OPEN FORUM:

Pauline Coe Park

Mr Colemane and Mr Horvarth addressed Council expressing their concerns with some
activities taking place in the Park and asking council to carefully consider the proposed
redevelopment of the area.

Cowra Golf Club

Mr Watmore addressed Council on behalf of the Club expressing that while the Club is
grateful for any assistance Council can offer, would Council consider increasing the amount
of the proposed donation to assist the Club’s endeavours in obtaining a 15 megalitre
allocation.

General Manager’s Resignation

Ms Michelle O’Donnell, Mr Alan Thompson and Mr Peter Riley addressed Council on the
subject of the General Manager’s resignation from Cowra Council expressing gratitude on
behalf of staff and ratepayers for the hard work and achievements accomplished by Council
during Mr Roncon’s term.

        1.     Council receive the resignation of General Manager, James
               Roncon, with regret and wish him all the very best with his future
               endeavours.

        2.     Council appoint Mr Paul Devery to the position of Acting General
               Manager to be effective 14 March 2009.

        3.     Council engage the recruitment services of LGSA Employment
               Solutions to conduct the recruitment process of Cowra Council’s
               new General Manager.

Naming of the existing laneway that is east of and parallel to Stuart Street and between
Noyeau Street and Belmore Street in the Village of Woodstock

31/09   Moved Cr JN Mallon, Seconded Cr RG Watt, That:

        1.     Council supports the naming of the existing laneway that is located
               east of and parallel to Stuart Street and between Noyeau Street
               and Belmore Street in the Village of Woodstock as ‘Kirkman
               Lane’.

        2.     Council publishes notice of the name ‘Kirkman Lane’ in the NSW
               Government Gazette.

Development Application No. 130/2008, for the construction of a dwelling-house and garage
on Lot 41 DP 826344, 50 Milburn Creek Road Woodstock lodged by R G Searle.

32/09   Moved Cr RG Watt, Seconded Cr JN Mallon, That Development Application
        No. 130/2008, for the construction of a dwelling-house and garage on Lot
        41 DP 826344 be approved subject to the following conditions:

        Approved Plans and Documentation

        1.    The development shall be carried out in accordance with:

               (a)    the approved plan(s) stamped by Cowra Shire Council and
                      attached to this consent; and

               (b)    the Statement of Environmental Effects lodged in respect of
                      Development Application No. 130/2008

               except where amended by any of the following conditions. A
               current and approved copy of the building approval/consent and
               stamped plans is to be maintained on site for constructional and
               reference purposes.

        Principal Certifier Requirements

        2.     The applicant is to submit to Cowra Shire Council, at least two
               days prior to the commencement of any works, a ‘Notice of
               Commencement of Building or Subdivision Works’ and
               ‘Appointment of Principal Certifying Authority’.

       3.     A sign must be erected in a prominent position on any site on
              which building work, subdivision work or demolition work is being
              carried out:

              (a)    Showing the name, address and telephone number of the
                     principal certifying authority for the work;

              (b)    Showing the name of the principal contractor (if any) for
                     any building work and a telephone number on which that
                     person may be contacted outside working hours; and

              (c)    Stating that unauthorised entry to the work site is
                     prohibited.

              Any such sign is to be maintained while the building work,
              subdivision work or demolition work is being carried out, but must
              be removed when the work has been completed.

       4.     Prior to any construction work being carried out on the site, the
              Applicant shall:

              (a)    Inform the Principal Certifying Authority in writing of
                     whether the work is to be carried out by a licensed builder
                     or owner builder as defined under the Home Building Act
                     1989; and

              (b)    Submit a Home Building Insurance Certificate issued under
                     Part 6 of the Home Building Act 1989.

              Note 1:      Details of the licensee's number and contractor license
                           number and/or owner-builder's name and permit
                           number is required to be submitted to satisfy Clause (a)
                           of this condition.

              Note 2:      The submission of a copy of an insurance policy that
                           covers the construction work is sufficient evidence to
                           satisfy Clause (b) of this condition.

              Note 3:      The Principal Certifying Authority must be informed of
                           any change of builder undertaking the construction
                           work.

       Inspections

       5.     The Applicant is to obtain a certificate from Council or an
              Accredited Certifying Authority, certifying compliance with the
              Building Code of Australia and any other relevant condition of
              consent for the stages of construction listed in Clause 162A of the
              Environmental Planning and Assessment Regulation 2000. For the
              purpose of obtaining a certificate the works must be inspected by
              the Accredited Certifying Authority at the time specified below:

              At the commencement of the building work;

              (b)    After excavation for, and prior to the placement of, any
                     footings;

              (c)    Prior to pouring any in-situ reinforced concrete building
                     element;

              (d)    Prior to covering of the framework for any floor, wall, roof
                     or other building element;

              (e)    Prior to covering waterproofing in any wet areas;

              (f)    Prior to covering any stormwater drainage connections; and

              (g)    After the building work has been completed and prior to
                     any Occupation Certificate being issued in relation to the
                     building.

              Note 1:      If Council is required to carry out compliance
                           inspections at least 24 hours notice shall be given to
                           Council to allow for the inspection.

              Note 2:      An Occupation Certificate in relation to the building
                           cannot be issued by Council or an Accredited
                           Certifying Authority until the certificates required by
                           this condition have been issued or registered with
                           Council.

       6.     The applicant is required to obtain a certificate from Cowra Shire
              Council, certifying that all works relating to the construction of
              access driveways have been constructed and completed in
              accordance with Cowra Operations Engineering Standards. For

              the purposes of obtaining the certificate, the works must be
              inspected by Council at the times specified below:

              (a)    Pre-construction: Prior to construction of works on the
                     roadway and after all sediment control and traffic controls
                     are in place.

              (b)    Vehicular Access: When the vehicular access driveways to
                     the site from the proposed new access road have been
                     constructed and prior to sealing.

