									                            ORDINANCE NO.                   OF 2006

           ORDINANCE OF THE BOROUGH OF TUCKERTON,
           COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING
           AND SUPPLEMENTING CHAPTER 255 OF THE BOROUGH
           CODE OF THE BOROUGH OF TUCKERTON ENTITLED
           “ZONING” SO AS TO REGULATE THE STORAGE OF
           BOATS, TRAILERS AND COMMERCIAL VEHICLES


       BE IT ORDAINED by the Borough Council of the Borough of Tuckerton, County of

Ocean, State of New Jersey, as follows:

       SECTION 1. Article V of Chapter 255 of the Borough Code of the Borough of

Tuckerton entitled “General Regulations” is hereby amended and supplemented to add new

Section 255-48.2 entitled “Storage of boats, trailers and commercial vehicles” which shall

read as follows:

§ 255-48.2. Storage of boats, trailers and commercial vehicles.

     The outdoor storage of an unoccupied recreational vehicle, motor home, travel trailer,
camper or boat shall be permitted on single-family properties, provided that:

A.     Such storage shall not be located closer than three feet to any side or rear lot line.

B.     The travel trailer, camper or boat shall not exceed 45 feet in length and ten feet in
       width.

C.     No travel trailer, camper, boat or boat trailer stored in conformance with this
       subsection shall remain in storage for longer than 12 consecutive months. No boat
       shall remain in storage if the registration or documentation required to operate the boat
       on the inland, lakes or coastal waters of the State of New Jersey is expired for a period
       of longer than 12 months.

D.     No travel trailer, camper or boat shall be stored on an unimproved, single-family
       residential lot which is not contiguous with a developed lot under common ownership.

E.     Any such vehicles stored in accordance with this subsection shall not be occupied and
       shall not be provided with utility connections other than required for vehicle
       maintenance and shall not be used for the storage of any nonrecreational material.
F.     No commercial vehicle with a gross vehicle weight of 15,000 pounds or greater shall
       be parked on the street or in a driveway in any residential zone except to make
       deliveries or provide services to or for residents on said street. Commercial vehicles of
       15,000 pounds or greater engaged in construction activities may be parked or stored on
       an active construction site in a residential zone for a period of no longer than 90 days.

G.     No trailer, auto trailer, trailer coach, travel trailer or camper shall be used for dwelling
       purposes or as sleeping quarters for one or more persons, nor shall any such trailer or
       camper be used for storage or space for the permanent conduct of any business,
       profession, occupation or trade, except that such facilities may be used for temporary
       residency for the temporary replacement of a damaged dwelling unit or for temporary
       use as a construction office located on a site during construction, provided that a
       temporary permit has been issued for its use by the Building Inspector. This
       subsection shall not be construed so as to prohibit the parking or storage of such
       trailers and campers on private premises or the recreational use of the same in
       campgrounds in conformance with all applicable ordinances and codes.

H.     Storage of tractor trailers or commercial trailers is governed by the provisions set forth
       in § 255-48.3 of the Borough Code of the Borough of Tuckerton.

       SECTION 2. Article V of Chapter 255 of the Borough Code of the Borough of

Tuckerton entitled “General Regulations” is hereby amended and supplemented to add new

Section 255-48.3 entitled “Storage of tractor trailers or commercial trailers” which shall read

as follows:

       § 255-48.3. Storage of tractor trailers or commercial trailers.

        No tractor trailers or commercial trailers empowered by truck tractors as defined in
N.J.S.A. 39:1-1 shall be stored or used as a storage facility on any property in the borough
except in accordance with a site plan approval or Land Use Board resolution and for a period
not to exceed 182 days.

       SECTION 3. Article V of Chapter 255 of the Borough Code of the Borough of

Tuckerton entitled “General Regulations” is hereby amended and supplemented to add new

Section 255-48.4 entitled “Enforcement” which shall read as follows:
       § 255-48.4. Enforcement.

         This section shall be enforced by the Police Department, Code Enforcement Officer

or Zoning or Construction Official of the Borough.


       SECTION 4. All ordinances or parts of ordinances inconsistent herewith are hereby

repealed.

       SECTION 5. If any section, subsection, sentence, clause, phrase or portion of this

ordinance is for any reason held to be invalid or unconstitutional by a court of competent

jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and

such holding shall not affect the validity of the remaining portions thereof.

       SECTION 6. This ordinance shall take effect after second reading and publication as

required by law.

        NOTICE IS HEREBY GIVEN that the foregoing ordinance was introduced and
passed by the Borough Council on first reading at a meeting of the Borough Council of the
Borough of Tuckerton held on the _____ day of _________, 2006, and will be considered for
second reading and final passage at a meeting of the Borough Council to be held on the _____
day of __________, 2006, at 7:00 p.m. at the Municipal Building located at 140 East Main
Street, Tuckerton, New Jersey, at which time and place, any persons desiring to be heard upon
the same will be given the opportunity to be so heard.

       The Borough of Tuckerton introduced the above ordinance at its _________, 2006
meeting. The Ordinance amends and supplements Chapter 255 of the Borough Code of the
Borough of Tuckerton entitled “Zoning” so as to regulate the storage of boats, trailers and
commercial vehicles. The Ordinance will be considered on second and final reading at the
__________, 2006 meeting of the governing body. All meetings are held at the Municipal
Building located at 140 E. Main Street, Tuckerton, New Jersey, commencing at 7:00 p.m.
Copies of all Ordinances are available at no cost at the Municipal Clerk’s Office located at
140 East Main Street, Tuckerton, New Jersey, Monday through Friday from 9:00 a.m. to 4:00
p.m.
