									   Registration of Pipe Repair & Maintenance Contractors with SYABAS



                         Instructions to Contractors

1. Introduction

Pursuant to the Concession Agreement (CA) between Syarikat Bekalan Air Selangor
Sdn Bhd (SYABAS) and the State Government of Selangor to ensure 30% of
Bumiputera participation, SYABAS has set up a Bumiputera Entrepreneurs Participation
and Development Program (Program Penyertaan dan Pembangunan Usahawan
Bumiputera – PPUB).

The objective of Bumiputera Entrepreneurs Participation and Development Program
(Program Penyertaan dan Pembangunan Usahawan Bumiputera – PPUB) are as
follows:-

       (a)    To increase the participation on Bumiputera entrepreneurs
       (b)    To develop, through a special training program
       (c)    To give the opportunity to use SYABAS as platform to grow

One of the area, where Bumiputera contractors can participate in the PPUB is by
registration with SYABAS as a pipe repair and maintenance contractors.

2. Background

The Government of Malaysia and the State Government of Selangor have awarded the
privatization of the management, operation and maintenance of the water distribution
system in the State of Selangor and the Federal Teritories of Kuala Lumpur and
Putrajaya to Syarikat Bekalan Air Selangor Sdn Bhd (SYABAS) which is a subsidiary of
Puncak Niaga Holdings Bhd (PNHB) for a period of 30 years via a Concession
Agreement signed on 15 December 2004.

Among the scope in the privatization is the commitment by SYABAS to attend to all
water supply problems such as pipe bursts, pipe leaks, dirty water etc in a speedy and
efficient way in order to ensure continuous supply of treated water to the consumers in
Selangor, Kuala Lumpur and Putrajaya.

Among the major problems in the distribution system are frequent burst and leaking
pipes due to yet a large number of old pipes in the system. The pipe bursts and pipe
leaks have to be repaired quickly in order to minimize water supply disruptions to
consumers as well as to curb Non-Revenue water losses. In this year 2005 up till
December 2005, there were 75,343 cases of pipe leaks and 9,080 cases of pipe bursts
for the whole of Selangor. The breakdown of pipe bursts and pipe leaks in 2005
according to districts are as follows ;

In order to respond speedily to consumer complaints in attending to pipe bursts and pipe
leaks, SYABAS is embarking on a registration drive to register and develop sufficient
number of competent Bumiputra maintenance contractors to undertake these repair
works all over Selangor , Kuala Lumpur and Putrajaya. The registration exercise will
complement repair works which will be undertaken by SYABAS in-house maintenance
teams located at all districts.

The above table is for information to Contractor to assess the Works but does not
represent the actual works.

3. Participation in repair works

Only contractors registered with SYABAS and having a valid Registration Certificate with
SYABAS under the approved categories will be allowed to attend to daily repair works to
be assigned by the respective districts.

4. Application Form for Registration

Application Form for Registration of contractors with SYABAS may be obtained at the
following address during office hours of 9:00 am to 5:15pm;

5. Elegibility and Categories of Registration

This registration is open to all contractors registered in Malaysia and based in Selangor,
KL and Putrajaya.

The contractor must be registered with the Pusat Khidmat Kontraktor (PKK) under
“Class E and Class F” and/ or registered with CIDB Malaysia.

The categories of works to registration with SYABAS are as below:-

                                               maintenance of reservoirs and pump
                                               houses,      building     and     compound
                                               maintenance etc.

The contractor shall clearly specify the categories of registration it wishes to be
registered in the application form. The contractor must also indicate their preferred
district to be assigned in the application form. However the final decision on the
allocation of district will be at the sole discretion of SYABAS.

SYABAS reserves the right to register the contractor under one or more categories or
reject any application.

6. Basic Requirement for Repair Contractors

Repair works for pipe bursts and pipe leaks will be undertaken by SYABAS on a 24
hours a day basis including weekends and public holidays. Repair contractors selected
by SYABAS are required to correspondingly be on standby 24 hours a day basis
including weekends and public holidays.

Each repair contractor will also be required to place on standby and in good working
condition, all the necessary equipment for the repair works which shall include but not
limited to the followings;

       Water pumps                                                  (2)
       Small tools such as spanners, spades, hoes etc               ( 1 set )
       Portable pipe cutter                                         (1)
       Safety signboards                                            ( 1 set )
       Backhoe                                                      ( Preferably owned )
       Vibrating plate compactor.                                   ( 1 set )


7. Materials for Repair Works

Generally, contractors are required to purchase the necessary material for repair works
however, materials such straight pipes, valves, fittings and specials for repair works shall
also be provided by SYABAS and to be collected at SYABAS designated store at district
office as mentioned in the tender document.

