Business of Safety Gains Strength in 2007
This final issue of Compliance Magazine of 2006 features three industry experts’ views on what safety professionals can expect in 2007 and beyond.

Some trends I am noticing in safety deal with a more focused emphasis by employers on developing or revising their written safety programs and implementing or increasing basic safety training. This appears to be becoming more of a priority of mid-size and smaller firms that may not have had a true safety program in the past. I believe this new focus is based upon insurance company requirements or to pre-qualify for work with larger and/or international entities. There also seems to be a similar push for the development of environmental management and/or environmental protection plans that are ISO 14001 compliant or equivalent. I am finding these trends within industrial, warehouse, office and construction firms.

In the United States, OSHA will help to spread the word that safety and health makes an organization efficient, productive and produces a quality product or service. This message to date has largely been presented by workplace safety and health professionals to other safety and health professionals. The message that “safety pays” is a good one and has been articulated very well in recent years with a business slant by many organizations such as Georgetown University, the National Safety Council, ORC and others. Look for a more focused effort to reach business leaders who make resource allocation decisions for their organizations and can create a culture that values the safety and health of human resources.

Another trend I see pertains to the discussion of the “business of safety” and the new ANSI Z-10 American National Standard for Occupational Health and Safety Management Systems. This new standard provides a revised framework that incorporates a revised hierarchy of controls, the concept of talking the language of business, and fundamentals of risk management to address workplace hazards. These business model and risk concepts have

begun to permeate the safety profession. Here the new buzz words are “acceptable risk” vs. the old school philosophy of zero accidents/incidents. More safety professionals are presenting safety programs to upper management through the business model pointing out the returns on investment in safety. In addition, safety professionals are learning to present workplace safety hazards in the context of acceptable risks within the business model. Expenses related to identifying hazards and eliminating or reducing these hazards to “acceptable” levels must also be inline with the corporate goals. I agree that there are business and financial benefits that are realized by sound safety programs that must be understood and supported by upper management. However, safety should not be viewed or sold as a profit center. Safety is an expense that is part of doing good business. I am concerned that this trend toward acceptable risk will force the safety professional to accept long-term risks instead of pushing for more costly initial approaches that will eliminate or reduce job hazards through design or substitution. In fact, designing out hazards and substitution to less hazardous substances are now the top two preferred choices in the revised hierarchy of controls found in the new Z-10 standard. I am concerned with moving toward a model that skips design and substitution and focuses more on “acceptable risks” that fit the business model. We should never forget that we are the voice for sound safety decisions and that many workers are injured and killed from what others call “acceptable risks.”

Business leaders who believe that a safe and healthy workplace results in more productive employees who care about the quality of their work and the organization they work for can be powerful models for other companies and competitors. Globally there will be an emphasis on workers using safety and health equipment that meets standards. Countries around the world are participating in the development of International Organization for Standardization (ISO) standards at a growing rate, with the goal of adopting an international standard and establishing conformity assessment programs for products that can be used by workers in their countries. This not only applies to China, but to many Central and South American countries, Russia, India, and others.

In the regulatory arena, efforts to reconcile the Hazard Communication Standard with the Global Harmonization System will have priority status. Other key initiatives include progress on the cranes/derricks project, confined spaces for construction, update of electrical standards and crystalline silica control.

The Mine Safety and Health Administration (MSHA) will complete its rulemaking to implement the MINER Act provisions and to add new penalty procedures on its own initiative. The inclusion of new “repeat violation” penalty criterion in setting penalties, an

increase in the maximum penalty from $60,000 to $220,000, and stronger criminal penalties under the MINER Act all combine to ensure more litigation between MSHA and mine operators, as well as the nonmining contractors that perform work at MSHA-regulated facilities. Consensus standards will continue to attract more attention, given the obligation for OSHA/MSHA to consider these in any applicable rulemaking under OMB Circular A119. ASTM is weighing procedures to add occupational exposure guidelines to selected occupational safety and health standards. ANSI carries on work to update parts of its A10 construction standard series, as well as completing a standard to protect those involved with mold assessment and remediation work. Congress may continue oversight in this area, as well as giving continued scrutiny to the activities of ACGIH in setting TLVs in a nonconsensus manner. Finally, a U.S. Court of Appeals D.C. Circuit decision issued in July 2006 could have signif-

icant impact on multi-employer worksite issues. In Secretary of Labor vs. Twentymile Coal Company and Federal Mine Safety and Health Review Commission, the court reversed FMSHRC’s decision to vacate citations that MSHA issued to a mining company for mobile equipment defects on a contractor’s equipment. The court upheld MSHA’s enforcement action, even though the mining company had minimal involvement with the contractor’s equipment. It went further, ruling that the agency has “unreviewable discretion” to cite a production operator, the contractor or both. The decision relied heavily upon the U.S. Supreme Court’s decision in Martin vs. Occupational Safety and Health Review Commission holding that in a dispute between OSHA and the commission deference is given to OSHA. I predict that it is just a matter of time before the Department of Labor decides to test its powers and seek a similar ruling with respect to OSHA’s citation authority over prime employers, contractors and subcontractors! CM

