I - INTRODUCTION

COMMUNITY-BASED RESPONSE RESOURCE GUIDE Eastern Charlotte Waterway developed this resource guide under the direction of the Community Action Partnership Program (CAPP). This guide was developed not only for oil spill response, but also for all environmental responses. In case of any such emergencies, please contact the Canadian Coast Guard Operation Centre at 1-800-565-1633. They will receive your calls 24 hours a day and notify the appropriate Government agency. *(Gasoline and chemical spills should also be reported to your local fire department.)

III NOTIFICATION ENVIRONMENTAL EMERGENCY NUMBER

IN THE EVENT OF AN OIL SPILL OR AN ENVIRONMENTAL EMERGENCY, PLEASE CALL - 1-800-565-1633 (24 HOURS) Your contact will be the Canadian Coast Guard Operations Centre, who will notify the appropriate government agencies. When reporting an incident to the operations centre, callers should give their name (optional), telephone number, and the time the spill or environmental emergency was sighted.

HERE ARE A FEW IMPORTANT THINGS YOU SHOULD TRY TO NOTE WHEN YOU REPORT A SPILL OR AN EMERGENCY: • • • • • • What is spilled, how much, and where it is located? Is the spill on land, in the water, and is it moving? Do you know the source of the spill? Is the spill an immediate threat to public safety? What type of environmental emergency is it? What the extent of the damage is.

IV COMMUNITIES ROLE

GENERAL

The community will identify local resources and sensitivity information.

The community will also maintain and update the community-based response resource guide with the assistance of Canadian Coast Guard and various organizations.

The community will work with the responding agencies to determine the definition of interface, roles and responsibilities.

V LEVELS OF RESPONSIBILITIES

A) POLLUTER (RESPONSIBLE PARTY) The polluter (responsible party) has the first responsibility for initiating effective action to counteract an environmental emergency. The polluter also has financial responsibility for damage and cleanup costs incurred as a result of a spill or environmental emergency. The responsibility is subject to any liability arrangements or limitations provided by statute or court decisions, or by international conventions in force and ratified by Canada at the time of the incident. If the polluter chooses not to initiate cleanup actions or if the situation is of such magnitude that the polluter is unable to respond adequately; or if the polluters response is inappropriate, ineffective, or unsafe then the Coast Guard will appoint an on-scene commander and assume command and control of the situation.

B) CANADIAN COAST GUARD THE CANADIAN COAST GUARD HAS THE LEAD ROLE IN RESPONDING TO THOSE MARINE EMERGENCIES WHEN: 1. Department of Fisheries & Oceans, by legislation, regulation, interagency agreement and precedent, has been authorized. 2. Assignment of authority has not been established but the Federal Government instructs the Department of Fisheries & Oceans, because of its authorities, marine expertise and resources, to lead the response. The Canadian Coast Guard is responsible to investigate and act as lead agency for spills originating from vessels within "waters of Canadian interest", under it's jurisdiction. In these cases, the CCG is responsible to ensure that the vessel owner complies with the Canada Shipping Act (CSR) and accepts responsibility for cleanup. The Canadian Coast Guard is also responsible for mystery spills.

C) DEPARTMENT OF FISHERIES & OCEANS The Department of Fisheries & Oceans is responsible for managing and providing information and advice regarding fisheries resource and their habitats, as well as scientific advice in relation to fish. Also, they have a major responsibility under the fish inspection act to ensure the contaminated product does not enter the market and that the public health is protected.

D) ENVIRONMENT CANADA Environment Canada, Environmental Protection Branch (EPB) leads the investigation of spills originating from Federal facilities and Federal vessels. EPB also has shared responsibilities with Fisheries & Oceans for spills impacting waters frequented by fish, under the Canadian Fisheries Act and the Canadian Environmental Protection Act. EPB is responsible for ensuring that regional mechanisms are in place for timely and effective environmental emergency response efforts. To this end, the Regional Environmental Emergencies Team (REET) has been organized to provide consolidated, coordinated and comprehensive environmental information and advice concerning environmental impacts, resource sensitivities, environmental forecasting, contingency planning, cleanup techniques and priorities, and a host of other matters which arise while planning and responding to emergency events which affect or risk environmental quality. While REET is chaired by Environment Canada, EPB, it includes a large number of Federal and Provincial agencies that have expertise, information and responsibilities/authority relevant to environmental emergencies and environmental protection. Private industry and industry associations also participate in REET as they have significant interest in emergency response. Coastal communities will link into the REET process through the regional Community Action Partnership Program (CAPP) coordinator.

