1.0 INTRODUCTION AND PURPOSE:
1.1 DESCRIPTION AND PURPOSE OF THE REQUEST FOR BIDS:
The State of Wisconsin, Department of Military Affairs, request bids for Lawn Care Services at
its five (5) facilities located in Madison, Wisconsin, and intends to use the results of this
process to award a contract for an initial period plus two (2) renewal periods.
The estimated annual value of this contract exceeds $25,000. The State does not guarantee
to purchase any specific dollar amount.
1.2 CONTRACT TERM AND RENEWAL:
The State of Wisconsin, Department of Military Affairs intends to utilize the results of this RFB
to award a contract for an initial period that ends October 30, 2008 with the option to renew for
two (2) additional one-year periods by mutual agreement of the Department of Military Affairs
and Contractor.
The contract shall automatically be renewed into its subsequent years unless Agency
Purchasing Services is notified, in writing, by the Contractor 90 calendar days prior to
expiration of the initial and/or succeeding Contract term(s); or Agency Purchasing Services
notifies the Contractor, in writing, 30 calendar days prior to expiration of the initial and/or
succeeding Contract term(s).
If a contract is awarded to a State-qualified work center the contract will begin November 1,
2007 and continue indefinitely under the condition that all State of Wisconsin work center
program criteria is met. Fair market pricing will be reviewed on an annual basis or when
significant changes occur in the contract.
2.0 QUALIFICATIONS:
To be eligible for an award, bidder must be qualified and able to provide the following as required or
the bid response will not be considered.
2.1 Bidder must be in the business of providing Lawn Care Services and must have done so for
the past three (3) years.
2.2 Bidder must supply with their bid a client list of three (3) firms to which similar Lawn Care
Services have been provided during the past three (3) year(s) to a comparable sized institution
or company. If contacted, information received from those clients may be used to determine
whether bidder meets Qualifications (see attached Vendor Reference form (DOA-3478).
2.3 Bidder must designate a person(s) to provide information on: Minority Business, Affirmative
Action. See attached Vendor Information form (DOA-3477).
2.4 The contractor is required to maintain insurance in compliance with Standard Terms and
Conditions (DOA-3054).
2.5 DEBARMENT: Federal Executive Order (E.O.) 12549 “Debarment” requires that all contractors
receiving individual awards, using federal funds, and all sub recipients certify that the
organization and its principals are not debarred, suspended, proposed for debarment, declared
ineligible, or voluntarily excluded by any Federal department or agency from doing business
with the Federal Government. Information on debarment is available at the following websites:

3.0 BID PROCESS, PROCEDURES AND INSTRUCTIONS:
3.1 REASONABLE ACCOMMODATIONS:
The Department will provide reasonable accommodations, including the provision of

3.2 VENDOR REGISTRATION:
The State of Wisconsin’s purchasing information and vendor notification service is available to
all businesses and organizations that want to sell to the State. Anyone may access VendorNet
on the Internet at http://vendornet.state.wi.us to get information on state purchasing practices
and policies, goods and services that the state buys, and tips on selling to the State. Vendors
may use the same website address for inclusion on the bidders list for goods and services that
the organization wants to sell to the State. A subscription with notification guarantees the
organization will receive an e-mail message each time a state agency, including any campus
of the University of Wisconsin System, posts a request for bid in their designated
commodity/service area(s) with an estimated value over $25,000. Organizations with Internet
access receive paper copies in the mail. Increasingly, state agencies also are using
VendorNet to post simplified bids valued at $25,000 or less. Vendors also may receive e-mail
notices of these simplified bid opportunities.
An organization may also read the legal notices of the official state newspaper, the Wisconsin

3.3 CORRESPONDENCE, CLARIFICATIONS AND QUESTIONS:
Bidders are expected to raise any questions, exceptions, or additions they have concerning the
RFB document by September 28. If a bidder discovers any significant ambiguity, error,
conflict, discrepancy, mission, or other deficiency in this RFB, the bidder should immediately
notify the below named individual of such error and request modification or clarification of the
RFB document.

