     Objective of the Study Visit:

     Since the adoption of The Electiricty Market Law (No.4628) in 2001, Turkey has begun to restructure its electricity
     industry. The former vertically integrated electricity sector has been seperated and generation and trading activities
     have been liberalized. However, distribution and transmission services are assessed as natural monopolies and they
     are subject to regulation.

     Currently, market structure is constituted by two parts: Bilateral contracts between suppliers and buyers and a
     balancing and settlement market. In the balancing and settlement market, the equality between demand and supply
     is ensured by the market operator. Studies on the amendment of the balancing and settlement system has beeen
     continuing. Besides the balancing market, establishment of a day ahead market is envisaged. The creation of the day-
     ahead market will be effective in providing signals for the market participants.

     Energy Market Regulatory Authority is responsible for monitoring the market, detecting market distorting and
     abusing activities, regulation and supervision of the market. Practically, monitoring, analysis and assesment of the
     price movements in electricity markets are very significant for understanding and evaluating the market power,
     abuse of dominant position and distortion of competition in the market.

     Within this framework, the main objective of this study visit is to gain information about the tools and devices used
     in monitoring, analysis and assesment of price movements in spot and balancing markets. Besides, acquiring
     information about the role of regulatory authorities in use and evaluation of the information based on these tools and
     mechanisms in detecting price movements, competition level, market power and abuses is another aim of this study
     visit.

recent developments that may be relevant in this regard (e.g. give details of the stage of
preparation of the legislation, outline the timetable for the adoption of the legislation etc.)
Electricity Market Law (No: 4628) and secondary regulation depending on this law state that EMRA is responsible for
ensuring a competitive market, monitoring of electricity market and supervision of the market. Within the scope of
existing system including bilateral contracts and balancing and settlement market, monitoring and analysis of prices
constituted in the wholesale market is significant in finding out the problems related with competition level, market
power and abuse of dominant position. In the near future, a day-ahead market will be introduced, as well. Therefore,
monitoring the price movements in this market effectively has also a great significance in analysing of the market.
EMRA needs to determine whether it should define or provide some new tools and systems to monitor and analyse the
prices.

According to article 23 of the Directive 2003/54/EC, regulatory authorities should be responsible for ensuring non-
discrimination, effective competition and the efficient functioning of the market monitoring the level of transparency
and competition. Besides, the same article states that "Member States shall create appropriate and efficient
mechanisms for regulation, control and transparency so as to avoid any abuse of a dominant position, in particular to
the detriment of consumers, and any predatory behaviour." .

In this context, gaining of the knowledge about the tools and devices used in monitoring of prices has a great

significance in monitoring of the market, assessing the competition level and detecting the market power and abuse of
dominance in Turkish electricity market.
