Terms of Agreement Web Site Design
Mystic Skillz Services includes the following elements in Standard Website Packages: Custom Graphics Package. Masthead graphic on first page (simple custom graphic incorporating company logo). Top-of-page graphic for all other pages of your website. Colorful lines and bullets, and colored and textured background. Links to external pages, up to an average of 2.5 per page. Photos and Graphic Images supplied by client (up to an average of 1.3 included per page in standard website and "regular" online store pages) in addition to masthead and top-of-page graphic. Basic Simplistic 2D/3D Animation is included in the graphic layout if requested.

Installation will direct you to great web hosting plans. Minor updates and changes to existing WebPages for six months, subject to the limits outlined below. Additional changes billed only "regular" pages, not product pages or the ordering system pages. E-mail response link on each WebPage to any e-mail address the client designates. Feedback are included if request. Note: Depending on your hosting plan, some may not support PHP. Standard Website Packages.
The client agrees to select a web hosting service which allows Mystic Skillz Services full access to the website and a cgi-bin directory via FTP. The client further understands that if the web hosting service's operating system is not a Unix system, standard CGI software may not work. Mystic Skillz Services does not Refund that the functions contained in these WebPages or the Internet website will meet the client's requirements or that the operation of the WebPages will be uninterrupted or error-free. (Example: AOL, Netscape, etc. Explorer. May not run some scripts properly.) In no event will Mystic Skillz Services be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these WebPages or WebSite, even if Mystic Skillz Services has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Changes to Submitted Text. Please send me your final text. Time required to make changes to client-submitted text after the WebPages have been constructed will result in additional cost.
The content of the WebPages will be supplied by the client and executed as specified by the client in the "Website Planning Worksheet" Website includes up to 4-7 WebPages. In case the client desires additional WebPages beyond the original number of pages specified above, the client agrees to pay Mystic Skillz Services an additional $50.00 for each additional webpage. Graphics or photos beyond the allowed average of 3 per webpage shall be billed at an additional $25.00 each. Time Line: Completion Date. Please have All Your Files in a Fashionable Order. Images, Music, Videos, Text, keep in a Separate Folder. Depending of the quantity of the site please Allow 2-3 weeks working time for final production. Mystic Skillz Services and the client must work expeditiously to complete the website. Payments Plans Available. Payment can be made in full or No less than half is required before proceeding. The Remaining balance can be put on a payment plan. However, FAILURE to make payments, of the amount and terms agreed too, within two weeks. The Website will be SUSPENDED UNTIL THE BALANCE IS PAID IN FULL. A Monthly/Yearly updates are included. * Additional Fee Applies*
Copyrights and Trademarks The client represents to Mystic Skillz Services and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Mystic Skillz Services for inclusion in WebPages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Mystic Skillz Services from any claim or suit arising from the use of such elements furnished by the client. The client is assigned rights to use as a website the design, graphics, and text contained in the finished assembled website. Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners. Mystic Skillz Service retains the right to display graphics and other Web design elements as examples of their work in a respective portfolio. Sole Agreement. The agreement contained in this "Website Design Contract" constitutes the sole agreement between Mystic Skillz Services and the client regarding this website. Any additional work not specified in this contract must be authorized by a written change order. All prices specified in this contract will be honored for two (2) months after both parties sign this contract. Continued services after that time will require a new agreement.
Initial Payment Policy. If the client halts work and the work has been completed beyond the amount covered by the initial payment, the client shall be liable to pay for all work completed at the rate stated above. No portion of this initial payment will be refunded. The undersigned agrees to the terms of this agreement on behalf of his or her organization or business.
