                                             February 3, 2004

                     A REGULAR MEETING of the Board of Chosen Freeholders of the County of
Somerset was held on the above date at 7:00 p.m.

                         The Pledge of Allegiance to the Flag was led by Director Coyle.

                      Director Coyle stated that the meeting was in compliance with the Open Public
Meetings Act and that adequate notice was provided on November 19, 2003 as follows:

1.                       Mailed to the Somerset Messenger Gazette, The Home News, and the Courier
                         News.
2.                       Posted on the Official County Bulletin Board.
3.                       Filed with the County Clerk.
4.                       Distributed to all persons requesting such information.

                     At this time Rennie Rothplitz presented the Special Recognition Awards to
Mary Jane Carlin (not present), Virginia Keil, Jennifer Weissner and Maria Mathews of the Family
Crisis Intervention Unit.

                  At this time Director Coyle spoke on the Somerset County 4-H Careers and
County Government Day Participants.


                         At this time Director Coyle read the following Proclamations:

                                              PROCLAMATION
                                            HOMESHARING MONTH
                                              FEBRUARY 2004

                      WHEREAS, according to guidelines published by the United States Department of
Housing and Urban Development, no more than 30% of a household’s gross income should go towards shelter
costs; and
                      WHEREAS, the cost of rent and utilities costs for the average apartment in Somerset
County comes to $1,164.00 per month; and

                         WHEREAS, those monthly costs represent 30% of an annual income of $46,560.00; and

                         WHEREAS, 90% of HomeSharing clients have an annual household income of less than
$46,500.00; and
                         WHEREAS, there is a serious shortage of affordable housing in Somerset County; and

                          WHEREAS, no community can survive without the workers who pump its gas, ring up its
purchases, wait on its tables, type its letters, clean its offices and homes, pick up its garbage, teach its children,
police its streets, and perform all those functions necessary to keep the community operating, and whose income
often falls short in meeting minimum rental requirements in the County; and

                        WHEREAS, HomeSharing, Inc. is a service to individuals and families who are unable to
access affordable housing and face the reality of becoming part of the growing homeless populations; and

                           WHEREAS, HomeSharing is a service to residents of Somerset and Hunterdon Counties
who want to share their homes for economic, service or companionship reasons, and in most cases face the
possibility of either losing their homes or being placed prematurely in a nursing home; and

                        WHEREAS, as of December 31, 2003, HomeSharing has helped people receive 686,782
days of affordable shelter by making 993 matches representing 1,986 households or 2,988 people in its nineteen
year history; and
                        WHEREAS, as of December 31, 2003, HomeSharing has assisted a total of 9,172 families,
12,363 people with their housing problems; and

                       WHEREAS, the population helped by HomeSharing includes single and divorced parents,
handicapped persons, senior citizens and children; and

                       WHEREAS, 93% of those helped by HomeSharing in 2003 fall into the low and moderate
income level categories as defined by the United States Department of Housing and Urban Development
guidelines.
                       NOW, THEREFORE, I, Denise M. Coyle, Director of the Board of Chosen Freeholders of
Somerset County, do hereby proclaim

in Somerset County, that the County of Somerset expresses its support and appreciation of HomeSharing, and that
the members of the Board of Chosen Freeholders, individually and collectively, urge our fellow citizens to support
the activities of HomeSharing by contributions of both their time and money and by letting other citizens know
about HomeSharing; and

                        FURTHER that the County of Somerset commends all the dedicated individuals who have
devoted their time and effort to keeping HomeSharing alive to serve the citizens of Somerset County.

                                            FEBRUARY 2004

                      WHEREAS, the County of Somerset, State of New Jersey, is very proud of its
heritage and ethnic background; and

                        WHEREAS, the black community of Somerset County, New Jersey, has made
significant and lasting contributions to all facets of community living; and

                       WHEREAS, New Jersey has also been a leader in cultural advancements by
establishing an official historical body whose mission is to study and promote the achievements of Black
Americans in our State; and

                     WHEREAS, on the National level, February has been proclaimed Black History
Month since Carter G. Woodson was recognized as the first black historian who established Negro
History Week in 1926; and

                      WHEREAS, in observance of Black History Month in Somerset County, all the
black religious and educational organizations are paying special tribute in recognizing this occasion.

