Subject :        Action Plan on Trafficking in Human Beings



1.    On 1-2 December 2005, the Council adopted the EU Action Plan on best practices, standards
      and procedures for combating and preventing trafficking in human beings (OJ C 311,
      9.12.2005) as required by the Hague Programme (section 1.7.1). The Action Plan includes
      key recommendations and actions.


2.    Point 6(2)(b) of the Action Plan envisages "an EU wide directory to map available support
      schemes". To implement this point and establish such an overview a questionnaire has been
      sent to Member States (15293/06 CRIMORG 174 MIGR 192 ENFOPOL 198).


3.    The Multidisciplinary Group on Organised Crime (MDG meeting of 2 March 2007) and the
      Article 36 Committee (CATS meeting of 26 April 2007) decided to set up a web-based
      directory of support structures. This directory would consist of weblinks, for all the Member
      States, on the existing support schemes, on one freely accessible webpage. It was decided that
      this webpage should contain links to a central body in each Member State, whether public or
      private, which could be accessed for information on existing support structures and contact
      details.

     The Commission has agreed that its (DG JLS) webpage could be used setting out the above
     links, it being understood that Member States remain responsible for the content of the
     weblinks they provide.


4.   Contributions received from Member States to both invitations have been compiled and are
     set out in Annex 0-IV to this document.


5.   Those delegations that have not yet sent their contributions under points 2 and 3 of this
     document are invited to send the relevant information as soon as possible to the General
     Secretariat of the Council, to the attention of Ms. Mieneke DE RUITER (e-mail:

     BE:   Coordination of policies on trafficking in human being is one of the tasks of the Interdepartmental Unit for coordinating efforts to combat smuggling and trafficking in
           human beings. See also ANNEX to ANNEX I

     BE:   The Interdepartmental Unit is not an institution in the strict sense of the term but a focal point for all those who are responsible for dealing with trafficking in human
           beings in order to lay down the main lines of the policy to be developed and the ways of implementing it. The Unit is chaired by Minister for Justice.
           The Centre for Equality of Opportunity and Combating Racism (CECLR), an autonomous public service, publishes an independent annual report on trafficking in
           human beings which includes an analysis of the situation with regard to trafficking in Belgium, development with regard to the victims' situation, etc. (see:
           www.diversite.be). The Government also produces a biennial report which explains the initiatives it has taken, in particular with regard to the CECLR's comments.
           The Government report is drawn up by the Criminal Policy Department.

      smuggling and trafficking in human beings and in particular with a view to dismantling
      traffickers' networks and putting a stop to the activities of traffickers' and their networks;

(3)   contribute to the drawing up of proposals and recommendations with regard to combating

      The Unit is chaired by the Minister for Justice or his representative. In order to prepare for
      the Interdepartmental Unit's meetings, a committee has been set up under the chairmanship of
      the Criminal Policy Department, with the Centre for Equality of Opportunity and Combating
      Racism acting as the Secretariat. The committee has the task of submitting proposals to the
      Unit, implementing its decisions and coordinating meetings (Royal Decree of 16 May 2004
      on combating trafficking in human beings).

      With regard to aspects concerning the reception of victims, the Centre for Equality of
      Opportunity and Combating Racism has the task of ensuring coordination of and cooperation
      in the action carried out by the specialised victim reception centres (Article 3 of the Royal
      Decree of 16 May 2004).

                 re "List coordinating agencies/bodies providing services for victims"