3.5 SUBMITTING A BID:
Bidders must submit one (1) original, marked as such, and one (1) copy of all materials for
acceptance of their bid, by the deadline shown on the Request for Bid form. A completed and
signed Request for Bid (DOA-3070) form, Certification of Site Visit, copies of permits,
insurance documents, those forms listed in Section 9.0, and other conditions proposed by the

3.8 MULTIPLE BIDS:
Multiple bids from a bidder will be permissible; however each bid must conform fully to the
requirements for bid submission. Each such bid must be separately submitted and labeled as
Bid #1, Bid #2, etc. on each page included in the response.
3.9 INCURRING COSTS:
The State of Wisconsin is not liable for any cost incurred by a bidder in the process of
responding to this RFB.
3.10 NEWS RELEASES:
News releases pertaining to the RFB or to the acceptance, rejection, or evaluation of bids shall
not be made without the prior written approval of the State.
4.0 BID ACCEPTANCE, EVALUATION AND AWARD:
4.1 METHOD OF BID:
Bidder must submit a net unit price and an extended net total for item(s) specified. Prices
listed should be in US dollars.
4.2 METHOD OF AWARD:
Contract may be awarded to the lowest cost, responsive, responsible State-qualified work
center meeting fair market price and other work center program criteria per Wisconsin State
Statute 16.752.

If the award is not made to a qualified work center, the contract will be awarded to the lowest
cost, responsive, responsible bidder whose bid is properly submitted and received and
provides the lowest price, as judged to be in the best interest of the State. In the event of
errors in calculation, unit price shall prevail.
4.3 BID OPENING:

Bids will be opened at 2:00 PM on October 10 at 101 E. Wilson St.,9 Floor, Madison,
Wisconsin. Names of the bidders may be read aloud at that time.
4.4 BID ACCEPTANCE:
Bids which do not comply with instructions or are unable to comply with specifications
contained in this RFB may be rejected by the State. The State retains the right to accept or
reject any or all bids, or accept or reject any part of a bid deemed to be in the best interest of
the State. The State shall be the sole judge as to compliance with the instructions contained in
this RFB.
4.5 BID REVIEW:
Bids will be reviewed to verify that they will meet all specified requirements in this RFB. This
verification may include requesting reports on the Bidder's financial stability, conducting
demonstrations of the Bidder's proposed products(s) and/or service(s), and reviewing results
of past awards to the Bidder by the State of Wisconsin.

4.6 MINORITY PREFERENCE:
The State of Wisconsin is committed to the promotion of minority business in the State’s
purchasing program and a goal of placing 5% of its total purchasing dollars with certified
minority businesses. Authority for this program is found in ss. 15.10(2), 16.75(4), 16.75(5) and
560.03(2), Wisconsin Statutes. The contracting agency is committed to the promotion of
minority business in the State’s purchasing program.
Bids from certified Minority Business Enterprises may have points weighted by a factor of 1.00
to 1.05 to provide up to a five percent (5%) preference to these businesses.
4.7 NOTIFICATION OF AWARD:
Any Bidders who respond to this RFB with a bid shall be notified in writing of the State's intent
to the contract as a result of this RFB.
4.8 APPEALS PROCESS:
The appeals procedure applies to only those requests for bids that are greater than $25,000.
Notices of intent to protest must be made in writing. Protestors should make their protests as
specific as possible and shall identify statutes and Wisconsin Administrative Code provisions
that are alleged to have been violated.
The written notice of intent to protest the intent to award a contract must be filed with:

and received in her office no later than five (5) working days after the notices of intent to award
are issued.
The written protest must be received in his/her office no later than ten (10) working days after
the notices of intent to award are issued.
The decision of the head of the procuring agency may be appealed to the Secretary of the
Department of Administration within five (5) working days of issuance, with a copy of such
appeal filed with the procuring agency, and provided the appeal alleges a violation of a statute
or a provision of the Wisconsin Administrative Code.
4.9 ORDER OF PRECEDENCE:
In the event of contract award, the contents of this RFB (including all attachments), RFB
addenda and revisions, the bid response from the successful bidder, and additional terms
agreed to, in writing, by the Department and contractor shall become part of the contract.
Failure of the successful bidder to accept these as a contractual agreement may result in a
cancellation of award.