                    NOW, THEREFORE, BE IT RESOLVED that I, Denise M. Coyle, Director of the
Board of Chosen Freeholders of the County of Somerset do hereby proclaim:

                     WHEREAS, February 8 through 14, 2004 has been proclaimed National Career and
Technical Education Week; and

                       WHEREAS, Career and Technical Education Week is an increasingly important
part of the education of our youth; and

                     WHEREAS, the Somerset County Board of Chosen Freeholders wishes to honor
Career and Technical Education Week and our participating youth.

                     NOW, THEREFORE, I, Denise M. Coyle, Director of the Somerset County Board
of Chosen Freeholders, do hereby proclaim February 8 through 14, 2004 as:

                         CAREER AND TECHNICAL EDUCATION WEEK

in Somerset County in recognition of the importance of vocational and technical education to today’s
youth and the community at large.

        RESOLUTION AUTHORIZING THE PLANNING AND IMPLEMENTATION OF MICA
       PROFESSIONAL AND CONSUMER TRAININGS FOR THE DEPARTMENT OF HUMAN
     SERVICES AND ACCEPTING FUNDING FROM THE NEW JERSEY DIVISION OF MENTAL
     HEALTH SERVICES FOR AN AMOUNT OF $1,500.00 FOR THE PERIOD JANUARY 1, 2004
                              THROUGH JUNE 30, 2004

                      WHEREAS, the County of Somerset received formal notification from the State of
New Jersey Division of Mental Health Services that funding was available for the purpose of educating
mental health professionals, substance abuse professionals and mental health consumers in the area of co-
occurring mental illness and substance abuse; and

                      WHEREAS, the County of Somerset has been allocated the sum of $1,500.00 for
the purpose of educating mental health and substance abuse treatment providers and mental health
consumers in the area of dual diagnosis; and

                    WHEREAS, the Somerset County MICA Committee met on January 5, 2004 and
recommended that an application be made for these funds; and

                    WHEREAS, the Somerset County MICA Committee will meet on various dates to
plan and implement MICA trainings in accordance with state guidelines.

                     NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of
the County of Somerset, that the Director and Clerk of the Board of Chosen Freeholders of the County of
Somerset be authorized to execute the contract with the New Jersey Department of Human Services,
Division Mental Health Services.

 RESOLUTION AUTHORIZING SOMERSET COUNTY BOARD OF CHOSEN FREEHOLDERS TO
  ENTER INTO AN AGREEMENT BETWEEN CIGNA BEHAVIORAL HEALTH AND RICHARD
                  HALL COMMUNITY MENTAL HEALTH CENTER

                       WHEREAS, there exists a need for Richard Hall CMHC to contract with
behavioral health organizations to arrange for the assignment of behavioral care services through a
participating provider agreement to provide access to contracted behavioral care professionals at Richard
Hall CMHC who have agreed to provide these services at a contracted rate; and

                      WHEREAS, CIGNA Behavioral Health provides such services; and

                       WHEREAS, CIGNA Behavioral Health is an organization specializing in services
of this type and can properly carry out services of this type.

                       NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of
the County of Somerset that the Director and Clerk of the Board of Freeholders of the County of Somerset
are hereby authorized and directed to execute a contract for the assignment of behavioral health services
to Richard Hall Community Mental Health Center with CIGNA Behavioral Health in accordance with the
terms of the Participating Provider Agreement on file with the Clerk of the Board, same being reviewed
and approved as to form and content by County Counsel.

                  RESOLUTION AUTHORIZING SUBMISSION TO THE
   US DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR AN AMENDMENT TO
  THE 2003 ANNUAL ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT
               AND THE HOME INVESTMENT PARTNERSHIP PROGRAMS

                    WHEREAS, the County of Somerset remains qualified as an Urban County pursuant
to the Housing and Community Development Act of 1974, as amended, and was allocated Community
Development Block Grant (CDBG) and HOME Investment Partnership (HOME) Program funds for Fiscal
Year 2003; and

                     WHEREAS, the County of Somerset now proposes an amendments to the
Consolidated Plan 2003 Annual Action Plan in the following manner:

The Annual Action Plan for Fiscal Years 2003 will be amended as noted below:

        Cooperative Housing Corporation no longer wishes to use the Community Development Block
Grant (CDBG) award for the Warren Ridge 24/7 Supportive Housing Program to undertake
rehabilitation and renovations at its existing Warren Ridge facility. Instead, Cooperative Housing
Corporation will use the CDBG award to expand the design of its Hospice House, which is currently
under construction. This change is necessary because rehabilitation to the existing home would be cost
prohibitive and further, there is a greater need for similar amenities at the Hospice House.