One of the tasks of the Interministerial Committee for the implementation of Article 18 of the consolidated
law on immigration (operating in the Department for Equal Rights and Opportunities, within the Office of
the Prime Minister) is to plan, finance and oversee victim support and social integration programmes, 70 per
cent of whose funding comes from national government and 30 per cent from local government sources.
The Committee is chaired by the appointee of the Minister for Equal Rights and Opportunities, the other
members being appointed by the Ministry of the Interior, the Ministry of Justice and the Ministry of Social
Solidarity.
The Committee manages two separate funds for support and social integration programmes. The first (under
Article 18 of Legislative Decree 286/98, the consolidated law on immigration) finances victim support and
social integration programmes; the second (under Article 13 of Law 228/03 on measures against human
trafficking) funds additional State assistance programmes, which provide the victims of trafficking with
provisional support in the form of suitable accommodation, board and health care in order to help them
recover from physical and mental trauma.
As well as launching tendering procedures, selecting projects and monitoring and overseeing their
implementation, the Interministerial Committee liaises between all ongoing schemes in the field, organising
single-issue panels; recently, with the involvement of the National Anti-Mafia Directorate and NGOs active
on the ground, alongside the government departments represented on the Committee, it successfully
sponsored a legislative amendment (enacted in Decree Law 300/06) extending the coverage of the support
programmes to victims of trafficking who are EU nationals.
Its terms of reference include the promotion and funding of systemic schemes, which include:
1.    A human trafficking free phone number (800290290) for use by victims themselves and individuals
      aware of instances of trafficking (prostitutes' clients, witnesses, etc.), to alert the authorities to possible
      cases. The 14 local hotlines (coordinated by a central switchboard) provide nationwide coverage and
      are managed - on behalf of local authorities with which agreements have been signed - by NGOs
      which also run social protection schemes.
2.    Training for NGO field workers.
3.    Information and awareness campaigns regarding human trafficking.
4.    Monitoring and study of data on human trafficking.
Under its terms of reference, the Committee also funds and coordinates, together with the Interior Ministry's
Civil Liberties Department and the International Organisation for Migration, a national scheme for the
voluntary return to and reintegration in their home countries of the victims of human trafficking. This
programme sets out to provide victims of trafficking with the option of assisted voluntary return and to
ensure that return is feasible in the context of protected social and work reintegration schemes.
The return of victims is funded by the Interior Ministry, with the IOM attending to the logistical aspects of
the return process and to the reintegration of victims either through its offices or through affiliated NGOs in
their home countries.

   The Central Government body: The Office for Criminal Justice Reform fund Eaves Housing for
    Women (a NGO) to run the Poppy Project which provides support services for adult victims of
    trafficking for sexual exploitation.

   OCJR have responsibility for the victim support strand of trafficking policy and have set up a
    „Support Service Provider‟ Group which aims to meet regularly.

   The UK Human Trafficking Centre has a „Victims Group‟. This is chaired by Central
    Government and attended by NGOs, Police, the Immigration Service and the Crown
    Prosecution Service. Membership is flexible and additional experts or practitioners are invited
    to meetings depending on agenda topics

   The UK Human Trafficking Centre have appointed a Victims‟ Co-ordinator who: scopes
    possible new service providers and co-ordinates Non Government Funded service providers;
    and referrals to UKHTC.

AUSTRIA:

     A kind of formal recognition of NGOs is provided for in Art. 25 (3) Security Police Act:
     The Ministry of the Interior is authorized to enter into contracts on service provision
     with suitable and reliable victim protection institutions.
     In case the institution is mainly active in counselling and supporting women, the
     contract with the institution is to be entered into jointly with the Ministry for Health
     and Women. The only recognized service providing institution for women victims of
     trafficking is the IBF Interventionsstelle für Betroffene des Frauenhandels) in Vienna. It
     receives funding via the contract described in 2.5.1.

     Furthermore, the pilot project on an additional “transition flat” for victims that no
     longer need the intensive support offered in the “emergency flat”, but still need
     counselling and support, has been established in September 2006. The Minstry of the
     Interior has provided the funding amounting to EUR 99.120,-. If the pilot project has
     proved successful and suitable for further supporting victims, it is intended that the
     “transition flat” project will be included into the contract between IBF and the Ministry
     of the Interior and the Ministry of Health and Women.

