       Under and by virtue of an order of the District Court of Edgecombe County, North Carolina, made
and entered in the action entitled “Edgecombe County and the Town of Tarboro vs. Henry Gray Stanley,
Jr. (File No.: 06-CV D-077 ),” the undersigned commissioner will on the 9th day of January, 2009, offer for
sale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in
Edgecombe County, North Carolina, in Tarboro, North Carolina at 12:00 noon the following described real
property, lying and being in Number One Township, State and County aforesaid, and more particularly
described as follows:
Being known as 818 E. Church Street, Tarboro, Nort h Carolina and more fully described as follows:

 TRACT ONE:
   All of Lot No. 5 in Block "D" as shown on the Plat as the property known as Panola Heights, copy of
which is recorded in Edgecombe Public Registry in Book 150, Page 58. For furt her reference see Deed
recorded in Book 901, Page 862, Edgecom be Registry. Being the identical property conveyed by Henry
Gray Stanley, Jr., unmarried, Angela Denise Stanley, unmarried and Alton Stanley, unmarried to Henry
Gray Stanley, Sr. by deed recorded in book 1133, Page 330, Edgecombe Public Registry. The said Henry
Gray Stanley, Jr., Angela Denis e Stanley and Alton Stanley are the only children of the late Arigaree
Stanley, who was the only child of the late Genetta Knight Burgess, the said Arigaree Stanley having
predeceased her mother, Genetta Knight Burgess, and both Arigaree Stanley and Genetta Knight
Burgess having died intestate. The said Henry Gray Stanley, Sr. died testate May 5, 1998 in Maryland
devising his property to Angel Bender, Henry G. Stanley, Jr., Alton Stanley and Clifton Knight.

TRACT TWO:
    All of Lot No. 6 in Block "D" as shown on the Plat as the property known as Panola Heights, copy of
which is recorded in the Edgecombe Public Registry in Book 150, Page 58, fronting on Church Street
38.8 feet. Being the identical property conveyed to Romaine Howard by C. H. Leggett, Trustee, by deed
dated March 3, 1937 recorded in Book 354, Page 400, in the aforesaid Registry. See also Deed from
Panola Land Company to Eliza Lewis, Book 167, Page 83, and Deed from C. E. Putnam, et ux, and W. S.
Babcock to Mack Whitley, Book 350, Page 403. This is the identical property conveyed by Jeanette
Knight (now being known as Genetta Knight Burgess) to Arigaree Stanley by Deed dated December 3,
1970 duly rec orded in Book 773, Page 465, Edgec ombe Public Registry to which Deed and Deeds
referred to therein reference is hereby made. This is also the identical property described in Deed from
Arigaree Stanley and husband, Henry G. Stanley to Genetta Knight Burgess, dated December 3, 1975,
recorded in Book 870, Page 697, Edgecombe County Public Registry. Being the identical property
conveyed by Genetta Knight Burgess to Henry Gray Stanley, Sr. by deed recorded in Book 1079, Page
470 of the Edgecombe County Public Registry. The said Henry Gray Stanley, Sr. died testate May 5,
1998 in Maryland devising his property to Angel Bender, Henry G. Stanley, Jr., Alton Stanley and Clifton
Knight.

The sale will be made subject to all outstanding city and county taxes and all local improvement
assessments against the above-described property not included in the judgment in the above-entitled
cause. A deposit of 5 percent of the successful bid will be required.
