Subject: PAYMENT OF SHARE FOR CONSTRUCTION OF NEW
HQ ML&C DEPTT. OFFICE BUILDING.
Reference: letter No. 23/490/A/RD/LR/91 dated 25-03-2011
To consider the payment of share for construction of new office building for HQ
ML&C Deptt amounting to Rs. 0.500 million. Govt of Pakistan has accorded sanction vide
ministry of Defense diary No.675/Secy/10,dated 16-01-2010 for the said purpose
It is pertinent to mention here that earlier a sum of Rs. 5.00 million was paid by
LCB which was objected by the Audit authorities and as a consequence of conversion of the
audit objection into audit para the amount was refunded and the Objection/para settled. Budget
provision does not exist.

Subject: ASSISTANCE PACKAGE.
To consider an application submitted by Mst. Rehana Arshad Wd/o Arshad Masih
S.Worker requesting therein for financial assistance as per Govt. of Pakistan Estt: Division
Islamabad O.M.No. 710/2005-E2 dated 13-06-2006.
It is apprised that Late Arshad Masih was working as Sanitary Worker and died
while in service. Payment of Rs. 2,00,000/- is admissible to his aggrieved family as per said
Assistance Package approved vide CBR No. 14 dated 13-01-2009. The expenditure shall be met
under head H-1.
The case is placed on the table.

Subject: ASSISTANCE PACKAGE.
To consider an application submitted by Mst. Sharifan Bibi Wd/o
Muhammad Saddique Naib Qasid requesting therein for financial assistance as per Govt. of
Pakistan Esst: Division Islamabad O.M.No. 710/2005-E2 dated 13-06-2006.
It is apprised that Late Muhammad Saddique was working as Naib Qasid and
died while in service. Payment of Rs. 2,00,000/- is admissible to his aggrieved family as per said
Assistance Package approved vide CBR No. 14 dated 13-01-2009. The expenditure shall be met
under head H-1.

Subject: RE-IMBURSEMENT OF MEDICAL CHARGES OF RS. 30,817/-
To consider an application dated 24-02-2011 submitted by Mr. Muhammad
Irshad, Naib Bill Distributor, Cantonment Board Lahore for reimbursement of medical charges
amounting to Rs. 30,817/- incurred on the treatment of his wife who remained hospitalized in
the Fauji Foundation Hospital Lahore Cantt. The case has been referred by the MS CGH and
bills have also been verified by him and the treating doctor.

R.A BAZAR WALTON CANTT FOR 2ND & 3RD QUARTER 2010-11.
To consider the purchase of medicines for Cantt General Hospital and Cantt
Board’s dispensaries for 2nd & 3rd quarter 2010-11 as mentioned below. The medicines are to be
purchased directly from the manufacturers/authorized distributors at the trade prices/hospital
discount. The subject rates were invited by the Medical Supdt, C.G.H directly from
manufacturing firms/distributors and the quotations were opened by the purchase committee
consisting of Dr. Javed Rashid, MS CGH, Dr. Mumtaz Rehman, SMO, Dr. Saud Ahmed Khan,
SMO, Dr. Zainab Jahangir, M.O and Dr. Capt. Muhammad Rasheed Minhas, Incharge Model
Dispensary R.A Bazar. Total expenditure on this account comes to
Rs. 26, 52,438/- against the budget provision under head F(I)b.

Subject: - REGULARIZATION OF EXPENDITURE
To consider regularization of the expenditure amounting to Rs. 1,27,670/- on
account of purchase of K-2 Kerb Stone as the audit authorities during the course of audit for the
year, 2009-10 have raised the following observation vide OL No.65:-
The observations were duly replied and contested with cogent points and record
evidence and the audit in concluding remarks recorded in the minutes of discussion desired that
“the amount may please be got regularized from the Board”.
In view of above the expenditure of Rs. 1,72,670/- may please be regularized for
settlement of O.L No. 65(Item No. 53) of 2009-10. The reasons are briefly elucidated as under:-
a- The rate of. Rs. 26/- red colour and Rs.23/- grey colour Kerb Stone each were
approved by the Board vide CBR No. 39 dated 22-2-2010 wherein it was
specifically mentioned that “ most essential quantity shall be procured on
as and when required basis and the expenditure on this account shall be met
out of relevant heads”.
b- M/s Concrete Concepts is the only manufacturer of the product K-2 Kerb Stone
and the rates are quite reasonable hence cannot be compared with local market.
c- The goods were purchased directly from the manufacturer to ensure quality of the
products and enlistment / registration of firms for supply of kerb stone is not
mandatory.

