TOPIC:            Ethics and ADR – Obligations, Challenges, and Pitfalls to Avoid
                  (1.0 hour of MCLE/CLAE credit)
SPEAKERS: Nicolas Machado and Melissa Lelaind
This program addresses the ethical duties of counsel, mediators/arbitrators, and clients. Advocacy and zealous
representation of clients can sometimes put counsel and neutrals in potentially challenging or conflicting positions
with one another, in addition to the vastly different obligations required in mediation versus arbitration. This program
combines a use of scenarios and a review of numerous guidelines, requirements, and rules governing ADR.

Nicolas Machado is a Practice Development Manager at JAMS who oversees marketing and client outreach activities
for the Sacramento, San Jose, and Walnut Creek JAMS Resolution Centers. He began his career in ADR seven years
ago as a case manager supporting Justice Nat Agliano (Ret.) and Judge Read Ambler (Ret.) in San Jose. Prior to
joining JAMS, he was a paralegal and legal assistant for 13 years working in large, mid-size, and small firms in
various cities across the county. His experience and substantive knowledge in numerous practice areas includes:
Personal Injury, Medical Malpractice and Insurance Defense, Bankruptcy, Intellectual Property, Real Property, and
Family Law. He has developed and presented numerous CLE programs throughout the Bay Area solo and in
conjunction with JAMS Neutrals, including the JAMS Institute ADR Certification Program.

Melissa Lelaind is the Business Manager for the JAMS San Jose Resolution Center. Prior to joining JAMS, she
served nearly a decade with the United States District Court in the Northern District of California, San Jose Division.
Among her various roles at the court, she worked as a Courtroom Deputy and Judicial Assistant to the Chief
Magistrate Judge Edward Infante and U.S. District Judge James Ware. Following her court service, Melissa
supported the general and patent litigation departments at DLA Piper in Palo Alto for 2 years as a legal assistant
before joining JAMS.
