               Board Meeting Minutes (Draft)
                      Oct. 10th, 2005

  Meeting was called to order by Supervisor Neuvirth at 7:30 P.M. In
attendance were Supervisor Kris Neuvirth, Treasurer Lynn Davidson, Clerk
Larry Lee, Trustee LeRoy Zieske, and Trustee Anthony Eaddy.
  The Pledge of Allegiance was recited.
  Motion by Supervisor Neuvirth and supported by Treasurer Davidson to
accept the agenda with additions.                           Motion carried.
  Citizen Time:
       Joanne Darling – Disbursement Journal: Larry and Lynn charged
mileage to the Clarity hearing and that is unlawful. Refunds for
overpayments? People sent in too much money or were they overpayments?
Phones not working, made calls from home since phone did not work and
did typing at home.
  Motion by Supervisor Neuvirth and supported by Trustee Eaddy to
approve the Consent Agenda.                                 Motion carried.
  Motion by Supervisor Neuvirth and supported by Trustee Zieske to
approve the Minutes of 9-12-05 meeting.                     Motion carried.
 Supervisor Report: We did lose another soldier in Iraq who was from
Monroe. A moment of silence, please. Many things going on, grading done
and way ditching was done. Larry ask about estimates. Tile had to be taken
care of, Supervisor tries to get best deal he can. Received a letter from
FEMA and will review the flood map. They want our participation when
they do the maps. Questions of way that I appoint members. I do have
authority to recommend for the Planning Commission. In past I have run the
meeting with great leeway. Things have to change, people will have a say in
a courteous way with time limits. One person to speak at a time. Stay out of
Open Meeting Act problems.
  Motion by Trustee Eaddy and supported by Supervisor Neuvirth to
approve of the Supervisor’s Report.                         Motion carried.
  Discussion of present procedure of digging ditches: Clerk Lee asked for an
estimate before the ditching is done. Supervisor Neuvirth wants to do the
other side of Wanty Rd. (Ditch). Treasurer Davidson asked what is wrong
with getting the estimates before doing the job. Trustee Zieske suggested
write down on bill the road ditched and the cross roads.
  Motion by Supervisor Neuvirth and supported by Treasurer Davidson to
approve the disbursements from the General Fund of $44,255.99. Roll call
vote: Neuvirth – Yes       Davidson – Yes Zieske - Yes              Lee – Yes
       Eaddy – Yes                                          Motion carried.
  Motion by Treasurer Davidson and supported by Supervisor Neuvirth to
approve the disbursements from the Sewer Fund of $87.48. Roll call vote:

       Davidson – Yes                                       Motion carried.
  Motion by Treasurer Davidson and supported by Supervisor Neuvirth to
approve the disbursements from the Building Fund of $20,121.74. Roll call
vote: Eaddy – Yes          Davidson – Yes Neuvirth – yes            Zieske –
Yes           Lee – Yes                                     Motion carried.
  Motion by Treasurer Davidson and supported by Supervisor Neuvirth to
approve the disbursements from the General Fund to pay McKenna of
$1,995.00.                                                  Motion carried.
  Discussion of why McKenna raised the hourly rate from $75 to $90.
  Wanty Rd. Barn: Supervisor Neuvirth had two meetings with Mr. Graves.
First went over the situation and tried to get on the property. He did not want
to do that. Second meeting, no cooperation. Did have a conversation with
Donna Krips and would like to talk to the attorney. Question of right to
farm. Joanne Darling stated that Mr. Graves attorney had advised him not to
let the township onto his property. Supervisor Neuvirth to take the
information to the attorney and get his recommendation.
   Discussion of ZBA and Board of Review appointments: Trustee Zieske
stated that the appointment for Compensation Committee was up in October
and needs to be filled. Clerk Lee stated that the ZBA and Board of Review
appointments are not Supervisor appointments. Next time, do it the proper
way. Mrs. Schils stated that Bill Brenner was never appointed or re-
appointed in the past per the minutes. Members have to be re-appointed after
each term. Trustee Eaddy remembers Trustee Zieske being appointed.
   Discussion of the Fee Schedule charged for Special Use, Site Plans, and
Ponds. Mr. Taepke presented a new fee schedule for the boards review. The
fee’s need to be revised as they are too high. The affected acreage must be
10 times the size of the pond. Mark Gaynier – Fee’s are so high cause
Planner charges so much. Discussion of whether McKenna should review all
Special Use and Site Plan reviews. This issue is tabled until the Nov.
meeting.
    Discussion of the Water Survey: Clerk Lee presented a draft of the water
survey. Alter the survey and bring back next month. Maybe a couple of
different survey sheets.
   Motion by Trustee Zieske and supported by Supervisor Neuvirth to table
the Water Survey until next month.                         Motion carried.
   Discussion of the 425 Agreement with the City of Milan. Reviewed the
recommendation from McKenna and Ready & Sullivan. Missing in the
contract is the 300’ setback from Darling Rd. Mark Gaynier talked about the
two people on the planning commission as advisors only. The City of Milan
have to take note of what we want for our township.
   Motion by Trustee Zieske and supported by Supervisor Neuvirth for the
Supervisor to contact the City of Milan and setback off Darling Rd. be 200’
(233’ from the center of the road) and review with them. If no agreement,
then they come to our next meeting.                        Motion carried.
   Discussion of a new speaker system for the meeting room. Supervisor
Neuvirth is looking into prices of a new system.
    Motion by Treasurer Davidson and supported by Supervisor Neuvirth to
approve of Special Land Use SLU 05-009 and parcel # 5810-009-007-50
owned by Christopher Marchand (building a residence in a Flood Plain
District).                                                 Motion carried.
   Motion by Supervisor Neuvirth and supported by Treasurer Davidson to
approve 4 rooms and three nights reservation for the MTA Conference in
January.                                                   Motion carried.
     Donna O’Dell – Already covered a lot of her items to talk about. People
accused of things without proof. Kris, your voice and body language speaks
a lot. Need to share information with the entire board.
   Motion by Supervisor Neuvirth and supported by Trustee Eaddy to
approve the Liquor Control Budget of $700 for fiscal year 2005/2006.