              (c)    Completion: When all vehicular accesses, internal
                     driveways, and stormwater works have been completed.

       Construction Works

       7.     All building work must be carried out in accordance with the
              provisions of the Environmental Planning and Assessment Act
              1979 and the Building Code of Australia.

       8.     The applicant is to obtain a construction certificate pursuant to
              Section 109C of the Environmental Planning and Assessment Act
              1979 from either Council or an accredited certifying authority,
              certifying that the proposed works are in accordance with the
              Building Code of Australia and applicable Council engineering
              standards prior to any building and or subdivision works
              commencing.

              Note 1:      No building, engineering or excavation work is to be
                           carried out in relation to this development until the
                           necessary construction certificates have been
                           obtained.

              Note 2:      It is the responsibility of the applicant to ensure that
                           the development complies with the Building Code of
                           Australia and applicable engineering standards in the
                           case of building work and the applicable Council
                           Engineering Standards in the case of subdivision
                           works. This may entail alterations to the proposal so
                           that it complies with these standards.

       9.     The builder must maintain on the work site a legible copy of the
              plan and specification approved with the Development Consent.

       10.    All construction operations involving the use of electric or
              pneumatic tools or other noisy operations shall be carried out only
              between 7.00am and 6.00pm on weekdays and 8.00am and 1.00pm
              on Saturdays.    No work on Sundays or Public Holidays is
              permitted.

       11.    All building rubbish and debris, including that which can be wind
              blown, shall be contained on site in a suitable container for
              disposal at an approved Waste Landfill Depot. The container shall
              be erected on the building site prior to work commencing and
              shall be maintained for the term of the construction to the
              completion of the project.

              Note 1:      No building rubbish or debris shall be placed or
                           permitted to be placed on any adjoining public
                           reserve, footway or road.

              Note 2:      The waste container shall be regularly cleaned to
                           ensure proper containment of the building wastes
                           generated on the construction site.

       12.    Any damage caused to footpaths, roadways, utility installations
              and the like by reason of construction operations shall be made
              good and repaired to a standard equivalent to that existing prior
              to commencement of construction.

              Note: The full cost of restoration/repairs of property or services
                    damaged during the works shall be met by the applicant.

       13.    All loading, unloading and storage of goods shall be carried out
              within the confines of the property. No loading or unloading of
              goods on the public roadway system shall be permitted.

       Access, Traffic and Transport

       14.    Prior to the issue of a Certificate of Completion, the applicant
              shall upgrade and seal/concrete/pave the existing entrance to Lot
              41 DP 826344 from Milburn Creek Road in accordance with Cowra
              Shire Council’s Development Control Plan – Subdivision Code

              1992 and Cowra Operations Rural Entrance Standard Drawings –
              CS00001A.DWG and CS00001B.DWG.

              Note: All costs associated with the upgrading of the access shall be
                    borne by the applicant and at no cost to Council.

       Stormwater

       15.    All roofed and paved areas are to be properly drained to comply
              with the following criteria:

              (a)    Discharge three metres clear of any building/structure in a
                     manner that does not cause soil erosion or nuisance to
                     adjoining properties; and/or

              (b)    Discharge to Council’s Stormwater Management System
                     where relevant.

       Plumbing and Drainage

       16.    The Applicant is to obtain all relevant approvals to carry out
              sewerage work and to carry out stormwater drainage work and to
              carry out water supply work from Cowra Shire Council prior to
              commencing works to and comply with any conditions of that
              permit.

              Note 1:      All work shall be carried out by a licensed plumber
                           and drainer and to the requirements of Australian
                           Standard 3500, 'National Plumbing and Drainage' and
                           the 'New South Wales Code of Practice; Plumbing
                           and Drainage'.

              Note 2:      The applicant is to obtain a Certificate from Council
                           certifying compliance with the conditions of any
                           relevant approval to carry out plumbing and drainage
                           work. For the purpose of obtaining a certificate the
                           works must be inspected by the Council at the time
                           specified below:

              (a)    Internal Drainage: When all internal drainage work is
                     installed and prior to concealment. Pipes should be under
                     water test.

              (b)    External Drainage: When all external drainage work is
                     installed and prior to concealment. Pipes should be under
                     water test.

              (c)    Water Supply: Hot and cold water supply pipework when
                     the pipework is installed and prior to concealment. Pipes
                     should be under pressure test.

              (d)    Stormwater: When the stormwater and roof water
                     drainage system has been completed.

       On-Site Sewage Management

       17.    The Applicant is to obtain all relevant approvals to Install and
              Operate an On-Site Sewage Management System from Cowra
              Shire Council prior to commencing works to install the system of
              waste management and comply with any conditions of that
              permit.

              Note 1:      All work shall be carried out by a licensed plumber
                           and drainer and to the requirements of NSW
                           Environment and Health Protection Guidelines and
                           Australian    Standard/New     Zealand     Standard
                           1547:2000     On-Site     Domestic      Wastewater
                           Management, Australian Standard 3500, 'National
                           Plumbing and Drainage' and the 'New South Wales
                           Code of Practice; Plumbing and Drainage'.

              Note 2:      The applicant is to obtain a Certificate from Council
                           certifying compliance with the conditions of any
                           relevant approval to carry out plumbing and drainage
                           work. For the purpose of obtaining a certificate the
                           works must be inspected by the Council at the time
                           specified below:

              (a)    Internal Drainage: When all internal drainage work is
                     installed and prior to concealment. Pipes should be under
                     water test.

              (b)    External Drainage: When all external drainage work is
                     installed and prior to concealment. Pipes should be under
                     water test.

              (c)      Absorption Trench: When void arching and stone void fill is
                       in place prior to covering.

