISK AND LARRY MURRAY WERE AWARE OF THE CHARGE AND THEY
AFFIRMED. JOHN GOTHARD PROVIDED A COPY OF THE POLICE REPORT AND COPY OF THE STATE
CODE. THE STATE CODE SAYS THE OWNER POTENTIALLY COULD BE HELD PERSONALLY LIABLE FOR

SOFTWARE. THE EMPLOYEES HAVE A TRAINING MANUAL TO STUDY FROM. THERE IS A WEEKLY
REMINDER LOG TO SIGN AS A REMINDER TO USE THE SOFTWARE. MONTHLY MEETINGS ALWAYS
INCLUDE SUCH A DISCUSSION. THEY USE THE SMART AND EASY PROGRAMS THAT ARE AVAILABLE
ONLINE. EMPLOYEES ARE TYPICALLY OVER THE AGE OF 21. THEY WILL GET IN    ToucH

STORY TELLING FESTIVAL: REPORT - LORI OLMSTEAD
THIS YEAR WAS A GREAT SUCCESS. THE FREE PERFORMANCE FRIDAY NIGHT HAD 350 IN ATTENDANCE,
BY A SHOW OF HANDS; NEARLY HALF WERE ATTENDING FOR THE FIRST TIME. THE BED TIME STORIES
RESULTED IN AN AUDIENCE OF 200. THE DINNER THEATRE SOLD OUT. STORIES WERE READ TO MORE
THAN 3000 STUDENTS. THE MIDDLE SCHOOL HAD A FESTIVAL FOR STUDENTS. TWENTY SIX
PARTICIPATED AND WERE EXTREMELY EXCITED. IT WAS A BIG En. THEY WERE ABLE TO BREAK
EVEN AND WILL CONTINUE TO WORK ON NEXT YEAR'S EVENT.

  COMMUNITY mwAcT BOARD (C113) PUBLIC HEARING - PURCHASE OF AIRPORT OSHKOSH
  FAA STANDARDS HAVE CHANGED. THE AIRPORT RUNWAYS MUST BE CLEARED FOR PLANES IN AN
. HOUR AND A HALF. THE CURRENT SNOW PLOW CANNOT COMPLY. THE COUNTY WILL PURSUE A ZERO
  PERCENT LOAN FOR UP TO 8800,000.00 FOR THE AIRPORT TO PURCHASE A NEW SNOW PLOW. THE
  EXPENSE IS ELIGIBLE FOR REIMBURSEMENT SOMETIME IN THE FUTURE.

COMMISSIONER RAYMOND MOVED TO APPLY TO THE CIB BOARD FOR A NEW OSHKOSH SNOW PLOW.
COMMISSIONER MCKEE SECONDED. MOTION PASSED UNANIMOUSLY.

Ell ZURBUCHEN ASKED WHAT SHARE WOULD BE THE CITY'S. IN RESPONSE, THE CITY IS RESPONSIBLE
FOR 25%.

RECESS FOR MUNICIPAL BUILDING AUTHORITY (MBA):

COMMISSIONER MCKEE.' MADE THE MOTION TO RECESS FOR THE MUNICIPAL BUILDING AUTHORITY
AND THEN TO RECONVENE BACK IN TO COMMISSION MEETING WHEN MBA BUSINESS IS COMPLETED.
COMMISSIONER RAYMOND SECONDED. MOTION PASSED UNANIMOUSLY.

COMMISSIONER RAYMOND WELCOMED ERIC JOHNSON.

RESOLUTION #1048-2010 MBAI : AUTHORIZING NOTICE OF NOT MORE THAN 8800,000.00 TAXABLE
LEASE REVENUE BONDS, SERIES 2010 OF THE MUNICIPAL BUILDING AUTHORITY OF UINTAH COUNTY,
UTAH; FIXING THE MAXIMUM AMOUNT, MATURITY, INTEREST RATE AND DISCOUNT ON THE BONDS;
CALLING A PUBLIC HEARING AND AUTHORIZING PUBLICATION THEREOF; PROVIDING FOR THE
RUNNING OF A CONTEST PERIOD; AND RELATED IVIATIERS.
APPROVAL OF THIS RESOLUTION IS THE STEP AFTER CII3 APPROVAL OF A ZERO INTEREST LOAN. A
PUBLIC HEARING WILL BE HELD NOVEMBER 15" 1 DURING 'IFIE COMMISSION MEETING. IT IS STATE
LAW TO STATE THE MAXIMUM AMOUNTS TO ENSURE THERE WILL BE ENOUGH MONEY AVAILABLE TO
COVER THE COSTS. ERIC WILL SEE TO IT THE PUBLIC HEARING NOTICES ARE SENT TO THE NEWSPAPER,
THE COUNTY WILL BE RESPONSIBLE FOR POSTING AROUND THE BUILDING AND ON THE PUBLIC
MEETING NOTICE WEBSITE BY NOVEMBER 1 ST .

COMMISSIONER MCKEE NOTED IT WAS DISCUSSED IN A JOINT CITY AND COUNTY MEETING. THERE
HAS BEEN A LOT OF OPPORTUNITIES FOR THE PUBLIC 10 COMMENT. THIS IS FAA ELIGIBLE FOR
REIMBURSEMENT. THIS FENCING IS VERY IMPORTANT FOR SAFETY AT THE AIRPORT.

