              SPECIFICATION NO. 2689

Summary:

This project consists of construction of a modular office building for the Port Police at 120
W. "C" Street in Wilmington, and an electrical upgrade of the former Bekin's Warehouse at
326 W. "C" Street in Wilmington. The lowest responsible bidderforthis project is California
Building Evaluation and Construction, Inc., located at 6281 Beach Boulevard #306, Buena
Park, CA 90621. The contract amount, plus contingency, is $935,000, and the contract
duration is 150 calendar days.

Recommendation:

It is recommended that the Board of Harbor Commissioners:

1.	 Find that the bid proposal from Joe's Sunrise Construction, Inc., did not meet Section
    00030.08.B of the provisions set forth in the contract specifications and therefore is
    non-responsive.

2.	 Award the above mentioned contract for Item Nos. 1 through 6 of the proposal
    schedule to California Building Evaluation and Construction, Inc., in the amount of
    $850,000; that a 10% contingency not included in the original contract amount be
    applied for a total authorized amount of $935,000; and that payment be authorized from
    the Construction Account. The contract time for performance of the work will be 150
    calendar days from the Notice to Proceed.

3.	 Authorize the Executive Director to execute and the Board Secretary to attest to this
    contract for and on behalf of the Board.

4.	 In accordance with the City Charter 655(g), delegate and authorize the Executive
    Director to accept the construction contract upon its completion.

Discussion:

1.	 The project includes:

           •	 Building a modular office at 120 W. "C" Street. The modular office was
              requested by the Port Police Division, per a memo dated December 5, 2005,
              to accommodate the additional police officers being hired due to the growth
              of the Port and the need for additional security. The construction cost for the
              modular office is $520,000.

           •	    Upgrading of the interior lighting and light fixtures at the former Bekin's
                Warehouse located on 326 W. "C" Street. The electrical and lighting retrofit
                is necessary since the existing lighting system is obsolete, does not meet
                current electrical codes, and is considered unsafe and insufficient for
                warehouse operations. In addition, light fixtures and control circuitry will be
                more energy efficient and meet current electrical code requirements. The
                Warehouse is currently occupied by two non-profit organizations with a rent­
                free revocable permit. The warehouse is in very good condition, and the
                electrical and lighting upgrade will ensure its adaptive use as part of the
                future development of the Wilmington Waterfront. The construction cost for
                the electrical and lighting upgrade is $330,000.

2.	 The Notice Inviting Bids was advertised on the Port of Los Angeles Website, and in the
    Dodge Green Sheet, Hoy, Metropolitan News, the Los Angeles Watts Times, and
    China Daily News.

3.	 As authorized by the Executive Director on November 5, 2007, the Chief Harbor
    Engineer received bids for the subject project on December 20, 2007. Twelve bids
    were received from Joe's Sunrise Construction, Inc.; California Building Evaluation and
    Construction, Inc.; NCCI, Inc.; WE Construction, Inc.; Western Group, Inc.; Sully-Miller
    Contracting Company; Chap General Contractors; W.W. Stephenson Co., Inc.; AVA
    BUilders, Inc.; 2H Construction; T&M Painting and Construction, Inc.; and Atelier
    Development Company, in the amounts shown on the attached Analysis of Bids. The
    bids received on that date were opened and declared. Joe's Sunrise Construction,
    Inc., was determined to be the apparent low bidder, subject to determination of
    responsiveness to all contract requirements.

      4.	 After review of all bid documents, the Chief Harbor Engineer, in consultation with the
          City Attorney, concluded that Joe's Sunrise Construction, Inc.'s bid was non­
          responsive. Section 00030.08.B of Specification No. 2689 states "... The Bidder shall
          complete, sign, notarize, and submit as part of the bid the Contractor Ownership
          Affidavit and the Subcontractor Information form included in the specification as
          subsections 00030-9 and 00030-9A." The Contractor Information form calls for each
          subcontract's dollar amount to be listed. The bid received from Joe's Sunrise
          Construction, Inc., did not include the dollar amounts for work to be provided by each
          subcontractor. As SUCh, the Port staff informed Joe's Sunrise Construction, Inc., that it
          intended to recommend that the Board of Harbor Commissioners declare its bid to be
          non-responsive.

         In addition, without the subcontractor dollar values, staff could not determine whether
         the requirement of Section 00022.15 "not more than 50 percent of the monetary value
         of the work shall be subcontracted" was met. The City Attorney has reviewed this
         matter and concurs that Joe's Sunrise Construction, Inc. is non-responsive.

      5. California Building	 Evaluation and Construction, Inc. have provided the required
         documents regarding the Small Business Development Program. California Building
         Evaluation and Construction, Inc., is a Small Business Enterprise (SBE); therefore they
         obtained an SBE participation level of 100%. The Department had set a minimumSBE
         participation level of 15% for this project.

      6.	 Construction staff has verified California Building Evaluation and Construction, Inc.'s
          state license and project references. In conformance with Section 10.8.4 of Ordinance
          No. 143429, certification is hereby made that California Building Evaluation and
          Construction, Inc., has executed and filed an Affirmative Action Plan with their bid. A
          notification letter has been sent to the Office of Contract Compliance as required in the
          ordinance.

      7. This contract is consistent with State of California Prevailing Wage provisions.

      8. A Coastal Development Permit is not required for this project.

Environmental Assessment:

The proposed action is a contract between the City of Los Angeles and California Building
Evaluation and Construction, Inc., to construct a modular office building forthe Port Police
and upgrade existing electrical systems at an existing warehouse in the Port to facilitate
safe operations at the Port. As such, the Director of Environmental Management has
determined that the proposed action is exempt from the requirements of the California
Environmental Quality Act (CEQA) under Article III, Section 3(4) and Section 3(6) of the
Los Angeles City CEQQ guidelines.

Financial Impact:

Funds for this contract are available in the current 2007/2008 Fiscal Year in Account No.
54510 (Capital Construction Services), Work Order Nos. 24844 and 24768, Center Nos.
1179 and 1002, and Program No. 000. It is anticipated that Funds will be expended as
follows:
                            FY 2007-2008                $200,000
                            FY 2008-2009                $735,000
                            Total                       $935,000

Although the Contractor is not obligated to perform any work under the contract in any
fiscal year in which no appropriation for the contract has been made, the Contractor agrees
to resume performance of the work required by the contract on the same terms and
conditions for a period of 50 days after the end of the fiscal year if an appropriation
therefore is approved within that 50-day period. The Contractor is responsible for
maintaining all insurance and bonds during this 50-day period. The time for performance
shall be extended during this period until the appropriation is made; however, such
extension of time is not compensable.

If in any subsequent fiscal year funds are not appropriated for work required by the
contract, the contract shall be terminated. However, such termination shall not relieve the
parties of liability for any obligation previously incurred.

    It is estimated that this construction spending will create the equivalent of 17 one-year full

    time jobs within the 5-county region.