       Water Supply Infrastructure

       18.    The applicant is required to provide a minimum of 25,000 litres of
              tanked water supply for domestic consumption throughout the
              dwelling-house or a larger volume of water supply in accordance
              with BASIX certificate commitments. In addition to the water
              supply required for domestic consumption and BASIX, an
              additional 10,000 litres of tanked water supply shall be reserved for
              fire fighting purposes in accordance with NSW Rural Fire Service
              requirements. Water tanks shall be generally located in close
              proximity to the dwelling-house and allow access for fire fighting
              vehicles.

              Note: Information relating to the location and design of water
                    tanks and emergency fire fighting requirements for water
                    tanks and connections can be downloaded from the NSW
                    Rural Fire Service website, www.rfs.nsw.gov.au.

       Erosion and Sediment Control

       19.    Prior to the commencement of work on the site, all erosion and
              sediment control measures identified in an Erosion and Sediment
              Control Plan (ESCP) shall be implemented and maintained prior
              to, during and after the construction phase of the development.
              The erosion and sediment control measures are to comply with
              Cowra Shire Council’s Soil Erosion and Sediment Control Plan
              2006 at all times.

       Occupation Certificate

       20.    Prior to the occupation or use of the dwelling-house and garage,
              an Interim or Final Occupation Certificate must be obtained from
              the Principal Certifying Authority for the subject development.

Victorian Bushfires

39/09    Moved Cr BE Miller, Seconded Cr WJ West, That:

         1.        Council provide the sum of $5,000.00 from section 356 donations
                   to the Municipal Association of Victoria (MAV) in support of the
                   local government of Victoria’s rebuilding program as a result of
                   the Victorian Bushfire Appeal.

         2.        The Mayor convene a meeting of all relevant community groups
                   and agencies with the emphasis to be on coordinating a structured
                   Cowra approach to assist the Victorian bushfire victims.

Woodstock Volunteer Bushfire Brigade

40/09   Moved Cr JN Mallon, Seconded Cr JA Smith, That Council donate from the
        Section 356 budget the sum of $1,435 to the Woodstock Volunteer
        Bushfire Brigade to assist in the construction of fencing around the
        Brigade’s water tanks.

Audio Interpretation at POW Camp Guard Tower

41/09   Moved Cr RJ Walsh, Seconded Cr IM Brown, That:

        1.     Council provide $10,000 from the POW Campsite Reserve and
               $4,000 to be loaned interest free and repaid over 2 years to the
               Cowra Breakout Association S.355 Committee for the installation
               of audio interpretation facilities on the Guard Tower at the Cowra
               Prisoner of War Campsite.

        2.     The Cowra Breakout Association S355 Committee be permitted
               to sell the remaining souvenir items from the 60th Anniversary of
               the Cowra Breakout with any funds so raised to be allocated to the
               POW Campsite reserve.

Railway Lane Pedestrian Zone

42/09   Moved Cr BE Miller, Seconded Cr RG Watt, That:

        1.     The report presented by the Director - Cowra Operations relating
               to the proposed upgrade of Railway Lane be received and noted.

        2.     Council adopts in principal the design known as “Option 1A” as
               detailed on the plans presented and that “Option 1A” is placed on
               public exhibition for a period of twenty-one (21) working days.

MATTER ARISING

Railway Lane Pedestrian Zone

43/09   Moved Cr PB Wright, Seconded Cr IM Brown, That Council assess how many
        carparks are proposed to be lost as part of any planned development of
        Railway Lane with such assessment to include how they may be recouped
        elsewhere in Cowra.

New/Replacement Street Tree Plantings

44/09   Moved Cr RJ Walsh, Seconded Cr RG Watt, That:

        1.     The Director - Cowra Operations’ report relating to the planting
               of trees to improve the appeal and visual amenity of Cowra’s
               streetscapes, be received and noted.

        2.     Senior Council staff be asked to consult with NRM Group.

       Principal Certifier Requirements

       3.     The applicant is to submit to Cowra Shire Council, at least two
              days prior to the commencement of any works, a ‘Notice of
              Commencement of Building or Subdivision Works’ and
              ‘Appointment of Principal Certifying Authority’.

       4.     A sign must be erected in a prominent position on any site on
              which building work, subdivision work or demolition work is being
              carried out:

              (a)    Showing the name, address and telephone number of the
                     principal certifying authority for the work;

              (b)    Showing the name of the principal contractor (if any) for
                     any building work and a telephone number on which that
                     person may be contacted outside working hours; and

              (c)    Stating that unauthorised entry to the work site is
                     prohibited.

              Any such sign is to be maintained while the building work,
              subdivision work or demolition work is being carried out, but must
              be removed when the work has been completed.

       5.     Prior to any construction work being carried out on the site, the
              Applicant shall:

              (a)    Inform the Principal Certifying Authority in writing of
                     whether the work is to be carried out by a licensed builder
                     or owner-builder as defined under the Home Building Act
                     1989; and

              (b)    Submit a Home Building Insurance Certificate issued under
                     Part 6 of the Home Building Act 1989.

              Note 1:       Details of the licensee's number and contractor license
                            number and/or owner-builder's name and permit
                            number is required to be submitted to satisfy Clause (a)
                            of this condition.

              Note 2:       The submission of a copy of an insurance policy that
                            covers the construction work is sufficient evidence to
                            satisfy Clause (b) of this condition.

              Note 3:       The Principal Certifying Authority must be informed of
                            any change of builder undertaking the construction
                            work.

       Construction Certificate

       6.     The Applicant is to obtain a Construction Certificate from either
              Council or an Accredited Certifying Authority, certifying that the
              proposed works are in accordance with the Building Code of
              Australia and applicable Council Engineering Standards prior to
              any building and or subdivision works commencing.

              Note 1:       No building, engineering or excavation work is to be
                            carried out in relation to this development until the
                            necessary construction certificates have been
                            obtained.

