NOTES:
I.   Best Buy: The following provision applies to mandatory use contracts only. This contract is subject to RCW
     43.19.190(2) & RCW 43.19.1905(7): which authorizes state agencies to purchase materials, supplies, services,
     and equipment of equal quantity and quality to those on state contract from non-contract suppliers. Provided that
     an agency subsequently notifies the Office of State Procurement (OSP) State Procurement Officer (SPO) that the
     pricing is less costly for such goods or services than the price from the state contractor.

         If the non-contract supplier's pricing is less, the state contractor shall be given the opportunity by the state agency
         to at least meet the non-contractor's price. If the state contractor cannot meet the price, then the state agency may
         purchase the item(s) from the non-contract supplier, document the transactions on the appropriate form developed
         by OSP and forwarded to the SPO administering the state contract. (Reference General Authorities document)

         If a lower price can be identified on a repeated basis, the state reserves the right to renegotiate the pricing
         structure of this agreement. In the event such negotiations fail, the state reserves the right to delete such item(s)
         from the contract.

II.      State Agencies: Submit Order directly to Contractor for processing. Political Subdivisions: Submit orders
         directly to Contractor referencing State of Washington contract number. If you are unsure of your status in the
         State Purchasing Cooperative call (360) 902-7415.

III.     Only authorized purchasers included in the State of Washington Purchasing Cooperative (WSPC) and State of
         Oregon Cooperative Purchasing Program (DASCPP/ORCPP) listings published and updated periodically by OSP
         and DAS may purchase from this contract. It is the contractor’s responsibility to verify membership of these
         organizations prior to processing orders received under this contract. A list of Washington members is available on
         the Internet https://fortress.wa.gov/ga/apps/coop/Default.aspx, and a list of the Oregon members is available at
         http://www.oregon.gov/DAS/SSD/SPO/docs/orcpp-member-list.pdfcontractors shall not process state

         including Standard Terms and Conditions, and Definitions, included in the Competitive Procurement Standards
         published by OSP (as Amended).

SPECIAL CONDITIONS:

1. Current Contract Information
      This Current Contract Information (Contract Change Notice No. 10) it to add four items to Rebuilding &
      Hardfacing, Inc. portion of the Contract. All other Terms, Conditions and pricing remain unchanged.

2. Contractor Performance
   A. General Requirements: The state, in conjunction with purchasers, monitors and maintains records of
      Contractor performance. Said performance shall be a factor in evaluation and award of this and all future
      contracts. Purchasers will be provided with product/service performance report forms to forward reports
      of superior or poor performance to the State Procurement Officer.

    B. Liquidated Damages: The state has an immediate requirement for the materials, equipment or services
       specified herein. Bidders are urged to give careful consideration to the state’s requirements and to the
       manufacturer’s production capabilities when establishing a delivery date(s). The State requires total
       delivery within the number of days indicated at Attachment “A”. Additionally, a Liquidated Damages
       of two tenths of one-percent (0.002) shall be levied against the outstanding value for each normal
       workday beyond the delivery date annotated on the Purchase Order or Field Order. Officially
       recognized state and federal holidays shall not be considered normal workdays. Suppliers will not be
       held responsible for Force Majeure delays, provided that the OSP State Procurement Officer is notified
       in writing, in a reasonably timely manner. The Purchaser shall deduct such late delivery penalties from
       the Contractors invoice, when making payment.

   C. Cost of Remedying Defects: All defects, indirect and consequential costs of correcting, removing or
      replacing any or all of the defective materials or equipment will be charged against the Contractor.
3. Reports

    Contractors are required to provide the following report(s) per requirements of IFB, Section 5..:
    Sales and Subcontractor Report:
    A quarterly Sales and Subcontractor Report (attached) shall be submitted in the format provided by the Office of
    State Procurement. You can get the report electronically at https://fortress.wa.gov/ga/apps/CSR/login.aspx.
    Total purchases for each State Agency, University, Community and Technical Colleges must be shown separately.
    Total purchases for all political subdivisions and non-profit organizations may be summarized as one customer.
    Additionally, all purchases by the State of Oregon or other purchasers must be reported as an aggregate total.

    The report shall include sales information (Section A) and amounts paid to each subcontractor during the reporting
    period (Section B).

    Reports should be rounded to nearest dollar. Contractors will be provided with all necessary sample forms,
    instructions, and lists. Reports are due thirty (30) days after the end of the calendar quarter, i.e., April 30th, July
    31st, October 31st and January 31st.

         3. The blade shall be made from 7/8 inch thick              
            hot rolled steel.
         4. Punching shall be 11/16 inch square holes                
            with countersunk holes to accommodate 5/8
            inch plow bolts, punched as per WSDOT
            locations at time of order.
         5. The distance from the top edge of the blade              
            to the center of the holes shall be 1 ½ inches
         6. Shall have Tungsten Carbide inserts and will                   1 ½ Gage x ½ x5
            contain 10 to 12 percent cobalt content.
         7. Bidder shall supply manufacturers                        
            specifications that will show the grade of the
            steel used. WSDOT desirers a Density of
            13.9 to 14.6 and a Hardness of 86.8 to 89.2
            based on the Rc “A” scale.
         8. The inserts shall be a cylindrical design with           
            a dome shaped end.
         9. The tungsten carbide insert shall be drilled             
            on ¾ inch centers.
         10. The inserts shall be brazed on all sides.               
         11. All blade sections shall be free of war-page            
             and longitudinal deviation not to exceed 1/8
             of an inch over a four foot length.

  II.   Exterior Finish
        1.   The exterior finish is expected to be superior           
             craftsmanship. There shall be no welding, or
             rough, edges.
        2.   Each bit shall be primed and or painted with             
             the manufacturers standard painting process


  III. Publications:
  1. Each plow bit order shall be delivered with the                  
  manufacturer’s specifications for the type and strength
  of metal being used.
