The Policy, consisting of this booklet, a Policy Schedule and the information provided by you, is a contract between you and us. We agree to insure you. We also agree to provide the services but we have appointed the Administrator and the Credit Reference Agency to administer or provide different aspects of these on our behalf. Credit Reports and monitoring services described within this Policy will be provided to you directly by the Credit Reference Agency. The information you gave to us or the Administrator either over the telephone and/or on your Application Form is part of your contract with us. The Policy Schedule shows the cover you have chosen and the maximum we will pay for each benefit. This booklet and the Policy Schedule must be read together. Please check these carefully to be sure the cover meets your needs. If you have any questions please contact: a) the Administrator’s Identity Theft helpline on 0800 013 9950 in respect of the services or b) us on 0800 519 9917 in respect of questions specifically related to the issue of the Policy. If your needs change, or if any information you gave us changes, please tell us because we may need to change the Policy. We will update the Policy and send you a new Policy Schedule each time we agree a change with you. This Policy shall be governed and construed in accordance with the Law of England and Wales and the English Courts alone shall have jurisdiction in any dispute. All communication of and in connection with this Policy shall be in the English language. You and we have agreed that it is not intended for any third party to have the right to enforce the terms of this contract (save for the Credit Reference Agency who has the right to enforce the Credit Reference Terms). You and we can cancel or vary the terms of this contract without the consent of any third party to this contract. It is your responsibility to provide complete and accurate information to us when you take out your Policy and throughout the life of your Policy. It is important that you ensure all statements you make on your Application Form, over the telephone, on claim forms and other documents are full and accurate. Please note that if you fail to disclose any material information to us, this could invalidate your insurance cover and could mean that part or all of a claim may not be paid. One of our authorised representatives must sign the Policy Schedule for your cover to be valid. Andrew Kendrick Chairman and CEO ACE European Group Limited 1 Essential Finance IDT PW 150309 Definitions Throughout the Policy, there are words and phrases, which have special meaning. These are listed here. ‘Administrator’ Pure Insurance Marketing Limited (FRN 465574) Ravens Court, Brewery Lane, Bridgend CF31 4AP ‘Benefit Amount’ The maximum amount shown in the Policy Schedule we can pay under a specific heading in respect of a claim following Identity Theft in any 12 month period. ‘Commencement Date’ The day, month and year shown in the Policy Schedule for the cover to start. ‘Credit Report’ The statutory credit report produced under section 158 of the Consumer Credit Act 1974. ‘Credit Reference Agency’ The Credit Reference Agency named in the Policy Schedule. ‘Credit Reference Terms’ The terms and conditions applicable to holders of a Policy, forming part of this Policy, contained within the Credit Reference Agency’s website. ‘Documents’ Papers or other items containing references to your identity including, but not limited to the following: I Passport I Driving licence I Credit, debit and bank cards I Share certificates I National Insurance number I Birth certificate I Bank account and ISA details I Building Society account details I Insurance documents - motor, home, travel and life I Utilities account numbers I Membership numbers of professional bodies ‘Effective Date’ The day, month and year shown in the Policy Schedule for any change in cover to start. ‘Identity Theft’ The theft of personal data or Documents relating to your identity which results in you: 1. having money taken fraudulently from your bank or building society credit or charge accounts; and/or 2. being held liable for payment of goods or services purchased or contracted for fraudulently by others; and a. being unable to recover the money referred to in 1 above; and/or b. being unable to avoid or recover the payments referred to in 2 above; 2 Essential Finance IDT PW 150309 ‘Legal Expenses’ Expenses reasonably incurred, following Identity Theft, in engaging legal assistance in order to: a) stop further fraudulent use of your identity; b) restore your credit rating; c) restore your bank, mortgage or loan accounts; d) amend or rectify records regarding your true name or identity; e) pursue the amendment or rectification of records regarding your true name or identity; f) to defend any suit brought against you by a creditor or collection agency or other entity acting on behalf of a creditor for non-payment of goods or services or default on a loan; g) to remove any civil judgment wrongfully entered against you. ‘Loss’ Irrecoverable financial loss and Legal Expenses incurred with our consent arising from Identity Theft. ‘Loss of Income’ 1. Actual personal income reasonably lost due to time taken from your work and away from your work premises. 