                        IA    TECHNICAL SPECIFICATIONS OF SUPPLY OF SS TUBES AND FITTINGS

                 1. Scope

             This standard specification, together with the data sheets attached herewith, covers the
             requirements for the design, materials, inspection, testing and shipping of instrument tube and
             fittings as per the details given below, which includes the following types:

                 a) Stainless steel compression fittings (for stainless steel tube)

In the event of any conflict between this standard specification, data sheets, statutory regulations,
related standards, codes etc., the following order of priority shall govern:

a) Statutory Regulations
b) Data Sheets
c) Standard Specification
d) Codes and Standards

    3.   Bids

Vendor's quotation shall be strictly as per the bidding instructions to the vendor attached along
with the material requisition.
Vendor's quotation shall include the following;

a) Compliance to the specifications.
b) Whenever specifically indicated, detailed specification sheet for each item, which
shall provide the information regarding type, size, material of construction etc. of
the items. The material specifications and units of measurement for various items in vendor's
specification sheets shall be to the same standard as those indicated in
purchaser's data sheet.
c) In case vendor has any valid technical reason to deviate, they must include a list of deviations
item wise, summing up all the deviations from the purchaser's data sheets and other technical
specification along with technical reasons for each of these deviations.
d) Catalogues giving detailed technical specifications, model decoding details and
other information for each type of instrument tube fitting covered in the bid.
 All documentation submitted by vendor including their quotation, catalogues, drawings,
installation, operation and maintenance manuals etc., shall be in English language only.

 4 Designs and Construction

Stainless Steel Tubes

   1.    Area classification shall be Class-I, Division-I; Group-D as per NEC or Zone-I Group IIA /
         IIB as per IS / IEC specification for equivalent specifications.
   2.    All the items shall be suitable for compressed natural gas service and meet following
         specifications.
   3.    The tubes shall be 316L Stainless Steel fully annealed, seamless and cold drawn as per
         ASTM A 269.
   4.    The hardness of the tubes shall be limited to HRB 70-79. Equivalent hardness as
         Rockwell superficial scale (30T/15T) or Vicker's hardness scale shall also be acceptable.
   5.    Tubes shall have good surface finish and shall be free from scratches burrs etc. and
         suitable for bending.
   6.    Maximum working pressure shall be as per Table
   7.    Tubes shall preferably be supplied in length of 5 to 6 metres without welding in between.
   8.    Tube length less than 5 meters shall be rejected.

5. Technical Specifications for SS 316/316L Instrument Tubing

1.     Tubing manufacturer should have ISO 9001/ 9002 certification and as well as product
       approvals from TUV and JIS.
2.     Quality System of the Tubing Manufacturer should have approval from ASME quality
       system certificate as material organization
3.     Tubing should be dual certified as TP 316 / 316L. Also, tubing should be clearly marked
       with heat code, lot code, outer diameter and wall thickness as in the inspection certificate.
4.     Testing of the tubing should be in accordance with SS 219711, SS219713, DIN 17458
       TC1, NFA 49 – 117, ASTM A213, ASTM A269, ASTM A789 AND ASTM B667.
5.     Tubing sizes upto 1” OD should be bright annealed.
6.     Tubing should have a minimum of 2.5% Molybdenum so as to ensure high resistance to
       corrosion.
7.     Tubing should have carbon content < 0.030%.
8.     The tubing should be supplied with plugged ends.
9.     Tubing hardness should be max of HRB 80
10.    Tolerance for 316/316L tubing from 6 to 42mm OD as per DIN/2391/EN 10305-I &
       Tolerance on wall thickness should be +/- 10%
11.    Tubing supplier should furnish an “INSPECTION CERTIFICATE” indicating:
       1)      Material description
       2)      Steel making process
       3)      Heat code
       4)      LOT code
       5)      Leak test : Eddy current test according to ASTM A-450
       6)      Test results of chemical composition, tensile test, hardness test, flaring test and
               flattening test.


6. Technical Specifications for SS 316/316L tube Fittings

1.     Tube Fitting manufacturer should have ISO 9001 certification and as well as product
       approvals from TUV, ASME, BSI, DNV, Lloyds Registrar of Shipping & PED etc
2.     The tube fitting shall consists of four machined pieces, i.e. – body, front ferrule, back
       ferrule and nut. The design configuration of all components shall be such as to present
       surface-to-surface contact, one part to another, keeping unit stresses below galling
       levels.
3.     A two-ferrule flare less stainless steel tube fitting shall be certified that it is produced
       under a Quality Assurance Program that has been audited by the ASME.
4.     All metallic fittings shall have a gaugeable shoulder. There will be no radius at the point
       where the shoulder meets the neck of the fitting body. The gaugeable shoulder will allow

       a Gap Inspection Gage to be inserted between the nut and shoulder; 180 flush around
       the neck of the fitting, to check for insufficient pull-up. The Gap Inspection Gage will not
       fit between the nut and shoulder of a sufficiently pulled-up fitting on the initial pull-up and
       it must be consistently reliable.
5.     The fittings shall be capable of holding the maximum working pressure of the tubing
       without any leak after sufficient pull up of the nut as indicated by the manufacturer for
       different sizes.
6.     The back ferrule shall have a machined recess on the inside diameter and shall have
       complete surface hardening to substantially reduce the required pull up torque. Both the
       requirements i.e., complete surface hardness and machined recess shall be met for all
       rear ferrules of sizes ranging from ¼” to 2” OD & 6mm to 50mm OD.

7.    The tube-fitting nut shall be internally plated with either high purity silver or zinc in order
      to eliminate chances of galling during assembly.
8.    All the fittings end connections shall be compatible to tube of hardness less than or equal
      to RB 80.
9.    Stainless Steel Tube Fittings made from bar stock (straight configurations) should meet
      ASTM A276 / ASME SA479 standards and those made from forgings (including elbows,
      crosses and tees) should meet ASTM A182 / ASME SA182 standards
10.   The manufacturer shall provide material compliance certificates confirming that the raw
      material for fittings conform to ASME section – II and ASME section – III sub section NB,
      NC and ND.
11.   The fittings shall hold the tube with a colleting action, producing a firm grip on the tube
      without substantially reducing the tube wall thickness.
12.   It shall not torque the tubing during original or subsequent make-up of the connection and
      should use geometry for inspection before or after make-up.
13.   The fittings shall not require disassembly for inspection before or after make-up.
14.   The tube seat counterbore in the body shall be faced flat 90  to the axis of the tubing to
      minimize tube expansion and subsequent galling.
15.   The sealing and gripping power of the fitting shall be controlled such that the action
      between ferrules will overcome commercial variations in tubing wall thickness, hardness,
      diameter and installer skill.
16.   The fittings body shall have no machined stop or shoulder to preclude additional
      tightening in subsequent make up.
17.   The front ferrule shall produce a long, smooth repeatable seal by sealing contact with
      body.
18.   The front ferrule shall always remain in an elastic condition to compensate for thermal
      stresses and to accomplish repeated make and break.
19.   The rear ferrule shall collet the tubing surface, improving the performance of the tubing in
      systems of high impulse or vibration due to support of the tube immediately behind the
      grip point.
20.   Stainless Steel bar stock material from which fittings are made shall be restricted to a
      maximum carbon content of 0.05% to provide better weldability and increased corrosion
      resistance.
21.   The Statistical Quality Control program of the fittings manufacturer shall have an AQL
      level of 1.5 and the inspection shall be done in accordance with C=0 plan
22.   All fitting components shall be roll stamped to identify manufacturer and material
23.   All component parts of the fitting shall be of the same material.
24.   The manufacturer shall furnish test procedure and typical test reports of tests conducted
      as required:

