									CHAPTER I EXECUTIVE SUMMARY

The tasks of consultant has been determined through ADB TOR dated 24 July 2006. The tasks consist of two focus of corruption eradication
acitivities, that are: Repression. is receiving the cases and monitor of its follow up and also to supervise and to coordinate with local police and attorney. During 2007 corruption allegation information received amount to 527 information. Evaluation: Since the establishment of KPK Aceh contact point office in 2005 until end of 2007, the general public awaiting for KPK repression action. The public has forwarded corruption allegation information and waiting for the real action both by KPK and local police/attorney. To accelerate law enforcement action, KPK has forwarded corruption allegation informations to local police and attorney. However, the data of its follow up are not available. To get maximum result, the hand over of corruption allegation information from KPK to local institutions should be well monitored and supervised of its follow up. Meanwhile, the data also shown that 9 information (cumulative since 2005 to 2007) has been decided to be followed up by KPK, both in repression and prevention unit. The decision has taken since 2005 which are now awaiting of its follow up. Prevention. is to arrange capacities building, complaint intake mechanism, informations dissemination and to arrange technical assistance of wealth report (LHKPN) and Graft. The prevention activities had resulted:

six universities have signed MOU with KPK and two of them have implemented anticorruption subject in their curriculum. The KPK Aceh budget is Rp 4.636.190.000 and budget absorbment amount to Rp 2.301.872.185 or 50% of the budget available. The absorbment of the budget which only 50% caused by DIPA approval which happened on May 2007 (ADB Grant) and the efficiency factors, that is the cost of activities implemented was not as high as budgeted. CHAPTER II PLANNING OF ACTIVITIES

The planning of KPK Aceh activities based on the Consultant TOR . The TOR has been spelled out by annual workplan and the issuance of the
DIPA.


The DIPA


In 2007 the budget of KPK Aceh has determined through DIPA 0001.3/093-01.0/-/2007 31 December 2006 Revised on III 23 November 2007 and DIPA : 0001/093-01.1/-/2006 31 December 2007 Revised on 22 May 2007. The total number of budget amount to Rp 4.636.190.000 which consist of GOI budget Rp 1.448.290.000 and ADB Grant Rp 3.187.900.000



The detail of the DIPA can be seen in annex I.



The Workplan To implement the TOR, the annual workplan has been prepared which consist of:


Corruption Investigation.

The activities involve facilitating the Investigation Team’s initiated by Jakarta Offices. All corruption

reports/complaints received by the KPK Banda Aceh Office shall be recorded and administered then to be forwarded to the KPK Jakarta Office for follow-up actions. In coordination with the appointed KPK Senior Functional Officer of Prevention, the Adviser continuesly abreast and update the progress of the investigation made by the Jakarta Offices Complaints Directorate under the Deputy of PIPM. Assisting and facilitating the investigation team may be provided to accelerate the investigation’s result..

Capacity Building. This involves training/orientation of: law enforcement, prosecution and audit agencies in case handling, verification/investigation and processing of corruption-related cases through training anti-corruption NGO networks working in NAD/Nias (i.e. Transparency International Indonesia, Gerak, etc) on government budget/procurement, accessing government records, basic investigation/evidence gathering methodologies citizens’ base anti corruption/grievance networks and village/community facilitators involved in ETESP subproject implementation on proper identification and reporting of fraud and corruption and basic information for dissemination to the public University/college student bodies on proper identification and reporting of fraud and corruption and basic information for dissemination to the public.. Complaint Intake Mechanism, This involves the establishment of a grievance/complaint intake system in the various Districts in NAD and Nias where there is ongoing rehabilitation-reconstruction work. This will be done by linking with the 15 anti-corruption NGOs working in NAD/Nias and their networks to serve as grievance/complaint intakes. Capacity of these NGO networks in basic/preliminary investigation and evidence gathering will be strengthened under the Capacity Building Component in order to facilitate the formal investigation of KPK/General Attorney’s Office or audit by the Supreme Audit Agency. Media networking and Information Dissemination, This involves the production and dissemination of pamphlets/flyers and other paraphernalia to the general public and networking with local and national media (print, radio, tv) to improve the awareness of the general public on the systems and developments related to the anti-corruption efforts of KPK and its partners in the NAD/Nias rehabilitation work. Media, donor and government briefing will also form part of this activity. LHKPN technicall assistance and Graft in coordination with LHKPN Directorate organize LHKPN TA and ensure compliance level on filling LHKPN reach 95%. Also in coordination with Graft Directorate organize graft socialization