8. Safety Requirements

All selected contractors are required to keep and maintain a minimum set of standard
safety signboards as attached and obtained from SYABAS approved suppliers. Failure
to keep and maintained the safety signboards will cause SYABAS to suspend the
contractor from undertaking any repair works until it has convinced SYABAS that the
safety signboards are in place again. Sufficient signboards, T-shirts, caps and safety
vests for contractors are also required.

9. Quality of Repair & Reinstatement Works

Contractors are required to adhere strictly to SYABAS’s standards and specification as
specified in the “Arahan Teknikal (AT) No. 1”. Contractors are also required to sign the
undertaking that they abide by this “Arahan Teknikal (AT) No. 1”.

10. Rates for Repair Works

A standard rate for all type of repair works will be established by SYABAS and will be
informed to the contractors before the official appointment. The standard rates shall take
into account, among other things, standby cost, distance, time of repair ( day or night),
type of repair etc.

11. Compulsory Documents to be submitted

The following documents are compulsory documents to be submitted together with the
application form;
        a. Company Particulars.
        b. Company Status & Capital Structure.
        c. Shareholders of company.
        d. Categories for the contractor register.
        e. List of the contractors plant and equipment (owned, hire etc).
        f. Present Work in hand.
        g. Past experiences of undertaking water related works, sewerage works or
           other similar projects of similar nature for the past 5 years.
        h. Registration with Statutory of Authorities or Company.
        i. Financial & Bankers Reference.
        j. Organization Structure of Company.
        k. Individual CV of the company’s management team.
        l. Declaration form.
        m. Copies of documents confirming Bumiputera status from Kementerian
           Kewangan Malaysia or any other approved Authorities if any.
        n. Copies of registration certificates with PKK, CIDB or other Authorities.
        o. Certified copies of the last 3 months financial statement of the contractor.
        p. Company brochures or Annual Reports.

12. Processing Fees

No processing fee is required.

13. Confidentiality of Documents

All documents submitted shall be owned by SYABAS. While care is taken by SYABAS to
maintain its confidentiality, the contractor shall indemnify SYABAS from any form of legal
action should the information given to SYABAS is disclosed to any third party for the
purposes of verification and confirmation. The contractor shall clearly indicate the
confidentiality of any document in order for extra care and precautionary measures be
taken by SYABAS to maintain its confidential status.

14. Further Clarification

Should further clarification is required by SYABAS during the evaluation process, the
contractor shall provide all the necessary documents within the prescribed time. If the
contractor fails to respond to the clarification request within the prescribed time, the
evaluation of the application shall be made entirely through the submitted documents.

15. Evaluation and Scoring

The Evaluation Committee who may evaluate the application in the best interest of
SYABAS will evaluate all applications. The Evaluation Committee may request for
further information to be submitted by the applicant in order to verify information
submitted earlier and the applicant shall henceforth reply to the request within the time
stipulated.

Each application will be evaluated for the following categories and the points will be
given accordingly. In order to qualify for registration, each contractor must be able to
meet the minimum total points required as set forth by the Evaluation Committee.

In order to qualify for registration, each contractor must be able to score a minimum
Total Points of 30 and meeting the Minimum Score to Qualify for each category.

16. Issuance of Registration Certificate

All qualified contractors will be issued with a registration certificate for a period of two (2)
years from the date of issuance.

17. Validity of Registration

The registration certificate will be valid for a period of two (2) years from the date of
issuance. Further extension of the registration will be at the discretion of SYABAS after

due consideration is given to the performance of the contractor during the period of
registration.
18. Deregister

The Contractor’s performance in attending to repairs are implementing of repair and
maintenance works, shall be exceed in a regular basis during for two (2) years. Should
the Contractor is find not to be performing the company shall Deregister Contractor off
the List of Registered Contractor and the Contractor will not be allowed to participate in
any of SYABAS’s Works.

19. Cost for Preparation of Application

All costs direct or indirect to this application shall be borne by the contractor.

20. Submission of Application

Two (2) sets of application (Original & Duplicate) complete with all relevant supporting
documents shall be submitted to the following address not later than 12:00 noon on
the 3rd February 2006;