                RESOLUTION AUTHORIZING AGREEMENT FOR A COUNTY DWI
                   ENFORCEMENT TASK FORCE PROJECT BETWEEN THE
                   NEW JERSEY DIVISION OF HIGHWAY TRAFFIC SAFETY
                            AND THE COUNTY OF SOMERSET

                    WHEREAS, the New Jersey Division of Highway Traffic Safety, Department of
Law and Public Safety has solicited grant requests from local governments to award grants for County
DWI Enforcement Task Force Projects; and

                       WHEREAS, Somerset County has indicated an interest in providing such a
program; and
                    WHEREAS, the County of Somerset wishes to file an appropriate application with
the Division of Highway Traffic Safety to provide supplemental funding for a County Traffic
Enforcement Task Force Project.

                       NOW, THEREFORE IT BE RESOLVED by the Board of Chosen Freeholders of
the County of Somerset that the Director of the Board of Chosen Freeholders is hereby authorized to sign,
execute, and submit a grant application to the New Jersey Division of Highway Traffic Safety for the
aforesaid purpose, a copy of which is on file in the Office of the Clerk of the Board; and

                    BE IT FURTHER RESOLVED by the Board of Chosen Freeholders of the County
of Somerset that the Project Director, Clerk of the Board and the Director of the Department of
Finance/County Treasurer is hereby authorized to co-sign the aforesaid grant application.

CONSENT AGENDA WAS ADOPTED BY VOICE VOTE.


               MR. PALMER INTRODUCED THE FOLLOWING RESOLUTION AND
MOVED ITS ADOPTION:
                                    R04-067
               RESOLUTION AUTHORIZING AWARD OF CONTRACT
       TO JOHN CILO, JR. ASSOCIATES, INC. FOR LAND SURVEYING SERVICES
             IN THE COUNTY OF SOMERSET ON AN AS NEEDED BASIS

                        WHEREAS, the Chief Financial Officer of Somerset County has certified in
writing the availability of funds for the purposes set forth in this Resolution, such certification on file in
the Office of the Clerk of the Board, and such funds are provided for in the duly adopted temporary
budget of the County of Somerset, line item $10,000.00 (01-0201-454-02805-04)(Engineering
Division/Consultants, Surveys and Appraisals) $10,000.00 (04-A030-454-08007-03-PL-RDVAR-
23)(County Capital Funds)Total: $20,000.00; and

                     WHEREAS, there exists a need for Land Surveying Services in the County of
Somerset on an as needed basis; and

                     WHEREAS, John Cilo, Jr., Associates, Inc., 198 West High Street, Somerville, NJ
08876 has submitted a proposal to perform the aforesaid services; and

                       WHEREAS, John Cilo, Jr., Associates, Inc., 198 West High Street, Somerville, NJ
08876 is a surveying services firm affording surveying services of the type and nature required to properly
carry out the aforesaid and their particular abilities and capacities have been previously demonstrated in
work in Somerset County and are recognized by the Office of the Somerset County Engineer and by the
Somerset County Board of Chosen Freeholders; and

                        WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A: 11-1 et seq) requires
that the resolution authorizing the award of contracts for "Professional Services" without competitive bids
and the contract itself must be available for public inspection; and must be publicly advertised.

                     NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of
the County of Somerset as follows:

1.     That the Director and Clerk of the Board of Chosen Freeholders of the County of Somerset are
       hereby authorized to enter into a contract with John Cilo, Jr., Associates, Inc., to perform the
       aforesaid surveying services and to be compensated in accordance with the fee schedule on file
       with the Clerk of the Board. Total amount of this contract covering all fees, costs and
       disbursements, not to exceed $20,000.00 to be approved as to form and content by County
       Counsel.

2.     That the engagement of John Cilo, Jr., Associates, Inc., shall be done without competitive bidding
       as a "Professional Service" under the provision of the Local Public Contracts Law, R.S. 40A: 11-5
       (1)(a)(i) and as described under R.S. 40A: 11-2 (6).