Item No. 8
Subject:- COMMISSIONING OF COMMUNITY CENTRE
To consider a proposal for leasing out the tenancy Cantonment Fund
Property Community Centre, Gole Bagh, Sarwar Road, Lahore Cantt for a term of 5 years on
private treaty without any premium on the terms and conditions to be approved by the DML&C
Lahore Region as per instructions of ML&C Deptt. Brief facts of the case are :-

i- The building in question was constructed out of Grant by Prime
Minister of Pakistan through Ms Kashmala Tariq Lady MNA.
ii- Since completion of the project the building i.e. 2009 it is lying vacant
and unproductive.
iii- Efforts were made in the past to lease out the said premises to catering
firms but the same could not be concluded due to multiple administrative hurdles.
iv- The issue remained pended with Standing Committee for Development
for more than 2 years is still unresolved despite a large number of meetings,
briefings, presentations.
v- Pursuant to the commitment of DGML&C before Standing Committee
of National Assembly on Development the lady MNA Kashmala Tariq was
twice approached to spare time for inauguration of the said project but of no
avail.
vi- The building is prone to deterioration and decay being vacant and audit has
already raised objection to the non-functioning of the facility vide O.L. No. 112
during audit 2009-10.
In view of aforementioned reasons it is suggested that the same may please be
rented out to private party for a term of 5 years so as to avoid future complications and to make
the building productive.

To note action taken by the Cantonment Executive Officer with the prior approval
of President Cantonment Board under Section 25 of the Cantonments Act, 1924 for creation of a
post of S/D’Man in BPS-11 for prompt and timely disposal of the work of Land Branch.

STAFF
To consider a proposal for imposing an embargo on regular appointments of
Enforcement Staff in Lahore Cantonment because the staff gets involved in malpractices and
disciplinary action against permanent incumbents is difficult and prolonged; whereas the
temporary staff can be removed instantly.

Subject: INSTALLATION OF TUBE-WELL NADEEM CHOWK
To consider report of Cantonment Engineer regarding non functioning of Cantt Board
Tube well installed in Nadeem chowk. The tube well has been checked by technical staff and it
has been observed that the tube well is not repairable and the report of technical staff has been
endorsed by the KSB Company vide their letter No. KSB/SER/PCZ-1606/02 Dated 07-01-2011.
As the strainer has been damaged badly. It had been throwing sand. Presently, the tube well has
been stopped. It requires new boring for installation. The said Tube-well was installed during the
year, 1987.
It is pointed out that one tube well was sanctioned in B.E 2010-2011 to be installed in
Donger Mohallah Sadder area, but as per said report of KSB company the existing tube well in
Donger Mohallah is delivering 210m3 /hr with efficiency of 69%. The power consumption
0.22kw/m3 is with in the allowable limits. The operation of this tube well should be continued.
New tube well at this stage is not required. It is, therefore, requested that tube well of Donger
Mohallah may be installed in Nadeem chowk area.

Subject: REFUND RS. 8088/- ON ACCOUNT OF PROPERTY TAX
To consider an application submitted by Wing Comdr. (Retd) Khalid Kamal
Tamton wherein he has requested to refund Rs. 8088/- deposited on account of property tax and
water charges in respect of property No.115/B Munir Road Lahore Cantt.
He stated that he erroneously deposited the said dues whereas he is Retired Air
Force Officer, and is entitled to avail 100% exemption of property tax and no Cantt Board
water/sewerage connection exist in the premises. The Engineering Branch checked and verified
that there is no Cantt Board Water/Sewerage connection exists in the said bungalow. It is
mentioned that the property is held in the name of applicant and he submitted relevant
documents for the year 2010-2011 which are in order. Details of dues erroneously deposited into
Cantt Fund vide Bank Challan No.8208 dated 28-09-2010 is as under:-

Subject:- COLLECTION OF TIP TAX FROM DHA PHASE VI- & VII
At present the phase VI & VII of DHA are outside limits of Cantonment but the
process of extension of limits to include the same into LCB has already been started. Survey /
demarcation of this area is being carried out and would be completed very soon.
As the area comprising phase VI & VII of DHA is moderately inhabited /
developed, considerable transfers of both plots and houses are taking place without levy /
collection of TIP tax. It is, therefore, proposed that LCB, may ask the DHA to refer all cases of
transfer of property to LCB as DHA cannot levy / collect this tax as per provisions of law.