CHAPTER III IMPLEMENTATION OF ACTIVITIES

The activities performed during 2007 can be grouped into:
I. Corruption Investigation According to the policy of KPK, the role of KPK Aceh in “Corruption Investigation Cases” activity is to receive corruption allegation information from the public. As well as, to encourage to the public to inform corruption allegation practices using the available form. The Aceh community may pass on the corruption allegation information both to KPK Office in Aceh or directly to KPK Jakarta. Each corruption allegation information received in Aceh administered and sent to Jakarta for the follow up action. Thus, the role of KPK Aceh is to receive, administered, and send the corruption allegation informations to Jakarta. During 2007, 527 information had been received from the general public. They were received in Jakarta as well as in Aceh Office. Compare to the year of 2006 the number of information received in 2007 is higher, while only 201 information received in 2006. More than 100% increase. However, of those numbers, only 121 information were valid corruption allegation information. The remaining information can not be follow up with several reason, among other was not a corruption information or not supported with sufficient preliminary data. In these category, there were several informations that were not supplied with complainant identity. Even this are not mandated, but it is essential for KPK staff to get further information needed from the complainant. Some of valid corruption allegation information has forwarded to local police and attorney and other related institutions as depicted in the annex

Beside receiving information from the public, supervision and coordination activities to local enforcement institutions were also planned to be conducted in 2007. The supervision and coordination activities has conducted in limited manner due to the lack of human resources and other urgent cases handling factors by KPK. Evaluation The table shown that the numbers of information received by KPK was increasing. It shows that the public participation role getting better, in terms of submission of corruption allegation information. Which mean also the increasing of public trust to KPK. Public participation role in combating corruption effort were protected by the Law. It was realized that the public participation could affect the effectiveness of fighting against corruption effort. Hence, it should be improved and strengthened. The cases handling and communication between KPK

and complainant are some of many alternatives to improve the public participation. Thus, in order to increase public participation, the cases handling either by KPK or local enforcement agencies is essential to undertake. Uncertainty on the follow up of information may affect to public reluctant to participate in the corruption eradication efforts. The statistical data also shown that the quality of informations provided by the public was decreasing. The 2007 data shown that only 121 of 527 information or 22,96 % suitable to be followed up by KPK. Compare to the year of 2006, the quality of information is decreasing, where the information suitable to be follow up up to 31,29%. It means that socialization event of KPK task, function, and mandates is important to be continued. It will avoid the KPK resources allocation to unnecessary works. Setting up monitoring mechanism and procedure of the cases that have been forwarded to local institutions seem essential to consider. Thus, the follow up progress of each cases could be monitored. Monitoring by KPK will provide psychological burden to local institutions. So they will put those as a priority works in their annual workplan. The follow up action is a part of the public service that should be undertake by each government institutions. II. Capacity Building The activities consists of: 1. Training to government employees, law enforcement officers, and District auditors (Bawasda) During 2007 training to Bawasda had been conducted 9 times in 9 different district. In general, the topics of training consists of District Financial Management, Fraud on Procurement Process, Anti Corruption Toolkit on Procurement, and Types and form of Corruption according to Anti Corruption Law. The three days training aimed to improve the understanding of Bawasda auditors on fraud in procurement process, and the speakers from Anti Corruption Unit (ACU) of BRR, Supervisory Financial and Developments Board (BPKP), and KPK, as well as Indonesia Procurement Watch (IPW) had presented their paper. Auditors and administration staff of Bawasda participated in this training. Lack of auditors constitute Bawasda common condition.

Meanwhile training to local police and attorney cannot be performed yet. There were many factors that should KPK commissioner be considered before decided to approve training program to local police and attorney. The seminar “The implementation of Integrity Pact in Procurement Process” was one of the training that has been conducted with District Government Employees. BRR staff and some of anti corruption NGO members participated in the training. The speakers were Deputy of Prevention of KPK, Deputy of Supervision of BRR, Chief of ACU BRR, and Director of IPW. At the end of the seminar the participants who held position as a project managers declared their commitment to avoid conflict of interest in the procurement process.