              Note 2:       It is the responsibility of the Applicant to ensure that
                            the development complies with the Building Code of
                            Australia and applicable engineering standards in the
                            case of building work and the applicable Council
                            Engineering Standards in the case of subdivision
                            works. This may entail alterations to the proposal so
                            that it complies with these standards.

       Inspections

       7.     The Applicant is to obtain a certificate from Council or an
              Accredited Certifying Authority, certifying compliance with the
              Building Code of Australia and any other relevant condition of
              consent for the stages of construction listed in Clause 162A of the
              Environmental Planning and Assessment Regulation 2000. For the
              purpose of obtaining a certificate the works must be inspected by
              the Accredited Certifying Authority at the time specified below:

              (a)    At the commencement of the building work;

              (c)    Prior to pouring any in-situ reinforced concrete building
                     element;

              (d)    Prior to covering of the framework for any floor, wall, roof
                     or other building element;

              (e)    Prior to covering waterproofing in any wet areas;

              (f)    Prior to covering any stormwater drainage connections; and

              (g)    After the building work has been completed and prior to
                     any Occupation Certificate being issued in relation to the
                     building.

              Note 1:       If Council is required to carry out compliance
                            inspections at least 24 hours notice shall be given to
                            Council to allow for the inspection.

              Note 2:       An Occupation Certificate in relation to the building
                            cannot be issued by Council or an Accredited
                            Certifying Authority until the certificates required by
                            this condition have been issued or registered with
                            Council.

       8.     The applicant is required to obtain a certificate from Council or an
              Accredited Certifying Authority, certifying that all works
              (including construction of access driveways) have been
              constructed and completed in accordance with Cowra Operations
              Engineering Standards.      For the purposes of obtaining the
              certificate, the works must be inspected by Council or an
              Accredited Certifying Authority at the times specified below:

              (a)    Pre-construction: Prior to construction of works on the
                     roadway and after all sediment control and traffic controls
                     are in place.

              (b)    Vehicular Access: When the vehicular access driveways to
                     the site from the proposed new access road have been
                     constructed and prior to sealing.

              (c)    Completion: When all vehicular accesses, internal
                     driveways, and stormwater works have been completed.

       Construction Works

       9.     All building work must be carried out in accordance with the
              provisions of the Environmental Planning and Assessment Act
              1979 and the Building Code of Australia.

       10.    The builder must maintain on the work site a legible copy of the
              plan and specification approved with the Development Consent.

       11.    All construction operations involving the use of electric or
              pneumatic tools or other noisy operations shall be carried out only
              between 7.00am and 6.00pm on weekdays and 8.00am and 1.00pm
              on Saturdays.    No work on Sundays or Public Holidays is
              permitted.

       12.    All building rubbish and debris, including that which can be wind
              blown, shall be contained on site in a suitable container for
              disposal at an approved Waste Landfill Depot. The container shall
              be erected on the building site prior to work commencing and
              shall be maintained for the term of the construction to the
              completion of the project.

              Note 1:       No building rubbish or debris shall be placed or
                            permitted to be placed on any adjoining public
                            reserve, footway or road.

              Note 2:       The waste container shall be regularly cleaned to
                            ensure proper containment of the building wastes
                            generated on the construction site.

       13.    Any damage caused to footpaths, roadways, utility installations
              and the like by reason of construction operations shall be made
              good and repaired to a standard equivalent to that existing prior
              to commencement of construction.

              Note: The full cost of restoration/repairs of property or services
                    damaged during the works shall be met by the applicant.

       14.    All loading, unloading and storage of goods shall be carried out
              within the confines of the property. No loading or unloading of
              goods on the public roadway system shall be permitted.

       Plumbing and Drainage

       15.    The Applicant is to obtain all relevant approvals to carry out
              sewerage work, to carry out stormwater drainage work and to
              carry out water supply work from Cowra Shire Council prior to
              commencing works to and comply with any conditions of that
              permit.

              Note 1:       All work shall be carried out by a licensed plumber
                            and drainer and to the requirements of Australian
                            Standard 3500, 'National Plumbing and Drainage' and
                            the 'New South Wales Code of Practice; Plumbing
                            and Drainage'.

              Note 2:       The applicant is to obtain a Certificate from Council
                            certifying compliance with the conditions of any
                            relevant approval to carry out plumbing and drainage
                            work. For the purpose of obtaining a certificate the
                            works must be inspected by the Council at the time
                            specified below:

              (a)    Water Supply: Hot and cold water supply pipework when
                     the pipework is installed and prior to concealment. Pipes
                     should be under pressure test.

              (b)    Stormwater: When the stormwater and roof water
                     drainage system has been completed.

       16.    All roofed and paved areas are to be properly drained to comply
              with the following criteria:

              (a)    Discharge three metres clear of any building/structure in a
                     manner that does not cause soil erosion or nuisance to
                     adjoining properties; and/or

              (b)    Discharge to Council’s Stormwater Management System
                     where relevant.

       17.    The Applicant is to obtain all relevant approvals to Install and
              Operate an On-Site Sewage Management System from Cowra
              Shire Council prior to commencing works to install the system of
              waste management and comply with any conditions of that
              permit.

              Note 1:       All work shall be carried out by a licensed plumber
                            and drainer and to the requirements of NSW
                            Environment and Health Protection Guidelines and
                            Australian Standard/ New Zealand Standard
                            1547:2000     On-Site     Domestic      Wastewater
                            Management, Australian Standard 3500, 'National
                            Plumbing and Drainage' and the 'New South Wales
                            Code of Practice; Plumbing and Drainage'.

              Note 2:       The applicant is to obtain a Certificate from Council
                            certifying compliance with the conditions of any
                            relevant approval to carry out plumbing and drainage
                            work. For the purpose of obtaining a certificate the
                            works must be inspected by the Council at the time
                            specified below:

              (a)    Internal Drainage: When all internal drainage work is
                     installed and prior to concealment. Pipes should be under
                     water test.