      a. Hydrostatic Pressure Test: should undergo testing conducted to evaluate the tube
         gripping ability of assembled tube fittings to sustain hydraulic over pressure, attaining
         up to 3.5 times working pressure without hydraulic leakage and upto 4 times the
         working pressure without fitting material rupture or tube slippage.
      b. Helium Proof / Nitrogen Re-make Test: should undergo testing conducted to evaluate
         the performance of tube fittings with 1.5 times the working pressure with Helium and
         at rated working pressure with Nitrogen after every re-make for 25 such re-makes.
      c. Helium Leak Test: should undergo testing to ensure that leakage is not in excess of
                  -9
         1.0 x 10 atm-cc/sec with the test assembly evacuated to approx. 20 millitorr while
         maintaining a differential pressure of 1 atm between the inside and outside of the
         assembly.

        d. Tensile Pull Test: should undergo testing conducted to evaluate the grip of tube
            fittings on tubing under tensile load. should pass the tensile test conducted using the
            tensile test stand where the shear load exceeded the force exerted on the tube by
            the system fluid at 4 times working pressure as calculated by the following equations:
            Tube calculated burst pressure = working pressure x 4,          Minimum       allowable
            force = tube calculated burst pressure x tube cross-sectional area
        e. Sodium Chloride Stress Test: should undergo testing conducted to evaluate the
            effect of an environment that promotes stress corrosion cracking (SCC); conducted
            as per ASTM B117-95 standards.
        f. Vibration Test: should undergo testing conducted to evaluate the amount of
            cantilever deflection that can be applied to a tube and fitting assembly and still pass
            through 10,000,000 cycles without failure.
        g. Tube Burst Test: should undergo testing conducted to evaluate the grip of tube
            fittings on tubing at the burst pressure of the tubing.
        h. Fire (Burn) Test with water quench: should undergo testing conducted to evaluate the
            performance when exposed to a 1,500F burn and a water quench based on API 607
            standards.
25.     The authorized representative of the manufacturer shall have the ability to conduct
        Installation Training Program.
26.     The authorized representative of the manufacturer shall have the ability to conduct Leak
        Audits.

7. Name Plate

 No separate nameplates are required on the fittings. However, manufacturer's name/trademark
should be punched on a visible place on the body of each fitting for easy identification.
For valves following shall be stamped

a) Material of construction to the same standards as in purchaser's data sheets.
b) Cold working pressure of each item to the same standards as in purchaser's data
sheets.
c) Manufacturer's identification and model number.
d) Flow direction (if applicable)
e) Material of construction.

8. Inspection and Testing

Unless otherwise specified, purchaser reserves the right to test and inspect all items at vendor's
works, inline with the inspection test plan for instrument tube fittings.
 Vendor shall submit following test certificates and test reports for purchaser's review:
 Type test reports for following tests in accordance with BS-4368 Part IV:
a) Hydrostatic proof pressure test.
b) Minimum hydrostatic burst pressure test.
c) Disassembly and reassembly test.
d) Minimum static gas pressure (vacuum) test.
e) Maximum static gas pressure test.
f) Hydraulic impulse and vibration test.
 Material test certificates as per clause 3.1 B of EN 10204.

Routine test reports for following tests:

a) Hydrostatic Test
Instrument tube fittings shall be hydrostatically tested at ambient temperature at test pressures
given in Annexure 1 of this specification. During and after the hydrostatic test, the tube fittings
shall not show any leakage or rupture.
b) Pneumatic pressure test
The fittings shall be tested at 7 kg/cm2g of dry air. There shall not be any visible
leakage when immersed in water or coated with a leak detection solution.
c) Disassembly and reassembly test.
d) Hardness verification:
Hardness test shall be carried out on each rod used for machining ferrules. Vendor
shall ensure that after machining, the finished ferrules shall meet the required
hardness given in the specification.
f. Dimensional test report

Valves

 Vendor shall submit following test certificates and test reports for purchaser's review:
a) Material test certificates as per clause 3. IB of EN 10204 for body and bonnet and as per
clause 2.2 for other parts.
b) Dimensional test report.
c) Pressure test report
d) Hydrostatic proof and burst tests as per MSS-SP-99 for each design and size of valve.

Pressure Test Requirements

Each valve shall be subjected to hydrostatic pressure test at ambient temperature for both seat
and shell leakage at test pressures given in this specification as per manufacturers standard.
During and after the hydrostatic test there shall not be any visible leakage.

Pneumatic Test

Each valve and manifold shall be subjected to pneumatic test for both shell and seat leakage at
7.0 kg/cm2g with testing medium as air at ambient temperature. There shall not be any visible
leakage when immersed in water or coated with a leak detection solution.

       Reports
    a) Product Test Reports for various testing that are done on random samples for Tube
       fittings
    b) Certificate of Compliance / Typical Material Certification to be provided for the Tube
       fittings.
    c) Hardness verification test report to be provided.
    d) All the Tube fittings shall be compatible to use with the SS Tubing of ASTM A 269
       standards.
    e) Dimensional Test Report for Tube fittings with dimensional details

Standardization Society - MSS-SP-61

Seat Leakage Test (water).

      i.   The valve inlet port shall be connected to the pressure source. All ports connected to the
           inlet port shall be blocked.
  ii.      The valve outlet port shall be connected to a leak tube. All ports connected to the outlet
           port shall be blocked.
  iii.     Each valve shall be opened to fill all internal cavities with de-ionized water then closed
           with normal closure force.
  iv.      Each valve shall be pressurized to 1.1 x the valve rated pressure. Period of application
           of pressure, leakage rate shall be as per relevant standards.

