386. Present:      Councillors Houghton (Chairman), Andrews, Burgess, Cheetham,
                   Gardiner, Miller, Newman, Platts and Stokes.

                   Councillors D. Birkinshaw, P. Birkinshaw, Fisher, Price, Spence and
                   Wainwright were also in attendance.

387. Declarations of Personal Interests

     There were no declarations of personal interest.

388. Leader of the Council - Call-In of Cabinet Decisions

     The Leader reported that no decisions from the previous meeting held on 23rd
     December, 2009 had been called-in.

389. Minutes of the Meeting held on 23rd December, 2009 (Cab.20.1.2010/3.1)

     The minutes of the meeting held on 23rd December, 2009 were taken as read and
     signed by the Chairman as a correct record.

390. Leader of the Council – Minutes of the One Barnsley Board Meeting held on
     28th October, 2009 (Cab.20.1.2010/3.2)

     RESOLVED that the minutes of the One Barnsley Board Meeting held on 28 th
     October, 2009 be received.

391. Leader of the Council – Minutes of the Joint Employees’ Consultative
     Committee Meeting held on 30th November, 2009 (Cab.20.1.2010/3.3)

     RESOLVED that the minutes of the Joint Employees’ Consultative Committee
     Meeting held on 30th November, 2009 be received.

392. Minutes of the Central Area Partnership Meeting held on 7th December, 2009
     (Cab.20.1.2010/3.4)

     RESOLVED that the minutes of the Central Area Partnership Meeting held on 7 th
     December, 2009 be received.

393. Minutes of the South East Area Partnership Meeting held on 7th December,
     2009 (Cab.20.1.2010/3.5)

     RESOLVED that the minutes of the South East Area Partnership Meeting held on 7 th

394. Decisions of Cabinet Spokespersons (Cab.20.1.2010/4)

       The Record of Decisions taken by Cabinet Spokespersons under delegated powers
       during the week ending 24th December, 2009 were noted.

395. Petitions Received Under Standing Order 40 (Cab.20.1.2010/5)

       It was reported that no petitions had been received under Standing Order 40.

396. Regeneration Scrutiny Commission’s Report on Helping Local Communities
     and Businesses through the Recession (Cab.20.1.2010/6)

       Councillor R. Wraith, Chair of the Regeneration Scrutiny Commission, presented the
       Regeneration Scrutiny Commission’s report on Helping Local Communities and
       Businesses through the Recession.

       RESOLVED that the report be received and the Executive Director Development be
       requested to respond to the report’s specific findings and recommendations within
       28 days.

397. Children’s Services Scrutiny Commission’s Report on the Number of Pupils
     and Students Taking Foreign Languages at GCSE and A Level
     (Cab.20.1.2010/7)

       Councillor Brook, Chair of the Children’s Services Scrutiny Commission, presented
       the Children’s Services Scrutiny Commission’s report on the Number of Pupils and
       Students Taking Foreign Languages at GCSE and A Level.

       RESOLVED that the report be received and the Executive Director Children, Young
       People and Families be requested to respond to the report’s specific findings and
       recommendations within 28 days.

398. Cabinet Spokesperson without Portfolio – Appointment of Representative to
     the Local Government Yorkshire and the Humber Cohesion Group
     (Cab.20.1.2010/8.1)

       RESOLVED:-

       (i)     that the Adult Social Services and Health Spokesperson be appointed as the
               Council’s representative on the Local Government Yorkshire and the Humber
               (LGYH) Cohesion Group;

       (ii)    that the Adult Social Services and Health Cabinet Support Member be
               appointed as a substitute representative to the LGYH Cohesion Group; and

       (iii)   that attendance at meetings of the above be confirmed as approved duties.

399. Cabinet Spokesperson without Portfolio – Appointment of Representative to
     the Barnsley Black and Ethnic Minority Board of Directors and Change of
     Representation on the Industrial Communities Alliance (Cab.20.1.2010/8.2)

       RECOMMENDED TO COUNCIL ON 28th JANUARY, 2010:-

       (i)     that a Member be appointed as the Council’s representative on the Barnsley
               Black and Ethnic Minority Initiative (BBEMI) Board of Directors;

       (ii)    that a Member be appointed as a representative on The Industrial
               Communities Alliance to replace Councillor Sanderson;

       (iii)   that Councillor Picken be confirmed as the Council’s other representative on
               The Industrial Communities Alliance; and

       (iv) that attendance at meetings of the above be confirmed as approved duties.

