Initial advice on liability decision on new claims, or old claims subsequently revived by $
workers.
Non-litigated Work Health Stage 1 - For work involving considering client documents, $
claims except exceptional obtaining initial instructions, and providing initial advice on
circumstances specific issues as required.
Stage 2 - Advising, acting and all attendances on behalf of $
Employer in relation to negotiating, discussing and finalising
settlement of worker’s claim (including all work to settle
claim eg. Deed or Commutation) and all work associated
with settlement.
Disputed Work Health claims Stage 1 - Considering client documents, obtaining $
to end of litigation except instructions and providing initial advice on specific issues as
appeals and exceptional required.
circumstances Stage 2 - Advising, acting, appearing on behalf of Employer $

Memorandum of Agreement, Deed and/or Commutation
and/or Notice of Discontinuance, receiving decision of Work
Health Court, and advising and reporting to client regarding
hearing and decision.

Firm Not To Accept Certain Instructions - COMPONENT 6 (Work Health)
The Firm will not, during the term of the Contract, accept instructions to act against
the Territory/client agency in work health matters which are within the Scope of AGREED
Services. If requested by the SFNT, the Firm will divest itself of any such existing
matters within the time agreed by the parties. Tenderers should refer to the NOT AGREED
attached Contract for further terms and conditions relating to this issue.

4 CAPACITY