An overview of radiation safety protocols post 9/11
adiation safety, or “health physics,” sometimes operates independently of facility safety programs because of the specialized nature of the hazard. The schooling received by most safety professionals also treats health physics as a distinct and degreed course of study. Most industrial hygienists have had a course or two that included radiation safety principles, but it was not their primary course of study. Radiation safety programs are regulated by non-OSHA entities such as the Nuclear Regulatory Commission (NRC) or “agreement” state radiation protection agencies. This, too, contributes to the independence of some health physics programs. But by bridging gaps between general safety and radiation safety programs, organizations may be able to develop business continuity or disaster recovery plans that are more effective. • The radioactive materials license issued by the regulatory body. • A radiation safety manual that explains the radiation protection program. • Supporting company standard operating procedures. Users learn about these documents at periodic and documented training provided by the RSO. The RSO must demonstrate during inspections by the regulating authority that the rules are followed. In some NRC-regulated and agreement states, inspections are annual. The less well-known aspects of health physics programs may impact only a few authorized isotope users. These include the shipment of radioactive materials, radioactive waste processing and security of radioactive materials. They are of particular concern in our post-9/11 world, and not just to inspectors. Recently, the NRC and state regulators issued new security requirements for large radioactive sources that are used in certain research equipment. These “radionuclides of concern” are considered potential homeland security issues because, if damaged or stolen, they could produce lethal exposures to employees and the public at the worst and panic from their loss at the least. Special precautions that are required include the following: • Users of the devices housing these large sources and the personnel who access the source area must undergo documented background checks. • The room housing the source of concern must be secured and alarmed. • Local law enforcement must be made aware of the source(s), be educated about it and agree to assist in the response to an emergency involving source security. This last bullet is important. It means inviting the local police to your site. This meeting can be beneficial, not only to smooth the way for a response to radiological emergency but also for any emergency. It brings management, your safety personnel, possibly your security detail and the police together — maybe for the first time in the history of your facility. This is a tremendous advantage: The more that emergency responders know about your facility, the better. That’s real synergy.

Areas of Emergency Preparedness Concern
Small sources of radioactive liquids or powders as used in many research laboratories generally represent minor occupational hazards. Past incidents involving employees have included deliberate food contamination. Therefore, a regulation was instituted years ago requiring that radioactive materials be locked away when not in use. Loss of specific quantities of such material is reportable within certain time frames to the NRC or state regulators. Shipment of class 7 radioactive material also raises security concerns. Facility shipping departments should be aware of all class-7 Department of Transportation requirements. Certifiable training for class-7 materials transport is also a requirement for anyone preparing such shipments. In many cases, to ease compliance with the shipment regulations, “excepted quantities” are shipped. These are prescribed, relatively low quantities of radioactivity with limited package-surface exposure rates. These packages must be shipped by a carrier trained and certified to handle radioactive materials. You are at an advantage if the carrier can also provide intransit package-tracking capability. Notifying the recipient that a radioactive package has been sent enhances security. Many research programs use isotopes with half-lives of weeks to months in order to decay the waste onsite to nonradioactive forms. Although waste generally contains radioactivity at much lower levels than the stock materials used at the bench-top, decay-in-storage holding facilities still need to be secure 24 hours per day to avoid theft and possible misuse of the waste material.

It is not imperative to fold radiation safety into the overall health and safety program of a facility. However, managers and other safety professionals stand to gain when the radiation safety officer (RSO) is included in the overall strategy. Periodic reports on the status of the health physics program will help to keep radiation terminology, program elements, areas of use, and level of hazard on the minds of the safety staff. They in turn can inform the RSO of radiation-related issues that they discover in the course of their inspections and investigations. Management obtains benefits from the sharing of information and synergy among the safety professionals. This synergy is more important than ever because planning for emergencies and for business continuity or disaster recovery can be enhanced with input from the RSO. By regulation or good practice, RSOs must have contingencies in place for lost or stolen sources, spills of radioactivity, overexposures and other related emergencies.

Conclusion
Most aspects of typical industrial and research and development radiation safety programs have not changed since 9/11. But, given the emphasis on security and business continuity, it was inevitable that enhancements would be needed for certain sources of radiation and for certain related practices. Considering these, it is essential to ensure that your radiation safety program dovetails with the general safety practices of your facility, especially when considering emergency response planning and business continuity contingencies.
