HEADQUARTERS, 25 INFANTRY DIVISION SCHOFIELD BARRACKS, HAWAII 96857-6000 DEPARTMENTTHOF THE ARMY APVG-CG 21 May 2008 MEMORANDUM FOR DISTRIBUTION SUBJECT: Policy Memorandum SJA-4, Prohibition Against Using Cellular Phones While Operating Motor Vehicles On 25th ID Installations. 1. References. a. 32 Code of Federal Regulations, Section 634.25, 28 November 2005. b. AR 190-5, Motor Vehicle Traffic Supervision, 22 May 2006. c. AR 385-55, Prevention of Motor Vehicle Accidents, 12 March 1987. 2. Applicability. This policy applies to all uniformed military personnel, DoD civilian personnel, contractors, family members, and other non-DOD drivers wishing to drive on 25th ID installations. 3. Policy. a. This memorandum establishes policy for all motor vehicles, whether tactical, non-tactical, privately owned, or government owned, operated on 25th ID installations. b. Vehicle Operators on a 25th ID Installation and operators of government owned vehicles shall not use cell phones unless the vehicle is safely parked or unless they are using a hands-free device. The wearing of any other portable headphones, earphones, or other listening devices (except for hand-free cellular phones) while operating a motor vehicle is prohibited. Use of those devices impairs driving and masks or prevents recognition of emergency signals, alarms, announcements, the approach of vehicles, and human speech. c. This policy is punitive in nature. Violations of this policy may be punished under Article 92, Uniform Code of Military Justice, as a violation of a lawful order. Civilians, contractors, and visitors to the installation who fail to comply with this policy are subject to administrative action to include loss of driving privileges on post and removal from and/or denial of re-entry to this installation. Community Commanders will enforce this policy IAW Policy Memorandum USAG-HI 16. 4. Expiration Date. This policy remains in effect until cancelled or superseded in writing. ROBERT L. CASLEN JR.