2. Compensation for annual leave taken by you (including discretionary days, floating holidays, and paid personal days but excluding sick days); where such income has been lost or such leave has been taken, following Identity Theft, in order to: a) stop further fraudulent use of your identity; b) restore your credit rating; c) restore your bank, mortgage or loan accounts; d) amend or rectify records regarding your true name or identity; e) solely to pursue the amendment or rectification of records regarding your true name or identity. ‘Motor Vehicle’ A motorised vehicle designed for use on a public road (as defined in the Road Traffic Act 1988 (or any replacement legislation thereof) and built in accordance with the appropriate construction and use regulations, including, but not limited to, motor cars, commercial vehicles, motor cycles, mopeds, motor scooters, Public Service Vehicles, vehicles designed to operate as tools of trade, coaches or minibuses. ‘Period of Insurance’ The time period for which you have a valid Policy with us and for which the appropriate Premium has been paid. The period will start on the day you purchase the Policy and for each premium you pay, whether monthly or annually, we will provide cover until the next premium is due. ‘Permanently Resident’ Resident in the first instance for at least 3 months and thereafter for 40 weeks on average each year. ‘Plan’ Identity Theft Protection ‘We’, ‘our’, ‘us’ ACE European Group Limited ‘You’, ‘your’ The person named in the Policy Schedule who has taken out the Policy. 3 Essential Finance IDT PW 150309 The cover we provide Pre-requirement for the insurance cover and provision of services to apply You must: I be 18 years or over; I be Permanently Resident in England, Scotland, Wales or Northern Ireland. When and where cover applies The cover applies 24 hours a day. I Credit Reference Services After the Commencement Date of the Policy, you can then, whilst the Policy is in force, utilise the following services through us, the Administrator and/or through the Credit Reference Agency: I by accessing the website through the link on your confirmation e-mail; or by calling the Identity Theft helpline on 0800 013 9950 between 8.00am and 8.00pm Monday to Friday and 10.00am to 4.30pm on Saturdays or Bank Holidays; or by writing to ACE Identity Theft, Customer Service Manager, Ravens Court, Brewery Lane, Bridgend CF31 4AP. The advice the Administrator and/or the Credit Reference Agency provides will concentrate on the fraudulent use of your identity in England, Scotland, Wales or Northern Ireland. Where possible, the Administrator will provide advice to assist in the prevention of the fraudulent use of your identity abroad. Such information may be limited. Insurance Cover 1. Loss of Income and Legal Expenses cover In the event of Identity Theft whilst the Policy is in force, where you have suffered Loss of Income or incurred Legal Expenses, we will: a) Where Loss of Income has been incurred, pay you up to the Benefit Amount b) Where Legal Expenses have been incurred, indemnify you for such expenses up to the Benefit Amount. 2. Passport and driving licence replacement cover In the event of you, whilst the Policy is in force, experiencing the loss or theft of your passport or driving licence and having to replace them, we will indemnify you to the extent of such loss up to the Benefit Amount. 4 Essential Finance IDT PW 150309 I a) Preventative advice The Administrator and/or the Credit Reference Agency will (if requested) provide specialist advice on how to reduce the risk of Identity Theft occurring. General preventative advice is available on our and the Credit Reference Agency’s websites. b) Credit Report monitoring We in association with the Credit Reference Agency will provide you with access to the monitoring service. The monitoring service consists of alerts which are sent to you via e-mail and which will inform you as soon as possible that changes have been made to your Credit Report. This may help you to determine whether Identity Theft has taken place when checking your Credit Report. The Credit Reference Agency will also send you a monthly statement e-mail. c) Access to your Credit Report You will have continuous access (subject to technical issues or down time of our and / or the Credit Reference Agency’s websites), to your Credit Report through the Credit Reference Agency. You will be able to receive updates of any significant changes to your credit history by e-mail. To obtain your Credit Report(s), please follow the instructions in your confirmation e-mail. Your Credit Report will be viewable online, and we recommend that you save or print a copy. Using the website will provide real-time access. If you cancel your Policy, access to all your Credit Reports, the preventative advice and the monitoring service will end immediately. For security reasons and to protect confidentiality we will (in circumstances where the Credit Reference Agency does not itself carry out such verification) verify your identity on behalf of the Credit Reference Agency by