1. By submitting this order Customer understands and agrees that they are hiring the services of Best Price Auto Transport to arrange the shipment of their vehicle(s) with a federally licensed and
properly insured Contract Carrier, hereinafter referred to as .Carrier.. They further have read, understand and will abide by the following terms.

2. Customer must prepare the vehicle for transport by disarming alarm systems, providing necessary remotes for such, and removing or retracting all loose and/or protruding accessories from the
vehicle. Customer's vehicle(s) is/are considered in operational condition and must be able to be driven onto and off of the carrier under the vehicle's own power at all times during shipment unless
clearly noted on cu stomers order as . In-op. or . Non-operational.. N on-operational ve hicles must r oll, brake and st eer. V ehicles that ar e non-operational o r b ecome non -operational du ring
shipment, for any reason, will be subject to an additional, industry standard, non-operational fee of two hundred Dollars ($200.00).

3. Customer agrees and understands that all vehicles must be free of contents as neither Best Price Auto Transport nor Carrier is licensed to knowingly handle the transportation of .Household
Goods..Damage to, loss of or fines levied to Carrier resulting from any unauthorized contents present in the vehicle during shipment are the sole responsibility of the Customer.

4. Customer's total price for the transportation of their vehicle(s) is factored using numerous pieces of information including, but not limited to, the size of the vehicle(s). Misrepresentation to Best
Price Auto Transport of the vehicle(s) size may result in additional fees and/or the cancellation of the order.

5. It is the Customer's responsibility to ensure that the vehicle(s) is/are paid for prior to the pickup date given on the order. Failure to release the vehicle(s) to the chosen Carrier on or after the date
given by the Customer when placing their order may result in a .Dry Run. Fee. Industry standard for said fee is One Hundred Dollars ($100.00). Cancellations must be made in writing and sent via
fax at least 48 hours prior to pickup and is subject to a minimum cancellation fee of $100.00.

6. F ederal laws prohibit au tomobile transporters from sh ipping house hold goo ds. A ll items in yo ur v ehicle m ust be co nfined t o the trunk, an d ar e limited t o 100 po unds and ar e su bject t o
acceptance by the carrier. Neither Best Price Auto Transport nor the carrier will be liable for damage resulting from items placed in the vehicle. If the vehicle is being shipped overseas, the vehicle
must be completely empty except for factory-installed equipment.

7. Once a Carrier is assigned to their vehicle(s), Customer will be given the estimated dates of pickup (and delivery when possible) as well as the driver's name and direct phone number. Again,
any dates given are the Carrier's projections only and are given solely to assist both the Customer and the Carrier in the general arrangement of their schedules; dates given are not guaranteed,
as ce rtain conditions can a lter a C arrier's schedule (i.e. weather, r oad co nditions, mechanical problems, et c.) A s such, C ustomer may not ho ld B est P rice A uto T ransport o r C arrier liable f or
expenses incurred as the result of unforeseen delays, including, but not limited to, any car rental fees incurred by Customer. It is strongly recommended that the Customer maintain reasonable
contact with the Carrier and/or Best Price Auto Transport to stay up to date on any scheduling changes.

8. Carrier will contact the Customer by phone at the numbers provided by the Customer in order to schedule an appointment for pickup and de livery of the vehicle(s). It is the Customer's sole
responsibility to verify that all contact phone numbers given to Best Price Auto Transport and subsequently to the Carrier are correct. In the event the customer is unable to meet the driver for an
appointed time for pickup or delivery, the Customer may designate an Agent on their behalf to release and/or accept the vehicle(s). Customer understands that if neither Customer nor their Agent
is able to accept and/or remit proper payment for the vehicle(s) on delivery at the destination, the vehicle(s) will be stored in a facility chosen by the Carrier at the Customer's expense.