Shell Test

      i.   The valve inlet or outlet port shall be connected to the pressure source. All ports
           connected to the pressurized port shall be blocked.
   ii.     The opposite valve port and all ports connected to the opposite port shall be blocked.
  iii.     Each valve shall be opened, but not backseated, all internal body cavities shall be filled
           with de-ionized water, and all air shall be vented from the system. Two-way Ball valves
           shall be cycled to place the ball in the 45° position.
  iv.      Each valve shall be tested for a minimum period of 60 sec., pressurizing all internal body
           cavities to 1.5 X the valve rated pressure, and observed for external leakage.
  v.       Visually detectable leakage through the pressure boundary walls is not acceptable. Stem
           seal leakage during shell test shall not be cause for rejection. Stem seals may be
           adjusted to eliminate leakage. Leakage after one (1) stem seal adjustment shall be
           cause for rejection.
  vi.      After testing, two-way ball valves shall be completely closed from the 45° position then
           opened.

Certificate of Compliance / Typical Material Certification (EN 10204-2.2) to be provided for the
Valves at the time of supply.
 Hardness verification test report for all Valves with Tube fittings shall be compatible to use with
the SS Tubings of ASTM A 269 standards.

Pneumatic Testing:

Ball valves shall be factory tested with nitrogen at 1000 psig (69 bar) or at its maximum rated
pressure if less than 1000 psig (69 bar). Seat tests have a maximum allowable leak rate of 0.1 std
cm3/min.

Tubes and fittings

All fittings shall be offered for pre-dispatch inspection for the following as a minimum:
a) Physical dimensional verification and workmanship on representative samples.
b) Hydrostatic and pneumatic tests on representative samples.
c) Hardness verification.
d) Diassembly and reassembly test on representative samples.
e) Review of all certificates and test reports as indicated

In the event when no witness inspection is carried out by purchaser, vendor shall anyway
complete the tests and test reports for the same shall be submitted to purchaser for scrutiny.

Vendor shall prepare their offer strictly as per this specification and shall attach
only those documents, which are specifically indicated in the material requisition.
Any offer not conforming to the above requirements, shall be summarily rejected.

            IB   SPECIFICATIONS FOR TUBE LAYING, TESTING AND COMMISSIONING

1       SCOPE OF WORK

        Laying

        Laying, testing and commissioning of SS tubes / fittings complete with all supports.
        Tubes / fittings should be erected with suitable support from pipeline to transmitter
        location as per the scheme. Payment shall be at the rate for the work set out in the
        agreed Schedule of Rates. Erection shall be carried out generally as per pipeline layout
        drawing that will be given along with order. Scheme are enclosed in this specifications.


        Generally the following shall constitute the Contractor's scope of work but not limited to
        as given herein:

i.      Installation of pressure transmitters and connections of pressure tubing. Receipt of tubes,
        fittings and other free issue items from FCRI's stores. Proper storing, stacking,
        identification, providing security and insurance during and before erection, and
        commissioning.

ii.     SS tubes shall be clamped to the MS Angle at every 1000 mm using wall mounted single
        support set with strict nut mounted. The practice of flattening tubes for clamping purposes
        shall not be permitted.

iii.    Tubes shall be bent using tube benders only and any hot bending will be totally rejected.
        Tubes shall be cut using pipe cutting device. Hot cutting is not allowed.

iv.     Carrying out pneumatic testing and purging with nitrogen as per approved procedures;
        providing all tools, tackles, instruments, manpower and other related accessories for
        carrying out the testing of tubes.

v.      Submission of final material appropriation statements for all the materials issued by
        FCRI. Returning surplus material to FCRI stores, reconciliation of free issue material /
        consumables and obtaining 'No Objection Certificate' from FCRI.

vi.     Start-up and commissioning assistance.

vii.    Handing over the completed works to FCRI for their operation/ use purposes.

viii.   Any other work not specifically mentioned herein, but required for the satisfactory
        completion/ operation/ safety/ statutory/ maintenance of the works shall also be covered
        under the scope of work and has to be completed by the Contractor within specified
        schedule at no extra cost to FCRI.

2       INSTALLATION PROCEDURE

        Tube End Preparation

i.      Cut the ends square with a hacksaw and a suitable guide. Tube cutters are satisfactory
        for most tube materials but tend to work harden stainless steel. As such proper care shall
        be exercised while cutting the SS tubes to avoid the hardening.

ii.    Burrs must be removed inside and outside for proper entry into fitting to prevent
       contamination and/ or restricted flow.

iii.   Remove all fittings, chips, and grit before attachment of fittings.

3      ASSEMBLY

i.     Tube line fabrication must be accurate so that the tube end easily enters the fitting in
       proper alignment. Do not force an improperly fitted tube line into the fittings.

ii.    Ensure that the tube end is bottomed against the shoulder in the fitting body. This is
       necessary to prevent movement of the tube while the nut forces the ferrule to grip the
       tube and to seal through any imperfections that may exist on the outside tube surface.

iii.   Never permit the fitting body to rotate during tube end make-up, use two wrenches.
       Assemble port connectors to components first and hold with a wrench while making up
       the tube joint. All types of union bodies must be held while each of the tube ends is made
       up.

iv.    Never attempt to make up by torque.

v.     Always turn the nut the prescribed amount regardless of torque required. Fitting end
       plugs required only 1- ¼ turn from finger tight make up in all sizes.

4      REMAKE OF FITTINGS

i.     A disassembled joint can be remade, simply by re-tightening the nut to the position of the
       original make up. For maximum number of remakes, mark the fitting and nut before
       disassembly. Before re-tightening, make sure the assembly has been inserted into the
       fitting until the ferrule(s) seats in the fitting. Retighten the nut by hand. Rotate the nut with
       a wrench to the original position as indicated by the previous marks lining up. (A
       noticeable increase in mechanical resistance will be felt indicating the ferrule is being
       resprung into sealing position.) Then snug the nut 1/12 turn (1/2 hex flat) past the original
       position.

5      CODES AND STANDARDS

i.     The Contractor shall carry out the work in accordance with this specification, ASME B
       31.8 - Gas Transmission and Distribution Piping Systems, Oil Industry Safety Directorate
       (OISD) norms.

ii.    Should the Contractor find any discrepancy, ambiguity or conflict in or between any of the
       Standards and the contract documents, then this should be promptly referred to the
       Engineer-in-Charge (EIC) for his decision, which shall be considered binding on the
       contractor.

6    SCOPE OF SUPPLY

A.   Supplied By FCRI

     Unless otherwise specified FCRI will supply the contractor free of charge all tubes and
     fittings necessary to complete the laying of loop. The Contractor shall not use material
     from any other source of supply other than FCRI except with written approval from the
     Engineer In-Charge (EIC).