3.     The County, its officers and employees shall be added as an additional insured as to all coverage.

4.     Neither party shall be responsible for any resulting loss or obligation to fulfill duties as specified
       in any of the terms or provisions of this Agreement if the fulfillment of any term or provision of
       this Agreement is delayed or prevented by any revolutions, insurrections, riots, wars, acts of
       enemies, national emergencies, strikes, floods, fires, acts of God, or by any cause not within the
       control of the party whose performance is interfered with which by the exercise of reasonable

that the resolution authorizing the award of contracts for “Professional Services” without competitive bids

                     BUDGET OF THE COUNTY OF SOMERSET

                       WHEREAS, the Chief Financial officer of Somerset County has certified in writing
the availability of funds for the purposes set forth in this Resolution, such certification on file in the
Office of the Clerk of the Board, and such funds are provided for in the proposed 2004 budget of the
County of Somerset.
                       NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of
the County of Somerset does hereby authorize the Director and the Clerk of the Board subject to the
adoption of the 2004 County Budget to execute a contract, a copy of which is on file with the Clerk of the
Board with:

       Interfaith Hospitality Network of Somerset County for the provision of case management services
       for the period January 1, 2004 through December 31, 2004 and appropriating amount of
       $35,000.00, line item 618; and
       Somerset/Sussex Legal Services for the provision of specific civil legal services (maintenance of
       habitable shelter cases and cases involving victims of domestic violence) to indigent Somerset
       County residents for the period January 1, 2004 through December 31, 2004 and appropriating
       amount of $46,200.00, line item 618; and
       Somerset Home for Temporarily Displaced Children for the provision of youth shelter services for
       the period January 1, 2004 through December 31, 2004 and appropriating amount of $205,000.00,
       line item 901; and

     Somerset Handicapped Children's Treatment Center to provide rehabilitation services for the
     period January 1, 2004 through December 31, 2004 and appropriating amount of $86,800.00, line
     item 607; and

     Resource Center for Women and Their Families for the provision of counseling, case management
     services to victims of domestic violence, and transitional housing for the period January 1, 2004
     through December 31, 2004 and appropriating amount of $75,289.00, line item 618; and

     Martin Luther King Youth Center for the provision of after school and summer camp services for
     the period January 1, 2004 through December 31, 2004 and appropriating amount of $88,000.00,
     line item 618; and

     Alternatives, Inc. for the Transitional Housing Program for the period January 1, 2004 through
     December 31, 2004 and appropriating amount of $17,250.00; for the Franklin House Program and
     appropriating the amount of $28,000.00; and for the Community Support Program and
     appropriating amount of $26,250.00; and for the Permanent Housing Program and appropriating
     amount of $23,100.00, line item 618; and

     Middle Earth for the provision of outreach services for the period January 1, 2004 through
     December 31, 2004 and appropriating amount of $94,600.00, line item 618; and

     Food Bank Network of Somerset County for the prescription medicine program for the period
     January 1, 2004 through December 31, 2004 and appropriating amount of $25,000.00, line item
     618; and

     Franklin Township Food Bank, Inc. for food distribution for period January 1, 2004 through
     December 31, 2004 and appropriating amount of $17,300.00, line item 618; and

     Catholic Charities for the Comprehensive Family Treatment of Addictions Program (CFTA) and
     appropriating amount of $23,625.00; and for the provision of mentoring services through
     Connections and appropriating amount of $10,000; and for the provision of Family Financial
     Stabilization Program services and appropriating amount of $17,500 for the period January1, 2004
     through December 31, 2004, line item 618; and

     The Learning Gate, An Association of Centers for day care services for the period of January 1,
     2004 through December 31, 2004 and appropriating amount of $150,500.00, line item 907-0001;
     and

     The ARC of Somerset for the Jerry Davis Day Care program to provide day care services for the
     period January 1, 2004 through December 31, 2004 and appropriating amount of $36,750.00, for
     Camp Jotoni services and appropriating amount of $15,000.00 and PACT (Parent and Children
     Together) for parent education services and appropriating amount of $23,000.00 and appropriating
     total amount of $74,750.00, line item 905-0001; and

     Somerset Treatment Services for the provision of substance abuse services in the amount of
     $35,500.00 and for the collaborative provision of psychiatric services with Catholic Charities,
     Family and Community Services and the Resource Center for Women and Their Families in the
     amount of $71,400.00 for the period January 1, 2004 through December 31, 2004 and
     appropriating total amount of $106,900.00, line item 618; and