9. P ayments made f or t he ba lance due t o the C arrier o n de livery are . COD., un less payment on pi ckup i s pre-arranged, and must be i n t he f orm of C ash or C ashier's Check only. ( It is the
Customer's responsibility to verify the Carrier's preferred payment method and/or the proper spelling of their Company's name for such)

10. Customer agrees and understands that the Carrier that accepts and transports the Customer's vehicle(s) will perform a ve hicle inspection report (AKA Bill of Lading) at the origin. Customer
should under no circumstances release a vehicle to a Carrier without said inspection report. This contract is subject to all of the terms and conditions of the Carrier's straight bill of lading and any
liability exclusions therein. Carrier and C ustomer, or Customer's agent, are both required to verify and sign the initial inspection report. Failure to do so could result in the Customer's inability to
process a dam age cl aim. C arrier assu mes responsibility for any damage not not ed on t he i nitial ve hicle inspection r eport f rom that point, and t hroughout t he t ransportation per iod, unt il t he
vehicle(s) is/are delivered at the agreed destination. Carrier and C ustomer, or Customer's Agent, must then thoroughly inspect the vehicle one final time and bot h must sign the final inspection
report. In the event there is damage during transport, Customer, or Customer's Agent, MUST not e those damages on t he final inspection r eport, pay the remaining balance due stated on t he
contract and then contact the Carrier's main office and, subsequently, their insurance company. Failure to note any damage on the final inspection report releases the Carrier of liability and could
result in the inability to process a damage claim.

11. All Carriers selected by Best Price Auto Transport are required to maintain the requisite insurance to protect your vehicle while it is being transported to its destination.

12. Rescheduling: If your vehicle has already been scheduled for transport and YOU have to have us reschedule your vehicle for a second time there will be a $50 rescheduling fee.

13. Customer under stands that in the event that the Carrier is unable to safely access the pickup or delivery addresses given by t he Customer, t he Customer agr ees to meet t he Carrier at a
nearby and safe area in order for the Carrier to perform their service. Carrier will make a good faith attempt to deliver vehicle to designated delivery point, however, owner acknowledges that due
to circumstances beyond the control of the carrier, a customer will pick up at the nearest accessible location to the Carrier.

14. Customer agrees and understands that the Customer's order form and these terms are the only contract between the customer and Best Price Auto Transport.

15. This agreement shall be gove rned by and construed in accordance with the laws of t he state of Texas / County of Harris. The parties further agree that any legal action arising out of this
Agreement shall be filed in a court of jurisdiction within Harris County, Texas and is limited to the amount of Best Price Auto Transport's service fee. Customer hereby submits to the jurisdiction of
such courts and waives any right to jurisdiction in any other location.

16. The following items are not to be inside the vehicle at time of shipment: guns, explosives, ammunitions, flammable products, narcotics, negotiable or legal papers, alcohol or jewelry.

17. N othing i n t his agreement sh all be c onstructed as m aking it b inding on c arrier t o pick up and / or de livery at location f rom or t o w hich i t is impractical t o ope rate ca rrier's equipment or
inadequate loading or unloading facilities, or local, state or federal laws.

18. In the event any party institutes legal proceedings to enforce their respective right arising out of this agreement, the prevailing party shall be entitled to the award of the attorney's fees and
court costs, plus cost for executing, enforcing and /or collecting all judgments at all trial and appellate levels.

19. Customer warrants that he will pay all monies due to Best Price Auto Transport for its agent services and will not seek to charge back a credit card or stop a check under any circumstances.
The Department of Transportation requires that all monies due Best Price A uto Transport must be pai d upon de livery and before any claims may be processed. If the customer does seek to
charge back a credit card or stop a ch eck or other payment, any extra charges incurred by Best Price A uto Transport in recouping payment will be t he responsibility of the customer. It is also
agreed that this agreement and the rights and obligations of the parties pursuant to the agreement are governed by the State of Texas law, and any legal action arising out of this agreement shall
be brought in Harris County, TX. All monies due to Best Price Auto Transport for transport of the vehicle that were not paid as a deposit with the order are due on delivery by cash, cashier's check
or certified check.