E) OFFICE OF CRITICAL INFRASTRUCTURE, PROTECTION & EMERGENCY PREPAREDNESS (OCIPEP) This agency has the mandate to advance civil preparedness in Canada for emergencies of all types... by facilitating and coordinating among Federal institutions and in cooperation with Provincial Governments, Foreign Governments and International Organizations, the development and implementation of civil emergency plans.

F) NATURAL RESOURCE CANADA (NRCAN) In the maritime region, EMR maintains the Atlantic Geo-science Centre to provide scientific advice in the area of coastal geomorphology, to determine the impact of cleanup methods on beaches and to conduct research aimed at better understanding beach process throughout Atlantic Canada. Atlantic Geo-science Centre can also provide technical advice on chemical and toxic substances and their interaction with coastal and marine sediment, and shoreline video coverage.

G) CANADA-NOVA SCOTIA OFFSHORE PETROLEUM BOARD Under the Canada-Nova Scotia accord implementation act, CNSOPB is responsible for environmental as well as health and safety matters associated with oil and gas activity. CNSOPB is the lead agency for response to spills associated with exploration and production activity in their area.

H) PROVINCIAL EMERGENCY MEASURES ORGANIZATIONS (NBEMO, NSEMO, PEIEMO) Provincial emergency measures organizations are lead agencies for incidents where public safety is the prime concern and can provide assistance to other lead agencies as required (e.g. evacuation, search and rescue, surveillance).

I) TRANSPORT CANADA - TRANSPORT OF DANGEROUS GOODS Transport of Dangerous Goods inspectors are responsible for the enforcement of the transportation of dangerous goods regulations as they apply to land, water, and air transport. TDG maintains a 24-hour national response centre named CANUTEC, and provides investigations during transport emergencies involving chemicals and other dangerous goods. CANUTEC is the Canadian Transport Emergency Centre. It is located in Ottawa and is operated by the Transport of Dangerous Goods directorate of Transport Canada. In an emergency, CANUTEC may be called collect at (613) 996-6666 (24 hours). CANUTEC provides a national bilingual advisory service and is staffed by professional chemists. Experienced and trained in interpreting technical information and providing emergency response advice when an emergency call is received by CANUTEC. The emergency response advisor obtains relevant information about the emergency and recommends the appropriate response actions for the protection of the public and for the stabilization and containment of the dangerous goods involved.

J) ROYAL CANADIAN MOUNTED POLICE (RCMP) The RCMP responsibilities at the accident site are for traffic and crowd control, dealing with casualties, explosives disposal, bomb threats, evacuations and investigation of criminal matters. By virtue of being first on the scene, the RCMP may also be obligated to handle initial spill containment.

K) CANADIAN HERITAGE, PARKS CANADA Parks Canada operates and maintains a significant number of national parks and heritage sites in the Atlantic Region. All the National parks have contingency plans to respond to environmental emergencies under their jurisdiction. Emergency section of EC liaises closely with Parks Canada staff during large incidents to share response resources and minimize the environmental impacts.

L) PROVINCIAL DEPARTMENT OF ENVIRONMENT (NS, NB, PEI) The Provincial Department of Environment acts as lead agency for spills that fall under Provincial jurisdiction and are responsible for the designation of disposal sites and disposal procedures. In addition, are a resource agency for human resources, surveillance, cleanup and environmental advice and where appropriate, soliciting input from other provincial government agencies such as fisheries, health, mines and energy. The Provincial Environment Dept. investigates spills originating from land-based sources or sewers or spills affecting potable water supplies.

