4 CITY OF MARGATE, FLORIDA, APPENDIX A
5 ZONING, ARTICLE XXII. SIGN CODE,
6 AMENDING SECTION 22.2 DEFINITIONS;
7 AMENDING SECTION 22.17 PROHIBITED
8 SIGNS; PROVIDING FOR DEFINITION AND
9 REGULATION OF HUMAN SIGNS; PROVIDING
10 FOR REPEAL; PROVIDING FOR SEVERABILITY;
11 PROVIDING FOR CODIFICATION; PROVIDING
12 FOR AN EFFECTIVE DATE.

14 BE IT ORDAINED BY THE CITY COMMISSION OF
15 THE CITY OF MARGATE, FLORIDA:

17 SECTION 1: THE CODE OF THE CITY OF MARGATE,
18 FLORIDA, APPENDIX A, ARTICLE XXII. SIGN CODE,
19 SECTION 22.2 Definitions is hereby amended to
20 read as follows:

22 Human sign: A person wearing a costume or
23 holding a sign or other display while outside for
24 the purpose of advertising a business, product,
25 or service.

30 SECTION 2: THE CODE OF THE CITY OF MARGATE,
31 FLORIDA, APPENDIX A, ARTICLE XXII. SIGN CODE,
32 SECTION 22.17 Prohibited signs is hereby amended
33 to read as follows:

35 (34) Human signs, when the person holding
36 a sign or other display is seated, when the
37 person holding a sign or other display is seated
38 or standing on a prop, and also anytime a person
39 shakes, swings, oscillates, waves, rotates,
40 twirls, or throws the sign or display. Human
41 signs shall not be permitted on any public street
42 or public median.

3 SECTION 3: All ordinances or parts of ordinances
4 in conflict herewith are and the same is hereby repealed
5 to the extent of such conflict.

7 SECTION 4: If any section, sentence, clause, or phrase
8 of this ordinance is held to be invalid or
9 unconstitutional by a court of competent jurisdiction,
10 then said holding shall in no way affect the validity of
11 the remaining portions of this ordinance.

13 SECTION 5: It is the intention of the City Commission
14 that the provisions of this ordinance shall become and be
15 made a part of the City of Margate Code, and that the
16 sections of this ordinance may be renumbered or relettered
17 and the word "ordinance" may be changed to "section",
18 "article" or such other appropriate word or phrase in
19 order to accomplish such intentions.

21 SECTION 6: This ordinance shall become effective
22 immediately upon adoption at its second reading.
