SUBJECT:        Comfort Inn and Suites Resolution of Intent to Annex

RECOMMENDATION

Approve the Resolution of intent to annex the Comfort Inn and Suites property at 2950 Mansell Road.


REPORT-IN-BRIEF

Mr. Nim Patel, the owner of the Country Inn and Suites, would like Alpharetta to annex his property into
this city. Mr. Patel’s hotel is located at 2950 Mansell Rd. (east side of GA 400) in the City of Roswell. He
has indicated that his motivation for this request is his desire to gain access to the services offered by the
Alpharetta Convention and Visitors’ Bureau.

In order for an annexation to be considered in Alpharetta, the property must first be de-annexed from
Roswell. To consider de-annexation, the City of Roswell and Fulton County require that a Resolution be
adopted by Alpharetta indicating that it will accept the annexation and provide interim services to the
property if Roswell chooses to de-annex.

A preliminary assessment of the property indicates that annexation would have a minimal impact on
existing Alpharetta services. Roswell reported that this property generated eight public safety calls in 2008
and paid $6,122 in taxes.

                 A RESOLUTION OF INTENT TO ANNEX CERTAIN PROPERTY
                    FOLLOWING ITS DEANNEXATION FROM THE CITY OF
                      ROSWELL AND TO PROVIDE SERVICES TO THE
                             PROPERTY IN THE INTERIM.


WHEREAS, under the provisions of O.C.G.A. §36-36-21, the City of Alpharetta may,
upon petition of 100% of the landowners residing on the area included in such petition,
take action to annex such property; and

WHEREAS, the property located in Land Lot 704 of the First District, Second Section of
Fulton County, Georgia, more particularly as shown on the map attached hereto as
Exhibit “A” and incorporated herein by reference (“Property”), total acreage
approximating 1.34 acres, is currently undergoing a process of de-annexation from the
City of Roswell; and

WHEREAS, following successful de-annexation from the City of Roswell, the owner of
the Property intends to petition for annexation of the Property into the City of Alpharetta
through the 100% annexation method as authorized in O.C.G.A. §36-36-21;


NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of
Alpharetta as follows:

SECTION 1. That the City of Alpharetta does hereby confirm its intent to annex the
Property described in the attached Exhibit A after its successful de-annexation from the
City of Roswell and the filing of a petition for annexation by the owner of the Property.

SECTION 2. That the City of Alpharetta intends to effect the annexation of the Property
after its successful de-annexation from the City of Roswell as soon as reasonable after
filing of the petition for annexation and, in any case, no later than sixty (60) days after the
petition is filed.

SECTION 3. That the City of Alpharetta will provide all the necessary city services to
the Property during the period between its de-annexation from the City of Roswell and its
successful annexation by the City of Alpharetta as if the Property was inside the
geographical boundaries of the City and to the same extent as the City will provide
services to the Property following its successful annexation into the City of Alpharetta.
The City therefore releases Roswell from providing same.
