                  On 7/4/2004 the Court designated this matter as complex litigation under the
19
     California Standards of Judicial Administration.
20
                  The purpose of this order is to establish a case management plan for this complex
21
     litigation in order to avoid inconsistent or duplicative rulings, reduce the costs of litigation, assist
22
     the parties in resolving their disputes and reduce the costs and difficulties of discovery and trial.
23
     This complex case management order supersedes all prior complex case management orders in
24
     this case.

                  On any matter about which this order is silent, the Code of Civil Procedure, other
26
     statutes, the California Rules of Court, and the local rules of this Court shall be controlling.
27
                  On Wednesday January 17, 2007at 1:30 pm a complex case management
28
     conference was conducted in this matter. An unofficial copy of this Order may be posted on the

17                  Plaintiffs James Fletcher and Mike Bustanchury, as putative class representatives,

18   have reached a tentative class and sub-class settlement with Defendant Brown & Brown of

19   California, Defendant Whilt Fatch & Perry Insurance Services, Defendant United Restaurant

20   Insurances Services, and Defendant Leon Toppin. The parties intend to move this Court for

21   preliminary approval of the class action settlement, with the moving papers to be filed no later

22   than February 28, 2007. The parties intend to move, in conjunction with their Application for

23   and Order Granting Preliminary Approval, for an order shortening time for hearing that

24   Application so that notice to the class can be given.

 4                   Plaintiffs filed a class certification brief on December 6, 2006.
 5                   As described above, a tentative class action settlement has been reached with
 6   Defendants Brown & Brown of California, Defendant Whilt Fatch & Perry Insurance Services,
 7   United Restaurant Insurances Services, and Leon Toppin, subject to preliminary and final
 8   approval by the Court Defendant Brown & Brown of California, Defendant Whilt Fatch & Perry
 9   Insurance Services, Defendant United Restaurant Insurances Services, and Defendant Leon
10   Toppin.
11                   As a result, Plaintiffs have requested that the Court take the motion for class
12   certification off calendar. If preliminary or final approval is not granted, Plaintiffs will request