400. Adult Social Services and Health Spokesperson – 2008/09 Annual Performance
     Assessment of Social Care Services for Adults (Cab.20.1.2010/9.1)

       RESOLVED:-

       (i)     that the report be received and the Grade 4 performance rating awarded to
               Barnsley Adult Social Services by the Care Quality Commission for 2008/09 be
               noted;

       (ii)    that Cabinet’s congratulations be passed to staff throughout the Adult Social
               Services Directorate, Barnsley Primary Care Trust and partner organisations
               for the achievement of maintaining excellent/maximum rating for the fourth
               consecutive year for Adult Social Care.

       RECOMMENDED TO COUNCIL ON 22nd APRIL, 2010 that the Grade 4
       performance rating awarded to Barnsley Adult Social Services by the Care Quality
       Commission for 2008/09 be noted.

401. Adult Social Services and Health Spokesperson – Personal Care at Home
     Consultation on Proposals for Regulations and Guidance (Cab.20.1.2010/9.2)

       RESOLVED that the consultation exercise by the Department of Health regarding
       Personal Care at Home as outlined in the report now submitted be noted and the
       Adult Social Services and Health Spokesperson and the Executive Director Adult
       Social Services be authorised to respond on behalf of the Council.

402. Development Spokesperson – Response to the Regeneration Scrutiny
     Commission Report on Promoting Tourism in Barnsley (Cab.20.1.2010/10.1)

       RESOLVED that the response to the Regeneration Scrutiny Commission’s
       recommendations regarding the promotion of tourism in Barnsley, as set out in the
       report, be approved and that the report be forwarded to the Commission.

403. Development Spokesperson – West Road/The Lindales/Cresswell Street,
     Pogmoor – Objections to Proposed Waiting and Loading Restrictions
     (Cab.20.1.2010/10.2)

       RESOLVED:-

       (i)     that the objections received to the proposed waiting and loading restrictions on
               West Road, The Lindales and Cresswell Street, Pogmoor, as detailed in the
               report now submitted be set aside and the objectors informed accordingly;

       (ii)    that the Assistant Director, Highways, Engineering and Waste be authorised to
               implement the amended Traffic Regulation Order, as detailed in Appendix 1 to
               the report, and the Borough Secretary be authorised to complete the necessary
               documentation.

404. Finance and Property Services Spokesperson – Anti Money Laundering Policy
     (Cab.20.1.2010/11.1)

       RESOLVED:-

       (i)     that the policy and guidance to staff relating to anti money laundering, as
               detailed in the report now submitted, be approved;

       (ii)    that the creation of the role of Money Laundering Reporting Officer and Deputy
               Money Laundering Reporting Officer, be noted;

       (iii)   that the appointment of the Assistant Director Finance (Audit and Risk
               Management) to act as the Money Laundering Reporting Officer (MLRO), be
               noted;

       (iv) that the appointment of the Assistant Director Finance (Financial and Business
            Support Services) to act as the Deputy Money Laundering Reporting Officer
            (DMLRO) be noted.

405. Finance and Property Services Spokesperson – Calculation of the Council Tax
     Base for the Year 2010/11(Cab.20.1.2010/11.2)

       RECOMMENDED TO COUNCIL ON 28th JANUARY, 2010:-

       (i)    that the report of the Executive Director Finance and Property for the calculation
              of the Council’s Tax Base for the year 2010/11 now submitted be approved;

       (ii)   that, pursuant to the Executive Director’s report and in accordance with the
              Local Authorities (Calculation of Tax Base) Regulations 1992, the amount
              calculated by Barnsley Metropolitan Borough Council as its Council Tax Base
              for the year 2010/11 shall be 68,890.99; and

       (iii) that, pursuant to the Executive Director’s report and in accordance with the
             Local Authorities (Calculation of Tax Base) Regulations 1992, the amount
             calculated as the Council Tax Base for the year 2010/11 in respect of each
             Parish shall be as follows:-