Subject: CANCELLATION OF PARKING STAND – OPPOSITE
KONICA LAB KHURSHID ALAM ROAD.
To consider the cancellation of Parking Stand Opposite Konica Lab. Khurshid
Alam Road, Lahore Cantt. as the Station Headquarters, Lahore Cantt: vide letter No.321/7/Q-
1/(L), dated 03-03-2011 alongwith its enclosures and also directed to terminate the tax stand
located opposite Konica Lab, R. A. Bazar, by 4th March 2011 and also install “NO PARKING
BOARD”.
It is mentioned here that the collection rights of Parking fee at Parking Stand
opposite Konica Lab R. A. Bazar, Lahore Cantt: were auctioned on 12-07-2010 after wide
publicity in the Daily “Nawa-e-Waqt” dated 03-07-2010. Sh. Abdul Sami offered the highest bid
of Rs. 90,000/- of the said parking stand for the period w.e.f 24-08-2010 to 30-06-2011. The
Board vide CBR No.32 dated 15-07-2010 approved the same. Highest bidder has deposited 50%
amount of the bid. As per instructions contained in the Station Headquarters, Lahore Cantt:
letter mentioned above, the auction of collection rights of Parking Fee needs to be cancelled and
proportionate balance amount be recovered from the highest bidder upto 4 March’2011 i.e
cancellation of contract.

Cantt: has not been completed as on 05-05-1997 due to non-payment of transfer fee etc. by

name and also requested for transfer of tenancy rights of said shop in favour Mr. Sohail Raza S/o
Muhammad Jahangir.
It is mentioned here that CB Shop No. 22 CB Plaza Tufail Road, Lahore Cantt:
transferred in favour of Mr. Shaukat Parekh vide CBR No. 25 dated 31-03-1997 on the request of
original allottee Mr. Muhammad Nazir. But the transferee Mr. Shaukat Parekh failed to complete
the transfer formalities so far. The said shop exists in the name of Mr. Muhammad Nazir as per
record of this office. The rent of shop is also being paid by Mr.Muhammad Nazir. The previous
CBR No. 25 dated 31-03-1997 may please be cancelled as the transferee did not fulfill the
transfer formalities. After cancellation of said CBR the tenancy rights transfer in favour of

reference has informed that due to lapse of fund the construction work was stopped. The site
inspected by the S/D man of this office & reported that at site there is construction at DPC level.
As per section 183-A of Cantt Act, 1924 two extensions can be allowed by the

extension to House No. 27, comprising Survey No. 94, West Ext)/27, measuring 800 Sq.yds
situated at Sarwar Colony, Sarwar Road, Lahore Cantt.
Description
MEO has apprised that House No. 27, comprising Survey No. 94 (west ext)/27,
measuring 800 Sq. Yds situated at Sarwar Colony, Sarwar Road, Lahore Cantt is held on lease in
Schedule- IX-B of the CLA Rules 1937 in the name of PA-10098 Major General (Retd) Sabih
Uddin Bokhari HI (M) SJ, S/O Faqir Syed Saleem Uddin Bokhari for residential purpose. The
date of expiry of lease is 27-02-2099.
Initially the case was referred by MEO vide letter No -38/Ask/94-W/H.NO.27/25,
dated 19-02-2011, Lahore Cantt Board returned the same with the observations that the lessee
has already occupied the area applied for extension. Moreover, the dimensions of existing house
and proposed extension are not mentioned in site plan traced on Schedule-V Form. Besides to
above, proposed additional land is classified as “C” whereas premium of said land has already
been deposited in Govt. treasury through your office, which should be deposited in Cantonment
Fund.

