Local business district. SECTION ONE. PURPOSE Local business districts are intended to provide a wide range of goods and services to a large consumer population coming from an extensive area. Within this district, automobile-related activities are of major significance. Good access by motor vehicle or public transit is important to local business districts, which should preferably be located adjacent to intersections of major thoroughfares and in close proximity to public transit transfer points. SECTION TWO. USES PERMITTED IN LOCAL BUSINESS DISTRICTS In a local business district, no building or land shall be used and no building shall be erected that is arranged, intended or designed for any use other than those specified in this section, as follows: 2.1. Any use permitted in a neighborhood shopping district as set forth in _________[cite applicable section(s) of zoning code or ordinance]. 2.2. Retail sales as follows: (a). Sale of any product from within a building, excluding a second-hand store, shop or yard, the principal business of which is to deal in used wearing apparel; household equipment other than antiques; automotive parts and supplies, machinery parts and supplies, or other mechanical parts and supplies. (b). Preparation and sale of food and/or drink for consumption on the premises or elsewhere with or without the provision of music or entertainment. (c). Motor vehicle sales and service, provided that motor vehicle servicing be done only within an enclosed building and that auto body repair, rebuilding or painting is to be done only as a part of a motor vehicle sales and service establishment in which not more than _________ percent (_____%) of total floor space is devoted to auto body repair, rebuilding or painting. (d). Motor vehicle service stations, not including heavy truck (exceeding two (2) tons in weight) service stations. (e). Plant nurseries and greenhouses, including the sale of flowers, plants or garden equipment from either inside or outside a building. 2.3. Offices, including ticket and/or travel agencies. 2.4. Theaters, except drive-in theaters. 2.5. Hotels and motels. 2.6. Schools, colleges and training institutions. 2.7. Membership organizations of the following types: (a). Business or professional. (b). Civic, political, social or fraternal. (c). Religious or charitable. 2.8. Repair or servicing of consumer products within an enclosed building, as follows: (a). Automobiles and other automotive vehicles, as prescribed in Subsections 2.2(c) and 2.2(d), above. (b). Other consumer products. 2.9. Ambulance service. SECTION THREE. SPECIAL EXCEPTIONS In a local business district, no land shall be used and no building or occupancy permit or any license as required by the _________[city] Municipal Code shall be issued for any of the following specified uses until the Board of Appeals, after receiving a report thereon from the City Planning Commission and after due notice to the parties in interest and public hearing, has determined that the special exception for the use is consistent with the spirit and purpose and intent of this ordinance, will not substantially and permanently injure the appropriate use of neighboring property and will serve the public convenience and welfare. 3.1. Motor vehicle dismantling yard, provided: (a). All activities are conducted within a completely enclosed building or within an area enclosed on all sides by a solid wall or fence at least _________[number] feet in height. (b). Inoperative motor vehicle bodies may not be stacked above the plane established by the top of the required surrounding wall. 3.2. Rental, sales, display and repair of operative contractor's and heavy equipment. 3.3. Contractor's equipment storage, or contractor's plant. 3.4. Feed or fuel storage or sales. 3.5. Tire recapping or retreading. SECTION FOUR. YARD REQUIREMENTS Whenever a premises in a local business district abuts on a property in a residential district, a side and/or rear yard of not less than _________[number] feet in width shall be provided.