              (b)    External Drainage: When all external drainage work is
                     installed and prior to concealment. Pipes should be under
                     water test.

              (c)    Absorption Trench: When void arching and stone void fill is
                     in place prior to covering.

       Section 94A Contributions

       18.    Pursuant to Sections 80A(1) and 94A of the Environmental
              Planning and Assessment Act 1979 and Cowra Shire Council
              Section 94A Contributions Plan, the following monetary
              contribution towards public services and amenities is required:
              $1,660.

              The above monetary contribution will be adjusted at the time of
              payment in accordance with the formula: Contribution (at time of
              payment) = C x CPI2
                             CPI1
              Where:

              C      =     the original contribution amount as shown in the
                           development consent;

              CPI2 =       the Consumer Price Index: All Groups Index for
                           Sydney (as currently available for the Australian
                           Bureau of Statistics at the time of payment)

              CPI1 =       the Consumer Price Index: All Groups Index for
                           Sydney which applied at the time of calculation as
                           shown on the development consent.

              Note 1:       The minimum payment will not be less than the
                            contribution amount stated on the consent.

              Note 2:       In accordance with Section 94EC of the Act and
                            Clause 146 of the Regulation, a certifying authority
                            must not issue a construction certificate for building
                            work or subdivision work under a development
                            consent unless it has verified that each condition
                            requiring the payment of monetary contributions has
                            been satisfied.

       Demolition

       19.    Demolition of all building structures shall take place in accordance
              with AS 2601-2001 “Demolition of Structures” and shall be carried
              out in such a manner that dust and noise are minimised as far as
              possible.

       20.    All handling, removal, transport and disposal of asbestos or other
              contaminated materials shall be controlled and in accordance with
              the Protection of the Environment Operations Act 1997 and the
              Occupation Health and Safety Act 2000.

       21.    All waste material in any form must be disposed of only at a
              landfill site that is licensed to receive the waste.

       22.    Prior to any construction work being carried out on the site, the
              applicant shall inform the Principal Certifying Authority in writing,
              details of the approved demolition contractor.

       23.    Upon the completion of the demolition of the existing dwelling-
              house a clearance certificate from a suitably qualified occupational
              hygienist shall be submitted to Council. This certificate shall be
              provided, prior to the commencement of construction works on
              the new dwelling-house.

       Access, Traffic and Transport

       24.    Prior to the issue of a Final Occupation Certificate, the applicant
              shall upgrade and seal the vehicular access from Barrs Road to Lot
              182 DP 752948 in accordance with Cowra Shire Council’s
              Development Control Plan – Subdivision Code 1992 and Cowra
              Operations Rural Entrance Standard Drawings – CS00001A.DWG
              and CS00001B.DWG.

              Note 1:       All costs associated with the upgrading of the access
                            shall be borne by the applicant and at no cost to
                            Council.

       Water Supply Infrastructure

       25.    The applicant is required to provide a minimum of 25,000 litres of
              tanked water supply for domestic consumption throughout the
              dwelling-house or a larger volume of water supply in accordance
              with BASIX certificate commitments. In addition to the water
              supply required for domestic consumption and BASIX, an
              additional 10,000 litres of tanked water supply shall be reserved for
              fire fighting purposes in accordance with NSW Rural Fire Service
              requirements. Water tanks shall be generally located in close
              proximity to the dwelling-house and allow access for fire fighting
              vehicles.

        Erosion and Sediment Control

        26.     Prior to the commencement of work on the site, all erosion and
                sediment control measures identified in an Erosion and Sediment
                Control Plan (ESCP) shall be implemented and maintained prior
                to, during and after the construction phase of the development.
                The erosion and sediment control measures are to comply with
                Cowra Shire Council’s Soil Erosion and Sediment Control Plan
                2006 at all times.

        Occupation Certificate

        27.     Prior to the occupation or use of the dwelling, an Interim or Final
                Occupation Certificate must be obtained from the Principal
                Certifying Authority for the subject development.

              be erected on the building site prior to work commencing and
              shall be maintained for the term of the construction to the
              completion of the project.

              Note 1:       No building rubbish or debris shall be placed or
                            permitted to be placed on any adjoining public
                            reserve, footway or road.

              Note 2:       The waste container shall be regularly cleaned to
                            ensure proper containment of the building wastes
                            generated on the construction site.

       12.    Any damage caused to footpaths, roadways, utility installations
              and the like by reason of construction operations shall be made
              good and repaired to a standard equivalent to that existing prior
              to commencement of construction.

              Note: The full cost of restoration/repairs of property or services
                    damaged during the works shall be met by the applicant.

       13.    All loading, unloading and storage of goods shall be carried out
              within the confines of the property. No loading or unloading of
              goods on the public roadway system shall be permitted.

       Plumbing and Drainage

       14.    The Applicant is to obtain all relevant approvals to carry out
              sewerage work, to carry out stormwater drainage work and to
              carry out water supply work from Cowra Shire Council prior to
              commencing works to and comply with any conditions of that
              permit.

              Note 1:       All work shall be carried out by a licensed plumber
                            and drainer and to the requirements of Australian
                            Standard 3500, 'National Plumbing and Drainage' and
                            the 'New South Wales Code of Practice; Plumbing
                            and Drainage'.

              Note 2:       The Applicant is to obtain a certificate from Council
                            certifying compliance with the conditions of any
                            relevant approval to carry out plumbing and drainage
                            work. For the purpose of obtaining a certificate the

                     the pipework is installed and prior to concealment. Pipes
                     should be under pressure test.

       Access, Traffic and Transport

       17.    Prior to the issue of a Construction Certificate the applicant is
              required to upgrade the existing Crown Road from its intersection
              with Lachlan Valley Way to a point 20 metres east of the proposed
              access point to Lot 1 DP 602577, to comply with Council’s “Minor
              Gravel Road Standard” as detailed in Cowra Shire Council Road
              Asset Management Plan 1997.

