					                             Terms of Reference for
             Appointment of a Pre-Shipment Inspection (PSI) Agent
       for Procurement of 17.5 million Compact Fluorescent Lamps (CFLs)
Background
Govern ment of the People’s Republic of Bangladesh (GOB) has taken a program to procure and distribute 17.5
million Co mpact Fluorescent Lamps (CFLs) in high -energy demand areas of the country in exchange of
incandescent lamps under the Efficient Lighting Init iatives of Bangladesh (ELIB). The purpose of the ELIB
program is to reduce peak electricity demand by replacing incandescent lamps with energy efficient CFLs that will
reduce the persistent gap in supply and demand of electricity in Bangladesh.

GOB has received a credit fro m the International Develop ment Association (IDA) towards the cost of procuring
17.5 million CFLs, and associated services for the Pre-Ship ment Inspection (PSI) of the CFLs to be procured,
distributing the CFLs in exchange of incandescent lamps, destruction of the incandescent lamps collected etc. The
Rural Electrification Board (REB) (the client) will be the implementing agency for procuring of the CFLs and
appointing the PSI agent.

REB has already floated tender for procurement of 17.5 million CFLs under International Co mpetitive Bidding
(ICB) against 8 lots:

            Lot No.   ELIB-6.2 for 300,000 Nos. CFL o f 13~14 watts.
            Lot No.   ELIB-6.3 for 300,000 Nos. CFL o f 20~23 watts.
            Lot No.   ELIB-6.4 for 300,000 Nos. CFL o f 20~23 watts.

Any bidder can participate in any or all lots. The tender is expected to be awarded by mid-January 2011 with
delivery at ‘first carrier’ in February 2011. Appropriate samples from the production batches/consignment meant
for supply to the ELIB p rogram, will be collected by the appointed PSI agent fro m the manufacturing facility(ies)
for testing at Efficient Lighting Initiative (ELI) certified testing laboratories. Prior to shipment of the products,
physical inspection will be carried out to ensure that the right products are shipped.
Objecti ve of Services
The objective of the PSI services will be to ensure that all (either one or eight different) manufacturer(s)/ supplier(s)
supply CFLs that are in comp liance with the requirements of REB as mentioned in the technical specifications and
associated testing procedures/protocol included in the contract document with the manufacturer(s)/ supplier(s)/ of
CFLs.
Scope of Services
The PSI agent in conjunction with the manufacturer(s)/supplier(s) are required to make a plan for comp leting the
tasks of sample collection, identifying and making arrangements with an ELI certified test laboratories, sending
samples to ELI certified test laboratories, and pre-shipment inspection so that the manufacturer(s)/supplier(s) could
meet the delivery schedule mentioned in the contract document. The services of the PSI agent will include:

i)       Draw samples for testing fro m the production batch/consignment to be supplied to REB. The PSI agent will
         propose the exact methodology, size and nu mber of samp les to be collected and these are to be agreed with
         REB;

ii)      Send the collected samples for tests at Efficient Lighting Init iative (ELI) certified test laboratories. The
          testing parameters are described at Sections GCC 26.1 and 26.2 of the bidding document for procurement
          of CFLs (available at www.reb.gov.bd). The PSI agent will present the testing schedule in agreement with
          REB within the context of the delivery schedule of the CFLs ;
iii)     Inspect quality assurance documents and shipping documents in accordance with a pre -determined
          inspection protocol supplied by REB;

iv)      Interpret and analyze test reports to determine whether the consignments ready to be shipped are in
          compliance with the technical specifications of the contract document with supplier(s)/ manufacturer(s);
v)      Pre-ship ment inspection of CFL of each shipment under each lot including packaging materials, packaging,
        size, d imensions, labeling, and marking etc at manufacturer’s facility prior to product shipment in
        accordance with the technical specification of the contract document ;
vi)     Make available qualified inspectors to visit international manufacturing facilities and/or test laboratories in
        a manner that minimizes travel costs.
vii)    Submit a summary report of the above tasks and inspection test results to REB.
viii)   Make available the information and data collected during the pre-shipment inspection process, to REB
        and/or collaborate with any other entity(ies) with wh ich REB may work to strengthen the quality assurance
        elements of CFLs supplied under ELIB.

Ti meline
The service of the PSI agent is likely to commence in January 2011 and end in June 2011 depending on the delivery
schedule of the supplier(s)/ manufacturer(s) of CFLs. The PSI agent will have to make arrangements for collecting
samples within a week of notification by supplier/ manufactu rer REB of availability of p roducts for sample
collection. PSI agent will have to ensure availability of pre-shipment inspectors at manufacturer(s)/ supplier(s)
facility.


Data and Facilities to be provi ded by the Client
The client will provide the fo llo wing inputs and facilities:
1. Contract agreement with supplier(s)/manufacturer(s) regarding technical specifications and specific testing
    requirements;
2. Adequate notice for sample co llect ion and pre-shipment inspection as per bidding document;
3. Test reports fro m ELI cert ified testing laboratories as per bidding document.