checking the details provided during registration for your Credit Report, against details you provided to us when you applied to take out the Policy. You agree that a record of the request for your Credit Report will be retained by the Credit Reference Agency and will be included on any further reports that are provided at your request. Your requests will ONLY be visible to you and NOT to any lenders. These requests will not be taken into consideration on any lending decision. d) Resolution A. The Administrator will: i) advise you of any appropriate fraud notifications that may be available to you and which you may wish to consider pursuing in order to reduce the risk of further fraudulent activity; ii) provide advice on how to register with CIFAS (the UK’s fraud prevention service) to alert UK credit agencies of possible fraudulent activity; iii) provide advice on letters that may need to be sent to third parties; B. The Credit Reference Agency will: i) seek to gain consent from financial organisations (such as banks and credit card companies) to rectify your incorrect credit history which has arisen as a result of Identity Theft. If consent is obtained, any rectification will be undertaken solely in respect of the Credit Reference Agency’s records. The Credit Reference Agency will advise you on how to contact the other credit reference agencies in respect of rectification of their records. ii) seek consent from the appropriate judicial authorities in order to remove any civil judgment wrongfully entered against you as a result of Identity Theft. If consent is obtained, the removal will be undertaken solely in respect of the Credit Reference Agency’s records. The Credit Reference Agency will advise you on how to contact the other credit reference agencies in respect of the removal of a wrongfully entered civil judgment from their records. 5 Essential Finance IDT PW 150309 What we do not cover We will not pay any claim for: I replacement of any item or credit obtained as a result of fraudulent use of your identity; I any Loss arising from any business pursuits or the theft of a commercial identity; I any Loss or liability arising from the use of any Motor Vehicle bought, leased or hired by fraudulent use of your identity, where civil or criminal action is, or has been, taken against you; I authorised charges that you have disputed based on the quality of goods or services; I theft of your identity by a family member who lives with you at your home address; I the amount of any claim which exceeds the Benefit Amount in any 12 month period; I any Loss of Income, costs or expenses in connection with any claim not agreed in advance by us; I authorised account transactions or trades that you had disputed, or are disputing, based on the execution (or non-execution) of electronic transfers, trades or other verbal or written instructions or directions; I any Loss that was not incurred or did not commence during the Period of Insurance; I an incident of Identity Theft for which you do not have a Police crime reference number. 6 Essential Finance IDT PW 150309 Conditions 1. Other insurance a) If you have any other valid insurance, which would apply in the absence of the benefits provided under this Policy, then this Policy shall only contribute its rateable proportion to the cost involved. b) You should not be covered under more than one Policy issued under this Plan. If you are named under more than one of these Policies: i) we will consider you to be insured under the Policy which provides the highest benefits; or ii) if the benefits are the same we will consider you to be insured under the Policy which was issued first. In any case, we will refund the premium paid under the Policy which is not giving cover and cancel it. 2. Subrogation If any settlement is made by the Administrator or us to you under the terms of this Policy, you grant to the Administrator all rights of recovery that you would have had against any parties from whom a recovery may be made and you will take all reasonable steps to preserve and not to prejudice such rights. 3. Rectification of your credit profile In assisting you to rectify errors contained in your credit profile, the Credit Reference Agency will fulfil its statutory obligations in providing your Credit Report and the Administrator will take all action reasonably and legally possible under the laws of England and Wales. There may be occasions which are due to events beyond the Administrator’s, or the Credit Reference Agency’s, control, where your credit profile cannot be fully rectified. 4. Claims of confidentiality or proprietary rights You consent to the Administrator and/or the Credit Reference Agency acting on your behalf using confidential information passed to Administrator and/or the Credit Reference Agency by you or discovered by the Administrator and/or the Credit Reference Agency on investigation into your Identity Theft. 