Arizona Administrative Register Notices of Rulemaking Docket Opening NOTICES OF RULEMAKING DOCKET OPENING The Administrative Procedure Act (APA) requires the publication of Notices of Rulemaking Docket Opening when an agency opens a rulemaking docket to consider rulemaking. Under the APA effective January 1, 1995, agencies must submit a Notice of Rulemaking Docket Opening before beginning the formal rulemaking process. The subject matter of the proposed rule: This rulemaking will modify outdated language, change incorrect references to subsections, increase fees for certification, and increase the time-frames for certification of services not previously certified by the State Agricultural Laboratory. The current publication standards of the Office of the Secretary of State will be applied to the rules. Section numbers: 2. The subject matter of the proposed rule: A.R.S. Title 36, Chapter 7.1, Article 1 authorizes the Arizona Department of Health Services (ADHS) to license and regulate child care facilities. The rules for child care facilities are contained in 9 A.A.C. 5, Articles 1 through 6. These rules have not been substantially revised since their adoption in October 1997. ADHS is currently working on a five-year review report for these rules that will be submitted to the Governor’s Regulatory Review Council by April 2003. This rulemaking will make the changes identified as necessary in the five-year review report, will update the rules, and will bring the rules into conformance with current rulemaking format and style requirements. This proposed rulemaking addresses conditions that have changed during the past 20 years, thereby enhancing administration of the rules. In order to clarify format and language, the Department proposes repealing the existing rules, and adding a new Article 6 with new Sections. The rulemaking arises from proposed agency action in the five-year review report approved by the Governor’s Regulatory Review Council on May 2, 2000 (F-00-0402).
