III.1) CONDITIONS RELATING TO THE CONTRACT III.1.1) Deposits and guarantees required (if applicable) Each Economic Operator is required to supply, prior to the final date for submission of tenders, a deposit of 30 000,00 PLN (in words: thirty thousand zlotys) for the entire validity period of the bid. III.1.2) Main financing conditions and payment arrangements and/or reference to the relevant provisions regulating them ________________________________________________________________________________ ________________________________________________________________________________ III.1.3) Legal form to be taken by the grouping of economic operators to whom the contract is to be awarded (if applicable) 1. Economic Operators jointly participating in the contract award procedure should meet the participation conditions and submit documents confirming the fulfillment of these conditions, according to the provisions of Point 9 of the Instruction for Economic Operators. 2. When two or more Economic Operators jointly participating in the contract award procedure, their joint technical and staff potential will be evaluated, as well as joint qualification and experience, as well as economic and financial standing. 3. Contactors jointly participating in the contract award procedure establish a plenipotentiary for representing them in the present contract award procedure and for signing the contract that is the object of this procedure. It is recommended that the legal representative is one of the Economic Operators jointly participating in the procedure. The fact of establishing a plenipotentiary must be indicated in the supplied documents. 4. All correspondence will be conducted solely with the plenipotentiary of the Economic Operators jointly participating in the contract award procedure. 5. Economic Operators jointly participating in the contract award procedure, when their tender is selected as the most advantageous and prior to signing the contract in question, must present the Awarding Entity with an agreement that regulates their cooperation. Economic Operators competing for a contract must fulfill the conditions for participation in open tendering, as listed below, and submit the required documents confirming the fulfillment of these conditions: 1) Economic Operators must possess proper authorizations to execute a particular work or action to the extent compliant with the object of the contract. In order to confirm the fulfillment of this requirement, Economic Operators are expected to submit the following documents: a) Valid copy of their entry to an appropriate court commercial register or a valid confirmation of their entry to the municipal commercial register, should other regulations require an entry to the court register or to the municipal register, issued not earlier than 6 months before the final date for submission of tenders (when two or more Economic Operators apply jointly for the present contract, each one must submit the documents in question); 2) Economic Operators must not be liable to exclusion from open tendering on the basis of Article 24 of Public Procurement Law. In order to confirm the fulfillment of this requirement, Economic Operators are expected to submit the following documents (when two or more Economic Operators apply jointly for the present contract, each one must submit the documents in question): a) Valid confirmation issued by the Head of the Tax Office and the Social Insurance Office or the Agricultural Social Insurance Fund, proper for the location of the Economic Operator’s seat, stating that there are

no overdue taxes, social and health insurance contributions in the Economic Operator’s account. Also, confirmation of a legal exemption from these duties, of a deference of outstanding payments, of their division into installments or of the decision to suspend the execution of a ruling of the proper authority, issued not earlier than 3 months before the final date for submission of tenders, must be submitted. b) Valid information from the National Criminal Record, as specified in Article 24, Paragraph 1, Items 4-8 of Public Procurement Law, issued not earlier than 6 months before the final date for submission of tenders. Information from this record must be submitted by an entrepreneur in case of natural persons, a partner in case of registered partnerships, a partner or a member of the management board in case of professional partnerships, a general partner in case of limited partnerships and limited joint-stock partnerships, and an active member of the managing body in case of legal persons. c) Valid information from the National Criminal Record, as specified in Article 24, Paragraph 1, Item 9 of Public Procurement Law, issued not earlier than 6 months before the final date for submission of tenders (concerns information on the court decision prohibiting collective entities from competing for contracts, issued on the basis of regulations on the responsibility of collective entities for deeds forbidden under the liability for penalty); 3) Economic Operators must submit a statement of fulfillment of conditions for participation in the contract award procedure, (when two or more Economic Operators apply jointly for the present contract, the statement may be submitted jointly, yet it should be signed by each of these Economic Operators or by their plenipotentiaries authorized to represent them during the contract award procedure and to sign the contract that is the object of this procedure). II. When the Economic Operator’s seat or place of residence is located outside the territory of the Republic of Poland, instead of documents mentioned above in Points: 1. 1.a), 2.a), 2.c) - submits a document or documents issued in the country where their seat or place of residence is located, confirming that: (i) The company liquidation procedure has not been opened and its insolvency has not been declared; (ii) There are no overdue taxes or social and health insurance contributions in the Economic Operator’s account, or that the Economic Operator is granted legal exemption from these duties, a deference of outstanding payments, their division into installments, or the decision to suspend the execution of a ruling of the proper authority; (iii) the Economic Operator has not been legally prohibited from competing in the contract award procedure. 2. 2.b) submits a confirmation from a proper legal or administrative authority according to the country of origin or residence of the person whom these documents concern. 3. Documents mentioned in Points II.1. (i) and (iii) and II.2. should be issued not earlier than 6 months before the final date for submission of tenders. The document specified in Point II.1. A contract equivalent in its category to supplies constituting the object of the present contract is understood by the Awarding Entity as the finished and have been executed properly supply of order for delivery of steam or condensate piping materials for heating plant, power plant or chemical plant with value no less then 800 000 EURO net.