4.10 LIQUIDATED DAMAGES:
Both parties acknowledge that it can be difficult to ascertain actual damages when a
Contractor fails to carry out the responsibilities of the Contract. Because of that, the
Contractor acknowledges that for the Contract resulting from this RFB, it will negotiate
liquidated damages, as required by the State, for the Contract. The Contractor agrees that the
agency shall have the right to liquidate such damages, through deduction from the Contractor's
invoices, in the amount equal to the damages incurred, or by direct billing to the Contractor.
5.0 SPECIFICATIONS / REQUIREMENTS:
All requirements in this section are mandatory. Conditions of bid that include the word “must” or “shall”
describe a mandatory requirement. All specifications are defined as mandatory minimum
requirements unless otherwise stated. If no bidder is able to comply with a given specification or
condition of bid, the State reserves the right to delete that specification or condition of bid. FAILURE
TO MEET A MANDATORY REQUIREMENT SHALL DISQUALIFY THE BID. This RFB document and
the awarded bidder’s (Contractor’s) response information shall become the Contract.
5.1 SCOPE OF WORK:
The work to be done by this project consists primarily of lawn maintenance and weed control.
The contractor shall provide all necessary personnel, labor, equipment, supervision and
materials to accomplish the work in accordance with specifications outlined below.
The principle items of work include:
5.1.1. Mowing, raking and trimming the areas designated on the attached maps.
Location 1: The Joint Force Headquarters (2400 Wright St.) will be mowed whenever
grass reaches the specified height (listed below).
Locations 2-5: There will only be twenty (20) cuttings between July 1 and June 30.
More cuttings during this time period will NOT be allowed.
Specified Height: The grass must be at least 3-½ inches in height before cutting.
Therefore, the number of cuttings may be less in the specified time period because of
slow growth.
The grass shall be mowed to an average height of 2¾ inches. Clippings on berms
shall be raked up or caught with a catcher. No grass clippings shall be permitted to
remain in the stone or bark mulch beds surrounding each building. Area's which
cannot be cut with a mower, including grass near sign posts, retaining walls, and
building walls shall be trimmed.
5.1.2. Pulling weeds by hand in the mulch beds surrounding the buildings, trees, and scrubs.
Application of Roundup to bark and stone mulch areas.
Weeding shall be accomplished as needed to preserve a good appearance. The area
included for weeding include all bark and stone mulch beds plus all individual trees
and scrubs which are surrounded by bark mulch. Roundup shall be used to prevent
growth of weeds in these areas.
5.2 SITE INSPECTION:
Prospective bidders will need to visit the job site between 7:30 a.m. and 3:00 p.m. on
September 25 or 26. Point of contact is Marv Messer, Supervisor of Building and Grounds,
(608) 242-3372, for all locations. Please call to schedule a time. The attached Certification of
Site Visit must also be signed by Bldg. Supervisor and submitted with your bid.