      Non-governmental, non-profitable organisations can be officially registered with the
      Registrar for Associations and Foundations, a role assumed ex officio by the Permanent
      Secretary of the Ministry of the Interior. The registration of NGOs is in accordance with
      the Laws on Associations and Foundations of 1972 and 1997 and the Regulations on
      Associations and Foundations of 1973-1998. In order to register, NGOs must, among
      other requirements, submit and get authorisation for their statutes, which explain their
      goals and targeted activities.

      NB- The criteria to be fulfilled by NGOs in order to receive funding from the Social
      Welfare Services are in the process of being revised/amended. There is ongoing
      preparation of a thorough study that will present suggestions on how to establish better

      No, we have a system where Comensha (the former Foundation Against Trafficking in
      Women) is the co-ordinator for the care of victims of trafficking. They have the task to
      registrate all the victims of trafficking in order of the Ministry of Justice and the
      Ministry of Health, Welfare and Sport. They are in contact with other NGOs that
      provide services to victims. These NGOs are organisations, public or private, who can be
      partly financed by the government. When a victim has a formal residence permit, he or
      she can falls back on the normal facilities such as legal or financial aid.

      Yes, Comensha has a public task with the co-ordination and registration of the care of
      victims of trafficking. Therefore they are provided with a structural funding. There‟s
      also the possibility for NGOs to hand in a proposal for a certain amount that can be

      The Ministry of Justice and the Ministry of Health, Welfare and Sport are responsible
      for the funding at national level. The organisations that are active in the broader field of
      providing care and services to all kind of victims can also be financed by other

5.1   The amount available per year

      It is difficult to state a fixed amount for service providers per year. The amount can
      vary each year and for the normal service facilities funding can also be given by other
      authorities (such as municipalities).
      This being said, Comensha received for their tasks as co-ordinator and registration of
      victims of trafficking from the Ministry of Justice an amount of € 561.976,00 in 2006.

      There is not such a system. However, in the Department of Social Assistance and
      Integration in the Ministry of Labour and Social Policy a new project is realizing. Its
      aim is to create a list of Polish centers of crisis intervention which among offered
      services can also lend assistance to victims of trafficking in human beings.

     Assistance to victims of trafficking in human beings was, like in most other countries,
     taken on by the civil initiative with the help of international non-governmental
     organisations. One such NGO is Društvo Ključ, which received EU funds in the
     framework of the "Witness" project, for setting up a safe house. The premises are
     intended for the accommodation and protection of victims of trafficking in human
     beings who were prepared to cooperate with law enforcement authorities in criminal
     procedure. Later on an agreement was signed between the Ministry of the Interior and
     Društvo Ključ, between the Supreme State Prosecutor's Office and Društvo Ključ and a
     year later between the General Police Directorate and Društvo Ključ.


     Developments both at the international level and at home brought about the need to
     more precisely determine the role of the IWG, its credibility with national institutions
     and the definition of its mandate. The Inter-ministerial Working Group for the fight
     against trafficking in Human beings was appointed with the decision of the Government
     RS no. 240-05/2003-1 of 18.12.2003. Formally the procedure was carried out by the
     Ministry of Foreign Affairs as the Group's founder. As the issues are very extensive and
     complex the Working Group consists of representatives of the Ministry of the Interior,
     General Police Directorate, Ministry of Foreign Affairs, Ministry of Justice, Ministry of
     Education and Sport, Ministry of Work, Family and Social Affairs, Public Relations and
     Media Office, Office for Equal Opportunities, Supreme State Prosecutor's Office,
     international organisations (IOM and UNHCR) and non-governmental organisations
     Društvo Ključ and Slovene Philanthropy. The group is led by a representative of the
     Ministry of the Interior, and his assistant is a representative of the Ministry of Foreign
     Affairs.

    The Government's decision also contained a rough outline of the group's tasks, which
    consist of preparation of periodic reports, drawing-up of policies in the field of fight
    against THB and preparation of action plans.


    Subsequently different concepts were developed by some international organisations as
    to how to approach this complicated issue most efficiently. In Slovenia we stuck to the
    continuity of some individuals who have been present in this segment since the
    establishment of the Inter-agency Working Group.