     In general the following tubes & fittings shall be supplied as free issue items :
     i)      1” OD, SS tubes
     ii)     ¾” OD SS Tube
     iii)    ½” OD SS Tube
     iv)     Double Compression Ferrule Fittings of sizes, ¾”, ½”
     v)      SS Valves of suitable sizes.
     vi)     Clamps

B.   SUPPLIED BY THE CONTRACTOR AT HIS OWN COST AS PART OF THIS
     SPECIFICATION:

     All materials and consumables except for the materials specifically enlisted under FCRI’s
     scope of supply, shall be entirely the Contractor's responsibility and its rates of execution
     shall be inclusive for all these items, as follows but not limited to these:

     i)        Bolts and nuts for supports, U-bolts with nuts, anchor bolts of various sizes for
               fixing to concrete structure.
     ii)       Bitumen paints primer and solvents.
     iii)      All material for minor civil works like grouting etc.,
     iv)       Minor structural steel for fabrication of tube/ tray supports like MS plates, GI
               plates, flats, pipe etc.,
     v)        Pumps, Corrosion Inhibitor for water used for hydrostatic testing, inert gas for
               purging.
     vi)       All items not expressly mentioned in the Contract but which are necessary for the
               satisfactory completion and performance of the Work under this Contract.

     Note:     Samples of all the consumables items / test certificates required to be approved
               by EIC.

7    SCRAPS AND EXCESS MATERIAL

     The Contractor shall submit an account for all the materials issued to him by the owner in
     the standard proforma prescribed for this purpose by the EIC.

     On completion of the work, the Contractor shall submit material appropriation statements
     for all the materials issued by FCRI in the standard proforma. The following scrap
     allowances are permissible.

All excess materials and scrap shall be returned after duly accounting for, to the FCRI
stores. Where materials are to be weighed before return, the Contractor shall be
responsible for making necessary arrangements for weighing etc. The contractor shall
not use scrap sections obtained during the course of construction for fabrication of
temporary supports or other items without prior written permission of EIC.

If the Contractor fails to return the surplus material aforesaid, the Owner will charge the
Contractor for such unreturned material at penal rates, which will be deducted from
whatever amount is due to the Contractor. In case any material issued by the Owner
deteriorates during storage by the Contractor, new material will be issued to him if
available at penal rates, but delay in procuring such materials will be at the Contractor's
account only. Any damaged valve and ferrule fittings should not be used and shall be
returned to FCRI stores.

disputes raised by the Contractor/Supplier in any suit or proceeding pending before any court
or Tribunal relating thereto our liability under this present being absolute and unequivocal.

making such payment.

for this provision have the effect of so relieving us.

This guarantee shall not be affected by any change in the constitution of the bank or the
FCRI of the C ontractor/Supplier nor shall this guarantee be affected by any change in the
constitution of the FCRI or said C ontractor/Supplier by absorption with any other body or
corporation and this guarantee shall be available to or enforceable by such body or
corporation.

                                      IX. Scope of Contract
1. General

1    Scope of contract shall be as defined in the Order and Technical Specifications, Drawings
     and Annexure.
2    Completeness of the work shall be the responsibility of the contractor . Any accessories not
     specifically mentioned in the specifications, but necessary for the satisfactory completion
     shall be provided by contractor .
3.   Contractor shall follow the best modern practices in erection/commission notwithstanding any
     omission in the specifications.
4.   All dimensions and weight should be in metric system.
5.   All items to be supplied and work to be carried out shall conform to and comply with the
     provisions of relevant regulations/Acts as may be applicable to the type of items/work carried
     out and necessary certificates shall be furnished.
6.   Specifications, design and drawings issued to the contractor are not soled or given but
     loaned. They remain property of FCRI. Contractor and his employees shall not make use of
     the drawings, specifications and technical information for any purpose at any time except for
     erection and shall not disclose the same to any person, firm or corporate body.

2. Standards

     Work under the CONTRACT shall conform to the standards mentioned in the Technical
     Specifications, or such other standards which ensure equal or higher quality.

3. Use of Contract Documents

     Contractor shall not, disclose the Contract or any provision thereof, or any specification,
     plan, drawing, pattern, sample or information furnished therewith, to any person other than a
     person employed by the contractor in the performance of the Contract. Disclosure to any
     such person shall be made in confidence and shall extend only so far as may be necessary
     for purpose of such performance.

4. Modification

1. Modifications with respect to technical and/or commercial aspects including terms of delivery
   shall be considered valid only when accepted in writing by FCRI.

2. FCRI shall not be bound by any printed conditions or provisions in the contractor ’s Bid Forms
   or acknowledgment of Contract, invoices, packing list and other documents which purport to
   impose any conditions at variance with or supplemental to Contract.

5. Patent Rights, Liability & Compliance of Regulations

     Not Applicable

6. Inspection & Testing

1. FCRI shall have the right to inspect and/or to test for conformity to specifications.

2. FCRI may reject any inspected or tested items/work fail to conform to the specifications and
   contractor shall either replace or make necessary alterations to meet specifications
   requirements at free of cost.

3. Contractor shall place at the disposal of FCRI, free of charge, with all tools, instruments, and
   other apparatus necessary for the inspection and/or testing

4. Arrangements for all inspections required by Indian Statutory Authorities and as specified in
   technical specifications shall be made by contractor .

7. Rejection of Work

1. When items/materials are rejected, the contractor shall be intimated with the details of such
   rejected items/materials, reasons, and location. Contractor shall remove the item or give
   instructions as to dispose within 15 days. In the case of dangerous, infected and perishable
   materials within 48 hours, failing which FCRI will either return the materials to the contractor
   freight to pay or otherwise dispose at the contractor’s risk and cost. FCRI shall be entitled to
   recover handling and storage charges for the period of not removed, @ 5% of the values of
   materials for each month or part of a month till the rejected materials are finally disposed off.

2. If items are not of specification or fail to perform specified duties, FCRI shall reject the items
   and ask free replacement at contractor’s cost and risk.

3. Items rejected shall be removed by the Contractor at his cost within 15 days of notice after
   repaying the amounts received against the supply. FCRI shall in no way be responsible for
   any deterioration or damage to the items under any circumstances whatsoever.

4. In case of rejection, FCRI shall have the right to recover the amounts, if any, from any of
   invoices.

8. Time Schedule

1. Contractors shall submit to FCRI, his time schedule regarding erection and commissioning of
   the loop.

2. The time schedule shall be in the form of network/a bar chart clearly indicating all main or key
   events as above.

3. Contractors shall advise FCRI, at the earliest possible date of any anticipated delay in
   progress.

4. In case progress at various stages are not as per phased time schedule and are not
   satisfactory. FCRI may give notice of the same in writing to the contractor to make good the
   failure, neglect or contravention. Should contractor fail to comply with such notice FCRI shall
   have the option and be at liberty to take the contract wholly or in part out of the contractor ’s
   hand and make alternative arrangements to obtain the requirements and completion of
   contract at the contractor ’s risk and cost and recover from the contractor all extra cost
   incurred by FCRI on this account. In such event FCRI shall not be responsible for any loss,
   contractor may incur and shall not be entitled to any gain. FCRI shall, in addition, have the
   right to encash Performance Guarantee in full or part.