5. Register of claims In the event of an insurance claim, any information that you provide to us may be included in a Register of Claims through which insurers share information to prevent fraudulent claims. A list of participants and the name and address of the operator are available from us. 6. Limit of liability for information provided by third parties We, the Administrator and the Credit Reference Agency make no warranty or guarantee that the provision of the services relating to the Credit Reports will be uninterrupted or error-free. Most of the data provided to the Credit Reference Agency will have been provided by third parties and neither we, nor the Administrator nor the Credit Reference Agency will be liable for any Loss or damage arising from any inaccuracies, faults or omissions in, or the provision of, the data: a) unless in the case of the Administrator or us, this is caused by our or the Administrator’s negligence or wilful default or arising under the provisions of the Data Protection Act 1998, or, b) in the case of the Credit Reference Agency, except to the limited extent to which such liability is accepted under the Credit Reference Terms. 7 Essential Finance IDT PW 150309 Conditions 7. Compliance with the Credit Reference Terms You agree to comply with the Credit Reference Terms (which form part of the terms and conditions of this Policy) when you access the Credit Reference Agency’s website (which is necessary in order to access the monitoring service and your Credit Report as detailed in the Policy schedule). Please read the Credit Reference Terms carefully. Paying your premiums When you must pay The amounts you must pay are shown in the Policy Schedule. If you do not start paying the premiums, this Policy will not provide any cover. Premiums are payable by Direct Debit through a bank or building society or charged to your credit/ debit card when due. You will pay the first premium at the Commencement Date or after any period of free cover applicable and; I I if you are paying premiums monthly, you will pay the other premiums on or around the same date each month; or if you are paying premiums annually, the first premium will have been reduced to reflect the period of free cover, if any, and you will pay the other premiums on or around each anniversary date of the Commencement Date thereafter. For each premium you pay, we will provide cover until the next premium is due. 8 Essential Finance IDT PW 150309 Ending or changing your cover Your right to cancel this Policy in the first 14 days If, for any reason, you are not satisfied with this Policy, you may, within 14 days of receipt, telephone us on 0800 519 9917 and we will cancel it. If this happens we will refund any premiums you have paid. However, if you have made a claim in this period we reserve the right to charge you a premium commensurate with the cover that has been in force. If you want to cancel You can cancel this Policy at any time by contacting us on 0800 519 9917 or write to us at: ACE Identity Theft ACE European Group Limited 200 Broomielaw Glasgow G1 4RU We will cancel it from the date you post your cancellation instruction or any later date you give us. There is no minimum duration on your Policy. If premiums are paid annually your premium refund will be calculated on a pro-rata basis. If we want to cancel If we no longer wish to offer this Plan and need to cancel your Policy we will write to you at the latest address we have for you. We will then cancel your Policy 30 days after our letter. If premiums are paid annually your premium refund will be calculated on a pro-rata basis. We may cancel your Policy or revise the covers and benefits, but we will do this only when we cancel or revise all Policies which we have issued under this Plan. When cover automatically ends All cover under your Policy will end: I if you stop paying premiums - from the date you owe us a premium; or I when you die; whichever happens first. The time cover will end Cover will stop at midnight on the day the cover ends. What happens to the premiums when cover ends? If you have paid a premium for any period after cover ends, we will refund it. If you owe any premiums up to the date cover ends, we will ask you to pay them. If we want to make changes to the Policy or premium We reserve the right to make changes or add to these Policy terms and to change the premiums applicable: I for legal or regulatory reasons; and/or I to reflect new industry guidance and codes of practice; and/or I to reflect legitimate costs increases or reductions associated with providing this Plan. If changes become necessary, they will be applied to all Policies issued under this Plan. We will not make changes which apply only to your Policy. We will write to you with details at least 30 days before we make any changes. You will then have the option to continue with, or to cancel, the Policy. Should you request us to cancel the Policy we will comply with your request either from the date we receive your letter or from any later date you give us. 9 Essential Finance IDT PW 150309 Making a claim How to claim If you think that you have been a victim of Identity Theft, the Administrator must be notified as soon as possible, but in any event within 24 hours of discovering your identity may have been used for fraudulent purposes. The Administrator may be contacted: a) by calling the Identity Theft helpline 0800 013 9950 between 8.00am and 8.00pm Monday to Friday and 10.00am to 4.30pm on Saturdays and Bank Holidays; or b) by writing to ACE Identity Theft, Ravens Court, Brewery Lane, Bridgend CF31 4AP NOTES: 1. Your claim will be allocated to a case specialist provided by the Administrator who will be your contact throughout the claim. 