					Crazy John's – Twitter Galaxy S Competition




1. Information on how to enter and prizes forms part of these conditions of entry. Submission of
an entry is deemed acceptance of these conditions of entry.


2. Entry is only open to Australian residents aged 16 years or over (“Entrants”).


3. Employees (and their immediate families) of the Promoter, participating retailers and
agencies associated with this promotion are ineligible to enter.


4. Competition commences 18 February 2011 and runs until 11:59 pm AEST on 4 March 2011.
The Promoter will ask a question on www.twitter.com via a Twitter message using the username
@crazyjohns (“Question”). The Entrant that the Promoter determines has provided the best
answer to the Question will be the winner of the competition (“Winner”). The Promoter will
announce the Winner by Twitter message by 5 pm AEST on [            ] February 2011. The Winner’s
name may be published on www.crazyjohns.com.au at the Promoter’s sole discretion.The
Winner agrees to provide a photo of themselves to be published on www.crazyjohns.com.au at
the Promoter’s sole discretion. The Promoter’s decision is final and no correspondence will be
entered into. An Entry is deemed to be received at the time of its receipt by the Promoter and
not at the time of transmission by the Entrant.


5. This is a game of skill and chance plays no part in the determination of the Winner. Each
Entry will be individually judged according to its merits on the basis of originality, creativity and
humour as determined by the Promoter in its sole discretion.


6. To enter, Entrants must (i) sign-up to follow “@CrazyJohns” on www.Twitter.com and (ii) send
a response to “@CrazyJohns” via Twitter to the Question (“Entry”) by 11:59 pm AEST on[            ]
February 2011. The response must adhere to the following format: “[The response]
@crazyjohns #FreeGalaxyS”. A failure to adhere to the Entry format may result in the Entry
being disregarded by the Promoter.


7. Only one Entry is permitted per registered Twitter account.
8. The Promoter reserves the right to verify the validity of Entries and Entrants (including an
Entrant’s identity, age and address) and to disqualify any Entrant who submits an Entry that is
not in accordance with these conditions of entry or who tampers with the entry process or who
submits an Entry that the Promoter, in its sole discretion, deems to be offensive, inappropriate,
defamatory or otherwise not in keeping with the spirit of the competition. Failure by the Promoter
to enforce any of its rights at any stage does not constitute a waiver of those rights.


9. It is the Winner’s responsibility to inform the Promoter if his or her personal details
change.


10. If there is a dispute as to the identity of an Entrant, the Entrant will be deemed to be the
person in whose name the corresponding Twitter account is held.


11. The best Entry as determined by the Promoter, in its sole discretion, will win one White
Samsung Galaxy S and one Crazy John’s prepaid SIM (“Prize”). No credit is included as part of
the Prize and the handset will be locked to the Vodafone or Crazy John’s network. Charges may
apply to unlock. The Winner must check handset box for details.


12. If the Winner is under 18 years of age, the Prize may, at the Promoter’s sole discretion, be
awarded to the Winner’s nominated parent or guardian.


13. If for any reason whatsoever the Winner does not redeem the Prize or an element of
thePrize by the time stipulated by the Promoter, then the Prize or that element of the Prize will
be forfeited by the Winner and neither cash nor any other prize will be awarded in lieu. In any
event, if the Winner does not claim the Prize within 10 days of the date upon which the
Promoter first attempts to contact them, they will forfeit the Prize and the Promoter will select
the next best Entry. This process will continue either until the Prize is claimed or valid entries are
exhausted, whichever occurs first.


14. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the
right to substitute the Prize (or that part of the Prize) with an alternative prize to the equal value
and/or specification (“Substituted Prize”), unless to do so would be prohibited by law.


15. If for any reason whatsoever beyond the reasonable control of the Promoter, the
competition is not capable of being conducted as reasonably anticipated, the
Promoter reserves the right, in its sole discretion, unless to do so would be
prohibited by law, to (a) disqualify any Entrant; and/or (b) to cancel, suspend,
modify orterminate the competition.


16. Unless otherwise stipulated, thePrize or the Substituted Prize, or any unused portion of
thePrize or the Substituted Prize, is not transferable, exchangeable or redeemable for cash.


17. Nothing in these conditions of entry excludes, restricts or modifies any right, remedy,
guarantee or warranty or other term or condition which cannot be lawfully excluded or limited
(each a “Non Excludable Condition”). Such laws include, but are not limited to, the Australian
Consumer Law which contains guarantees that protect the purchasers of goods and services in
certain circumstances. Subject to the Non Excludable Conditions and to the fullest extent
permitted by law, , the Promoter
excludes from these conditions of entry all conditions, warranties and terms,
implied by statute, general law or custom. Except for any liability in relation to a
Non Excludable Condition, the Promoter (including its officers, employees and
agents) excludes all liability whether arising in tort (including, without limitation,
negligence), contract or otherwise for any personal injury or any other loss or
damage (including without limitation loss of opportunity or loss or profits) whether
direct, indirect, special or consequential, arising in any way out of the
competition, including, without limitation, the following: (a) any technical
difficulties or equipment malfunction (whether or not under the Promoter’s control
including, without limitation, any technical difficulties associated with the website
www.twitter.com); (b) any theft, unauthorised access or third party interference;
(c) any Entry or Prize claim that is late, lost altered, damaged or
misdirected (whether or not after receipt by the Promoter) due to any reason
beyond the reasonable control of the Promoter; (d) any variation in thevalue of the Prize; (e) any
tax implications; and/or (f) the Prize or any or all use of the Prize.


18. The Winner consents to the Promoter using (or permitting authorised third
parties to use) the Winner’s name in any media for an unlimited period of time
without remuneration for the purpose of promoting this competition (including any
outcome), the Promoter and any products orservices supplied by the Promoter.
19. The Promoter collects personal information in order to conduct the competition
and provide any goods or services requested and may, for that purpose, disclose
such information to third parties, including, but not limited to, the Prize suppliers or a
regulatory authority and for any purpose to which the Winner has previously
consented, including but not limited to, future promotional, marketing and
publicity purposes. The Winner should direct any request to access, update or
correct information to the Promoter.


The Promoter is Mobileworld Operating Pty Ltd ABN 49 090 451 433 (trading
as Crazy John’s) (“Promoter”).


The Twitter name, logo, Twitter T, Tweet, and Twitter blue bird are trade marks of