5.3 REFERENCES:
Bidder must include in its bid response a completed Vendor Reference Form (DOA-3478),
which is attached, listing at least three (3) names of companies with whom the bidder has
performed commercial lawn mowing services similar to that required by this solicitation within
the last three (3) years. For each customer listed, the bidder must include the company name,
address, contact person and telephone number along with a brief description of the
product/service, which was the basis for the business relationship. The Agency will determine
which, if any references to contact to assess the quality of the product/service.
6.0 PERFORMANCE REQUIREMENTS:
6.1 GOVERNMENT REGULATIONS:
All work shall be preformed in accordance with normal conduct of government business.
6.2 DAMAGE TO GOVERNMENT PROPERTY:
The Contractor shall be liable for any damage to government property caused by his
employees or equipment in the execution of the work.
6.3 WORK SCHEDULE:
The Contractor shall arrange his work so not to cause interference with the normal conduct of
government business. All work schedules shall be approved by the Building Superintendent.
6.4 POOR PERFORMANCE:
All work will be observed by the Superintendent or his representative. Any failure to meet the
requirements herein may lead to the cancellation of the contract. Contractor will correct or
have corrected any substandard work as requested by the agency. Such work shall be at no
extra cost to the State.
7.0 SUPPORT REQUIREMENTS:
7.1 PERMITS:
The Contractor shall, without additional expense to the government, obtain any licenses and
permits required for prosecution of the work and for complying with all applicable federal, state,
and local laws.
7.2 INSURANCE:
The contractor performing services for the State of Wisconsin shall:
7.2.1 Maintain worker’s compensation insurance as required by Wisconsin Statutes, for all
employees engaged in the work.
7.2.2. Maintain commercial liability, bodily injury and property damage insurance against any
claim(s) which might occur in carrying out this agreement/contract. Minimum
coverage shall be $1,000,000 liability for bodily injury and property damage including
products liability and completed operations.

10.0 TERMS AND CONDITIONS:
The State of Wisconsin reserves the right to incorporate standard State contract provisions into any
contract negotiated with any bid submitted responding to this RFB (Standard Terms and Conditions
(DOA-3054) and Supplemental Standard Terms and Conditions for Procurements for Services (DOA-
3681)). Failure of the successful bidder to accept these obligations in a contractual agreement may
result in cancellation of the award.
SPECIAL TERMS AND CONDITIONS
10.1 CANCELLATION AND TERMINATION:
The State reserves the right to cancel the Contract for any reason, by giving written notice to
Contractor of such cancellation and specifying the effective date thereof, at least XXX days
before the effective date of such cancellation. Contractor shall, in the event of such
cancellation, be entitled to receive compensation for any work accepted hereunder in
accordance with the State's order(s). Contractor may also be compensated for partially
completed work in the event of such cancellation. The compensation for such partially
completed work shall be no more than the percentage of completion of each work effort, as
determined in the sole discretion of the State, times the corresponding payment for completion
of such work as set forth in the State's order(s).
In addition, the State reserves the right to terminate the Contract for reasons of breach of
contract, by giving written notice to Contractor of such termination and specifying the effective
date thereof, at least ten (10) days before the effective date of such termination. Contractor
shall, in the event of such termination, be entitled to receive compensation for any work
accepted hereunder in accordance with the State's order(s). Contractor shall also be
compensated for partially completed work in the event of such termination. The compensation
for such partially completed work shall be no more than the percentage of completion of each
work effort, as determined in the sole discretion of the State, times the corresponding payment
for completion of such work as set forth in the State's order(s).
Failure to maintain the required Certificates of Insurance, Permits and Licenses shall be cause
for Contract termination. If the Contractor fails to maintain and keep in force the insurance as
provided in the State of Wisconsin Standard Terms and Conditions, the State has the right to
cancel and terminate the Contract without notice.
Upon cancellation, termination or other expiration of the Contract, each party shall forthwith
return to the other all papers, materials, and other properties of the other held by each for
purposes of execution of the Contract. In addition, each party will assist the other party in the
orderly termination of this Contract and the transfer of all aspects hereof, tangible or intangible,
as may be necessary for the orderly, non-disruptive business continuation of each party.