9   Incidental Services

1. Contractor shall furnish tools for assembly and maintenance for performance/supervision
   and start-up of system .
2. Furnishing tools for assembly and/or maintenance.
3. Contractor shall depute necessary personnel for supervision of erection at site
4. Cost of applicable incidental services shall be shown separately in the price schedules.

10 Guarantee

1. Contractor shall execute the work strictly in accordance with the specifications, drawings, ,
   other attachments and conditions. No deviation from such specifications or alterations or of
   these conditions shall be made without written permission of FCRI, which must be obtained
   before any work. Work shall be guaranteed to be of the best quality and shall be free from
   faulty workmanship and materials

2. Contractor shall make alterations, repairs and replacements for any trouble or defect
   originating with the workmanship arises at any time prior to twelve (12) months form the date
   of the commissioning at his own expense and as promptly as possible. Contractor shall
   guarantee for repaired or replaced materials/items for a period of not less than twelve (12)
   months from the date of repair/ replacement. The contractor shall attend the site within seven
   (7) days of receipt of such notice to meet and agree with representatives of FCRI, the action
   required to correct the deficiency. Should the contractor fail to attend, FCRI shall immediately
   rectify the work/materials and contractor shall reimburse to FCRI all costs and expenses
   incurred in connection with such trouble or defect.

3. If the contractor fails to prove the guarantee, FCRI shall take over and rectify, if possible, to
   fulfill the guarantee. All expenditure incurred by FCRI shall be to contractor ’s account.

11 Subletting & Assignment

     The contractor shall not without previous consent in writing of FCRI authority, sublet, transfer
     or assign the contract or any part thereof or interest therein or benefit or advantage thereof in
     any manner whatsoever. Provided, nevertheless, that any such consent shall not relieve the
     contractor from any obligation, duty or responsibility under the contract.

12       Termination

1. If the contractor fails to deliver the works within the time specified, If the contractor fails to
   perform any other obligation and If the contractor does not cure his failure within a period of
   30 days after receipt of the default notice, FCRI may terminate the contract in whole or in
   part.

2. FCRI shall procure services similar to those undelivered and the contractor shall be liable to
   FCRI for any excess costs. However, contractor shall continue performance of the contract to
   the extent not terminated.

3. In case of termination of contract, FCRI shall not be issued any type of enquiry to the party
   for three years from the date of termination.

4. Termination for Insolvency FCRI may at any time, terminate the contract by giving written
   notice to the contractor , without compensation to the contractor , if the contractor becomes
   bankrupt or otherwise insolvent, that such termination will not prejudice or affect any right of
   action or remedy which has accrued or will accrue thereafter to FCRI.

13       Force Majeure

1. Force Majeaure shall be limited to

     a) War/hostilities
     b) Riot or Civil commotion

    c) Earthquake, flood, tempest, lightening or other natural physical disaster.
    d) Restrictions imposed by the Government or other statutory bodies

2. Contractor shall inform FCRI duly certified by the local chamber of commerce or
    Statutory authorities, causes of delay within seven days of the occurrence and cessation of
    such Force Majeure Conditions. FCRI reserves the right to cancel the contract if the delay
    lasting over one month.

3. Contractor shall specify the extent of Force Majeure Conditions at the time of submitting their
   bid and shall take into consideration in bid. In the event of Force Majeure cause, the
   contractor or FCRI shall not be liable for delays in performing their obligations and delaying
   period will be extended.

14 Resolution of Disputes/Arbitration

1. FCRI and contractor shall make every effort to resolve amicably by direct negotiations any
   disagreement or dispute

2. If FCRI and the contractor have been unable to resolve amicably within thirty days, either
   party may require that the dispute be referred for resolution to the formal mechanism.

3. The Contract shall be construed and operated as an Indian Contract in accordance with
   Indian Laws as in force for the time being and is subject to and referred to Indian Court.

15 Arbitration

1. All disputes, controversies, or claims between the parties, where the decision of the
   Engineer-in-Charge is deemed to be final and binding, which cannot be mutually resolved
   time shall be referred to Arbitration. FCRI shall suggest a panel of three independent and
   distinguished persons to select one to act as the sole Arbitrator. In the event of failure of the
   Contractor to select within 30 days, FCRI shall have discretion to proceed with the
   appointment of the Sole Arbitrator. The award of the Sole Arbitrator shall be final and binding
   on the parties and unless directed/awarded otherwise by the Sole Arbitrator, the cost of
   arbitration proceedings shall be shared equally by the parties.

2. The arbitration proceeding shall be in English and the venue shall be at Palakkad, Kerala
   India. Subject to the exclusive jurisdiction of the Courts situated in the State of Kerala, India.

3. The work shall continue during the Arbitration proceedings and no payment shall be withheld
   during arbitration.

16 Notices

1. Any notice given by one party to the other shall be sent by email and confirmed by fax.

2. A notice shall be effective when delivered or it’s effective date, whichever is later.

17 Taxes & Duties

1. Foreign Contractor is entirely responsible for taxes, stamp duties, license fees, and other
   such levies imposed in foreign country.

2. Indian contractor shall be entirely responsible for all taxes, licence fees etc. incurred until the
   delivery of items to FCRI. FCRI is permitted Excise duty exemption with reference to Govt.
                                                  st
   Notification No. 10/97-Central Excise dated 1 March 1997. If Excise duty is applicable, the
   same may be indicated separately.

3. Income tax payable for services rendered by contractor shall be as per the Indian Income
   Tax Act and shall be borne by contractor. Bidder/contractor shall ascertain the amount of
   these taxes and to include them in bid price.


18 Books & Records

1. Contractor shall maintain adequate records and shall make them available for inspection and
   audit by FCRI or their authorized agents or representatives during the terms of Contract until
   expiry of the performance guarantee.

19 Permits & Certificates

1. Contractor shall procure all necessary permits, certificates and licenses required by virtue of
   all applicable laws, regulations, ordinances and other rules in effect at the place where any of
   the work is to be performed, and contractor agrees to hold FCRI harmless from liability or
   penalty which might be imposed by reason of any asserted or established violation of such
   laws, regulations, ordinances or other rules.

20 General

1. Losses due to non-compliance of Instructions:Losses or damages occurring to FCRI owing
   to the contractor ’s failure to adhere to any of the instructions shall be recoverable from the
   contractor .

2. All costs, damages or expenses which FCRI may have paid, for which contractor is liable,
   may be recovered by FCRI from any money due to or becoming due to the CONTRACTOR
   under this Contract. If the same due to the CONTRACTOR be not sufficient to recover the
   recoverable amount, the CONTRACTOR shall pay to FCRI, on demand, the balance amount.

3. No sum paid by FCRI nor any extension of the date for completion granted by FCRI shall
   affect or prejudice the rights of FCRI against the contractor or relieve the contractor of his
   obligation for the due fulfillment of CONTRACT.