       18.    Prior to the issue of a Construction Certificate that part of the
              Crown Road from the intersection of Lachlan Valley Way to a
              point 20 metres east of the existing entrance to Lot 1 DP 602577 is
              required to be transferred into the ownership of Cowra Shire
              Council.

       19.    Prior to the issue of a Final Occupation Certificate, the applicant
              shall upgrade the existing entrance to Lot 1 DP 602577 in
              accordance with Cowra Shire Council’s Development Control Plan
              – Subdivision Code 1992 and Cowra Operations Rural Entrance
              Standard Drawings – CS00001A.DWG and CS00001B.DWG.

              Note: All costs associated with the upgrading of the access shall be
                    borne by the applicant and at no cost to Council.

       Water Supply Infrastructure

       20.    The applicant is required to provide a minimum of 25,000 litres of
              tanked water supply for domestic consumption throughout the
              dwelling-house or a larger volume of water supply in accordance
              with BASIX certificate commitments. In addition to the water
              supply required for domestic consumption and BASIX, an
              additional 10,000 litres of tanked water supply shall be reserved for
              fire fighting purposes in accordance with NSW Rural Fire Service
              requirements. Water tanks shall be generally located in close
              proximity to the dwelling-house and allow access for fire fighting
              vehicles.

     Principal Certifier Requirements

           ‘Notice of Commencement of Building or Subdivision
           Works’ and ‘Appointment of Principal Certifying Authority’.

     3.    A sign must be erected in a prominent position on any site
           on which building work, subdivision work or demolition work
           is being carried out:
           (a)    Showing the name, address and telephone number of
                  the principal certifying authority for the work;

           (b)    Showing the name of the principal contractor (if any)
                  for any building work and a telephone number on
                  which that person may be contacted outside working
                  hours; and

           (c)    Stating that unauthorised entry to the work site is
                  prohibited.

           Any such sign is to be maintained while the building work,
           subdivision work or demolition work is being carried out, but
           must be removed when the work has been completed.

    4.    Prior to any construction work being carried out on the site,

                builder or owner-builder as defined under the Home
                Building Act 1989; and

          (b)   Submit a Home Building Insurance Certificate issued
                under Part 6 of the Home Building Act 1989.

          Note 1:     Details of the licensee's number and contractor
                      license number and/or owner-builder's name and
                      permit number is required to be submitted to
                      satisfy Clause (a) of this condition.

          Note 2:     The submission of a copy of an insurance policy
                      that covers the construction work is sufficient
                      evidence to satisfy Clause (b) of this condition.

          Note 3:     The Principal Certifying Authority must be
                      informed of any change of builder undertaking the
                      construction work.

    Construction Certificate

    5.    The Applicant is to obtain a Construction Certificate from
          either Council or an Accredited Certifying Authority,
          certifying that the proposed works are in accordance with
          the Building Code of Australia and applicable Council
          Engineering Standards prior to any building and or
          subdivision works commencing.
          Note 1:      No building, engineering or excavation work is
                       to be carried out in relation to this development
                       until the necessary construction certificates
                       have been obtained.

          Note 2:     It is the responsibility of the Applicant to ensure
                      that the development complies with the
                      Building Code of Australia and applicable
                      engineering standards in the case of building
                      work and the applicable Council Engineering
                      Standards in the case of subdivision works. This
                      may entail alterations to the proposal so that it
                      complies with these standards.

    Inspections

          condition of consent for the stages of construction listed in
          Clause 162A of the Environmental Planning and Assessment
          Regulation 2000. For the purpose of obtaining a certificate the
          works must be inspected by the Accredited Certifying
          Authority at the time specified below:

          (a)     At the commencement of the building work;

          (b)     After excavation for, and prior to the placement of,
                  any footings;

          (c)     Prior to pouring any in-situ reinforced concrete
                  building element;

          (d)     Prior to covering of the framework for any floor, wall,
                  roof or other building element;

          (e)     Prior to covering waterproofing in any wet areas;

          (f)     Prior to covering        any    stormwater     drainage
                  connections; and

          (g)     After the building work has been completed and prior
                  to any Occupation Certificate being issued in relation
                  to the building.

          Note 1:       If Council is required to carry out compliance
                        inspections at least 24 hours notice shall be given
                        to Council to allow for the inspection.

          Note 2:       An Occupation Certificate in relation to the
                        building cannot be issued by Council or an
                        Accredited Certifying Authority until the
                        certificates required by this condition have been
                        issued or registered with Council.

    7.    The applicant is required to obtain a certificate from Council
          or an Accredited Certifying Authority, certifying that all
          works (including construction of access driveways) have been
          constructed and completed in accordance with Cowra
          Operations Engineering Standards. For the purposes of
          obtaining the certificate, the works must be inspected by
          Council or an Accredited Certifying Authority at the times
          specified below:

                driveways to the site from the proposed new access
                road have been constructed and prior to sealing.

          (c)   Completion: When all vehicular accesses, internal
                driveways, and stormwater works have been
                completed.

    Construction Works

    8.    All building work must be carried out in accordance with the
          provisions of the Environmental Planning and Assessment
          Act 1979 and the Building Code of Australia.

    9.    The builder must maintain on the work site a legible copy of
          the plan and specification approved with the Development
          Consent.

    10.   All construction operations involving the use of electric or
          pneumatic tools or other noisy operations shall be carried
          out only between 7.00am and 6.00pm on weekdays and
          8.00am and 1.00pm on Saturdays. No work on Sundays or
          Public Holidays is permitted.

    11.   All building rubbish and debris, including that which can be
          wind blown, shall be contained on site in a suitable container
          for disposal at an approved Waste Landfill Depot. The
          container shall be erected on the building site prior to work
          commencing and shall be maintained for the term of the
          construction to the completion of the project.

