Enclosure Recycled/Recyclable " Printed with Vegetable Oil Based Inks on Recycled Paper (Minimum 50% Postconsumer content) Internet Address (URL) . http://www.epa .gov OSWER # 9200.2-51 FY 2005 REPORT TO CONGRESS SUPERFUND FIVE-YEAR REVIEWS PURPOSE : The U.S. Environmental Protection Agency (EPA) is responsible for reviewing Superfund remedial actions at least every five years where hazardous substances, pollutants, or contaminants will remain on site above levels that allow for unlimited use and unrestricted exposure . EPA is also responsible for preparing a report to Congress on these reviews . BACKGROUND : Section 121(c) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), as amended, states : "If the President selects a remedial action that results in any hazardous substances, pollutants, or contaminants remaining at the site, the President shall review such remedial action no less often than each S years after the initiation of such remedial action to assure that human health and the environment are being protected by the remedial action being implemented. In addition, ifupon such review it is the judgment of the President that action is appropriate at such site in accordance with section 9604 or 9606 ofthe Title, the President shall take or require such action. " CERCLA also requires that EPA report to Congress information regarding these sites for which the reviews are required . This report provides a list of sites, information about sites where additional work is required, and contacts for additional information. FINDINGS : The attached table presents a list of statutory five-year reviews for non-Federal sites and NPL Federal facility sites, including the following: . Reviews Reviews Reviews Reviews due in FY 2005, currently completed ; due in prior or later fiscal years, but completed in FY 2005 ; due in FY 2005, still pending ; and due in prior fiscal years, still pending. For non-Federal sites, a total of 163 sites required five-year reviews in FY 2005 . 162 reviews were completed for 161 of the 163 sites requiring reviews . Another 13 reviews, due in other fiscal years, also were completed, bringing the total number of nonFederal site five-year reviews completed to 175 . For Federal facility sites, a total of 24 sites required five-year reviews in FY 2005 . Reviews for 22 of the 24 sites requiring reviews were completed . Another ten reviews that were due at nine sites in other fiscal years also were completed, bringing the total number of Federal facility five-year reviews completed to 32 . In all, the total number of five-year reviews completed for both non-Federal and Federal facility sites was 207. The remedies at 15 of these sites (or portions of the sites) required additional work or additional study. For these sites, implementation ofthe recommendations in the five-year review reports are underway . For FY 2005, two Federal facility five-year reviews remain pending. The Federal Agencies responsible for producing the five-year review report are aware that these reports are due and are working to complete them. Five-year reviews at two non-Federal facility sites also are pending. In addition, two five-year reviews (one Federal facility site and one non-Federal facility) that were due in fiscal years prior to FY 2005 remain pending. EPA expects that these six reviews will be completed in the near future . The five-year reviews contained in this report are publicly available . The statement that is considered "least protective" is used as the general determination for the review in this report. For example, if one operable unit is protective but another operable unit has protectiveness deferred, the determination for the entire review will be protectiveness deferred. Protective - The remedy is protective of human health and the environment. Short-Term Protective - The remedy is protective of human health and the environment in the short-term . This statement is generally used when the remedy is protective but requires further actions or institutional controls to remain protective in the long-term. Will Be Protective - The remedy is expected to be protective of human health and the environment completion, and in the interim, exposure upon pathways that could result in unacceptable risks are being controlled . This statement is generally used for remedies that are under construction . Protectiveness Deferred - A Protectiveness determination of the remedy cannot be made until further information is obtained . Generally, reviews that include this determination identify both the timeframe necessary to obtain the information actions and so a Protectiveness determination can be made through an addendum to the five-year review report . Not Protective - The remedy is not protective of human health and/or the environment . For example, a new exposure pathway may be identified or a remedy may not be able to meet a new cleanup reviews that include this determination level. Generally, identify actions that need to be taken to ensure protectiveness .