2. The Administrator will initially discuss your circumstances and provide you with individually tailored assistance. If necessary, the Administrator will then refer you to the Credit Reference Agency or to us for further advice. 3. The Administrator and/or the Credit Reference Agency will tell you what actions you need to take and when you need to take them and assist you in doing so where possible. 4. The advice we, the Administrator and/or the Credit Reference Agency provides will concentrate on the fraudulent use of your identity in the United Kingdom. Claims provisions 1. You must inform the Police, relevant Banks, Building Societies, payment and store card issuers or any other organisation through which the Identity Theft is being (or may be) perpetrated as soon as possible, but in any event within 24 hours of discovering that your identity may have been lost or stolen and/or used for fraudulent purposes. You must obtain a Police crime reference number. 2. You must arrange to be registered with CIFAS (the UK’s fraud prevention service). The Administrator and/or the Credit Reference Agency will assist you to do this. 3. You must request a statutory Credit Report from each of the credit reference agencies in the United Kingdom. The Administrator and/or the Credit Reference Agency will provide instructions on how to do this. 4. You must obtain authorisation before incurring any expense, take all reasonable steps to keep your claim costs and expenses as low as possible and, where possible, prevent any continued use of your stolen identity. 5. We have sole control of any Legal Expenses and all related negotiations. You must make no admission or settlement and must not enter into any correspondence or exchange of communications in respect of the claim without our prior authorisation. You shall provide us with all assistance, information and authority, including performing all actions, and executing all documents and/or deeds, necessary for them to perform their obligations under this insurance. 10 Essential Finance IDT PW 150309 6. You must complete and return the claim form to us within 14 days of receiving it, ensuring that you have followed the procedures detailed on the claim documentation and that any documentation requested has been included. 7. You must keep books, receipts, bills and other records to prove the amount of any Loss or expenditure. We will not be able to provide reimbursement without proof of expenditure. We will ask you to forward appropriate documentation to us when we require it. 8. You must keep all letters and documentation received from any third party involved in your claim for Identity Theft. We will ask you to forward the documentation to us when we require it. 9. You will be required to prove Loss of Income. You will be required to provide evidence, details of which will be provided by us, at the time you need to claim. Paying claims If you have a claim, we will deal with it based on the cover details shown in the last Policy Schedule we sent you before the Identity Theft was discovered. Loss of Income and Driving Licence or Passport Replacement benefits will be paid to you directly and your receipt shall be a full discharge of all liability by us in respect of the claim for such Benefit Amount. Legal Expenses benefits will be paid by us to the solicitor directly and receipt shall be a full discharge of all liability by us in respect of the claim for such Benefit Amount. Interest No sum payable under this Policy shall carry interest unless payment has been unreasonably delayed following our receipt of all the required information, documents or other evidence necessary to support the claim. Your commitment to the Policy You must keep to the terms of this Policy. If you do not, we may not accept a claim. Fraud The personal details you supplied to the Administrator and us during the enrolment process will be used to combat fraud. These details will be retained for legal reasons for a reasonable period after your Policy expires, and for up to one year after your Policy expires in relation to fraud specifically. The contract between you and us is based on mutual trust. If you (or anyone acting on your behalf): a) applies for a Policy for any person other than you, or provides information you know or should know to be false; or b) applies for access to (and/or makes use of) information to which you are not legally entitled; or c) makes a claim under the Policy knowing the claim to be false or fraudulently exaggerated in any respect; or d) makes a statement in support of a claim knowing the statement to be false in any respect, or submit a document in support of a claim knowing the document to be forged or false in any respect; or makes a claim with the intent to defraud us, the Administrator or the Credit Reference Agency; 11 Essential Finance IDT PW 150309 Making a claim then: I I I I I we