Agreement to Pay Commission

Comment [Note1]: Agreement by which a Seller of a Property agrees to pay Commission to a Person who procured a Buyer for the Property.
Reference is made to the Purchase and Sale Agreement dated ______/______/2009 between Encore Investments &_________________________________________________________ (the "Buyer") as buyer and the undersigned as seller, as amended, in respect of the property municipally known as _________________________________________________________ (the "Property"), pursuant to which the Buyer has agreed to buy from the undersigned the Property.
In consideration of your services rendered in connection with procuring the Buyer and selling the Property, the undersigned hereby agrees to pay to you a commission in the amount of $5,000.00 USD ou t of escrow and releasing _______________________________________, from any liablity to the porperty or what retail location sits on it. Furthuer more the process should take no longer then 15-20 business days from the signing of the deposit note, if there is any delays all buyers will be notified in writing and an extra $2,500.00 USD will be added to the paid commision to _________________________________________________________, upon the satisfactory completion of the sale of the Property to the Buyer. This Agreement shall enure to the benefit of your heirs, executors, administrators and other legal representatives and shall be binding upon the undersigned and his or her heirs, executors, legal representatives, successors and assigns.