     Adult Day Center for the provision of adult day care services for the period January 1, 2004
     through December 31, 2004 and appropriating amount of $108,000.00, line item 907-0002; and

     Edgemere Tenants Association for provision of family support services for the period January 1,

       January 1, 2004 through December 31, 2004 and appropriating amount of $20,000.00, line item

       Samaritan Interim Homeless Program for mobile soup kitchen services for the period of January 1,
       2004 through December 31, 2004 and appropriating amount of $21,840.00, line item 618; and

       Catholic Charities/New Moms/New Expectations for daycare and support services for the period
       of January 1, 2004 through December 31, 2004 and appropriating amount of $15,000.00, line item

       Somerset Hills Adult Day Care Center for adult day care services for the period of January 1, 2004

                      WHEREAS, the New Jersey Department of Human Services, Division of Mental
Health Services has distributed an RFA to develop or enhance integrated treatment programs for persons
with co-occurring serious mental illness and substance abuse disorders; and

                      WHEREAS, the DHS is seeking to fund at least one community-based pilot
program in each of three regions, total annualized funding not to exceed $1.2 million; and

                       WHEREAS, the Richard Hall Community Mental Health Center has developed a
proposal in response to the RFA in a competitive effort to provide this service to the residents of Somerset
County; and
                       WHEREAS, said RFA will not exceed $425,000.00 and only require an in-direct
cost match from the County of Somerset.

                    NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of
Somerset County approve the submission of a competitive Request for Application by the Richard Hall
Community Mental Health Center to the NJ Department of Human Services, Division of Mental Health
Services.

                   RESOLUTION AUTHORIZING A LICENSE AGREEMENT
               BETWEEN COUNTY OF SOMERSET AND BEDROCK TOWER, INC.

                       WHEREAS, the County of Somerset desires to enter into a License Agreement
with Bedrock Tower, Inc. which would permit Bedrock Tower to use a portion of the realty and/or
buildings or structures on the property located at Lot 43 Old Georgetown Road in Franklin Township,
New Jersey; and
                       WHEREAS, the County of Somerset and Bedrock Tower have proposed a
consideration for the execution of a License Agreement, a copy of which is on file in the Office of the
Freeholder Clerk of the County of Somerset.

                      NOW, THEREFORE, BE IT RESOLVED by the Somerset County Board of
Chosen Freeholders that the Director and Clerk of the Board of Chosen Freeholders are hereby authorized
to execute the License Agreement with Bedrock Tower, Inc. which would permit Bedrock Tower to use a
portion of the realty and/or buildings or structures on the property located at Lot 43 Old Georgetown
Road in Franklin Township, for a term of ten (10) years at a rate of $2,000.00 per month, on file with the

the County for the provision of rescue squad calls at the County facilities located in Somerville Borough;
and
                       WHEREAS, this Interlocal Agreement has been executed for the purpose of the
provision of certain services in relation to the rescue squad calls at the County facilities located in
Somerville Borough.
                       NOW, THEREFORE, BE IT RESOLVED that the Director and the Clerk of the
Board of Chosen Freeholders of the County of Somerset are hereby authorized to execute the Interlocal
Agreement with regard to the provision of certain services in relation to the rescue squad calls at the
County facilities located in Somerville Borough, prepared by County Counsel and on file with the Clerk
of the Board.

       RESOLUTION REAPPOINTING MEMBERS OF THE SOMERSET COUNTY
                        IMPROVEMENT AUTHORITY

                     WHEREAS, the Somerset County Board of Chosen Freeholders on June 19, 2001
by Resolution R01-393, authorized the establishment of the Somerset County Improvement Authority;
and
                     WHEREAS, the Somerset County Board of Chosen Freeholders previously
appointed five (5) members, residents of Somerset County, as the initial Board of the Somerset County
Improvement Authority; and

                    WHEREAS, the Somerset County Board of Chosen Freeholders desires to renew
the term of one of the initial five (5) members to be appointed to Board of the Somerset County
Improvement Authority.

                     NOW, THEREFORE, BE IT RESOLVED by the Somerset County Board of
Chosen Freeholders that Raymond Brown shall be reinstated as a member of the Somerset County
Improvement Authority and his term shall be for a period of five years, which term shall terminate on
February 1, 2009.
