					           MINUTES OF THE REGULAR MEETING OF MAYOR AND CITY COUNCIL
           OF THE CITY OF DALTON GARDENS

           Meeting was held at the City Hall July 5, 2007 at 7:00 p.m.
           Meeting was called to order by Dan Franklin, Mayor
           Steve Roberge led in the Pledge of Allegiance.

           ROLL CALL
           Present were:    Councilman Epstein, Councilman Koontz, Councilman Myers and
           Councilman Roberge.
           Also present were: Cheri Howell, Planning Consultant/Code Enforcement and Marcia
           Wingfield, Clerk

           CONSENT CALENDAR
           Mr. Roberge made a motion to approve the consent calendar consisting of the minutes of
           the regular meeting held June 7, 2007, a copy of which has been provided, and the
           Financial Statement from June 1, 2007 to June 30, 2007 and the claims so listed.
           Motion seconded by Mr. Koontz. Motion carried by roll call vote.

           NEW BUSINESS LICENSE:
           Larry Brotzman Jr. dba Team Ramco Northwest at 5968 N. Gov’t Way. Received sign
           off from Panhandle Health and Kootenai County Fire Dist. This site is in compliance
           with water restrictions.
           Mr. Epstein moved to approve the new business license for Team Ramco Northwest.
           Mr. Myers seconded the motion. The motion carried.

           Dennis Hall dba D&K Precision Machine Inc at 5968 N. Gov’t Way #304. Received
           sign off from Panhandle Health and Kootenai County Fire Dist.        This site is in
           compliance with water restrictions.
           Mr. Koontz moved to approve the new business license for D&K Precision Machine Inc.
           Mr. Epstein seconded the motion. The motion carried.

           CONTRACT WITH KOOTENAI COUNTY FIRE & RESCUE:
           Contract between Kootenai County Fire & Rescue District and the City concerning fire
           hydrants
           The Council as well as Ron Sampert, Chief of Kootenai County Fire & Rescue reviewed
           the contract and made minor changes mostly for clarification. Chief Sampert will take to
           his board after the Fire District’s attorney has review the new draft.
           Mr. Roberge moved to approve the contract once the changes discussed had been made.
           Mr. Koontz seconded the motion. The motion carried.

           Mr. Epstein moved to approve the business licenses renewals as listed on the agenda.
           Mr. Koontz seconded the motion. The motion carried.

           COUNCIL REPORTS:
           Councilman Myers reported that there would be a workday at the Arena on July 26th
           utilizing volunteers from Home Depot

Councilman Koontz had nothing new
Councilman Roberge had nothing new
Councilman Epstein reported that the majority of the striping had been completed and
that Lakes would begin the chip sealing late this month. The Sweep had swept all the
streets within the City.

CITY ENGINEER REPORT:
Phil Boyd of Welch Comer attended the meeting to discuss the Hanley Project. He asked
for clarification on what the Council was asking of Welch Comer Engineering. They
will do a value engineering review for the City. The City will get them additional
information on the project, geo-tech report, concept report and a traffic report if one was
done.

PLANNING CONSULTANT REPORT:
Ms Howell discussed the possibility of a lot line adjustment on 15th, that would take 3
parcels and make them into two. No additional building sites would be created. The
Council agreed that this would be alright but if the applicant didn’t want it done the way
Ms Howell suggested, then he would need to apply for a variance and go through the
process.

CODE ENFORCEMENT:
P&Z Commission would like to have a workshop with the Council concerning the draft
Nuisance Ordinance. Ms Howell will report back the P&Z that August 2nd at 6:00 would
work for Council.
They are also working on height restrictions, impervious area and site disturbance for the
residential district.

The next budget workshop was rescheduled for July 25th, Wednesday, at 6:00 p.m. due to
a conflict.

Mr. Roberge moved to go into Executive Session Per Idaho Code 67-2345 (one) (b)
personnel
Mr. Epstein seconded the motion. The motion carried.

Mr. Koontz moved to come out of executive session. Mr. Myers seconded the motion.
The motion carried.

Mr. Koontz moved to adjourn with a second from Mr. Roberge. The motion carried.