10.2 MODIFICATIONS OF CONTRACT:
Any alterations made to the Contract must be rendered in writing and signed by both
responsible parties; no changes without such signed documentation shall be valid. No
alterations outside of the general scope and intent of the original Request for Bid or in excess
of allowable and accepted price changes shall be made.
10.3 PROPRIETARY INFORMATION:
Any restrictions on the use of data contained within a Request for Bid must be clearly stated in
the bid itself. Proprietary information submitted in response to a request will be handled in
accordance with applicable State of Wisconsin procurement regulations and the Wisconsin
public records law. Proprietary restrictions normally are not accepted. However, when
accepted, it is the bidder’s responsibility to defend the determination in the event of an appeal
or litigation.
Data contained in a bid, all documentation provided therein, and innovations developed as a
result of the contracted commodities or services cannot be copyrighted or patented. All data,
documentation, and innovations become the property of the State of Wisconsin.
Any material submitted by the bidder in response to this RFB that the bidder considers
confidential and proprietary information and which qualifies as a trade secret, as provided in s.
19.36(5), Wis. Stats., or material which can be kept confidential under the Wisconsin public
records law, must be identified on a Designation of Confidential and Proprietary Information
form (DOA-3027), which is attached. Confidential information must be labeled as such.
Cost (pricing) always becomes public information when bids are opened, and therefore cannot
be kept confidential. Any other requests for confidentiality MUST be justified in writing on the
form provided and included in the bid submitted.
10.4 AFFIRMATIVE ACTION:

can lead to bidder’s company being banned from doing business with any agency of the State

10.5 TAX EXEMPTIONS AND CERTIFICATION OF COLLECTION OF SALES AND USE TAX:
The State of Wisconsin shall not enter into a contract with a bidder, and reserves the right to
cancel any existing contract, if the bidder or contractor has not met or complied with the
requirements of s.77.66 Wis. Stats., and related statutes regarding certification for collection of
sales and use tax.
The State of Wisconsin is exempt from payment of all federal tax and Wisconsin state and
local taxes on its purchase except Wisconsin excise taxes as defined in the Standard Terms
and Conditions. Minnesota allows sales tax exemption for IRC 5019(C) organizations, which
includes the Agency. Therefore, the Owner does not pay Minnesota tax.

10.6 PAYMENT TERMS:
Payment will not be made until the service is determined to meet all specifications and has
been accepted by the State of Wisconsin.
State agencies must meet a statutory mandate to pay or reject invoices within 30 days of
receipt. Before payment is made, the ordering agency must verify that all invoiced charges are
correct and financial conditions are in compliance with the contract and corresponding
Purchase Order. Only properly submitted invoices will be officially received for payment.
Prompt payment requires that invoices be clear, complete and in compliance with conditions of
this Request for Bid and subsequent purchase orders.
Each invoice shall be itemized and must include any applicable purchase order number.
Payment for invoices that do not include detailed pricing information may be delayed until this
information is received.
The Contractor shall submit charges to reflect the prices and discounts established for the
items on the Contract. The Contractor will be paid after goods and/or services have been
delivered, installed (if required), and accepted as specified. A good faith dispute creates an

Wisconsin’s Cooperative Purchasing Service
Wisconsin statutes (s. 16.73, Wis. Stats.) establish authority to allow Wisconsin municipalities to purchase from state contracts.
Participating in the service gives vendors opportunities for additional sales without additional bidding. Municipalities use the
service to expedite purchases. A "municipality" is defined as any county, city, village, town, school district, board of school
directors, sewer district, drainage district, vocational, technical and adult education district, or any other public body having the
authority to award public contracts (s. 16.70(8), Wis. Stats.). Federally recognized Indian tribes and bands in this state may
participate in cooperative purchasing with the state or any municipality under ss. 66.0301(1) and (2), Wis.Stats.
Interested municipalities:
will contact the contractor directly to place orders referencing the state agency contract number; and
are responsible for receipt, acceptance, and inspection of commodities directly from the contractor, and making payment
directly to the contractor.
The State of Wisconsin is not a party to these purchases or any dispute arising from these purchases and is not liable for
delivery or payment of any of these purchases.