4. No claims or correspondence shall be entertained by FCRI after 90 days after expiry of
   performance guarantee

21 Publicity & Advertising

1. Contractor shall not make a reference to FCRI or any Company affiliated with FCRI or to the
   destination or the description of Items or services supplied under the contract in any
   publication, publicity or advertising media without the written permission of FCRI.

22 Limitation of Liability

1. Total liability of contractor under the Agreement shall be limited to 100% of Agreement
   / Order price. However, neither party shall be liable to the other party for any indirect
   and consequential damages, loss of profits or loss of production.

                        X. General Rules and Directions for Guidance

1.   Bid Submission

1. Tenders shall be submitted in sealed covers superscribing the Tender Number and name of
   the work due date and nature of bid (priced or unpriced), and addressed legibly to officer
   inviting the tender. Full name and address of the tenderer should be written on the
   envelope as well as on the tender below the signature.

2.   All the pages of the tender documents and any other enclosures submitted by the tenderer
     must properly signed or initialed and dated on each page, and also signed and dated at
     the places mentioned in the documents by the tenderer or such person or persons on his
     behalf as are legally authorized or required to sign for the tenderer. The tenderer shall in
     particular satisfy the Institute that he is competent and authorized to submit the tender
     and to enter into a legally binding contract with the Institute on behalf of himself, his firm,
     Company or Corporation as the case may be. A person signing the tender or any
     document forming part of the tender on behalf of another shall be deemed to warrant that
     he has the requisite authority of sign for other, and if, on enquiry, it appears that the
     person so signing has no authority to do so, the Institute may, without prejudice to any
     other Civil and Criminal remedies, cancel the contract and hold the signatory liable for all
     costs and damages.

3.   Schedule of quantities and rates should be carefully and properly filled in. All rates should
     be indicated in words as well as in figures. Erasures and alterations in the tender
     documents should be avoided. If any corrections are necessary the original entry should
     be scored off and new entry legibly made duly attested by the full signature of the
     tenderer with date. Failure to do so may cause rejection of the tender by the Institute at
     its discretion. Any statement and/or letters signed separately and issued to the Institute
     either before or after the tender may not be considered.

4.   In case of firms, all partners of the firm or such person or persons as may be legally
     competent to sign for the firm should sign the tender documents. In case of company, the
     official seal of the company should be affixed in the tender documents and should be
     signed by such person(s) as may be authorized by the articles of Association of the
     Company to sign for and on behalf of the Company. A copy of the Articles of Association
     should be sent with the tender. In any case, the tenderer should disclose his constitution
     and copies of all necessary legal documents in support thereof such as the duly registered
     partnership deed in the case of partnership firm should be produced as and when called
     for by the Institute.

5.   Each tenderer shall submit a declaration as to whether he is an individual, firm or
     Association of firms, Company or Corporation and has the requisite organization including
     technical and other personnel and financial and other resources to handle the work. Full
     information, supported by documentary evidence shall be furnished by the tenderer in
     regard to the following among other things so as to demonstrate his ability to undertake
     the work as specified.

     a) In the case of firm, company or corporation

     i.    The legal name, the nature of business and the date and place of registration
           (including the state of incorporation where it is a corporation).

     ii.   The authorized, subscribed and paid up capital.

     iii.   The names and addresses of all the Directors including those of the Chief Executive
            Officer, President, Secretary or the person authorized to bind the firm, company or
            corporation in the matter.

      b) Tenderer shall include the names and addresses of all the partners in case of
         partnership.

      c)    If the tenderer is an association of firms, the details of all participating firms shall be
            shown in tender.

      d) In the case of Indian Agent of a Foreign Organization, percentage of commission
         payable to Indian Agent, copy of agency agreement with Foreign Organization and
         certificate of enlistment with DGS&D under compulsory registration scheme of Ministry
         of Finance.

            The Institute will be the sole judge as to the merits of the tender‟s ability to perform
            the work. Non-submission of documentary evidence of any of the aforementioned
            aspects may render the tender liable to summary rejection.

6.    Total amount of tender should be written in the same language that the tender signed.

7.    The specified amount of Earnest Money must be deposited either by a Demand Draft
      crossed “Account payee” drawn in favour of “Fluid Control Research Institute” payable at
      Palakkad or by cash. The EMD should be enclosed with the Technical Bid. Cheque will not
      be accepted.

8.    The Earnest Money of the successful tenderer will be retained towards „Security Deposit‟
      and in the case of others, will be returned on application after finalization of the purchase.

9.    The Earnest Money shall be liable to be forfeited without prejudice to the other rights and
      remedies of the Institute in the event of the tenderer failing (a) to keep his tender valid
      and open for acceptance by the Institute for and during the period of six months reckoned
      from the date of opening of tenders; or (b) to furnish, the requisite documents, etc. within
      the specified time.

10. The Security Deposit shall liable to be forfeited without prejudice to the other rights and
    remedies of the Institute if the successful tenderer is failing to accept the purchase order
    placed by the Institute, within 15 days of its issue. The Institute shall also have the right
    to forfeit the Security Deposit in case the suppliers fail to execute the order as per the
    terms & conditions of the order.

11. Should the tenderer have relative or relatives, or in the case of a firm or company or
    contractors, one or more of its shareholders employed in any capacity in the Institute, the
    tenderer should furnish complete information to that effect at the time of submission of
    the tender.

12. Tenders which do not fulfill all or any of the above conditions or incomplete in any respect
    are liable to be rejected.

13. The right of accepting any tender or rejecting any or all tenders without assigning any
    reason is reserved.

14. Tenderer should be enclosed Sales tax and Income tax clearance certificates along with
    the tender.

15 FCRI has standard payment terms (ie) 100% of the material cost will be
   paid within 30 days from the date of supply of the material at our work
   sites and acceptance, and also in producing a Bank Guarantee for 10% of
   the value as performance guarantee valid for atleast one year.

16. Tenderer can notify FCRI in writing or by faxing or by email for any clarification on
    documents. FCRI will respond in writing to any request for clarification on bidding
    documents within 5 days prior to the deadline for the submission of bids. FCRI‟s response
    will be sent to all prospective bidders who have downloaded bidding documents.

17. At any time prior to the bid due date, FCRI may, for any reason, whether at its own
    initiative or in response to a clarification requested by a prospective bidder, modify the
    bidding documents, by issuing addenda.

    Any addendum thus issued shall be part of the Bidding Documents pursuant to ITB Clause-
    5.1 and shall be notified in writing by fax/post to all prospective bidders. Prospective
    bidders shall promptly acknowledge receipt of each addendum by post, fax and email to
    FCRI.

18 I shall extend the bid due date in order to allow prospective bidders, a reasonable time to
   furnish their most competitive bid considering the amendments issued.

2   Documentation

    Documentation shall be delivered in due time, in proper form and in the required number
    of copies as specified, in English.

