The question of whether the father or the mother should have the care and custody of Franklin S. and Edlrid
(Eldred?) J. Washburn, minor children of Geo. V. and Rose Washburn, of Kearney Township, was one in which
the people of Bellaire, as well as the parents of the two children manifested a deep interest.

Mrs. Washburn left her home, it was claimed at the command of her husband, and went to her father, Simon
Flewelling, taking her babe with her, but the husband refused to allow her the possession of their three-year-old
boy.

The hearing was held before the probate court last Thursday, Hon. W. S. Mesick appearing for the father and
Hon. C. L. Bailey for the mother. The court room was thronged with the friends and relatives of the contesting
parties, and also with neighbors and acquaintances, who while not drawn there by any ties of kinship,
nevertheless took a very deep interest in the proceedings.

The proceedings were instituted by the mother filing a petition asking the court to give her possession of the
older as well as the younger child. The case was fought hard by both attorneys and it was late in the afternoon
before the arguments were closed. Judge Slussar decided in favor of the mother and made an order giving her
the care and custody of both children.

His decision as greeted with prolonged cheering and shouts of approval on the part of the spectators, which
showed clearly that the sympathy of the people was largely with the mother.
