Sealed tenders are invited from the intending parties for Sale of the following construction

machinery/materials on ‘AS IS WHERE IS BASIS’ lying at our Vizag Works Unit.

Tender documents can be had from our Vizag Office and Bhubaneswar Zonal Office from

10.06.2009 to 06.07.2009 on payment of Rs.200/- by cash. Tender documents can also be

downloaded from our website www. npcc.gov.in and agency has to submit D.D. for Rs.200/-

drawn in favour of NPCC Ltd. payable at Bhubaneswar along with tender documents towards

cost of tender documents. Tender documents will be received in the above two Offices up to 3

P.M on 07.07.2009 and will be opened on the same day at 4 P.M.

INSTRUCTIONS FOR PARTIES INTENDING TO SUBMIT THEIR

TENDERS FOR SALE OF CONSTRUCTION MACHINERY/VEHICLES,

SPARE PARTS ETC.



1. The following particulars should be clearly written on the top of the sealed envelope

containing tender:-



Sale Notice No.600025/374 Dt.05.06.2009 for “Sale of Machinery/ Materials.



The sealed tenders should be addressed to the Zonal Manager, NPCC Ltd.,

Bhubaneswar Zonal Office, Plot No. VII-H-167, Sailashree Vihar, Bhubaneswar-

751021



2 (i) Parties intending to send their tenders, through post, are requested to ensure

that their tenders are received by the undersigned before the due date and time.



(ii) Those who are interested to deposit their tenders in person can deposit the same

in the tender box, kept in our Vizag Office and Bhubaneswar Office on or

before 07.07.2009 at 3 P.M.



3 The parties are requested to give their offer against the schedule. Bank Draft towards

earnest money @ 10% (Ten percent) should accompany the tender, failing which their

tender will not be accepted.



4 Sealed Tenders will be opened in the Office of the Undersigned at 4 P.M. on

07.07.2009.



5 The terms and conditions of sale, as enclosed would be applicable in the event of any

offer being accepted.



6 Tender documents can be down loaded from our website www.npcc.gov.in and cost of

tender documents as mentioned in the Sales Notice shall be enclosed along with the

tender in shape of D.D. in favour of NPCC Ltd. payable at BBSR.

TERMS AND CONDITIONS OF SALE



1. Each tender is to be accompanied with Bank Draft (cheques will not be accepted) at

the rate of 10% of the tendered value drawn in favour of NPCC Ltd. payable at

Bhubaneswar towards EMD. In the event of tenders not being accepted, EMD will be

refunded to the tenderer after finalization of the tender.. No tender will be considered

without EMD.

2 Reference to any deposit with the Corporation shall not be considered as Earnest

Money Deposit for this tender.

3 The tender should be kept valid for a period of two months from the date of opening of

the tender.

4 The successful tenderers will be intimated after finalisation of tenders, calling upon

them to deposit the entire cost of machinery/materials allotted to them within the period

stipulated by us and then the tenderers should make their own arrangement at their cost

to clear and lift the machinery/materials in lot or lots from our site/yard, during normal

working hours. Failure on their part to deposit the entire cost of machinery/ materials

within the stipulated period, will entail forfeiture of their EMD without any further

reference/notice to them and the machinery/materials would be resold by us at our

discretion.

5 The successful tenderers will have to pay within 30 days of acceptance of their offer,

the full sale value of machinery/materials purchased by them in Bank Draft, and the

machinery/materials will be removed from site/yard within 30 days of acceptance of

offer.

6 In case of delay in depositing the full amount of the accepted offer within the stipulated

period, interest may be charged for the balance amount for the period of delay at the

discretion of the Corporation.

7 Delivery of the machinery/materials shall be from our site/yard of respective Units on

“AS IS WHERE IS’ basis. In case the machinery/materials are not removed by the

successful tenderers within the date stipulated by us, ground rent @ 1% per day of

delay on the value of the balance items left uncleared, may be levied at the discretion of

the Corporation for a further period of 60 days from the expiry of the stipulated date

and thereafter unless it is decided otherwise, the Corporation reserves the right to

dispose of the items at the risk and responsibility of the tenderer without any further

reference/notice to him and any loss incurred by us thereon together with ground rent

will be recovered from the amount lying with us to his credit.

8 The Corporation does not bind itself to accept the highest offer and reserves the right to

accept or reject any or all tenders either in whole or in part and the Corporation will

have the right to split up and divide the sale order amongst the tenderers at its

discretion.



9 The machinery/materials are open for inspection on any working day, after contacting

the unit Officer concerned. The tenderers should thoroughly satisfy themselves with

regard to quality and condition of the machinery/materials offered before sending their

tenders and no complaint of any sort whatsoever will be entertained afterwards in this

respect while taking delivery of the machinery/materials or thereafter.



10 Purchasers/tenderers representatives, workers, lorry drivers etc. will have to

observe our store yard working hours and regulations, regarding discipline and

security while they are inside the yard.



11 Sales Tax/VAT or any other Tax/Levy etc. applicable on this sale shall be borne by

the purchaser/tenderer.(VAT deposit receipt against the sale value is to be deposited to

the Project Manager/Engineer In Charge before lifting of the materials)



Income Tax @ 1.03 % of the sale value shall be deducted from the deposited EMD or

else bidder has to submit the Income Tax deposit receipt (from Income Tax Authority)

against the sale value, along with the No- claim certificate from the concerned Project

Manager/ E-I-C after lifting of the materials/machinery( Scrap).



13 Zerox copy of the PAN card TAN No. of the bidder shall be submitted along with

the tender.



14 Bank Account No., Name of Bank & Branch Name are mandatory to be

submitted by the bidder along with the tender for refund of the EMD.





15 JURISDICTION:



The enforcement of the terms of contract, as well as the transactions entered into by the

purchaser with us, shall be within the jurisdiction, where our Zonal Office is situated

i.e. Bhubaneswar. Any cause of action arising in the due performance or breach of this

contract, by either of the parties hereto, shall be deemed to have arisen, within the

jurisdiction of Bhubaneswar not withstanding the residence or place of business of the

purchaser.