shall not honour the claim; we shall not honour any other claim which has been made under this Policy; we shall not make any return of payments made for cover and we may, at our option, cancel the Policy; we may be entitled to recover from you the cost of any claim already paid under this Policy (if necessary the cost may be recovered through the instigation of court proceedings); we may be entitled to recover from you the cost of any investigation into a fraudulent claim under this Policy (if necessary the cost may be recovered through the instigation of court proceedings); and I we, and/or the Administrator and/or the Credit Reference Agency may inform the Police, Government or regulatory bodies of the circumstances; If we or the Administrator or the Credit Reference Agency has a reasonable suspicion of fraud, then we and/or the Credit Reference Agency reserve the right to cancel your access to the Credit Reference Agency website. I Information on CIFAS CIFAS, the UK’s fraud prevention service, is a non-profit-making organisation dedicated to the prevention of financial crime. Among other initiatives, CIFAS helps prevent the misuse of individuals’ identities through the sharing of information and the use of identity protection tools. The organisations that co-operate with CIFAS are committed to sharing information and expertise to develop best practice in the field of fraud prevention. The company is managed by a board of directors. The voting directors are elected by the membership. The company works closely with the National Consumer Council, The Information Commissioner, The Office of Fair Trading and the Police. More information can be obtained from the CIFAS website www.cifas.org.uk 12 Essential Finance IDT PW 150309 Data Protection Each of we, the Administrator and the Credit Reference Agency is a data controller (as defined in the Data Protection Act 1998) of the information which any of us collects about you in connection with this Plan. The information we collect about you is made up from the details you give to any of us during your relationship with us and includes information you give any of us or our agents or service providers in respect of this Plan or from your subsequent requests and instructions, and other information any of us or our agents or service providers gain about you from managing this Plan. Each of we, the Administrator and the Credit Reference Agency will use this information for the following purposes: (a) to administer this Plan, in particular to provide you with the insurance cover and Credit Reference Services specified in this Plan; (b) to comply with legal and regulatory requirements; (c) to carry out credit checks, to detect, investigate and prevent fraud and to trace debtors; and (d) for internal analysis and research. Each of we, the Administrator and the Credit Reference Agency may use agents and service providers to collect, hold and process on our behalf your personal information for the purposes set out above. Each of we, the Administrator and the Credit Reference Agency may disclose your personal information to: (a) each other and our agents and service providers for the purposes set out above; (b) credit reference agencies, the police, Government departments and agencies for the purposes of carrying out credit checks, detecting, investigating and preventing fraud and tracing debtors; and (c) any person for the purpose of complying with legal and regulatory requirements. In addition, unless you have informed us otherwise, we may use your information to contact you by post or telephone to let you know about any goods, services or promotions that we think may be of interest to you. We may use agents and service providers to collect, hold and process on our behalf your personal information for this purpose. You have the right to withdraw your consent to our use of your information for this purpose at any time. Each of we, the Administrator and the Credit Reference Agency may monitor and/or record your communications with us, either ourselves or by reputable organisations selected by any of us, to ensure consistent servicing levels and account operation. Each of we, the Administrator and the Credit Reference Agency may transfer your information to, and store it at, a destination outside the European Economic Area. It may also be processed by staff operating outside the European Economic Area who work for any of us or for one of our agents or service providers. Some of these destinations may not have data protection laws that protect your information to the same extent as the European Economic Area, but each of us will ensure that your information is properly protected, irrespective of where it is processed. Each of we, the Administrator and the Credit Reference Agency will take appropriate steps to help prevent the loss, misuse or unauthorised disclosure of your personal information and will try, with your help, to keep such information accurate and up to date. 13 Essential Finance IDT PW 150309 Data Protection You have the right to ask for a copy of the information we, the Administrator and the Credit Reference Agency hold about you (for which a small fee may be charged).