VI RESPONSE ORGANIZATION ROLES

A) GENERAL The response organizations have been created to ensure that a capability exists to deal with oil spills in the Canadian Marine Environment. Every bulk oil tanker over 150 gross tonnes, every dry cargo vessel over 400 gross tonnes, and all designated Oil Handling Facilities (OHF's) are required by the Canadian Shipping Act to have an arrangement with a certified response organization. The entire above is referred to as "clients" by the response organization. The response organization may respond to a client's request for assistance in the event their property is involved in an oil spill. The response organization may provide operational management for the client who is the "responsible party" in the event of a spill. OPERATION MANAGEMENT INCLUDES: LOGISTICS: the procurement of resources to support the operation. PLANNING: the identification of sensitivities, shoreline impact assessment, prioritization of activities, waste disposal coordination, application of cleanup techniques, health and safety plan development, and documentation. OPERATIONS: the application of the procured resources. FINANCE: payment of costs incurred by the response organization and invoicing for services rendered. THESE DEFINITIONS ARE RESPONSE ORGANIZATION DOCTRINE. The response organization is not responsible for the effects of an oil spill. This remains with the polluter. Command and control of all activities remains with the polluter. In the event the polluter does not accept this role, the Canadian Coast Guard assumes "command and control" of the incident and the response organization may be hired by the Canadian Coast Guard. The response organization will also plan for the protection of the identified sensitivities prior to oil spills occurring in its geographic area of response and will work with communities to this end.

XI ENVIRONMENTALLY SIGNIFICANT AREAS

Areas of environmental significance around Deer Island and among the West Isles are each diverse and unique in their recognized qualities. This is a list of the environmentally significant areas in the Deer Island and West Isles area.

1. Hardwood Island - The Island is an important stopover for migratory birds. 2. Wolves/S. Wolf & Spruce Island - Rare plants as listed by Hinds (1983 & 1986). An important breeding area, including the Harlequin ducks. 3. Robert M Stewart Nature Preserve - Fundy ecology with high bluffs, white spruce, and some coastal salt marsh; One bald eagle nest. 4. White Horse Island - This Island is noted for its bird breeding colonies. 5. White Island - The Island supported a pair of breeding Bald eagles in the past. 6. Pendleton’s Island - UNBSJ leased the island in 1986; The Island is important for its very high diversity of land and marine ecosystems. In the process of being turned over to the Nature Conservancy of Canada 7. Mohawk Island - This Island has a Great Blue Heron colony. 8. Head Harbour Passage - This turbulent area of high marine productivity attracts a very large concentration of seabirds; Black-crowned Night Heron found here. 9. Deer Island Archipelago - An abundance of zooplankton-basis of the food; Bird breeding colonies (including Bald Eagles); Right and Humpback whales are regular visitors. 10. Dick's Island - Nesting Island for Eiders and Herring Gull.

34.1 NO RAMP BOAT LAUNCHING SITES (Datum: NAD 83) Richardson Landing Gravel beach slipway. Accessible most all tides. Located next to non-operating Deer Island Sea Urchin plant. 66°56’49” 44°59’37” Leonardville Slipway This slipway is located on the Bar Road to Bar Island. Only useable after 3hrs. ebb tide. Paved to high water mark. Beach gravel follows. 66°57’06” 44°58’33” Deer Island Point Ferry Landing This beach has hard-packed beach gravel and is used all summer as a ferry landing. Easily accessible all tides, except winter ice buildup. 66°59’10” 44°55’42” Cummings Cove Beach This is a sandy beach area. Accessible by 4X4 only due to sand. 66°59’42” 44°56’38” Fairhaven Wharf There is a gravel slipway located next to the Fairhaven wharf. Rough gravel and stone plus a moderately steep incline make this a useable but not preferable slipway. 4X4 is advised. Only useable ½ to high tide due to mud flats. 66°59’41” 44°56’32”

Gardner’s Beach This is a gravel beach used only by salmon farmers. Beach is accessible only with 4X4. Access road property of Nordic, (pending sale to Heritage). 67°00’03” 44°59’30”

34.2 BOAT LAUNCH RAMPS Ferry Landing – Butler’s Point This wharf has two slipways. They are both cement to low water. Easily accessible all tides. Each ramp is 30’ wide. 66°56’21” 45°01’26” Deer Island Point Park Campground Hard-packed beach ramp with part asphalt, easily accessible to all vehicles. Used in summer months for both Campobello & Eastport Ferries.