In turn MEO, Lahore Circle vide letter under consideration has informed that the
lessee of subject House has already deposited a sum of Rs. 13,16,000/- (10,88,000/-+2,28,000/-)
on account of premium of additional land in accordance with the directions contained in GHQ
AG`s Branch (Housing Dte) Rawalpindi letter No. HD/AOHS-G/27 S.R/MS-9266, dated 14-07-
2006 and even No dated 29-10-2007 and ML&C Deptt Rawalpindi letter No. 20/2060/ Lands/
ML&C/ 2005, dated 14-03-2007 vide TR No. 101559, dated 21-08-2006 amounting to
Rs. 10,88,000/- and TR No. 637396, dated 06-09-2008 amounting to Rs. 2,28,000/-.
MEO has further apprised that the above said amount has been deposited into
Government treasury by this office. However, at the time of initiating the proposal for obtaining
Government sanction of the additional area measuring 165 Sq. yds the case will be processed
further to refund the above said amount of Rs. 13,16,000/- to Cantonment Board after
Government sanction. It may please be noted that cost of land is calculated @ Rs. 2, 00,000/-
per Marla whereas market value of land in that area is Rs. 10 to 12 Lac per Marla
(approx).
The site was checked by SDM of this office and reported that the lessee has
already occupied the area of extension measuring 165 Sq. yds which is classified as “C” land.
It is pertinent to mention here that a case of similar nature was placed before the
Board in its meeting held on 11-08-2009 and the Board vide its CBR No. 41, dated 11-08-2009
resolved as under:-
“Considered. The Board resolved to seek prevalent market value cost against the
applied reclassified Class-C land. MEO Office be asked to furnish willingness of the
lessees to proceed further in the matter”.

Subject: REGULARIZATION OF UNAUTHORIZED CONSTRUCTION IN EDEN
AVENUE EXTENSION / EDEN CITY HOUSING SCHEME.
To consider the proposal of disposal of plots in Eden City Housing Scheme
Pledged with LCB through auction in lieu of total payable amount of
Rs. 2,71,08,465/- on account of composition fee & other allied charges etc. for regularization of
unauthorized construction carried out in Eden Evenue Extension and Eden City Housing Scheme
as per consent of M/s. Eden Developers (Pvt) Ltd.
The background of the proposal is that M/s. Eden Developers (Pvt.) Ltd carried
out unauthorized construction of 212 Houses and Shops in Eden Avenue Extension Scheme &
some House in Eden City Housing Scheme.
In February 2010, the Developers submitted Building plans for regularization of
un-authorized construction along-with willingness of composition on stamp paper dated
10-02-2010. The case was placed before the Board in its meeting held on 22-02-2010 for
consideration. The Board vide CBR No. 12, dated 22-02-2010 approved the payment of
composition fee amounting to Rs. 2, 39, 56,300/- in eight equal quarterly installment alongwith
other allied charges.
As per decision of the Board, the Developers deposited 1st Installment of Rs. 30,
73,352/- vide Pay Order No. 2174839, dated 13-03-2010 without any hesitation but, thereafter,
they went into appeal before the Director Military Lands & Cantonments, Lahore Region,
Lahore Cantt under Section 274 read with Schedule-V of the Cantonments Act, 1924 followed
by a Writ Petition No. 11946/10, dated 02-06-2010 in Lahore High Court, Lahore. The case is
still subjudiced in relevant courts.
Now, M/s. Eden Developers has offered that 47 Commercial plots already
mortgaged against security of Development work (i.e. Roads, Parks, Graveyard etc) in respect of
“Eden City Housing Scheme” vide mortgage deed Registered as No. 5126, Book No. 01,
Volume No. 1091, dated 27-08-2008 may be adjusted in lieu of total payable amount by the
Developers on account of composition fee etc. The area of these 47 mortgaged plots is 229
Marlas and 62 Sft and estimated price comes to Rs. 458 Million @ Rs. 2.0 Million each. The
estimated cost of Development works comes to Rs. 450 Million.
Before the proposal offered by the M/s. Eden Developers is accepted, it should be
confirmed that whether the Development works for which plots were mortgaged are in progress
& how much work has been completed at site. It is pertinent to mention here that if 50% of
Development work has been completed at site, then Board will be in position to adjust 50%
mortgaged plots in lieu of composition fee and other allied charges amounting to Rs.
2,71,08,465/-