   Motion by Trustee Zieske and supported by Supervisor Neuvirth to place

2 Quarter Budget vs. Actual Report on file.                Motion carried.
Note: Clerk Lee brought to everyone’s attention that expenses for first two
quarters were $343,688.77 and the fact that board needs to watch the
spending.
   Motion by Supervisor Neuvirth and supported by Treasurer Davidson to
approve $300 for cemetery improvements.                    Motion carried.
  Discussion of the Compensation Committee – Clerk Lee sent a letter to the
chairman and awaiting reply. Supervisor will recommend replacement for
the one member who’s term is up at the next month’s meeting.
  Rich Horn – Concern of the FOIA’s, did not receive all requested
materials. A FOIA was late. Records were altered on requested FOIA with
personal notes written on them. Open Meeting Act violations. Last Planning
Commission should have been a joint meeting since 3 board members were
present. Would like the rest of resumes that he FOIA’ed.
  Motion by Treasurer Davidson and supported by Trustee Eaddy to prepare
and put in envelopes the 2005 Winter Tax Bills/stamps from Express Bills.

  Motion by Supervisor Neuvirth and supported by Trustee Eaddy to get a
dumpster if we can legally clean up the trash at property on _________ for
cost up to $400.                                            Motion carried.
Note: Will contact lawyer for his opinion.
  Motion by Clerk Lee and supported by Supervisor Neuvirth to purchase
two file cabinets (one for ZA and one for Code Enforcer) at cost of $350.
                                                            Motion carried.
  Motion by Supervisor Neuvirth and supported by Trustee Eaddy for Code
Enforcer to work 2 extra hours per week for months of Nov. and Dec. to file
material in new cabinet.                                    Motion carried.
  Motion by Clerk Lee and supported by Supervisor Neuvirth to purchase a
Digital Voice Recorder at cost of $100.                     Motion carried.
  Motion by Clerk Lee and supported by Trustee Eaddy to purchase (6)
Authorities and Responsibilities Books and (1) Board of Review book at
cost of $180.                                               Motion carried.
  Motion by Supervisor Neuvirth and supported by Treasurer Davidson to
purchase cleaning supplies at cost of $100.                 Motion carried.
  Motion by Treasurer Davidson and supported by Supervisor Neuvirth for
deputies to work at home under extreme circumstances and get paid.
                                                            Motion carried.
  Motion by Treasurer Davidson and seconded by Clerk Lee to appoint Julie
Horn as the Zoning Board of Appeals Alternate.              Motion carried.
  Motion by Clerk Lee and supported by Treasurer for Deputy Clerk to work
10 extra hours per months of Oct. and Nov.                  Motion carried.
  Motion by Treasurer Davidson and supported by Trustee Eaddy for
Deputy Treasurer to work 15 extra hours per months of Nov. and Dec.
                                                            Motion carried.
  Discussion of sharing the cost of stoning of Rawsonville Rd. with Exeter
Township. Cost to London Twp. would be about $5,000. Trustee Zieske
suggested that since we did the stoning last time, let Exeter do it this time.
Milan Twp. also wants to stone Wells Rd. and share the cost with us.
Supervisor to get cost and bring back to the board.