          Note 1:     No building rubbish or debris shall be placed or
                      permitted to be placed on any adjoining public
                      reserve, footway or road.

          Note 2:     The waste container shall be regularly cleaned
                      to ensure proper containment of the building
                      wastes generated on the construction site.

    12.   Any damage caused to footpaths, roadways, utility
          installations and the like by reason of construction
          operations shall be made good and repaired to a standard
          equivalent to that existing prior to commencement of
          construction.

          Note: The full cost of restoration/repairs of property or
                services damaged during the works shall be met by the
                applicant.

    13.   All loading, unloading and storage of goods shall be carried
          out within the confines of the property. No loading or
          unloading of goods on the public roadway system shall be
          permitted.

    Plumbing and Drainage

    14.   The Applicant is to obtain all relevant approvals to carry out
          sewerage work, to carry out stormwater drainage work and
          to carry out water supply work from Cowra Shire Council
          prior to commencing works to and comply with any
          conditions of that permit.

          Note 1:     All work shall be carried out by a licensed
                      plumber and drainer and to the requirements of
                      Australian Standard 3500, 'National Plumbing
                      and Drainage' and the 'New South Wales Code
                      of Practice; Plumbing and Drainage'.

          Note 2:     The applicant is to obtain a Certificate from
                      Council certifying compliance with the conditions
                      of any relevant approval to carry out plumbing
                      and drainage work. For the purpose of obtaining
                      a certificate the works must be inspected by the
                      Council at the time specified below:

          (a)   Water Supply: Hot and cold water supply pipework
                when the pipework is installed and prior to
                concealment. Pipes should be under pressure test.

          (b)   Stormwater: When the stormwater and roof water
                drainage system has been completed.

    15.   All roofed and paved areas are to be properly drained to
          comply with the following criteria:

          (a)   Discharge three metres clear of any building/structure
                in a manner that does not cause soil erosion or
                nuisance to adjoining properties; and/or

          (b)   Discharge to Council’s Stormwater Management
                System where relevant.

    16.   The Applicant is to obtain all relevant approvals to Install
          and Operate an On-Site Sewage Management System from

                        and Drainage'.

          Note 2:       The applicant is to obtain a Certificate from
                        Council certifying compliance with the conditions
                        of any relevant approval to carry out plumbing

          (a)   Internal Drainage: When all internal drainage work is
                installed and prior to concealment. Pipes should be

          (c)   Absorption Trench: When void arching and stone void

    Section 94A Contributions

    17.   Pursuant to Sections 80A(1) and 94A of the Environmental
          Planning and Assessment Act 1979 and Cowra Shire Council
          Section 94A Contributions Plan, the following monetary
          contribution towards public services and amenities is
          required: $12.60.

          The above monetary contribution will be adjusted at the
          time of payment in accordance with the formula:

          C         =   the original contribution amount as shown in
                        the development consent;

                        consent.

          Note 1:       The minimum payment will not be less than
                        the contribution amount stated on the consent.

          Note 2:       In accordance with Section 94EC of the Act
                        and Clause 146 of the Regulation, a certifying
                        authority must not issue a construction
                        certificate for building work or subdivision
                        work under a development consent unless it
                        has verified that each condition requiring the
                        payment of monetary contributions has been
                        satisfied.

    Water Supply Infrastructure

    18.   The applicant is required to provide a minimum of 25,000
          litres of tanked water supply for domestic consumption
          throughout the dwelling-house or a larger volume of water
          supply in accordance with BASIX certificate commitments.
          In addition to the water supply required for domestic
          consumption and BASIX, an additional 10,000 litres of
          tanked water supply shall be reserved for fire fighting
          purposes in accordance with NSW Rural Fire Service
          requirements. Water tanks shall be generally located in close
          proximity to the dwelling-house and allow access for fire
          fighting vehicles.

          Note: Information relating to the location and design of
                water tanks and emergency fire fighting requirements
                for water tanks and connections can be downloaded
                from the NSW Rural Fire Service website,
                www.rfs.nsw.gov.au.

    Erosion and Sediment Control

    19.   Prior to the commencement of work on the site, all erosion
          and sediment control measures identified in an Erosion and
          Sediment Control Plan (ESCP) shall be implemented and
          maintained prior to, during and after the construction phase
          of the development. The erosion and sediment control

     20.    Prior to the occupation or use of the dwelling, an Interim or

            Principal Certifying Authority for the subject development.

    Principal Certifier Requirements

    2.    The applicant is to submit to Cowra Shire Council, at least
          two days prior to the commencement of any works, a
          ‘Notice of Commencement of Building or Subdivision
          Works’ and ‘Appointment of Principal Certifying Authority’.

    3.    All loading, unloading and storage of goods shall be carried
          out within the confines of the property. No loading or
          unloading of goods on the public roadway system shall be
          permitted.

    4.    A sign must be erected in a prominent position on any site
          on which building work, subdivision work or demolition work
          is being carried out:

          (a)     Showing the name, address and telephone number of
                  the principal certifying authority for the work;

          (b)     Showing the name of the principal contractor (if any)
                  for any building work and a telephone number on
                  which that person may be contacted outside working
                  hours; and

          (c)     Stating that unauthorised entry to the work site is
                  prohibited.

          Any such sign is to be maintained while the building work,
          subdivision work or demolition work is being carried out, but
          must be removed when the work has been completed.