RESOLUTION 0048-2010 RI: APPROVING THE ADOPTION BY THE MUNICIPAL BUILDING AUTHORITY
OF UINTAH COUNTY, UTAH OF A PARAMETERS RESOLUTION AUTHORIZING THE ISSUANCE OF NOT
MORE THAN S800,000.00 TAXABLE LEASE REVENUE 130NDS, SERIES 2010 FOR FENCING AT THE AIRPORT;
AND RELATED MATTERS.

RESOLUTION #10-I8-2010 R2: RECERTIFICATION OF THE UINTAH COUNTY JUSTICE COURT - JOHN
GOTHARD.
EVERY FOUR YEARS THE JUSTICE COURT MUST BE RECERTIFIED. THE OPINION LETTER FROM THE
ATTORNEY'S OFFICE AND THE WORK SLIM' FROM JUSTICE COURT HAVE ALL BEEN RECEIVED. JOHN
GOTHARD HAS REVIEWED THEM AND APPROVES.

COMMISSIONER MCKEE MOVED TO APPROVE RESOLUTION #110-18-2010 R2. COMMISSIONER RAYMOND
SECONDED. MOTION PASSED UNANIMOUSLY.

PLANNING, BUILDING AND ZONING: PUBLIC HEARING - MATE CAZIER
1. UINTAH RECREATION: WAIVE FEES FOR A PAVILION AT 3500 NORTH 8000 EAST, TRIDELL. A NEW
PAVILION WILL BE BUILT AT THE TRIDELL PARK. 'THE BUILDING PERMIT 1S S475.00. THE RECREATION
DISTRICT IS REQUESTING THE FEE BE WAIVED AS THEY ARE A GOVERNMENT ENTITY FUNDED BY
MINERAL LEASE MONIES.

COMMISSIONER RAYMOND MOVED TO WAIVE THE BUILDING PERMIT FEE FOR THE RECREATION
DISTRICT AS PRESENTED. COMMISSIONER MCKEE SECONDED. MOTION PASSED UNANIMOUSLY.

2. AREA FUNK: REQUESTING THE COUNTY ACCEPT 600 NORTH IN THE COBBLE CREEK SUBDIVISION.
THIS STREET ACCEPTANCE WILL INCLUDE 600 NORTH AND ABOUT 100 FEET OF 650 EAST. QUENTIN
JOHNSON HAS INSPECTED THE ROAD. IT NEEDED SOME CLEAN UP. THERE WAS A DISCREPANCY AS TO
WHETHER THE ROAD SHOULD BE INSPECTED AGAIN.

COMMISSIONER RAYMOND MOVED TO TABLE THE ROAD ACCEPTANCE UNTIL COMMISSIONER
RAYMOND AND QUENTIN JOHNSON CAN INSPECT IT. COMMISSIONER MCKEE SECONDED. MOTION
PASSED UNANIMOUSLY.

BUREAU OF LAND MANAGEMENT COOPERATIVE AGREEMENT WITH THE CORRECTIONS
DEPARTMENT FOR INMATE LABOR. - JOHN GOTHARD
THE COUNTY WILL BE REIMBURSED 51.25 AN HOUR AND S.49 A MILE FOR INMATE LABOR. THE
SUPERVISION WILL ALSO BE REIMBURSED. THIS IS AN ANNUAL AGREEMENT AND HAS BEEN SIGNED
BY THE BLIVL JOHN GOTHARD RECOMMENDS APPROVAL.

COMMISSIONER MCKEE MOVED TO APPROVE THE BLM AGREEMENT FOR INMATE LABOR,
COMMISSIONER RAYMOND SECONDED. MOTION PASSED UNANIMOUSLY.

UINTAII BASIN MEDICAL CENTER AGREEMENT RATIFICATION; PROVISION OF MEDICAL SERVICES -
UTAH CODE SECTION 17-50-302. COMMISSIONER RAYMOND
UBMC HAS PUT UP A CLINIC WITHIN VENAL CITY LIMITS. IN ORDER TO MOVE IN AND GET A VERNAL
CITY BUSINESS LICENSE, THEY MUST HAVE AN AGREEMENT WITH UINTAH COUNTY. THERE HAS BEEN
A LOT OF DISCUSSION BEFORE AN AGREEMENT COULD BE FINALIZED.

COMMISSIONER RAYMOND MOVED TO RATIFY THE UBMC AGREEMENT. COMMISSIONER MCKEE
SECONDED. MOTION PASSED UNANIMOUSLY.

UINTAll TRANSPORTATION SPECIAL SERVICE DISTRICT: RATIFY APPROVAL FOR IRRIGATION
BARRICADE - 420 NORTH AGGIE BOULEVARD. COMMISSIONER RAYMOND
THE IRRIGATION SYSTEM CONTROLS ARE ABOVE GROUND WITHIN THE COUNTY RIGHT OF WAY BUT
NOT WITHIN ANY TRAVEL SURFACES. THE BARRICADES WERE NEEDED TO PROTECT THE CONTROLS
FROM POTENTIAL HAZARDS.
COMMISSIONER RAYMOND MOVED "f0 RATIFY THE BARRICADE. COMMISSIONER MCKEE SECONDED.

ED ZURBUCHEN ASKED FOR ADDITIONAL INFORMATION. THERE ARE TWO BARRICADES AND THEY
LOOK VERY NICE. THEY ARE NOT A HINDRANCE TO AUTOMOTIVE OR PEDESTRIAN TRAFFIC.

COMMISSIONER BURNS CALLED FOR A VOTE. MOTION PASSED UNANIMOUSLY.
