LGPS: ILL HEALTH MONITORING GROUP: RECENT DATA GATHERING
EXERCISE: REPEAT OF THE CAPABILITY DISMISSALS EXERCISE

I have been asked by the Chair of CLG’s Ill Health Monitoring Group (IHMG)
Lynda Jones, to thank those employers who assisted the Group with the
recent data gathering exercise which helped to test the effectiveness of the
new LGPS 3-tier ill health retirement regime, as well as identifying the number
of ill health capability dismissals.

You may recall that the exercise ran from 23 December 2008 to 31 January
2009. Since then, the relevant data has been analysed by CLG and the
results were put forward to the IHMG for their consideration when they met on
19 February.

The Group has studied the results in detail and after a lengthy discussion, it
was noted that the ill health capability dismissals data warranted further
investigation. The Group, have, therefore, decided to repeat the ill health
capability dismissals exercise.

My purpose in writing to you is to seek your further co-operation in this matter.
CLG has asked that the data to be collected this time is the total number of ill
health capability dismissals from 1 October 2008 to 31 March 2009 inclusive.

An ill health capability dismissal, for the purposes of this exercise, is defined
as an employee who is a member of the LGPS, has been referred to the
independent occupational health adviser for potential ill health retirement, and
whose employment is terminated on capability grounds due to ill health but
without receiving the payment of an ill health LGPS pension. This would be
because the member either:-

i) does not meet the permanent ill health criteria as defined in the LGPS
(Benefits, Membership and Contributions) Regulations 2007 (as amended); or

ii) does meet the permanent ill health criteria but is judged not to have a
reduced likelihood of obtaining gainful employment before age 65.

Where you have dismissed an employee in these circumstances, please
complete the attached spreadsheet and return it to me no later than
Tuesday, 16 June 2009. We do want the data we collect to be as accurate
as possible, and so hope you will supply this where appropriate. Nil returns
are not required.

Additionally, CLG has asked me to point out that in order for the results to be
as meaningful as possible all data fields within the spreadsheet must be
completed if you submit a return.