    Vendor shall submit the following documents during the submission of bid:

    In pursuant to ITB Clause 9, the bidder shall furnish, as a part of the bid, document
    establishing the eligibility and conformity to the bidding documents of all equipment and
    services, which the bidder proposes to supply under the Contract.

    Description of the essential technical and performance characteristics of the Equipment
    and a clause-by-clause commentary on FCRI‟S Technical specifications demonstrating the
    Equipment and services‟ substantial responsiveness to the specifications.

    General arrangement / assembly drawings showing all features and relative positions and
    sizes of vents, gear operator / actuator, painting, coating and other external parts
    together with overall dimensions.

    Sectional drawing showing major parts with reference numbers and material specification
    and a blow-up drawing of ball-seat assembly shall be furnished complying the requirement
    of this specification.

    For purpose of the commentary the bidder shall note that standards for workmanship,
    material and equipment, and reference to brand names or catalogue numbers, designated
    by FCRI in its Technical Specifications are intended to be descriptive only and not
    restrictive.

    The drawings to be submitted shall be in total compliance with the requirement of
    technical specification and data sheets of equipment with no exception & deviation.

    Detailed sectional arrangement drawings showing all parts with reference numbers and
    material specifications as referred above.

   Assembly drawings with overall dimensions and features. Complete dimensional details of
   support foot (where applicable) shall be indicated in these drawings as referred applied on
   the equipment.

   Manufacture of equipment shall commence only after approval of the above documents.
   Once the purchaser has given the approval, any changes in design, material and method
   of Manufacturer shall be notified to FCRI whose approval in writing of all changes shall be
   obtained before the item is manufactured.

3. Withdrawal and Modification of Tender

   Bidder can modify or withdraw his bid after the bid submission, but before the due date of
   submission provided that the written notice of the modification, including substitution or
   withdrawal of the bid is received by FCRI prior to the due date for submission of bids.

   Bidder‟s modification or withdrawal notice shall be prepared, sealed, marked and delivered
   in accordance with the provisions of ITB Clause-20, with the envelopes marked
   “modification” or “withdrawal” as appropriate. A withdrawal notice may also be sent by
   fax/post, but followed by a signed confirmation copy post marked not later than due date
   for submission of bids.

   No bid shall be modified after the due date for submission of bids.

   No bid shall be allowed to be withdrawn in the interval between the deadline for
   submission of bids and the expiration of the period of bid validity specified by the bidder
   on the Bid Form. Withdrawal of a bid during this interval shall result in the bidder‟s
   forfeiture of his bid security.

4. Process Confidentially

   Information relating to the examination, clarifications, evaluation and comparison of bids
   and recommendations for the order, will not be disclosed to bidders or any other person
   officially concerned with. FCRI requires that Bidders/Suppliers observe the highest
   standard of ethics during the procurement and execution of the order. In pursuance of this
   policy, FCRI defines for the purposes of this provision

5. Contacting FCRI

   From the time of the bid opening to the time of the release of order, if any bidder wishes
   to contact FCRI for any matter relating to the bid, he should do so in writing.

6. Conversion To Single Currency

   To facilitate evaluation and comparison, FCRI will convert all bid prices expressed in the
   amounts in various currencies to Indian Rupees at the bills selling exchange rate declared
   by the State Bank of India on the day prior to price bid opening.

7. Supply & Advance Notice

   Mode of transport shall be through road only.
   Immediately on dispatch, Supplier shall send advance information of dispatch particulars,
   by way of fax message to the following, giving details of Transport, LR no. its date, Invoice
   No., Date & value, No. of cases, gross weight, contents, etc. to M/s. Fluid Control

   Supplier shall ensure that transmission of dispatch documents are arranged in accordance
   with the contract terms. In case of delay in clearance due to non-availability of documents
   shall be the responsibility of supplier & will be liable to bear expenses incurred on account
   of demurrage, wharfage etc.

8. Preparation of Despatch Documents

   All documents including LR, packing-list, Invoice etc. shall be in English. LR Invoice and
   packing list specifically must show, Mark & No., contents, case wise, consignee, final
   destination and all other particulars. The packing list must also show the actual contents in
   each case, net & gross weights and dimension with number of packages. The invoice must
   show item wise price break –up.

   One set of Despatch Documents should include the following documents.

   i)     LR (original)
   ii)    Invoice in Triplicate
   iii)   Packing List in Triplicate
   iv)    Manufactures test certificates/inspection note, warranty to Quality Certificates and any
          other document as specified in Purchase order


9. Shipping (For Foreign Bidders)

                                          Equipment packing

        Equipment packing shall be strong and sturdy. Don‟t frail the packing that may
        cause to damage the equipment when loading/unloading, pushing and crane lifting
        etc. supplier is responsible for any damages occurred while shipping the equipment.
        All packaging shall be done so as to minimize volume and weight as much as
        possible         without jeopardizing the safety of the material. All packing materials
shall be new    and shall be of packer‟s standard for export shipments. Fragile articles should
have    special packing materials depending on type of materials.

Surface of equipment shall be thoroughly cleaned, freed from rust and grease and applied with
sufficient coats of corrosion resistant paint. Surface preparation shall be carried out by shot
blasting to SP-6 in accordance with “Steel Structures Painting Council – Visual Standard SSPC-
IS-1”. Manufacturer shall indicate the type of corrosion resistant paint used, in the drawings
submitted for approval. Sealant lines and cavities of the valve shall be filled with sealant
before shipment.

   All mechanical and electrical equipment and other heavy articles should be securely
   fastened to the bottom of the case, to avoid damage.

   All packages requiring handling by crane should have sufficient space at appropriate place
   to put sling of suitable dia (strength). Irons/steels angle should be provided at the place
   where sling markings are made to avoid damage to package/equipments while lifting.

   Attachments and spare parts of equipments and all small pieces shall be packed
   separately in wooden cases with adequate protection inside the case and sent along with
   main equipment. Each item shall be tagged so as to identify it with the main equipment
   and part number and reference number shall be indicated.

   All protrusions shall be suitably protected and openings shall be blocked by wooden/steel
   covers. All threaded fittings and pipes should be greased and provided with plastic caps

     Wherever required equipments/materials shall be packed in polythene bags and silica gel
     or similar dehydrating compound shall be put inside the bags.

     Detailed case wise packing list in waterproof envelope shall be inserted in each package
     together with equipment/material. One copy of „Detailed Packing List‟ shall be fastened
     outside of the package in waterproof envelope and covered by metal cover. In case of
     bigger dia pipes and large equipments, documents contained in the envelope shall be
     fastened inside a shell connection with an identifying arrow sign „Documents” applied with
     indelible paint.


10. Marking on Equipment.

     Following markings are required shall appear on three sides of each package with proper
     paint/indelible waterproof ink for air / sea transportation.