    Very important for the work of IWG are regular meetings of its members and exchange
    of information in various work areas. Thus in Slovenia we have a practice of regular
    meetings and reporting. At meetings decisions and initiatives are adopted and put in the
    minutes and then we try to implement them through state mechanisms. Special
    emphasis is given to the preparation of action plans and annual reports. There is regular
    reporting on participation of members at international events and activities at
    operational level (police measures, work with victims, etc.).


    In the light of past experience it is recommended that the leadership of such inter-
    ministerial working groups by a national coordinator should be specialised. His or her
    focus should be especially on THB issues, following international activities in this field,
    leading and directing the working group and creating conditions for new ideas and
    initiatives. If visible progress is to be achieved, a certain level of authority and
    competence are needed for the realisation of the set goals. Management of the
    coordinating body should be supported by a secretariat, and the members of the
    working group should be experts, representatives of individual agencies with sufficient
    knowledge on THB and human rights.


    The Inter-ministerial Working Group must know exactly what it wants to achieve in the
    field of combating THB. Based on the analysis of the situation it must prepare a strategy
    and determine the purpose and strategic goal. Then it prepares periodic action plans,
    which concretise individual activities for the achievement of the set goals. It is very
    important that these action plans are concrete, financially and temporally determined
    with a reference to the contractor and approved by the Government.

      The basis for the financing of projects of assistance to victims of trafficking in human
      beings carried out by NGOs is to be found in the National Action Plan of the Inter-
      agency Working Group for the fight against trafficking in human beings approved by
      the Government of the Republic of Slovenia. For each project the funds and the
      provider of funds (i.e. the competent ministry) are defined. In the case of the project
      "Care for the victims of trafficking in human beings" the providers of funds are the
      Ministry of the Interior and the Ministry of Labour, Family and Social Affairs, which
      annually prepare a public tender procedure and select a non-governmental organisation
      to provide the care. In case of the project "Identification of victims of THB in asylum
      procedures (PATS) the fund provider is the Ministry of Foreign Affairs, the service
      provider a NGO and participant the Asylum Division of the Ministry of the Interior.
      The Ministry of Labour, Family and Social Affairs co-finances the European project
      EQUAL – reintegration of victims of trafficking in human beings, which is also carried
      out by a non-governmental organisation.

         Eaves Housing for Women successfully were awarded a grant following a
          commercial procurement exercise. OCJR have a grant-agreement with Eaves
          Housing for Women (THE Poppy Project) which sets out their commitments.
         The UK are planning on developing Guidance on Minimum standards of care for
          supporting victims of trafficking for sexual violence.
         There is an MoU between Poppy/UKHTC/Association of Chief Police
          Officers/Crown Prosecution Service that sets out their commitments and
          arrangements for working together and information sharing. The UKHTC are
          planning on extending this to other organisations

CYPRUS

Article 7(1) of the Law on Combating Trafficking in Human Beings and Sexual Exploitation of Children, (Law No.3(I)/2000), provides that the
Republic of Cyprus has a duty to provide victims with reasonable protection and support during their stay in the territory of the Republic, including, to
the extent feasible and reasonable, arrangements for maintenance, temporary shelter, medical care and psychiatric support until the victims are
considered as having recovered from any traumatic experience.

On 09/08/2000 the Council of Ministers with its decision no. 50.203, in light of article 10 of the Combating Trafficking in Human Beings and Sexual
Exploitation of Children Law, appointed the Director of the Social Welfare Services as guardian of victims of exploitation. According to article 11 of
the Law, the Guardian has the following functions:

a.   to advise, counsel and give guidance to victims of exploitation,
b.   to hear in the first instance complaints of exploitation or violation of the law and to take all steps for the full investigation of the said complaints
     by the appropriate bodies,
c.   to ensure, through the appropriate authorities, for the treatment and safe residence of the victims,
d.   to take steps through the appropriate agencies for the prosecution of persons responsible for exploitation of other persons or other contravention
     of the law,
e.   to take all measures aiming at the rehabilitation or re-employment or assisted repatriation of the victims,
f.   to identify any weaknesses or deficiency of the Law or regulations and recommend to the Minister their amendment.