    Inspections

    5.    The applicant is to obtain a certificate from Council or an
          accredited certifying authority, certifying compliance with
          the Building Code of Australia and any other relevant
          condition of consent for the stages of construction listed in
          Clause 162A of the Environmental Planning and Assessment
          Regulation 2000. For the purpose of obtaining a certificate
          the works must be inspected by the accredited certifying
          authority at the time specified below:

          (a)     At the commencement of the building work;

          (b)     Prior to covering       any   stormwater    drainage
                  connections; and

         (b)   After excavation for, and prior to the placement of,
               any footings;

         (c)   Prior to pouring any in-situ reinforced concrete
               building element;

         (d)   Prior to covering of the framework for any floor, wall,
               roof or other building element;

         (e)   Prior to covering waterproofing in any wet areas;

         (f)   Prior to covering         any   stormwater      drainage
               connections; and

         (g)   After the building work has been completed and prior
               to any occupation certificate being issued in relation to
               the building.

               Note 2:      If Council is required to carry out
                            compliance inspections at least 24 hours
                            notice shall be given to Council to allow
                            for the inspection.

               Note 3:      An occupation certificate in relation to
                            the building cannot be issued by Council
                            or an accredited certifying authority until
                            the certificates required by this condition
                            have been issued or registered with
                            Council.

    6.   The applicant is required to obtain a certificate from Cowra
         Shire Council or an accredited certifying authority, certifying
         that all works (including construction of access driveways)
         have been constructed and completed in accordance with

                Standard 3500, 'National Plumbing and Drainage' and
                the 'New South Wales Code of Practice; Plumbing and
                Drainage'.

    14.   All stormwater from the rear patio must be properly drained
          to the existing stormwater system.

    Access, Traffic and Transport

    15.   Prior to the issue of an Occupation Certificate, car parking
          facilities including all internal driveways, parking and
          manoeuvring areas are to be constructed and sealed in
          accordance with AS 2890.1 Off-Street Car Parking and are to
          include all necessary line marking, directional arrows and
          signage to delineate parking spaces, traffic flow and traffic
          priority.

          Note: All costs associated with the construction of the
                parking area shall be borne by the applicant.

    16.   A minimum of one parking space for disabled persons is to
          be provided in the development. The disabled parking space
          is to be constructed and signposted in accordance with the
          requirements of AS 2890.1 Off-Street Car Parking.

          Note: All costs associated with the construction of the
                parking area shall be borne by the applicant.

    Fire Safety

    17.   A Final or Interim Fire Safety Statement issued in
          accordance with Clause 170 of the Environmental Planning
          and Assessment Regulation 2000 in form prescribed by
          Clause 174 of the Environmental Planning and Assessment
          Regulation 2000 shall be issued by the owner of the building
          and a copy provided to Council prior to the occupation of
          the building.

    18.   Hereafter at a period of at least once every 12 months the
          owner of the building shall cause to be furnished to Council
          and the Fire Commissioner, in accordance with Clause 177
          of the Environmental Planning and Assessment Regulation
          2000, an Annual Fire Safety Statement in the form
          prescribed in Clause 181 of the Environmental Planning and
          Assessment Regulation 2000, certifying that each Fire Safety
          Measure has been maintained in accordance with the
          provision of the relevant standard.

    Food Shop Compliance
    19.   All areas where food is stored, made, manufactured,
          produced, collected, extracted, processed, transported,
          delivered, prepared, treated, preserved, packed, cooked,

      Moved Cr BE Miller, Seconded Cr PB Wright:

      That:

      1.      Council fund the purchase and installation of a storm water
              pit, and that all associated costs be covered from the Works
              Function Drainage – Kerb Inlet Maintenance.

      2.      All costs associated with diverting the storm water from the
              pit to the tanks be at the full cost of the Cowra High School.

      3.      Council request written documentation from Cowra High
              School confirming the statement that the storm water does
              not present a health risk and will not be used as a potable
              water supply at any time.

      That Council support DA 6/2009 proposing to change the use of an
      existing function centre on Lot 1 DP 789770 25 Chardonnay Road,
      Cowra to a dwelling-house and refer the application to the
      Director-General of the NSW Department of Planning for
      concurrence in accordance with State Environmental Planning
      Policy No. 1 – Development Standards.

12.   Cowra and Gooloogong Floodplain Risk Management Study and Plan.

      Moved Cr BE Miller, Seconded Cr RG Watt:

      That Council:

      1.      Endorses the make-up of the Cowra and Gooloogong
              Floodplain Risk Management Working Party.

      2.      Appoint Councillor Ray Walsh to Chair the Cowra and
              Gooloogong Floodplain Risk Management Working Party.

      3.      Commit the sum of $15,000 through its 2009/2010 budget
              deliberations to employ a project officer on a temporary part
              time basis to support the ongoing implementation of the
              Cowra and Gooloogong Floodplain Risk Management Plan.

13.   Section 96 Modification of Development Application No. 40/2008 –
      proposing a number of minor alterations to the external features of a
      proposed new dwelling-house and relocation of a proposed new retaining
      wall and water tank on proposed Lot 2 approved in accordance with DA
      40/2008. The application has been lodged by David Le Lievre on behalf of
      Habitat for Humanity.

      Moved Cr BE Miller, Seconded Cr RT Bridges:

      That:

      1.      Council accedes to the request to modify Development
              Consent No. 40/2008 issued by Council on 29 October 2008
              by amending the external features of the proposed dwelling
              house and relocation of the retaining wall and water tank, in
              accordance with Section 96 of the Environmental Planning
              and Assessment Act 1979.

      2.      The modified development plans be stamped and approved.

      That Council defer consideration of the General Manager’s report
      and an onsite meeting be arranged with the owners of the carpark
      to discuss all the relevant issues.

15.   Wyangala Dam Wall

      Moved Cr BE Miller, Seconded Cr WJ West:

      That:

      1.      Council seek clarification from State Water as to their
              intentions in closing the road across the dam wall and seek
              comment as to how they intend to facilitate access and
              movement of people from the southern to the northern side
              of the river, particularly emergency vehicles.

      2.      An urgent meeting be sought with the appropriate Minister
              to express Council’s extreme displeasure at finding out about
              the intentions of State Water at Wyangala by means of a
              press release.