     Most appropriate and suitable packing for economical air/sea freight applicability, and
     shipping documentation, flight/shipment invoice and AWB/Bill of Lading & other
     documents as per normal practice shall be enclosed.

11. Disposal of Shipping Documents

     Sea Shipments

     The supplier shall prepare the complete shipping documents in all respects including three
     original stamped copies of Bill of Lading and courier the same as under :

i)  Three copies of original Bill of Lading with one non-negotiable copy of Bill of Lading along
    with three copies each of original (a) Invoice, (b) Packing List, and (c) all other documents
    as specified in L/C shall be forwarded / negotiated through Beneficiary‟s Bank to L/C
    Opening / Issuing Bank.
ii) One set of non-negotiable shipping document as mentioned towards “M/s Fluid Control
    Research Institute Kanjikode west, Palakkad, Kerala, India – 678 623, Phone: (91) 491-
    2566120, 2566206, Fax No. (91) 491-2566326” to facilitate in pre-assessment of Custom
    Duty & other necessary formalities at Indian Port before arrival of consignment for speedy
    clearance of same.

12. Air Shipments

     Supplier shall prepare complete shipping documents including three original stamped
     copies of MAWB/HAWB/AWB and courier the same as under: -

i)   Three copies of original AWB with one copy of non-negotiable AWB along with three copies
     each of original (a) Invoice, (b) Packing List, and (c) all other documents as specified in
     L/C shall be forwarded / negotiated through Beneficiary‟s Bank to L/C opening / Issuing
     Bank.

ii) One set of non-negotiable shipping documents towards “M/s Fluid Control Research
    Institute, Kanjikode west, Palakkad, Kerala, India – 678 623, Phone: (91) 491-2566120,

13. Short Supply

     Supplier should thoroughly check all items in the packing before effecting shipment. If any
     item(s) are found short packed in sound boxes on examination at project site, Supplier
     shall be responsible to supply short packed items free of charge on receipt of advice from
     FCRI. Supplier shall also be responsible to bear the import duty levied by Indian Customs
     on such short packed items.

14. Shipping Instruction (For Domestic bidders)

     Marking
     Supplier shall dispatch the consignment in road transport worthy packing conforming to
     the prescribed current standard. Packing should withstand journey & ensuring the safety
     to en-route & also arrival of equipment at ultimate destination in good condition.

15. Dispute

   Any dispute regarding the Tender/Purchase Order shall be deemed to have arisen in
   Palakkad and only competent court in Palakkad will have jurisdiction.

16 Overruling Clause

   Not withstanding anything stated anywhere in this document, the Director FCRI has the
   power to revise/add/review/delete/modify any of the conditions/statements indicated
   therein.

                                     XI. Award of Contract

1. Post Qualification

   In the absence of pre qualification, FCRI will determine to its satisfaction whether the lowest
   bidder is qualified to satisfactorily perform the contract.

   The determination criteria will be bidder’s financial, technical and service as well as such
   other information as FCRI deems necessary and appropriate.

   Affirmative determination will be a prerequisite for award of contract to the bidder. A negative
   determination will result in rejection of the bidder’s bid.

2. Award Criteria

   FCRI will award the contract to Bidder whose bid has been determined as responsive and
   has been determined to be the lowest evaluated bid, provided further that the Bidder is
   determined to be qualified to perform the contract satisfactorily.

3. Change in Quantities

   FCRI reserves the right at the time of award of ORDER to increase or decrease the quantity
   as per actual requirements, without any change in unit price or other terms and conditions.
   Variation beyond 25 % will be subject to mutual agreement between FCRI and the
   Contractor.

4. Corrupt or Fraudulent Practices

   “Corrupt practice” means the offering, giving, receiving or soliciting of any thing of value to
   influence the action of official in the procurement process or in contract execution. Any effort
   by a bidder to influence FCRI in any manner in respect of bid evaluation or award will result in
   the rejection of that bid.

   “Fraudulent practice” means a misrepresentation of facts in order to influence a procurement
   process or the execution of a contract to the detriment of FCRI, and includes collusive
   practice among Bidders (prior to or after bid submission) designed to establish bid prices at
   artificial non-competitive levels and to deprive FCRI of the benefits of free and open
   competition;

   FCRI will reject a proposal for award of it determines that the bidder recommended for award
   has engaged in corrupt or fraudulent practices in competing for the contract in question. FCRI
   will declare a firm ineligible, either indefinitely on for a stated period of time, if at any time
   FCRI determines that the firm has engaged in corrupt or fraudulent practices in competing for
   or in executing a contract.

                        XII Preambles To Schedule Of Quantities

1.     Rates quoted shall include all the operations, materials, etc., mentioned in the
       specifications of respective items of work, schedule of quantities, the preambles and
       required to complete the job.

2.     Rates quoted shall include all labour, materials, tools, plants, equipments and other
       sunderies etc, for workman like completion of work.

3.     Rates quoted shall be firm and shall not be subject to any variation due to increase in
       labour wages, cost of materials etc. or any other price variation whatsoever either by
       act of Government or otherwise whether during the stipulated period of execution or
       during extended period of completion if any.

4.     The works “as described”, “as specified”, “as shown”, “as directed” or          “as
       approved” shall mean as described in the specifications, schedule of quantities and
       other tender documents, as shown on the drawings and as directed or as approved by
       the Engineer in-charge.

5.     Your offer should remain valid for 6 months from the date of opening of tenders.

6.     For the purpose of quoting the rates, you may treat it as a case where there is no “C”
       or “D” form.

7.     The rate of taxes should be shown in the schedules and which should cover all taxes
       whatever form may be applicable and as prevailing on the date of quotation.

8.     The central excise duty tariff item and the normal duty thereof should be indicated
       separately. We are permitted Excise Duty Exemption with reference to Govt.
       Notification No. 10/97-Central Excise dated 1st March 1997.

9.     We are permitted Customs duty exemption with reference to Govt. Notification No.
       51/96-Customs dated 23rd July 1996.

10.    Any concession in excise duty/sales tax enjoyed by you should be clearly indicated in
       the covering letter.

12.    In case the components as per our specification is not available, you may quote for
       the components of better specifications with clear indication of make, technical details
       etc. However such alternative components will be considered only on extraordinary
       circumstances.

12.    Liquidated damages for delay beyond the agreed delivery and commissioning schedule
       @1% per week subject to maximum of 10% of the total order value will be applicable.

13.    Failure to supply the materials as per delivery schedule is liable to result in
       cancellation of the order.

14.    Descriptive leaflets, brochures, drawings etc. showing the details should invariably be
       attached with your quotation.

15.    Declaration to the effect that the equipment supplied is original and is not
       reconditioned or refurbished items.

Note: Preambles apply to all the sections of the schedule of quantities and tendered rates
      shall take into account all these provisions in addition to various provisions in other
      parts of the tender documents.