The “Manual of Interdepartmental Procedures for the Handling of Cases of Trafficking in Human Beings and Sexual Exploitation of Adult Persons”,
published in February 2007, provides for more practical measures in order to facilitate cooperation and task-sharing between the different Government
services when dealing with cases of human trafficking.

      It should be noted that the Social Welfare Services are planning to operate a shelter for victims of sexual trafficking, expected to start functioning by the end of March 2007.
      The shelter will provide support services. Its estimated budget will be 40,000 CYP (approximately 70,000 EUR).
      Article 7(1) of the Combating Trafficking in Human Beings and Sexual Exploitation of Children Law states the Republic has the duty to provide victims with reasonable
      protection and support during their stay in the territory of the Republic, until the victims are considered as having recovered from any traumatic experience.
      Legal aid is provided to victims according to the Law on Legal Aid (Law No. 165(I)2002), articles 4 and 5.

DURATION SERVICES:

After the reflection period, the victims are to decide whether they are willing to cooperate with police or not. If yes, current regulation offers the victims of human
trafficking the possibility of obtaining:

a. Visa for the purpose of toleration of residence exceeding than 90 days (pursuant to the provision of Section 33, Act no. 326/1999 Coll., on residence of
   foreigners in the Czech Republic) for the period by reason of existence of an obstacle independent of the person‟s will which prevents them from leaving the
   country and due to current penal proceedings against offender of trafficking in human beings in which the victim of trafficking acts as the damaged party or a
   witness.
       -     According to the present regulation visa validity is limited for the minimum necessary period of time, i.e. for the duration of the obstacle that, however,
             cannot exceed 365 days. But it can be extended repeatedly, and in practice the extension of visa validity of the victims of human trafficking does not
             pose any problems.

b. Long-term stay for the purpose of protection in the territory of the Czech Republic (pursuant to the provision of Section 42e, Act no. 326/1999 Coll., on
   residence of foreigners in the Czech Republic)
       -    reflects the Council Directive 2004/81/EC of 29 April 2004 on the residence permit issued to third-country nationals who are victims of trafficking in
            human beings)
       -    - Ministry of the Interior issues this confirmation at least for the period of six months, and pursuant to the provision of Section 44a (1a) this validity
            can be extended repeatedly.

These procedures may be repeated during the term of penal proceedings. After its termination, the victim is offered a voluntary and safe return to her/his home
country through IOM services.
In cases worthy of special consideration (e.g. when the victim faces significant risk in the country of its origin) and at the application of the victim,
such person may be granted permanent residence on humanitarian grounds.

     amount of 10,000 CYP (approximately 17,000 EUR) for 2006. This was given through
     the “Mechanism for Women‟s Rights”, a programme for funding of NGOs that promote
     women‟s rights.

     The Limassol Bishopric has ceded premises free of charge that are used to house the
     shelter of “STIGMA” and is also paying for electricity supply. The building was
     appropriately modified/extended in order to enhance accommodation capacity. The cost
     for the modification of the building and its equipment was undertaken by Members of
     the Management Board of “STIGMA”.

     Moreover, the shelter occasionally receives funding from the Holy Monastery of
     Kykkos.

     Donations are received by supporters and parishioners of the founder of the shelter,
     Father Savvas Michaelides. Other Members of the Management Board also contribute
     to the financing of the shelter.

     “STIGMA” has submitted an application to the Social Welfare Services for funding
     under the “Grants-in-Aid Scheme” (see Annex II question 5 above).

           There are 77 schemes under Article 18 of the consolidated law on immigration and
           26 under Article 13 of Law 286/98 (measures against human trafficking) currently