Evaluation Lack of auditor is common condition in every Bawasda. Hence, the training would be meaningful if it could facilitate Bawasda to increase the number of auditor, which of course its need time. Commitment of Bupati/Walikota is also an essential factor to make internal auditor more professional and competent. Knowledge building in management, auditing, and government accounting is elementary subjects that should be provided in order to improve Bawasda auditors quality. 2. Anti corruption NGO network training During 2007 had been conducted series of anti corruption training together with members of anti corruption NGO. The training had been conducted in a way by invited them in the public seminar or arranged a training together with them, and participated in their seminar as a resource person. In general, the training topics relate with procurement process. It aimed to improved capabilities of NGO member to monitor the rehabilitation and reconstruction process which taking place in Aceh. Thus, the public would get benefit from the result of rehabilitation and reconstruction process for long time. The table below show the training activities held with anti corruption NGO:

Evaluation Many international institutions took part in the Aceh rebuilding process. Various humanity activities and events conducted by them. In general, the organizers gave some amount of money to the participants, both as a honorarium as well as transportation expenses reimbursement. This condition be in effect when they arranged a training to the public. Which means that the participants got two benefit, informations and money. The problem arise when some of the participants were government employees. Normally, when the government employee received official assignment, any expenses incurred would be cover by the state. When the government employees participated in the training held by NGO, they will receive payment twice for one event they participated in, from the government budget and from the organizers. To some extent this condition creating a perception that in every training event the government employees should received cost reimbursement from the organizers eventhough they had received payment from the government.

The training especially held by KPK for anti corruption activists would be difficult to implement if budget for participants honorarium and transportation expenses reimbursement is not provided. However, as part of building anti corruption culture and creating professional community, rendering participants honorarium should be definitely avoided. To some extent, providing transportation expenses reimbursement might properly considered, if it comply to the government regulation. III. Complaint intake mechanism In the course to strengthen public participation in the corruption prevention efforts, some activities has been conducted in cooperation with youth club and student activists. The training on the understanding of the type of corruption and the role of youth in corruption prevention has been held in some districts. It aimed to make the students aware of the on going process of rehabilitation and reconstruction and in turn they could participate in the monitoring activities. Beside making an alliance with anti corruption club, networking with ACU BRR was also strengthened. Until end of the year 2007, ACU had submitted some monitoring and investigation report to KPK Jakarta Evaluation Establishment of student and youth anti corruption clubs would facilitate the dissemination of anti corruption movement. Real effort of corruption eradication through law enforcement could maintain the club members spirit to arrange corruption prevention events. The acceleration of corruption case handling might contribute in the creation of anti corruption clubs in the public. Which in turn creating the anti corruption culture. IV. Information Dissemination and Networking The information dissemination of KPK tasks and role as well as fighting against corruption efforts were done through training, discussion, and anti corruption campaign. These activities conducted in cooperation with government employees, NGO's and student clubs. Some of the topics of the training for the public, are:

In the course of anti corruption culture building systematically, allied with Dinas Pendidikan (District Education Office) was one of the activities implemented in 2007. Anti corruption Training of Trainer for teachers of SMP and SMA teaching counseling, religion, and civic education topics had been undertaken in some SMP and SMA in Banda Aceh and Bireun. This event aimed to facilitate to the teacher able to implanting anti corruption character to their students. The TOT has resulted the preparation of anti corruption learning material which adopted local wisdom. However the document is still in draft and waiting to be imprinted and disseminated to entire NAD province. During 2007 anti corruption TOT and Socialization had been conducted, as follow:

The MOU signing has resulted the implementation of anti corruption topic in the curriculum of Syariah Faculty of IAIN Ar Raniry. Meanwhile the preparation of anti corruption subjects as part of the curriculum has been undertaking by Political Science Faculty of University of Teuku Umar Meulaboh. Beside making an alliance with the realm of education, networking activities also made with moslem expert. As already known that the majority population of NAD Province are moslem. Normally the acehness took two way of education, in a public school and in a Madrasah school. In average there are one madrasah in each village. Therefore making an alliance with Ulama is a strategic way to disseminate anti corruption subjects. Strategic alliance with Ulama has resulted the handbook of anti corruption which refer to Holy Quran and Alhadits and various preaching titles of anti corruption. Socialization with Ulama was also made during 2007 which was attended also by Acehness traditional prominent figures of entire NAD. In this occasion has been presented anti corruption behavior according to values of Islam and acehness tradition. The one day discussion has resulted the need to produce anti corruption material which adopted Aceh culture.