To consider MEO Lahore letter No. L-38/139/SRR/Ask-15/I/34 dated 02-04-2011
for Re-Classification of land situated at Sarfraz Rafiqui Road, Lahore Cantt from class “C” to B-
4.
In this connection, it is apprised that the lessees of house / plot No. 11, 12, 13, 14,
15, 16, & 17 have encroached upon class “C” land of an area measuring 555 Sq.yard or 22.02
Marlas. The Govt. of Pakistan, Ministry of Defence (ML&C Deptt) Rawalpindi has already
accorded permission to grant extension in cases of Askari villas vide Govt. of Pakistan
corrigendum No. 30/12/HD/PT-1/51/D-30/07 dated 22-09-2007.
Previously the case was placed before the Board and the Board vide its CBR No.
41 dated 11-08-2009 “Considered. The Board resolved to seek prevalent market value cost
against the applied reclassified class-c land. MEO Office be asked to furnish willingness of
the lessees to proceed further in the matter.”
The same was forwarded to the MEO vide this office letter
No. 3800/S.R Road/5420 dated 03-09-2009 to obtain willingness of the lessees to the effect
whether they are willing to get lease of class c land on prevalent market values or otherwise.
The MEO forwarded the requisite willingness certificate / application dated 16-
09-2009 only of Mr. Arslan Hameed Mian lessee of plot No. 15, out of seven (7).
Later on the case was again placed before the Board and the Board vide its CBR
No. 24, dated 22-12-2010 resolved “Considered. The Board resolved to proceed further with
case of Mr. Arslan Hameed Mian lessee of Plot No. 15, out of seven. Notices to the rest of
occupants be served either to vacate the land or get lease at market value”
The same was forwarded to MEO vide this office letter No. 3800/Sarwar
Road/DSP01/11/1477, dated 11-01-2011 for their further necessary action.
Now the MEO, has requested vide letter under reference to issue NOC for
reclassification of land from “C” to B-4 in respect of Plot No. 15, Sarfraz Rafiqui Road, Lahore
Cantt.

To consider a proposal for altering the pattern of holding Annual Flower Show
owing to the wastage of finances, energy and precious time. It is suggested that in future the
following pattern may be adopted to avoid the wastage of precious resources:-
i. Flowers be displayed in open public places / parks/ centre medians etc having
open view instead of display of stalls in Pakistan Park. Following roads / parks
are proposed to be declared as Flower Show display sites and special flower
beds are to be created on the pattern of Flower Show exhibited in the Pakistan
Park.

Army Auditorium or at the Community Centre of Cantonment Board, Lahore
in a simple and sober manner wherein only the winners are to be invited.
iv. Malis be given cash prizes to encourage them for their dedicated services and
zeal.
The above proposal is expected to save the public funds besides an open view for all
which will also improve the beauty and aesthetic of the vicinity.

Subject: INSTITUTION OF SUIT AGAINST DEFAULTERS FOR RECOVERY OF
MONEY UNDER SECTION OF 96 AND 259 THE CANTONMENT
ACT.1924.
To consider the report of Office Supdt. (Legal) that there are so many defaulters
regarding payment of money and huge amount is to be recovered from the under mentioned
defaulters.
It is pertinent to mention here that Cantonment Board Lahore has the power to
institute the recovery suits against the defaulters under section 96 and 259 of Cantonment Act
1924.It is therefore proposed that Cantt Board may file suits against defaulters for this purpose,
the Board may delegate powers to Cantonment Executive Officer to institute the Recovery
suits against any defaulter of the Board or any recoverable amount of the Cantonment Board
Lahore as well as all other power i.e appear and plead ,act and answer in the above courts or any
appeals revision statement, accounts, exhibits, comprises or other documents whatsoever, in
connection with the said matter or any matter arising there from and also to apply for and receive
all documents or copies of documents, deposition etc., and to apply for and issue summons and
other writes or subpoena and to apply for and get issued any arrest, attachment or other
execution, warrants or order and to conduct any proceeding that may arise there out, and to apply
for and receive payment of any or all sums or submit to exercise the power and authorities
hereby conferred on the Cantonment Executive Officer whenever he may think fit to do so.
And to do all acts legally necessary to manage and conduct the said case
in all respects, whether herein specified or not .as may be proper and expedient.
And I/we herby agree to ratify and confirm all lawful acts done on my /our
behalf; under or by virtue of these present or of the usual practice in such matter .
In this regard all kind of expenses i.e. court fee, stamp papers and Misc expenses to
be incurred of suit and also shall be allowed to engage a senior counsel if required during the
pendency of litigation.