As a follow up of the discussion, anti corruption compiler team which refer to Islamic Values were formulated. All the team member also committed to present anti corruption subject whenever they have the chance. They may socialized through Friday preaching or in a recitation of the Quran. The same topic of discussion were also conducted in Tapak Tuan. Attended in this occasion were Ulama of South Aceh and Mosque Preacher. To strengthen alliance between journalist and KPK, the journalist and government district public relation training had been conducted in East Aceh. The two days training was attended by Indonesia Journalist Alliance (AJI) representative and participated by 59 participants. This event aimed to give the journalist better understanding on the types of corruption and to make them able to write a news according to journalism ethic. Meanwhile, public campaign was conducted also to disseminate anti corruption material which organized in cooperation with NGO's. Anti corruption campaign to commemorate world of anti corruption day has been conducted in Banda Aceh supported by various anti corruption elements. Research report that has been conducted by Research and Developments unit of KPK is one of suitable learning material for the student. Evaluation In addition to conducting technical assistance, improvement of compliance level on filling of LHKPN might be done through demanding the fulfillment of wealth report and coaching to mandatory registrant. In 2007, intensification and enforcement effort has not been conducted yet. Hence, the 2008 workplan should consider of those activities. Graft report data shows there were no graft report from Aceh. Its implies two thing, is the government official had never received a gift or are they understood on the graft definition well? If they never received a gift from the public, this condition seem contradictory with corruption allegation information which increase significantly.

CHAPTER V CHALLENGES AND LESSON LEARNED

Lesson learned.

Corruption eradication effort become more effective if there is integration between prevention and repression action. Public participation in
monitoring and reporting corruption allegation practices would become more increasing if there is follow up on every information. In addition, systematic and consistent communication effort to the public might improve public support to law enforcement efforts. In relation with the activities undertaken during 2007, some useful lesson could be taken, that are:


The existence of KPK Aceh office which has been widely socialized by the Commissioner and other KPK official had grown up the Acehness expectation on the effort of corruption eradication in NAD. Thus, increasing the public support to KPK activities. The expectation surface from the perception that there were local corruption eradication institution which carry out its tasks and function fully (prevention and repression) in NAD jurisdiction.



National and International communities had actively involved in Aceh rebuilding. Most international as well as national NGO performed their programs. While performing their program they get interact with government employees. It has been found that the event organizers provided sum amount of money to government employees who participated in their event as a per diem, honorarium as well as reimbursement of transportation expenditure incurred by the participants. Even those had been provided by the government. Thus the government employees will have received payment twice for one event they participated in. And it was part of the corruption practice that should be prevented. The public could take part to

prevent such corruption practices. Keeping such practices continuesly would creating a culture, that is the right of the government employees to receive money from the organizers and the government for the assignment they had performed. Challenges: a. Different perception in attention of rebuilding Aceh process. The emergency status of Aceh had been determined by the Government. The devastating impact of Eartquake and Tsunami had caused the rehabilitation and reconstruction can not be undertaken by the existing institutions. Therefore, the government had established BRR to rebuild Aceh. The huge amount of fund to rebuild Aceh potential to create the misuse of the fund. And sound governance system has been put in place. However the law enforcement practices, especially pertain to corruption cases handling, are performing as in normal mechanism. The mobilization of professional and integrity of law enforcement officer to assist corruption cases handling in Aceh has not been seen yet. Rebuilding Aceh process is in emergency nature, however the law enforcement was performed as in normal condition. b. One of the caused of corruption practice widely spread is less understanding of the definition and types of corruption as stipulated in the Law. KPK had socialized anti corruption Law to the public widely. Aceh having specific history compare to other province within Indonesia. The prolonged conflict in Aceh had hampered the dissemination of information to Aceh community. Including dissemination of anti corruption Law. It need long and intensive effort to disseminate the definition of corruption in order to be able to be accept by the communities and to avoid misunderstanding in the definition and type of corruption.

Suggestion and Recommendations 1. The decision of KPK Commissioner to established Contact Point Office in Aceh having nomerous qonsequency. The public had suspiciously

response. Some minor expression had revealed both in formal meeting as well as informal. All of them having political nuance. It could be realized that Aceh had just free from political conflict. Where in every conflict situation, conflicting parties performed dissinformation practices. In the other side, some Acehness expecting that the presence of KPK could eradicate corruption practice in Aceh. The real action of KPK could answer it. 2. The status determination of Aceh Contact Point Office which accompanied by Permanent official who has clear authority and tasks and supported with standard operating procedures would ease the implementation of activities. Distance and time factors might be considered to the need of standard operating procedures for Aceh office. In line with the Commissioner strategy to speed up corruption eradication locally, then Aceh Contact Point Office could be a pilot project prior to the establishment of KPK branch.
